Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is the proposed action is INCONSISTENT with the below Policy Standards and, therefore, is INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The as built expansion of the single-family residence does not meet this policy. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this reconnnendation in preparing its written determination regarding the consistency of the proposed action. The house was being renovated and the front porch and rear stoop were demolished due to structural.issues. The rear covered porch and front stoop were under construction when the building department required a variance to reconstruct the.front covered stoop and rear covered porch. The existing house needed renovations and remodeling. The foundation-under. the front stoop and rear deck were the original boards and stone without-any structural supports/footings. The existing structures could not be restored, and they had-to be reconstructed"'to code"with structural support. The reconstruction is in kind in place with a small reduction of the west side of the covered porch to maintain a small setback from the property line. No change to the character of the neighborhood will occur by this construction. The existing house is being.renovated which will enhance.the character of the neighborhood and Fishers Island community. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant.to pursue, other than an area variance,because: The existing front stoop and rear covered porch were constructed with little to no structural support and would not have complied with the building codes.
