SUPERVISOR COCHRAN: As you know each month the Town Board receives Reports from the different committees and from the different departments. They are on file with the Town Clerk's Office. It is public information. If there is anything you are interested in, please, feel free to come in and request it through the Town Clerk's Office. 1. Southold Police Department Detective Division/JAB Report for January 2000. II. PUBLIC NOTICES SUPERVISOR COCHRAN: Public Notices, there is one from the U.S. Army Corp of Engineers. It is a Notice of Application for New York State Department of Environmental Conservation to discharge fill material to construct an artificial reef in Little Peconic Bay in the Town of Southold. Written comments by March 17, 2000. 1. COMMUNICATIONS SUPERVISOR COCHRAN: Communications, we have a letter from State Senator Hugh Farley, a thank you for contacting him about legislation that affects towers, and also a letter from Joan Gilroy in relation to Cablevision and re-evaluation of the channel line-ups. I have since had a call from her also, and you probably received this in the mail. Most of you probably have. But, the way she explained it what they are doing is trying to group the same type channels together,be it all news together on your dial, be it all romance movies, be it all game shows, so that as you go through the channels the same type of programs are together. She also said I could share with you that anyone that has a TV set that only goes to Channel 12, that there is a gizmo that they are looking at to either to be sold at Radio Shack, or they will be providing, and they haven't made that decision yet. So, if your channel only goes to 12,please, contact Cablevision, and see what their decision is. 1. IV.PUBLIC HEARINGS. 1. 8:00 P.M. in the Matter of the Increase and Improvement of Facilities of The Southold Solid Waste Management District in the Town of Southold, in the County of Suffolk,New York,pursuant to Section 202-b of the Town Law. V. RESOLUTIONS. SUPERVISOR COCHRAN: As you know the Town Board has a policy that if there is any questions or any comments in relation to any of the resolutions that are on the agenda for the evening, we would be very happy to entertain them at this point. Later on after the Town has acted on it's business we will then be very happy to hear any comments you may have on any Town business on any topic. Also, we have a public hearing scheduled for eight o'clock, so whatever our business is we will stop at that time for the public hearing. Is there anyone that would like to address the Town Board on any of the printed resolutions? Mr. Williams? JACK WILLIAMS: Jack Williams from East Marion. I was just curious to have a little bit more explanation of Resolution#2. SOUTHOLD TOWN . BOARD FEBRUARY 29,2000 97 JUSTICE EVANS: NADA stands for National Association of Drug-Free Employees. SUPERVISOR COCHRAN: We have employees, especially through the Highway Department, and they are at random tested for drugs, and this is accepting the proposal of the firm that does this testing for us. JACK WILLIAMS: Is that a competitive bid? SUPERVISOR COCHRAN: I don't think it is a competitive bid. It doesn't reach that kind of a figure. I don't know how they were originally found, this company. Does anyone else have that knowledge? I am not sure how. It was done through the, who was it done through? COUNCILMAN ROMANELLI: CSEA. SUPERVISOR COCHRAN: I am not sure,but I can certainly get that answer for you. JACK WILLIAMS: What is the figure? SUPERVISOR COCHRAN: The amount is, each testing is $32.00. It is up a dollar from last year. It was $31.00 last year. COUNCILMAN ROMANELLI: I can just say from private industry, because in my business you have to test for licensing. SUPERVISOR COCHRAN: That's a good point. There is a certain license. COUNCILMAN ROMANELLI: Anyone with a commercial drivers license. That has to be tested on an annual basis by Federal Law. SUPERVISOR COCHRAN: It affects, Jack, both our Highway Department and our Landfill, because of the different licenses that they have. It is by law. COUNCILMAN ROMANELLI: A commercial drivers license. A random drug test. SUPERVISOR COCHRAN: Any other questions anyone? (No response.) If not, we will act on the resolutions starting with#1. 1 .- Moved by Councilman Romanelli, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to Detective Martin Flatley to attend the MAGLOCLEN Conference at Cleveland, Ohio on Monday, April 17, 2000 through Friday, April 21, 2000. Hotel accommodations and airfare will be paid by MAGLOCLEN, registration fee of$100.00, meals and any additional travel expenses to be a legal charge to the Police Training 2000 budget line. 1 .- Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 2.- Moved by Justice Evans, seconded by Councilman Richter, it was RESOLVED that the Town Board of Town of Southold hereby accepts the proposal of the National Association of Drug-Free Employees, Inc. (NADE) to amend their current contract with the Town of Southold to cover providing continuous services to the Town under the same commercial terms with a raise in drug testing price to $32.00 (from $31.00) for the Lab Corp collection sites. 2.- Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. .This resolution was duly ADOPTED. 9 �8 FEBRUARY 29, 2000 SOUTHOLD TOWN BOARD 3.-Moved by Councilman Richter, seconded by Justice Evans, it was RESOLVED that the Town of Southold hereby accepts, with regret, the resignation of Edward Dart as a member of the Architectural Review Committee for the Southold/Peconic Hamlet area, effective immediately. 3.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 4.-Moved by Councilman Murphy, seconded by Councilman Romanelli, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk Elizabeth Neville to advertise for members of the Architectural Review Board for the Southold/Peconic Hamlet area. 4.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 5.-Moved by Councilman Romanelli, seconded by Councilman Richter, it was RESOLVED that the Town Board of the Town of Southold hereby accepts, with regret, the resignation of Edward Dart as a member of the 'Southold Town Tree Committee, effective immediately. COUNCILMAN ROMANELLI: I personally want to say that Ed is going to be dearly missed on that committee. He pretty much has done a lot with the trees in town, so we will miss him. 5.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. SUPERVISOR COCHRAN: We are holding #10, contract for fire alarm system, for more information. 1 1 .-Moved by Councilman Romanelli, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Supervisor Jean W. Cochran to execute a contract with Dvirka & Bartilucci for development of a yard waste composting plan, engineering report, and submission of a Part 360 permit application and design, at a cost not to exceed$23,000.00, all in accordance with the approval of the Town Attorney. 11 .-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 12.-Moved by Justice Evans, seconded by Councilman Romanelli, it was RESOLVED that the Town Board of the Town of Southold hereby determines that requests for the refund of fees in amounts less than or equal to $100.00 and previously collected by the Southold Town Clerk, shall not be brought before the Town Board for action; rather, said refund requests are to be reviewed by the Town Clerk, who shall determine if said request is reasonable and approve same for refund by the Accounting&Finance Department; and be it FURTHER RESOLVED that the Town Board hereby adopts the foregoing resolution as a Town Policy. 12.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. SUPERVISOR COCHRAN: Resolution#13 will be held until after the public hearing. 14.-Moved by Councilman Romanelli, seconded by Councilman Richter, it was RESOLVED that the Town Board of the Town of Southold hereby requests the New York State Department of Transportation to conduct a traffic study for the purpose of lowering the speed limit in the area of Oaklawn Avenue and Route 25 in Southold. 14.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. .15.-Moved by Councilman Richter, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the bid of East Coast Mines & Materials Corporation, East-Quogue, New York in the amount of $6.98 per yard to supply 10,000 yards, more or less, as may be needed, of screened sand for ice control and highway maintenance to the Southold Town Highway Department. 15.-Vote of the- Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. _ 16.-Moved by Councilman Romanelli, seconded by Councilman Richter, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the bid of Electro Environmental Technologies, Inc. to remove, transport, and dispose of scavenger waste from the Southold Town Scavenger Waste Treatment Facility, Greenport at a price of$.07195 per gallon on Item I (contract period April 1, 2000 to December 31, 2000; and $.07554 per gallon on Item 2 (January 1, 2001 to December 31, 2001, all in -accordance with bid specifications and the approval of the Town Attorney; and be it FURTHER RESOLVED that Supervisor Jean W. Cochran be authorized to execute any and all necessary agreements between the Town of Southold and Electro Environmental Technologies, Inc. in connection with the acceptance of this bid. 16.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 20.-Moved by Justice Evans, seconded by Councilman Romanelli, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Supervisor Jean W. Cochran to execute any and all necessary documents in connection with the agreement between. the Town of Southold and Nelson, Pope & Voohis to perform environmental engineering services related to the Laurel Links project in an amount not to exceed $5,000.00, all in accordance with their proposal and the approval of the Town Attorney. 20.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 21 .Moved by Councilman Romanelli, seconded by Justice Evans, WHEREAS, the Town of Shelter Island and the Town of Southold each have a temporary need at their respective Landfills for certain screening equipment currently owned by the other; and WHEREAS, the tow Towns have agreed an exchange of this equipment to be in the best interest of each Town; now,therefore,be it RESOLVED that the Town Board of the Town of Southold hereby authorizes Supervisor Jean W. Cochran to execute any and all necessary documents to permit a mutual exchange of a "Read-Screen-All screening plant" from the Town of Shelter Island to Southold and a "Re-Tech Trommel Screen" from Southold to Shelter Island with no additional payment due or required, the terms and conditions of same subject to the review and approval of the Town Attorney. SOUTHOLD TOWN BOARD FEBRUARY 29, 2000 101 COUNCILMAN ROMANELLI: I will just give that a quick explanation. Easthampton has rented our Trommel Screen for a couple of days, and that a device that helps make compost, and screen out large material. Now Shelter Island wants to borrow it, so we are going to take it from Easthampton, bring it to Shelter Island. They are going to borrow it. We are going to borrow one of Shelter Island's screeners, which help take the sand out of metal that we have dug up at the Landfill for a two week period. The three towns are at the moment sharing a couple of different composting and screening equipment to help us all out. Everything is working out nice. 21 .- Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Justice Evans, Supervisor Cochran. The-subject zone charge site does not appear to contain ample parking to meet needs of the commercial uses allowed on the north part of the site_ The changc of zone application will facilitate the continued use of the southern portion of the property for parking. It should also be noted this portion of the site does not conform to the minimum lot size requirement within the R-40 Residence district. Location. The project site is located on the south side of Main Road, approximately 375' east- of Bay Avenue in Mattituck, Town of Southold,. County of Suffolk. The property has approximately 134.15' of road frontage along Main Road and approximately 218' of frontage on John's Road, a private right of way, to the south. Access to the property will remain along Main Road. SCTMNo.: 1000-122-03-06 Reasons Supporting This.Determination: 1. The application'has been reviewed pursuant to the Criteria for Determination of Significance contained in Part 617.7. Consideration has been given to information supplied by.the applicant,. ' The change of zone application.is anticipated to act as.a precursor for the expansion of a parking area,.. . 2. The proposed action is.considered a minor project. The site is developed commercially within the Gr(General Bncinem)zoned portion of the site,and the area subject to the zone change application is vacant. This portion of the site is cleared and has.historically been utilized as a parking area. The site.located in an area that contains a mix of residential and commercialuses. The site does not contain any environmental features that would be .impacted.as-a result of the change of zone application. The site is relatively flat, contains soils conducive;#o sanitary.systems, has.on.adequate depth to groundwater, and does not contain significant vegetation. 3. The proposed zone change is-somewhat unique in that the site is cleared and has historically been used for parldng. The proposed zone change can be mitigated by proper site design and landscaping. Additionally, the site does not conform to the minimum lot size requirements for the R-40 zoning district under existing conditions, and would also- r equirc either a front and/or rear year variance. .4. Once zoned commercial,the applicant would require site plan review and approval and at that time the Planning Board would require the applicant to supplement and/or create wooded buffers along those site boundaries that abut residentially zoned parcels. Due to 'the historical use of the site as a parldng:arca and through adequate of landscaping, the resulting impact is expected to be minimal. 23.- Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanellli, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 2 4.-Moved by Councilman Murphy, seconded by Councilman Romanelli, it was RESOLVED that the Town Board of the Town of Southold hereby adopts the following Local Law which amends the Zoning Map of the Town by changing the zone district designation from (r-40) R-40 Residential District to (B) General Business District for the part of the parcel of property identified by SCTM#1000-122-3-6 as is in the R-40 Zoning District: LOCAL LAW NO. 4—2000 SOUTHOLD TOWN BOARD . FEBRUARY 29, 2000 10 A Local Law in Relation to Amending the Zoning Code (including the Zoning Map) of the Town of Southold by changing ,the zone from (R-40) R-40 Residential District to (B) General Business District for that part of the parcel of property identified by SCTM #1000-1-22-3-6 as is in the R-40 Zoning District. BE IT ENACTED by the Town Board of the Town of Southold as follows : Section 1. Enactment SCTM #1000-122-3-6 is more fully described below. GAIL WICKHAM: I would just like to thank the Board for their prompt handling of the King application. JACK WILLIAMS: Mr. Williams from East Marion. Two observations in the spirit of the late Frank Carlin. One being that I am glad to see that the sharing of equipment that goes on from town to town. SUPERVISOR COCHRAN: You said the late Frank Carlin? JACK WILLIAMS: I mean he was late tonight. SUPERVISOR COCHRAN: I thought something had happened to him. JACK WILLIAMS: No. I am sure he will be with us for years. That sharing of the equipment of Easthampton, Shelter Island to Southold is the progenitor of more action towards Peconic County. SUPERVISOR COCHRAN: I don't think so. JACK WILLIAMS: My second observation has to do with the fact that as I spin the dial occasionally I come upon Sea Span, and I watched the activities in the U.S. House of Representatives, and I am always interested to see how many empty seats there are down there, because it seems to me that reflects upon the quality of the legislation which is being passed. Here I noticed that tonight Councilman Moore has been sort of expunged . His sign is not up there, and his seat is in the back. The casual viewer might not know that there was somebody absent here you see, and I would respectfully suggested that unless you are feeling extra crowded up there that you just leave the chair in a position so that the viewers can tell when there is a person who is absent from the Town Board,when it is undertaking it's actions. SUPERVISOR COCHRAN: I am hopeful that our residents realize who is on their Town Board. They do elect them to office. There are times when Board members are not able to make the evening meeting, and that is as far as I am concerned it is part of life. You don't always have a cut and dry.. John was missing for three weeks, all three times with good reason. Last week I was missing. I was home in bed with the flu. Tonight Bill has a personal thing. JACK WILLIAMS: I am not questioning the reason for the action. I am just saying somebody took the chair out. SUPERVISOR COCHRAN: I do it every time. Every time some one is absent I remove the chair. I don't like see an empty chair. I like seeing a full dais up.here. JUSTICE EVANS: I like the space. SUPRVISOR COCHRAN: These chairs are pretty good size, and when we are all here we squished in, and I have no problem. Mr. Moore is not here this evening. The record shows he is absent. JACK WILLIAMS: Should there be a weight qualification the next time they are voting for Town Board members? SUPERVISOR COCHRAN: Do you have anything else to share with us, Jack? Anyone else like to address the Town Board? We still have seven minutes. SOUTHOLD TOWN BOARD FEBRUARY 29, 2000 1 'O COUNCILMAN ROMANELLI: I have just have one thing I can tell the viewing public. I got another letter, and this time it is signed by our Governor to remind us about Census 2000. They are going to be mailed out. Everyone should be receiving their census information mid-May, and they stress, and they keep requesting that us, as public officials, and Town leaders to keep on promoting the fact that the Census is going to show up in your mailbox within the next couple of weeks, to be diligent about filling them out, to make sure it gets in the mail in the month of April and back to them. They also keep on stressing that if you know of any areas that have farm help, and I know we have a lot of Spanish help and labor around here, but they are important to count too. So, anybody watching this who knows of where there is housing for them, and can communicate, or knows a way to communicate, stress the issue to everyone about this Census. There are potential dollars there on a Federal level, the bigger the numbers. It is important issue, and it will be in your mailbox within the next couple of weeks. Please watch for it. I am going to be at the Greenport Chamber.next month, and Rotary has asked me to talk about it, so I will be around trying to spread the word also. There are also jobs available if anyone is interested also. MAN IN AUDIENCE: Can I ask a question? There has lot on the radio about Social Security numbers; and information being stolen, and people's identity charges placed against them. Does the Census require that you put your Social Security number down? COUNCILMAN ROMANELLI: I don't know. I haven't seen the form yet. I can't answer that question. SUPERVISOR COCHRAN; Legally all that information is protected, though. There is a jail sentence and so forth if anyone from the Census Bureau divulge any of this information, which is highly personal. I had a call from Rich McMurray today in relation to the ferries that are running, the high speed that are running out of Glen Cove. I believe they start tomorrow. They take an hour and forty minutes to get from Glen Cove to Connecticut, and they are landing, or docking, at the ferry site. So, he called to let me know that the docking on the Connecticut side was at Cross Sound Ferries docks. They are the boats that Foxwood built. They belong to Foxwood. It is not New London. They are just using dockage, but he wanted us to know so we had the correct information. He seems to think that it will help somewhat with the numbers that are going out of New London, so we will wait and see before we passed judgment on that. Also, they were required to come with a site plan, which I understand was submitted today. I haven't verified that yet, because the Town had given them a deadline. So, hopefully, their site plan is in, and it will help benefit the congestion that we have down there in relation to traffic. I was amazed. I had to go to Albany a couple of weeks ago, and it is a lot of people. Okay, we have two minutes. Many of us went into the Association of Towns. I think it was beneficial. I know I came home with some riew thoughts and ideas. Also, I am very pleased. I was elected as Fourth Vice President to the State Organization New York State Association of Towns, so I have been on the Board of Directors, but I will now be serving as an Officer. I am pleased with that. Anybody have anything they would like to add? COUNCILMAN RICHTER:I could give you a little bit here on the first two months on the Town Board. First of all I would like to say all the departments have'been real helpful in introducing me to their staff. I didn't realize how many people I didn't know at Town Hall. Being involved in some of the other organizations I thought I knew quite a few people, but I am still trying to keep the names straight. That has been a very positive challenge, but I am enjoying it. RESOLUTION AND ORDER AFTER FURTHER PUBLIC .HEARING WHEREAS, the Town Board of the Town of Southold (herein called "Town Board" and "Town", respectively) , in the County of Suffolk, New York, on behalf of Southold Solid Waste Management District, in the Town (herein called "District") , has determined to increase and improve the facilities of the District by the purchase of a new payloader, at the estimated maximum cost of $260, 000; and WHEREAS, pursuant to the Order Calling Public Hearing adopted February 1, 2000, a public hearing was duly called and held by the Town Board on this 29th day of February, 2000 at 8 : 00 o'clock P.M. We have closings coming up in the not too near future, so things are cranking along, and we are leveraging as much of the money as we can as far as what the County program, either fifty-fifty or seventy-thirty projects, so it is really stretching our dollars for us.
