A public hearing was hled by the Southold Town Board at Village Hall in Greenport, on Tuesday' Januar 28, 1958 with the following present: Supervisor Klipp; Councilman lbertson; AJustices Tuthill and Clark; Supt . of Highway. Price ; Town Attorney Tasker Pnd Town Clerk Booth. This hearing was on the proposal to amend the Building Zone Ordinance of the T6wn of Southold by changOing from ".A" Residential and Agricultural District to "B" Business District on a parcel of land in East Marion, a parcel of land near Greenport, two parcels of land in Mattituck, a par- cel of land in Peconic and a parcel of land in Cutchogue . Supervisor Klipp opened the hearing at 7:30 P.M. and read the call of the hearing. He then called upon any person present who wished to spead either dor or against the proposal to amend the Building Zone Ordinance on the aforesaid parcels of land. the hearing was duly closed at 8:30 P.M. .The minutes of this meeting were recorded by George Lederle . , The Board adjourned to the Supervisor 's Office to hold a Town Board meeting. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That the minutes of January 21 , 19589 be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilman `-'lbertson; Justices Tuthill and Clark. Moved by Justice Clark;' seconded by Justice Tuthill: RESOLVED: That the regular monthly audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on Thursday, February 6, 1958, at 7 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill and Clark. Moved by Jusiice Clark; seconded by Councilman Albertson; WHEREAS , a petition was heretofore filed with the Town Board of the Town of Southold by James Wasson requesting a change , modification and amend- ment of the Building Zone Ordinance and Building Zone ;Maps of the Town of Southold by changing from "A" Residential and 2x±±daXgx2uxzxMxps CD Agricultural District to "B" Business District , the property descri in said petition, and WHEREAS , said petition was referred to the Planning Boa-d for its invest- igation, recommendation and report and thereafter, a public hearing was held by the Town Board in relation thereto on .Debem'Ber. -.5, ~z9-7!;. andr•_-, n.; WHEREAS , after examination of said petition and the the facts stated therein, and after due deliberation, it was determined that said petition was not in proper form in that the petitioner is not the sole owner of the real property as stated in slid petition, NOW, THEREFORE, BE IT RESOLVED: That the relief demanded in said petition be denied. Vote of Town Board: Ayes-Supervioor Klipp; Councilman Albertson; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS , a petition was heretofore filed with the Town Board of the Town of Southold by EDNA . A BROWN, requesting a change , modification and amend- ment of the Building Zone Ordinance including the Building Zone Maps made a part thereof by changing from "A" Residential and Agricultural District to "B" Business District the property described in said petition, and WHEREAS , said petition was duly referred to the Planning Board for its investigation, recommendation and report, and its report having been filed with the Town Board , and thereafter, a public hearing in relation to said petition having been duly held by the Town Board on the 25th day of Nov. 1957, and due deliberation having been had thereon, . NOW, THEREFORE , BE IT RESOLVED: That the relief demanded in said petition be , and it hereby is denied. Moved by Councilman Albertson; seconded by Justice Tuthill: WHEREAS , the Southold Town Planning Board has prepared an official report and recommendation upon the petition of LYDIA C.ADUG.AN for a change of zone from "A" Residential and Agricultural District to "B" Business District certain real property situate at Cutchogue, NOW, THEREFORE BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor 's Office at Greenport , on Monday, February 17, 1958, at 7:30 P.M. on the proposal of LYDIA CADUGAN for change of zone on the aforesaid property. Vote of Town Board: Ayes-Supervisor Klipp; ouncilman Albertson; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Jt1stcce Clark: WHEREAS , the Southold Town Planning Board has prepared an official report and recommendation upon the petition of THE CHASE MANHATTAN BANK for a ' change of zone f rom "A" Residential and Agricultural District to 11B" Business District certain real property situate at Cutchogue, NOW, THEREFORE , BE IT RESOLVED: That a public hearing will be held nby the Southold Town Board at the Supervisor 's Office in Greenport on Monday, Feb. 177 1958, at 7:30 P.M. on the proposal of the Chase Manhattan Bank for a change of zone from "A" Residential and .Agricultural District to "B" Business District certain peal property situate at Cutchogue, NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Town Board at the Supervisor 's Office. in Greenport, on Monday, Feb. 17, 1958, at 7:30 P.M. on the proposal of The CHASE MANHATTAN SANK for change of zone on the aforesaid property. Vote of Town Board: Ayes-Supervisor K-Lipp; Councilman Albertson; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Councilman Albertson; WHEREAS , LEONE D. HOWELL has made 'application to the Town Board for the establishment of an Open Developement Area , pursuant to the provisions of Section 280-A of the Town Law, and WHEREAS , the Town Board has heretofore regerr.ed the matter to the Planning Board for its advice , and WHEREAS , the Planning Board has recommended that the application of LEON HOWELL be granted , NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Southold dries hereby establish an Open Developement Area over the premises of LEON D. HOWELL as shown forth on the map attached to the applicat.-i.on. Vote of Town Board: Ayes-Supervisor Klipp; Councilman "lbertson; Justices Tuthill and Clark. Moved by Justice Clerk; seconded by Justice Tuthill: WHEREAS , Hon. L. Barron Hill has made application to the Town Board for the establishment of an Open Developement Area pursuant to the provisions of Section 280-A of the Town Law, nnd WHEREAS , the Town Board has heretofore referred the matter to the Planning Board for its advice and WHEREAS , the Planning Board has recommended that the application of Hon. L. Barron Hill be granted, NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the To• n of Southold does hereby establish an Open Developement Area over the premises of Hon L. Barron Hill as shown forth on the map attached to the application. Vote of Town Board: Ayes-Supervisor Klipp; "ouncilman '�lbertson; Justices Tuthill and Clark. 4.9 1 Moved by Councilman Albertson; seconded by Justice Tuthill: WHEREAS , WILLIAM H. WERTENBERG hh.s made application to the Town Board for the establishment of an Open Developement Area pursuant to the provisions of Section 280-A of the Town Law, and WHEREAS , the Town Board has heretofore referred the matter to the Planning Board for its advice and WHEREAS , the Planning Board has recommended that the application of WILLIAM H. WERTENBERG, be granted, NOW, THEREFORE; BE IT RESOLVED: That the Town Board of the Town of Southold does hereby establish an Open Developement .Area over premises of WILLIAM H. WERTENBERG as shown forth on the map attached to the application. Vote of Town Board: Ayes-Supervisor Klipp; councilman `�lbertson; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Justice Clark: WHEREAS , It was the determination of the Planning Board that since the Town Board had passed a resolution to the effect that tax exempt properties would not have to pay a fee for applications or appeal, the Planning Board recommends to the Town Board a _refuhd of $15.00 to William H. Beebe . The fee in question was paid by Mr . Beebe on Appeal NO. 41 for the Cutchogue methodist Corporation, Main Road end Stillwater Avenue , Cutchogue , N.Y. NOW, THEREFORE, BE IT RESOLVED: That Norman E. Klipp, Supervisor, is hereby authorized to refund $15.00 to William Beebe .
