9:00 A.M. Appointment was delayed due to a court arraignment being held in the
meeting room. 9:25 A.M. Planning Board Chairman Bennett Orlowski appeared
before the Town Board to update them on the status of the Cross Sound Ferry
litigation.
On motion by Justice Evans, Seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of Southold enter into Executive
Session at 9:25 A.M. to discuss the Cross Sound Ferry Litigation. Vote of the'
Town Board: Ayes: Councilman William D. Moore, Councilman John M. Romanelli,
Councilman Brian G. Murphy, Justice Louisa P. Evans, Councilwoman Alice J.
Husie, Supervisor Jean W. Cochran.
Executive Session ended at 10:52 A.M.
10:55 A.M. - The Town Board reviewed IV. For Discussion Items: IV. 1. Park
Stewardship Program. The Board will wait for Jim McMahon for an explanation.
IV. 2. Review of Speed• Limit between Sound Avenue and Factory Avenue and CR
48, Mattituck. Town Attorney'Yakaboski will research this.
The Town Board discussed and set the date of Monday, August 16, 1999, 9:00
A.M. for work sessions for the County Road 48 Study. It will be all day starting
at 9:00 A.M., a morning and afternoon session will be held.
10:10 A.M. - Appointment with Edward Forrester, Building Department Head with
regard to hiring a building inspector. He presented the Board with historical
data on the issuance of building permits from 1984 to the present. He reported
that we are experiencing a record number of permits similar to the 1986-87
figures. At that time. the staff was 5 building inspectors, 4 full-time clerks
and 1 part-time clerk. Currently, there are only 3 building inspectors, the
building department head, and Jamie Richter - Town Engineer and 3 full-time
clerks and one part time clerk. When Mr. Richter was placed in the building
department it was with the understanding that his time would be split between
the Public Works Department and the Building Department. Unfortunately, it Is
a busy time of year for both departments and most of his time is spent with
Public Works Department at this time. There is currently a building inspector
out on sick leave. Allowances also have to be made for vacation and time off, as
most of these employees are long term who have time coming to them. All of
these factors added together create a labor shortage. At this time they have a
back log of 116 permits. Consideration has to be given to the time and the
responsibilities involved in issuance of a permit. The following items have to be
to be confirmed as meeting the requirements: the survey, the ingress and
egress, fire exits, window area, and flood zone criteria. Councilman Romanelli
suggested privatizing the Building Department. This could not be done due to
union requirements. Councilwoman Hussie questioned the -number of permits,
currently at 456 to date, would be 3 per day. Building Inspector Verity advised
that some days 12 applications arereceived and some of them are for .major
permits requiring a. lot of investigation, work, and responsibility. Mr.
Forrester also advised that it is the Town's responsibility to make sure that the
contractors carry workmens compensation. The Town Board suggested a
checklist of . the steps for reviewing an application and obtaining a permit in
order to speed up the process. There used to be a blue brochure handed out
"How to Get::a Permit in the Town of Southold". The information is outdated and

it is no longer given out. It will be -updated for distribution again. Inspector
Verity said that they also help people with the flood maps, check on single and
separate ownership, and lot mergers. Adding all of this together with constant
telephone calls from people who want answers to questions from persons in
authority, further increases the work load. The CIS maps could assist the
building department if- they were up and running. Also, New York State no
longer sends out State. Building Codes, they tell you that you must go on, the
internet to get the information. Councilman Romanelli suggested bringing in some
people from the community such as architects, contractors;, and realtors to
develop a checklist for4 steamlining and speeding up the permit process. He also
stated that a more thorough inspection should be done in the framing stage. He
recently had to tear out walls in his new building because it was discovered that
it didn't meet the code. Inspector Verity stated that he would rather catch it
on paper before it gets to that stage. Even though the plans are required to
have an architects seal, the responsibility still lies on the inspector to catch
any mistakes the architect might make. This is another reason, there are some
many time consuming considerations that go into the initial issuance of a permit
that could have serious consequences later on. Supervisor Cochran stated that
she would like to see the in-house computer committee functioning once agairi''
Supervisor Cochran identified the primary question of hiring an additional
building inspector. The money is in the budget, it was put in the budget the
first of the year. She asked for the Board's straw vote on this question.
Councilman Moore: Yes. Justice Evans, yes, but only if it is for a replacement
for the inspector out on sick leave, Councilwoman Hussie: No. Councilman
Murphy: Yes. Councilman Romanelli: No, only if it is for a replacement.
Supervisor Cochran: Yes. The expected length of sick leave and absence of
Building Inspector Gary Fish must be determined in order to make a decision and
put it up for a vote.
11:00 A.M. Appointment - Greenport Village Mayor Kapell and the members of
the Greenport Pool Committee: Elizabeth Serkin, Mary Gilligan, Paul Dinizio,
Frederick Tedeschi, Andreas Boldin, Lily Dockerty Johnson, Michael Famiglie' tti,
Fritz Trinklein, and Michael Acebo. Mayor Kapell thanked the Town Board for
the invitation and started out by giving a presentation. Supervisor Cochran
asked Councilwoman Hussie to introduce the members of the previous Southold
Town Pool Committee who were present: William F. Mullen, Jr., Joseph
Lizewski, Frank Thorp, Arthur Farber, and Larry Ostermann. Mayor Kapell
invited the Town Board to join them in their efforts. He advised that there is a
strong desire for the pool to be located in Greenport. They have a large
number of kids with nothing to do and end up getting in trouble.
Comprehensive recreational activities are needed to alleviate their boredom. The
skate park has helped a. lot and they also had a summer camp program this year.
The Mayor presented a visual aid of the proposed Mitchell Park complex which
included the YMCA pool, a municipal parking facility of approximately 350-400
spaces with a pedestrian connection between Front Street and the park, water
treatment improvement, facilities, marina and docking' facilities, and a
refrigerated ice skating rink. The Mayor stated that their . plan is to build a
pool facility without cost to the taxpayer, to be run by the YMCA. The Village
has donated one million dollars and they have developed private sources of
funding, a particularly generous donor possibly contributing one to two million
dollars. It will augment and supplement the off season, winter season for the
Greenport businessman. They will draw from the Town of Southold as well as
the Town of Shelter Island. Councilman Murphy asked what the time frame
would be to accomplish the project? Mayor Kapell asked for a year to raise the
money and to determine positively whether or not it can be done without any
cost to the taxpayer and two to three years to build it.
10:22 A.M. - There was a fire alarm in Town Hall at this time and the building
had to be evacuated for a short period of time.
10:35 A.M. - Mayor Kapell reported that .,the Village of Greenport will be
submitting a grant application to the Department of Parks 'on August 18th for
development of the ice skating rink and asked for the Town's support, if the
Town Is not submitting an application for any development project of their own.
He advised that they appealed to the school, districts of Southold Town and
Shelter Island to inquire if they would want an ice skating rink. Over 400
letters were received which he presented to the Town Board and also asked for
a letter of Support or a' resolution from- them. Ms. Elizabeth Serkin added that
not only the children need these recreational facilities, but everyone, all ages
representing the entire 'community would like it. She advised that they made a
trip to Bay Shore to look at a similar facility and it was surprising to see the
number of all age groups, young and elder utilizing the facility. Former Justice
Frederick Tedeschi made the comment "I only know what I `read in the
newspapers". He said that he doesn't think that the Village and the Town can

support two separate facilities. We don't need two pools for 20,000 people.
Therefore, due to economics, the question of a referendum on the Town pool
should become moot because it is -not economically feasible. John Dinizio added
that it is being proposed to be built in a building that has 8 vacant stores.
Mayor Kapell cited the old rule of thumb "reduce the supply and you can meet
the demand", commenting ,that there are too many vacant 'buildings in Greenport
Village so this would be another advantage. The Mayor went on to describe the
facility as a one story building with a mezzazine level which would be located
just 10 feet from the American Legion building which has a capacity for 1100
persons and in which many special programs and events could be held. He
asserted that in this case "what is good for Greenport is good for Southold
Town". William F. Mullen, Jr. objected to Judge Tedeschi's suggestion that
there be no referendum on the Southold Town pool. Joseph Lizewski stated that
he agrees that this is a smart move and a good location, but that the promise of
a referendum was made to the people of Southold Town when they did the
study. Councilman Moore brought up the fact that several years ago the
proposed YMCA was moved from Greenport, to Peconic, to Laurel for population
reasons. He also questioned the fee structure assistance to the Village.
residents. Michael Famiglietti explained that the Town of Southold could do the
same for its' residents. The Town Board informed that no decision would be
made on this matter tonight. It will be put on the agenda for discussion at the
next regular Town Board meeting on August 17th.
12:03 P.M. - The Town Board continued For Discussion Items. IV. 1. Park
Stewardship Program. Executive Assistant James McMahon addressed the Town
Board on this item. The location is opposite the KOA Kampground on a 35 acre
parcel of property with a two story house. The Audubon Society, Cornell
Cooperative Extension Service, the Arts in Southold and the North Fork
Promotion Committee are all interested in office space in the house. The parcel
is a Suffolk County Park and they are asking the Town of Southold to be the
Stewards, as they prefer to have a municipality. The Town Board related their
interest in pursuing this, but added that there are many questions and many
details that would have to be worked out in the contract. Mr. Mahon
expressed his belief that all of these park properties need management plans.
IV. 3. Proposed Local Law mandating underground utility wires, per Supervisor
Cochran. Supervisor Cochran advised that she send a strong letter to Richard
Kessel, Chairman of LIPA demanding underground wires due to the extremely
sensitive environmental areas located in Southold Town. This local law will be
referred to the code committee. Councilman Moore said that he plans to do an'
amortization of existing. 'utility lines in the Town of Southold. IV. 4. Proposed
Newsletter for Southold Town Hall. Supervisor Cochran stated that this would
be an avenue to keep the public informed of what is going on in town hall and
offer information and assistance to them on dealing with town departments as far
as where to go for what and how to apply. It would be completely
non-political. All Town Board members were in favor and agreed that it was a
good idea. It was decided that perhaps a quarterly distribution would be a good
idea. Councilman Moore suggested the possibility of adding it to the town web
site. IV. 6. Community Preservation Fund 20 Tax - Affirmation signatory. The
way it is drawn up it calls for the Town Attorney or other town official's
signature. Town Attorney Yakaboski feels it could be a conflict of interest. He
suggested designating a position in the planning department as the signatory. He
will further investigate this matter. Supervisor Cochran advised that we are
Supplement to the CR48 Study. Town Attorney Yaka'boski advised that there were 34
comments that were not .included in the initial SEQRA which will now be added by
this supplement. Mr. Cramer is currently in the process of doing the findings.
IV. 8. Request of Chief Conway for adding a Public Safety Dispatcher I.
Councilman Murphy will set up interviews.
12:45 P.M. The Town Board reviewed resolution numbers 1 - 16 to be voted
upon at the 7:30 P.M. regular meeting. Resolution number 9 was supplemented
by adding a. and b. ;Resolution no. 12 was held for discussion in executive
session session because t it related to particular personnel. Resolution No. 16,
Supervisor asked that the committee supply a list of priorities of properties to
be submitted with this proposal to the NYS Agriculture E Markets for a grant.
On motion by Councilman Murphy, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board of the Town of Southold enter into Executive Session
at 1:00 P.M. for the purpose of discussing acquisition of property - Dam Pond,
Personnel - Resolution-Number 12, Contract Negotiations - CATV, NFAWL.

A Regular Meeting of the Southold Town Board was held on August
3, 1999, at the Southold Town Hall, Main Road, Southold, New York.
Supervisor Cochran ,opened the meeting at 4:30 P.M. with the Pledge of
Allegiance to the Flag.

held at 1 :30 P.M., Wednesday, August 11, 1999, at Fishers Island, New
York.

SUPERVISOR COCHRAN: On August 16th will be the first Work Session
the Board will be having in relation to the moratorium on 48, and so we will
be notifying the press, although it is not required for a Work Session of
this caliber, but we certainly want anyone that is interested in the topic
to, please, join us. You will not be afforded the opportunity for input,
but you are more than welcome to come, and watch while the Town Board
does their thing. I think all of us are very proud and pleased with
volunteers. They are what makes things tick in the Town of Southold is
because there are volunteers. People get involved. If we had to pay all
these many people. From time to time we have people who give of
themselves in a given situation, for which they should really be thanked;
and many times day after day you read in the newspaper where a police
officer is perhaps on a call, and he encounters a problem, and most people
just stand and watch. We have been fortunate here in Southold that they
didn't just stand and watch, that they came to aid of a police officer.
Officer Tirelli is President of the Southold Town Police Benevolent
Association, and we asked him to come in and do a. presentation to those
that gave of themselves in helping a police officer. So, perhaps, Vinnie,
you would like to explain to the people what happened, and then we can
continue ahead with the presentation.
POLICE OFFICER TIRELLI : I want to thank the Board for giving us the
opportunity to present these at .public forum. We don't really have the
means to do it other than here. On Thursday, June 17, 1999, at
approximately 9:45 P.M. a woman driving at a high rate of speed eastbound
on Front Street in Greenport drove her car through the front windows of a
local store. On witnessing the crash several local gentleman, Mr. Albert
McMoore, Mr. Bill Swiskey, Mr. Ira Millman, Mr. Rich Fiedler, all
entered the store to render assistance to the driver. Unbeknownst to them
at the time the woman was extremely distraught and bent on suicide. As
these men approached the vehicle, already endangering themselves because
there was a tremendous amount of broken glass in the building. The woman
doused herself with flammable liquid, and set herself ablaze. Without
concern for their own personal safety Mr. McMoore, Swiskey, Millman,
and Fiedler entered the vehicle, and with their bare hands extinguished
the flames before any serious injury could be afflicted from them. As they
attempted to calm the woman down she then grabbed a large shard of
broken glass and a knife, and started slashing at herself, inflicting
several serious cuts to her wrists. At that point as first responding
officer I arrived on scene, and had to investigate. Mr. McMoore quickly
informed me as to what had occurred, and we removed the woman from the
vehicle. Due to her agitation, the fact that she was soaked with blood and
kerosene, the woman was extremely slippery, and difficult to handle, yet
these gentleman stayed inside the splashed through building, and assisted
me in restraining her despite her repeated threat to harm herself and
others further. Without their assistance I have no doubt that I would not
have been able to sufficiently controlled the subject without greater injury
to her as well as myself considering the amount of broken glass. The
woman was transported to Eastern Long Island Hospital, is undergoing
treatment for her injuries, and is expected to fully recover. These four
gentlemen without regard for their own personal safety, despite glass,
flammable liquids, and ,not knowing what blood-borne diseases they were
exposing themselves to unselfishly went to the aid of another human being
who was in need of -assistance, and did so with a caring and compassionate
way. As a result of .their involvement all four -of these men suffered some
form of injury mainly to bites, to burns, to cuts, as well as exposure to
blood, which in this 'day and age could be extremely alarming in itself. In
this age of 'uncaring; and dispassionate people I am truly impressed with
these gentlemen's actions. They acted quickly and bravely, neither .knowing
or caring who the victim was, simply offering assistance. Then they simply
walked away once the Greenport Fire Department Rescue

Squad arrived to take over treatment not expecting any thanks or
accolades. As a small token of our appreciation, a small plaque. Mr. Ira
Millman, Southold Town Police Benevolent Association grateful recognition
of your brave and selfle4s actions on the evening of Thursday, June 17,
1999 in assisting a 'police officer in a incident in the Village of
Greenport.
SUPERVISOR COCHRAN: Thank you for your action and in becoming
involved in assisting one of our police officers. For unselfishly coming to
the aid of another human being in desperate need of assistance and for his
open public display and support given to the police officer during the
performance of his duty, while giving no regard to his own personal safety,
during an incident that occurred in Greenport on the evening of Thursday,
June 17, 1999. We would also like to thank you for giving of yourself to the
community. Thank you. There are people out there that do give support
when it is needed, so we offer our congratulations. Perhaps you would like
to identify the other two gentlemen.
POLICE OFFICE VINCENT TIRELLI: Al McMoore, who - is the gentleman
who ended up by being transported in the ambulance with myself, and I
repeatedly got the chance to thank him, and he just kept blowing it off.
That was the attitude from all four of the gentlemen. They really didn't
want any thanks. They did what they had to do. It is very, very
impressive. The other subjects are Bill Swiskey, who is an employee with
the Village of Greenport, Ira Millman, and Rich Fiedler. They were
there, all four of them did a tremendous job, and thanks to them the woman
made a full recovery. I spoke to her on the phone. She ,was apologetic, a
temporary lapse, she told me sometimes, and she thanked everyone
profusely. I know I spoke to several men from the Greenport Rescue
Squad, who were also very highly impressed with the way once the help
was there they backed off, and basically disappeared, ' and instead of
staying, and almost getting in the way they knew when to step back, let
people do what they were trained to do.

II . PUBLIC NOTICES.
SUPERVISOR COCHRAN: We have several public notices in relation to
dock building, and notice of some road improvements, placing shellfish
cages in Great P,econic Bay, and these also are public information, and
usually the public notices are also placed on the back Town Clerk Bulletin
Board.

project on Route 25 between the LIRR overpass and Marratooka Road in
Mattituck, and between Highland Road and Cox Lane in Cutchogue, from
the end of September 1999 IN Mattituck and October 1999 in Cutchogue,
between 9:00 a.m. and 3:00 p.m. weekdays. Work to be completed

IV. PUBLIC HEARING.
1 . 5:00 P.M., on the Matter of the Increase and Improvements of
Facilities of the Southold Solid Waste Management District in the Town of
Southold, in the County of Suffolk, New York, pursuant to Section 202-b of
the Town Law.
2. 5:05 P.M., on the Question of acceptance of the offer of El
Joanrac Cop., a.k.a. Jack Levin, for acquisition of approximately 59.4
acres in Greenport, SCTM #1000-44-4.5 and SCTM #1000-45-1 .9.
V. RESOLUTIONS.
SUPERVISOR COCHRAN: I am going to move right along because there are
some that have an appointment after the meeting, so I don't want to keep
them any longer than we have to, but I would like you to know that at this
time I invite the public to address the Town Board on any resolution that
we will be acting on. If your business with the town is not in reference to
a resolution, at the end of the adoption of the resolutions we will make
time for the 'public's input. So, is there anyone that would like to address
the Town Board at this point on any of the printed resolutions? We have
two hearings tonight, one on 5:00 and one at 5:05 in relation to
acquisition, and the first one is in . relation to Solid Waste Management
District. At this time is there anyone that would like to address the Town
Board in relation to any of the printed resolutions we will acting on now.
(No response.) If not, we will begin the resolutions.
I .- Moved by Councilman Romanelli, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board of the Town of Southold hereby grants
permission to the Knights of Columbus, Marion Council No. 3852,
Cutchogue, New York, to use Depot Lane from New York State Route 25 to
Sacred Heart Cemetery for a Pro Life March to the Shrine of the Unborn at
Sacred Heart Cemetery, on Saturday, October 16, 1999, beginning at
approximately 11 :30 A.M., provided they file with the Town Clerk a One
Million Dollar Certificate of Insurance naming the Town of Southold as an
additional insured.

WHEREAS, THE Board of Cooperative Educational Services of the Sole
Supervisory District of Northern Westchester and Putnam Counties (the
"BOCES") has heretofore entered into a certain MUNICIPAL
COOPERATION AGREEMENT (the "Agreement") made pursuant to. New York
General Municipal Law, Article 5-G, Section 119-0, amended and restated as
of July 20, 1992, by and among BOCES and each district and municipal
Cooperation, as defined in Section 119-n of the New York General Municipal
Law, that enters into the Agreement (with the BOCES, the
"Participants")' and•
WHEREAS, Section 13.1 of the Agreement provides that the Agreement,
including the Exhibits thereto, can be amended from time to time, by the
Participants in the manner set forth therein; and
WHEREAS, for various reasons, including, but note limited to the
compliance with the recently enacted Article 3-A of the New York General
Municipal Law which mandates the inclusion of certain provisions in the
agreement; and
WHEREAS, among such reasons is that certain provisions of the
Agreement have been identified as being unnecessary, in light of other
provisions of the Agreement; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby, approves
the amended and restated Municipal Cooperative Agreement, dated October
20, 1999, copy of which- is attached as an Exhibit; and be it

purchases of Open Space Land and compliance with the State Environmental
Quality Review Act; and be it further
RESOLVED that the Town Board- of the Town of Southold requests that
the Town Clerk forward this resolution authorizing participation in the
Preservation Partnership Program to the Suffolk County Executive and the

along the County Route 48 Corridor; and
WHEREAS, the Study constitutes a Type I action under SEQRA that may
have a significant adverse impact on the environment; and
WHEREAS, the Town Board of the Town of Southold is the only involved
agency; and
WHEREAS, the Town Board of the. Town of Southold has not identified
any significant adverse environmental impacts, but wishes to provide a
format through the SEQRA review and public comment of the Study; and
WHEREAS, a Final Generic Environmental Impact Statement (FGEIS) has
been prepared and adopted by the Town Board; and
WHEREAS, a Supplemental Generic Environmental Impact Statement has
been prepared to address the Study; and
RESOLVED that the Town Board . of the Town of Southold, acting as lead
agency hereby adopts the annexed Notice of Completion for the
-Supplemental Generic Environmental Impact Statement on the Town of
Southold County Route 48 Corridor Land Use Study.

SUPERVISOR COCHRAN: I see some frowns. I would just like to explain
that there are some letters that were sent in on the Generic Environmental
Impact Statement that were not put into the report. There were a stack of
form letters, so this is like a supplement adding it to the main body, just
so that you understand. That is the end of our prepared 'resolutions. We
still have five minutes before we go into our hearings. I would like to just
remind everyone, I did have a notice from the County today in relation to
SOUTHOLD TOWN BOARD AUGUST 3, 1999 2 .6 y9
the dry conditions that we have, and they asking all areas to, please, be
very, very cautious, and no throwing cigarettes out of car windows or some
of things that start fires along the highway. There are asking for
everyone's cooperation, because it is very dry out there, and they are
very concerned. We need rain badly. What else can I give you while we
wait a couple of minutes? You may be aware that at our last Board meeting
we had three gentlemen from LIPA come out, and we questioned the high
poles and wires that are replacing the old ones that are there along the
North Road, and so forth, and I wasn't quite happy with the results of the
meeting, so I have recommended to the Board and the Code Committee to
look at the possibility of putting a local law in place which would mandate
putting all future power electric phone wires and cables underground, so
we will see where this goes but sometimes you have to hold the foot to the
fire. We will see where it goes.
COUNCILWOMAN HUSSIE: Along with that topic it probably would be a
good idea if the people of Southold, in addition to the Town Board, if the
people individually told the LIPA officials how they felt about being the
ones who had to sustain these ugly poles.
SUPERVISOR COCHRAN: We have got petitions out to the public. We have
petitions out, and we are going to put more out. Some groups have offered
to help. I don't know if the rest of the Board got their mail today, but I
got a letter, also from a watch dog. I wish I had it here. A watch dog
group that keeps an eye on LIPA, and what they do, and they are
looking to build three power plants. Is it the island, or Suffolk County?
COUNCILWOMAN HUSSIE: LIPA RFP has identified the Town of
Southold as a possible location for construction of these power plants. The
power plants have numerous impacts on your committee, and among the
impacts are air pollution, water pollution, ground pollution, lots of stuff.
SUPERVISOR COCHRAN: But, they were here. When I read the letter this
noon I said—they were here two weeks ago. Didn't even mention that
Southold was a possible site for this, what kind of plant do they call it?
COUNCILWOMAN HUSSIE: Fossil fired electric generating plant, fossil
fired, which means what? Coal and oil? Oil. .
SUPERVISOR COCHRAN: They own the property up there on the Line, you
know, Riverhead up there by the. . I don't know what they picked as a
location, but they do own numerous acres up there. So, we are going to
have to keep an eye at that, too, see what is going on. Question them.
Also we sent a letter to Mr. Cassell in relation to their plan .to add a
new 69B transmission line in the Town of Southold, and it is questioning
where they are, or what they are doing in relation to SEQRA, because they
certainly have to comply with SEQRA, so if the press Is interested in a
copy of that letter you may have it also. - I think, and I am speaking in
part for the Board, but I think that all of us agree that we are not just
going to get down and roll over. We want some answers, and we are asking

RESOLUTION AND
ORDER AFTER PUBLIC
HEARING
WHEREAS, following a determination by the Town Board of
the Town of Southold (herein called "Town Board" and "Town"
respectively). to proceed with the increase and improvement of
facilities of the Southold Solid Waste Management District,
(herein called "District") , in the County of Suffolk, New York,
consisting of (i) construction of a new scale house at the
estimated maximum cost of $40, 000 and (ii) acquisition of various
equipment at the estimated maximum cost of $160,000, and after a
public hearing duly called and held, the Town Board of the Town
determined by the Resolution and Order After Public Hearing duly
adopted on November 12, - 1997., that it is in the public interest
to increase and improve the facilities of the District, and
ordered that such facilities be increased and improved at the
estimated total cost of $200, 000; and

WHEREAS, due to increased costs of materials and labor
for the construction of such scale house, the estimated maximum
cost thereof has increased by the amount of $10, 000 to $50, 000
and the estimated total cost of said increase and improvement of
facilities is now $210, 000, and it is necessary and desirable and
in the public interest and the best interests of the Town to
increase the total appropriation therefor by said amount of
$10,000, from $200, 000 to $210, 000; and
WHEREAS, the Town has completed modifications to the
map, plan and report to provide for said increase in costs of
materials and labor for said increase and improvement of
facilities, which now consists of (i) construction of a new scale
house at the estimated maximum cost of $50, 000 and (ii)
acquisition of various equipment at the estimated maximum cost of
.$160, 000, and filed the same with the Town Clerk; and
WHEREAS, the Town Board thereafter adopted an Order
describing in general terms the proposed increase and improvement
of the facilities, specifying the increase in the estimated
maximum cost of constructing such scale house and the increase in
the estimated total cost of said increase and improvement of
facilities from $200, 000 to $210, 000, and stating that the Town
Board would meet to hear all persons interested in said increase
in the cost to the increase and improvement of facilities on
August 3 , 1999, at 5: 00 o'clock P.M. (Prevailing Time) at the
Town Hall, in the Town; and
WHEREAS, copies of such Order, certified by the Town
Clerk, were duly published and posted pursuant to the provisions
of Article 12 of the Town Law, and such further public hearing
was duly held by the Town Board on this 3rd day of August, 1999
at 5: 00 o'clock P.M. (Prevailing Time) at the Town Hall, in the
Town, and considerable discussion on the matter having been had
and all persons desiring to be heard having been heard, including
those in favor of and those in opposition to said increase in the
cost to the increase and improvement of the facilities;

WHEREAS, the Town Board has duly considered and
reviewed all applicable federal, state and local laws and
regulations regarding environmental matters, including compliance
with the New York State Environmental Quality Review Act,
comprising Article 8 of the Environmental Conservation Law, as
related to the impact that the increase and improvement of
facilities of the District may have on the environment and, on
the basis of such consideration and review, the Town Board has
determined that no substantial adverse environmental impact will
be caused thereby;
NOW, THEREFORE, on the basis of the information given
at such hearing, it is hereby
DETERMINED, that it is in the public interest to
increase, by the amount of $10, 000, the estimated cost to the
increase and improvement of the facilities of the District by (i)
construction of a new scale house at the revised estimated
maximum cost of $50, 000 and, (ii) acquisition of various
equipment for use in and for the District at the estimated
maximum cost of $160, 000, as hereinabove referred to, the
estimated total cost thereof not to exceed $210, 000; and it is
hereby
ORDERED, that the cost of increasing and improving the
facilities of the District as hereinabove described is hereby
increased by the amount of $10, 000 and such new, scale house shall
be constructed and such equipment shall be acquired at the
estimated maximum cost of not to exceed $50, 000; and it is hereby
FURTHER ORDERED, that the Engineer heretofore retained
by the Town Board shall prepare specifications ,and make careful
estimates of the expense of said increase in cost to said
increase and improvement of .the facilities and, with the
assistance of thelTown Attorney, prepare a proposed contract or
contracts for the construction of such new scale house at such
increased cost and the acquisition of' such equipment, which
specifications, estimate and proposed amended contract(s) shall
be presented to the Town Board as soon as possible; and it is
hereby

FURTHER ORDERED, that the expense of so increasing and
improving such facilities shall be financed by the issuance of
not to exceed $210, 000 serial bonds of the Town, including the
$200, 000 serial bonds heretofore authorized, and the costs
thereof, including payment of principal of and interest on said
bonds, shall be assessed, levied and collected from the several
lots and parcels of land within said District by the Town Board
in the manner provided by law, but if not paid from such source,
all the taxable property within said Town shall be subject to the
levy of ad valorem taxes, without limitation as to rate or
amount, ' sufficient to pay the principal of and interest on said
bonds; and it is hereby
FURTHER ORDERED, that the Town Clerk record a certified
copy of this Resolution and Order After Public Hearing in the
office of the Clerk of Suffolk County within ten (10) days after
adoption hereof. '

WHEREAS, the El Joanrac Corp, a.k.a. Jack Levin has offered to sell
property to the Town of Southold under the Open Space Program; and
WHEREAS, the Town Board of the Town of Southold held a public
hearing on the question of 'the acquisition of the El Joanrac Corp./Levin
property on the 3rd day of August, 1999, pursuant to the provisions of.
Chapter 59, Open Space Preservation of the Town Code of the Town of
Southold, at which time all interested persons were given an opportunity to
be heard; and
WHEREAS, the Town Board deems it in the public. interest that the Town
of Southold acquire the El Joanrac Corp./Levin Property; now, therefore,
be it
RESOLVED that the Town Board hereby elects to purchase the property
of El Joanrac Corp. a/k/a Jack Levin, described as follows:
Suffolk County Tax Map No. 1000-45-1-9 and 1000-44-4-5, comprising
approximately 59.4 acres, located on the south side of the Sound Avenue
(Route 48) and the west side of Chapel Lane, Greenport, New York, at a
total cost of $430,000 subject to Suffolk County appropriating and providing
funds in the amount of 50% of the total cost of said acquisition and 500
undivided interest in the property to be held by Suffolk County; and be it
FURTHER RESOLVED THAT Supervisor Jean W. Cochran be and she
hereby is authorized to 'execute any and all required documents required
for the acquisition of the aforesaid property.

SUPERVISOR COCHRAN: That is the end of our resolutions. At this time
we will take comments from the audience in relation to any Town business.
Is there anyone that would like to address the Town Board?
DOMINIC PRINCIPI: Earlier, I just caught the tail end regarding Route
48 about next week. Is that going to be on the agenda?
SUPERVISOR COCHRAN: The 16th, the Town Board, we are going to
begin our Work Sessions in relation to Route 48, and our first Work Session
is on the '16th at 9:00 o'clock in the morning, and we will be going all
day. What we will be doing is looking at the Code, I believe, and the
changes that are required in .the; Code to add some uses to some of the
zones, and there will be no action in relation to changing any zones at that
time. .This is just Code work, and you are more than welcome to come and
sit and listen.
COUNCILMAN MOORE:, It will be subject to public hearings. The Town
Board is going to get' a chance .to look at what was given to us. This is
the first chance to talk it out, and hash it around.
DELORES PRINCIPI : After you make a decision, can we speak after that?

COUNCILMAN MOORE: There will public hearings. Just like tonight we had
public hearings scheduled and properly , noticed; and everybody gets a
chance to come into the room.
SUPERVISOR COCHRAN: That will be our Work Session.
DELORES PRINCIPI: When do we speak?
SUPERVISOR COCHRAN:- When we set the hearings.
DELORES PRINCIPI: How will we know?
SUPERVISOR COCHRAN: Do you own property up there? You will be
notified. Yes, sir? Would you use the mike and state your name, please? 1
know who you are, but the record doesn't.
DOUGLAS MORRIS: Douglas Morris of Morris Cesspool Service. Jean,
rumor has it where you might be closing the sewer plant, reducing the
hours?
SUPERVISOR COCHRAN: That- has not been discussed at this point. John
is the liaison for the Board.
COUNCILMAN ROMANELLI : Corinne has been out for an indefinite amount
of time. We really don't know when she is coming back in. John Adamo
has been covering the extra hours at this point. There was talk with Jim
Bunchuck in the landfill about getting a substitute up there, so the present
work up at Scavenger Waste doesn't accumulate too much comp time.
There was also some discussion about closing one-. day a week to eliminate
the comp time. No decisions were made. I tell you it all depends on how
long the employee is out, and when she is coming back. I think that is
going to determine a lot of decisions to be made.
DOUGLAS MORRIS: Are we going to be notified when we talk about it?
COUNCILMAN ROMANELLI: If any changes and hours are not there I
would anticipate, Doug, that we would send a letter out to everyone, the
five or six carters that come in there, let you know what the proposed
changes are, let you come back and give us you opinion on it, pro or con,
and then a decision will be made. I don't anticipate any decision happening
up at that Scavenger Waste Facility, and the change, of hours without
notifying everyone of the five or six carters that come in there.
DOUGLAS MORRIS: Talk about it before?
COUNCILMAN ROMANELLI: I would hope so.
SUPERVISOR COCHRAN: John, I think before we go in any direction I
think we should meet with the carters. You know, . have their input.
COUNCILMAN ROMANELLI : I am really waiting for Corinne.
SUPERVISOR COCHRAN: We haven't discussed' it at all, We should put it
on the agenda, and see what is going on. Anyone else I'ike to address the
Town Board? Yes., sir?
JACK WILLIAMS: Jack Williams, East Marion. On the Main Road across .from
Laurel Park there is a sign of the town that celebrates it's youth, etc.
Below that sign is another sign, which says a bias free community. When
the Anti-Bias Task Force met with the Town Board in a Work Session six
weeks ago one of the Task Force members indicated that she felt that the
goal while commendable was not necessarily being fully met at this, time. It
might be an overstatement to say that we were a bias free community. She
proposed that sign instead say, working towards a bias free community,
and when she said that I thought I saw a chorus of nodding heads around
the table, that indicated that everyone agreed with that, and yet I went by
the sign today, and it continues to say the same thing that it did before,
and I was wondering whether or not there was a deadline for the change of
that sign?

SUPERVISOR COCHRAN: The direction has been given to the person that
is responsible for taking it down. I believe the one down in Orient has
been taken down. New ones are being ordered to say what the committee
has recommended that it should say, and it is a matter of someone to get
up there, and get that. one down, but the order has been- given for them to
take it down. I 'don't believe it was six weeks, Jack, but it has been a
couple of weeks anyhow. We are very aware of the fact ..that it is going to
be changed, and it is going to come down.
JACK WILLIAMS: I worked very hard at finding out how long it was. It
was six weeks.
SUPERVISOR COCHRAN: • If that is what you want, you may have six
weeks.
JACK WILLIAMS: I never argue with the lady who has- her hand on the
button which turns off the mike.
SUPERVISOR COCHRAN: Also to the Town Board tomorrow morning at
11 :00 o'clock our interviews for the Administrative Assistant. Do I know
who is going to be there to help interview? I will start over here on my
left. John, anything?
COUNCILMAN ROMANELLI : No, nothing at this time.
COUNCILMAN MOORE: I just . want say, we had a very busy and
productive Work Session. We met with the Mayor of Greenport, and
representatives regarding the pool proposal out of Greenport, an interesting
presentation. I was very glad to see the Village in a spirit of working
cooperatively with the town recognizing that we are partners in the entire
township, ' and too often we find ourselves at loggerheads with another over
a variety of issues, who serves what, and who is doing what for whom, and
it is very refreshing to get a sense that the town and village work
cooperatively toward a venture. We are going to look at that and discuss it
more fully,. but it was an interesting presentation, and I was glad to see
the Mayor come up here with folks from the Village, and discuss it with us.
The Code Committee is going to get to work on a neat idea. We were
bouncing around this underground wires and cables whatnot we have
required in our subdivisions presently, and look forward to having further
discussions on that, because it is a neat idea helping reduce the visual
impact and others of power lines, putting them underground and the like.
Obviously we are spending a lot of money on open space acquisition and
vistas up in the corridor section of our community. It would be great if we
could sit there and eliminate some of the visual impact of that, so we will
work on that.
SUPERVISOR COCHRAN: Thank you, Bill. Brian? Louisa?
JUSTICE EVANS: I just want to say thank you to all the people that
helped with the air lift last Saturday. It was supposed to happen Sunday,
but they are coming back September 11th. Thank you for arranging it
with the National Guard, Eddie Cappabianca, who works for the town and
came over, and helped clear the cars of all the liquids and stuff, and Ed
Riley, and Phil Knauff, and particularly the Fishers Island Fire
Department for standing by in case something went wrong, and it didn't.
The only thing that went wrong was the weather, so. they couldn't finish,
but it was very exciting. The picture in the paper didn't show how exciting
it was.
SUPERVISOR COCHRAN: They will be back September 11th to finish the
job. We still have ten cars to remove from the island, and it really is
exciting. The Colonel, Colonel Ittiny invited me to stand right behind
him. He directs the copter in, and when that thing is sitting right above
your head with a car dangling ten feet in front of you, and they can set it
down on a dime. I am telling you,, it was unbelievable.
JUSTICE EVANS: We talked to some people that saw it actually from the
water. They didn't really know what is going on, and they looked up and
then there was this car just flying over there.

SUPERVISOR COCHRAN: Through the air. It is really is interesting to
come see, and it will be September 11th. That is the next time the Guard
is available, and hopefully we can finish up the job then, but it was fun,
and hopefully the Board will come down. I know some people did see, but
come down and see it. It's exciting. The kids would Love to see it. Bring
your families. It has been very, very busy between meetings, and Osprey
Dominion is sponsoring. . l know you golfers in the audience Osprey
Dominion is sponsoring . the Senior PBA Tournament or, something up in
Meadowbrook, and they did have a kickoff for that last week, and it is
really the first time that a business in the Town of Southold is sponsor of
a large undertaking, so we are quite pleased with that, and as you may or
.may not know I had the privilege of playing Queen Elizabeth over the
weekend in Shakespeare in the Park in Greenport. It was fun. I got to
meet new people, and I think I have developed some- friendships that will
last quite awhile, because it was a good thing to be involved in. Also, met
with Chief, Lieutenant and .John Raynor, and Bill in relation to the year
2000 and Y2K business. The County is meeting and other people, and I
just had Frank Petrone ask me if I would serve on a committee with
Legislator Levy in relation to this topic, and of course I have accepted it,
but we are really looking at many things, and a lot of our companies are
notifying that we are in compliance, and we should be okay, but there is a
lot of unknowns also, so we are looking at those kind of things. We are not
getting paranoid, but we are just for your' information looking at everything
in a good solid way. I was very pleased on Saturday to, go on the Coast
Guard cutter for the celebration of the Coffeepot one hundred years.
Congressman Forbes was brought, out by launch, and words were spoken,
and the-boats sprayed the water, and there was a nineteen gun salute, and
they had the canons set over on Plum Island, so alFtand all it was exciting.
Then we were invited to lunch at Claudio's which was very nice. It was
a nice day. So, we wished the coffeepot well. John and I did meet on
Monday with the representatives of the .Animal Shelter, and we have come to
an agreement in relation to the contract, and hopefully we will now finalize
that, but we were pleased that .that is being taken care of, and it will be
hopefully a three year contract. There has been lot going on, and we have
been very busy, but we will just keep going here. I would just like ' to
remind you again the weather index is extreme. Please be careful in relation
to fires. We certainly don't have the woods as the Pine Barrens, but we do
have some woodland. We would like to keep the little bit we have. Thank
