SOUTHOLD TOWN BOARD
JULY 20, 1999
WORK SESSION:
PRESENT: Supervisor Jean W. Cochran, Councilwoman Alice J. Hussie, Justice
Louisa P. Evans, Councilman William D. Moore, Councilman John M. Romanelli,
Councilman Brian G. Murphy, Town Clerk Elizabeth A. Neville, Town Attorney

9:00 A.M. . Appointment - Sylvia Pafenyk of Southold and David Olsen, Attorney
appeared before the Board on behalf of a new organization they founded called
"Bike Safe". Ms. Pafenyk stated that we have a lot of people in Southold who
are using a bicycle as a necessity for transportation. Ms. Pafenyk related how
she almost hit someone riding a bicycle early one morning on Sound Avenue. As
a result of this she.'decided to do something about it. A retired executive from
3M Manufacturing Company assisted her in designing reflective vests made from
3M reflective materials, a light mesh so it is cool in the summer, but large
enough so that it can be put over a down parka in winter.The cost is
approximately $6.50 plus shipping per vest. Ms. Pafenyk and Mr. Olsen asked
the -Town Board for financial assistance to provide these vests to the
farm/vineyard workers and others In the community who need them. Supervisor
Cochran spoke about the Bicycle Safety Program of the Southold Town
Transportation Committee headed by Neboysha Brashich. Supervisor Cochran
suggested that they coordinate their efforts together with the town committee to
find out how many people there are out there who need this equipment and then
report back to the Town Board.
9:12 A.M. - The Town Board reviewed IV. For Discussion Items. IV. 1.
Technical Coordinator 11, John Sepenoski's position will be discussed in
Executive Sessi-oh., IV. 2. Fishers Island Constables - per Judge Evans. The
present constable, Dick Grebe has indicated that he would like to retire soon.
Justice Evans would like the new constable that comes on to keep a log of
activities and to have some sort of training. Mr. Grebe has indicated a
willingness to stay on to train and help out in any way that he can. They will
try to coordinate it so that the new constable comes in right away so that there
is no gap in services. Also, that the constables coordinate' their time so that
there is always one on the island. Lieutenant Cochran 'stated that it was his
understanding that there will be some sort of modified in-house training since
these people can't attend ' the academy on a regular or even part-time basis
because• they all have jobs they need to work at. Lieutenant Cochran said that
the training can be worked out. Justice Evans reported that the Fishers Island
PAC (Police Advisory Committee) which consists of the State Police, Southold
Town Police and the Constables are trying to work towards more coordination
together. (Interviews will be set-up by Personnel Assistant Barbara Rudder for
the Fishers Island Town Board meeting day on August 11th. Justice Evans also
advised that she would like to arrange for the Town Board to visit the two
parcels which they recently acquired from Fitzgerald so that they can be more
aware of the situation when island residents refer to it or make requests in the
future. IV. 3. Telephone System Upgrade. Comptroller John Cushman said that
they will plan to utilize the current handsets with a new system. They did
receive proposals with new handsets,, but they were of a much lower quality than
what we currently have. Mr. Cushman informed that the new system. will also
have voice mail. Supervisor Cochran was adamant that.the first connection is to
a human voice before going into any voice mail menus. Mrs.Cochran said that a
lot of her time is wasted when she calls other government agencies by this voice
mail menu system and she will notehave it work in the same manner here in our
town hall. The Town Board stressed the importance of obtaining three new
speaker telephones that work well, one for here in the meeting hall, 'the
conference 'room and the Supervisor's Office. This new. system wilf be capable of

handling up to 200 handsets, we currently have only 72. There Will be no cost
for maintenance 'during the first year which will mean a savings of over
$6,000-00. Then after the first .year, it will be just $48.00 per handset, still a
savings of almost half. It will be set-up to handle .8 ports;' for computer lines-!so
that It will eliminate a lot of the interruption with fax machines. The total cost
is $24,445.00 and the company has assured the town that there will not be any
down time in the switch over. Two (2) resolutions were added, Resolution No.'s
13 and 14). IV. 4. Family Activity Center - Partnership with Greenport rather
than Town pool. Councilman Romanelli suggested that the Town -throw their
support behind the Village of Greenport pool efforts. He said that the fact that
there was no out-pouring of support f'or the Town pool at the July 12th meeting,
together with the promise of Mayor Kapell that he intends. to build the pool
without any taxpayer dollars has led him to this opinion. Supervisor Cochran
responded that it behooves the town• to look at the Greenport Village proposal if
it is "at no cost to the taxpayer". Councilman Murphy stated that he doesn't
think that the town should scrap theirs, just .put it in abeyance to look at the
Village's. Councilman Romanelli stated that he thinks that the Village Board
should be asked to come down to our work session and show us their numbers.
Councilman Romanelli, who is a member of the Greenport Village Pool Committee,
suggested that the Mayor and the members of the pool committee should be
invited to the next . meeting. The Board was of the opinion that the SEQRA
process should be started now, in case we want to do a referendum for funding
through a bond.
9:50 A.M. The Board took a short break at this time.
10:10 A.M. - Supervisor Cochran advised that her office called the Village and a
11 :00 A.M. appointment on August 3t-;d has been -set up.
10:10 A.M. - Appointment - Tom Cramer and his assistant Ken Weiner appeared
before the Town Board to answer any questions about the FGEIS for the CR48
Stud I y. Councilwoman Hussie questioned the timing of this and raised many
concerns of the Town Board not yet having given Input Into the Recommendation
Discussion and how the acceptance of this FGEIS will affect that..- Mr. Cramer
answered that a ten day period - must 'elapse after which time he will give the
Board a set of findings. Any implementation or changes can only ' begin after
this is completed. He explained that the adoption of the FGEIS is separate from
the Board's adoption of his specific recommendations and that the environmental
review process must be completed before they can act on any of the
recommendations. Mr. Cramer once again reaffirmed that this is not a new study
but a pulling together of everything the Town has done In the past. Councilman
Murphy questioned if we accept this FGEIS that It will not commit us to accept
the Recommendation Discussion? Mr. Cramer answered that it will not in any.
way commit the Board to accept any part of the Recommendation Discussion. Ms.
Hussie also took exception to the statement in the study that his
recommendations could be used as a blueprint for the community. Mr. Cramer
replied that this was his general statement and In fact It could be used as a
blueprint . for planning anywhere in the state or country. Supervisor Cochran
informed that there is a resolution on the agenda for this and it will be voted
upon this evening.
10:25 A.M. - The Town Board reviewed resolution numbers 1 through 14 to be
voted upon at the 7:30 P.M. meeting this evening.

Session at 10:30 A.M for the purpose of discussing Acquisition of Property,

Resolution Numbers 115-, appointing John Sepenoski provisionally to the position of
Technical Coordinator II; 16 - to set 5:00 , p.m.. August 3, 1999. as date for
public hearing upon I.. acquisition of Levin property at Arshamomaque -under the
open space preservation program; 17- to authorize obtaining prices fr"om
engineering firms to--,.determine the structural Integrity of-Brushes Creek Bridge;
and 18- to grant salary Increases to lifeguards and beach attendants were placed
on the agenda as a result of the foregoing Executive Session.

the town pool, not to stop, at least by starting the SEQRA process. (Resolution
No. 19 was placed on the agenda). The Board also directed the Town Clerk to
place a resolution on the agenda to advertise for members of the Landmark
Preservation Commission (Resolution No. 20).
3:00 P.M. - Appointment with LIPA - William Davidson, Director of Government
Relations, LIPA, Bert Cunningham, Vice-President Communications, LIPA, and.
Matt Millhous, Manager of Electric System Planning & Development for Keyspan
Energy appeared before the Town Board to explain their plans for the upgrade
to the 23ky line. Supervisor Cochran advised that the reason they were invited
here was because the Town has many concerns about it. Mr. Davidson reported
that they are still in the planning stage. Mr. Millhous put together three brief
fact sheets: (1) giving an overview of why they are doing the, planning. (2)
Status of the liabilities of the system. (3) project sequence which he briefly .
reviewed. Supervisor Cochran described the towers as ugly and requested them
to put in underground lines and questioned the health hazards. They answered
that there are no health hazards and it would be too costly to put in
underground wiring. Supervisor Cochran stated that she was not satisfied with
their answers. Councilman Romanelli questioned the underground facilities that
they recently completed on the south fork. Mr. Davidson said that the south
fork was done for environmentally sensitive issues and the need for permits from
the DEC every time they had to fix something. Supervisor Cochran advised that
they are proposing to cross two very important environmentally sensitive areas
at Mattituck Creek and Arshamomaque wetlands in Southold. . James Bunchuck,
Solid Waste Coordinator met with officials of Keyspan a few weeks ago to see
what could be done at the landfill about these towers. They are going to create
a serious problem with the landfill capping project. Dvirka & Bartilucci called
LIPA and Keyspan and will deal directly with their engineer on this problem.
The town will send them maps of our environmentally sensitive areas. Supervisor
Cochran informed them that the Town will actively oppose these towers and
requested a copy of their underground wiring study report and more information
on health and safety issues.

Moved by Supervisor Cochran, seconded by the Entire Town Board,
WHEREAS, the Town Board of the Town of Southold wishes to recognize
VICTOR BROWN for his meritorious service to the'community; and
WHEREAS, VICTOR, ' BROWN played an important. role in the
development and articulation of a shared vision for the Towns future as a
member of the Southold Town Stewardship Task Force during the years
199201994; and
WHEREAS, VICTOR 13ROWN served with distinction on an . ad-hoc
transportation committee (1991-1994). and subsequently on the Town
Transportation Committee (1994-1999); and
WHEREAS, VICTOR BROWN'S singular contributions to the development
and implementation of the North Fork Traffic Study and the 1999 Town
Bicycle Safety Program (involving some 1,750 elementary school children)
need to be highlighted; now, therefore be it
RESOLVED that the Town Board of the Town of Southold, on behalf of
the residents of Southold Town, hereby commends and applauds VICTOR
BROWN for his unique achievements and lasting contributions to the North
Fork community.

SUPERVISOR COCHRAN: It is with a great deal of .pleasure that we
present this to you on behalf of the entire town.
VICTOR BROWN: Thank you very much.
SUPERVISOR COCHRAN: You are welcome. We thank you for serving all
the years . you did for the town. We depend greatly on. our volunteers.
Also, if Dick would join us. Gentlemen; would you please join us? As
liaison of the Town Board Brian felt it was important, as we all know, to
recognize this committee at this time. It has been fifteen years in the
town, and' it goes back to many, many people and many Town Board
members. We used to have two committees. One was an 'Ag Committee and
one was Open Space. Somewhere along the way they were joined, and it
now the Land Preservation Committee which covers both areas. We would
like to call attention to the fact that you are volunteers of the highest
caliber, because not only do you investigate, go out and look for land, but
now you have the added responsibility of the 20 sales tax. There are
additional records that have to be maintained that is yet to come. Joyce,
also, as Secretary to the committee. We would like to present these
certificates of appreciation to you gentlemen. for the work you have done in
the area of land preservation, and the work that is yet to come. So, I
would like each Board member to present one to each of the members. I will
read this. A Certificate of Appreciation presented to Richard Ryan, Land
Preservation Committee, Richard serves as Chairman of the committee, for
the giving of his .time and talents as a dedicated volunteer, working
towards the safekeeping of our environment in plans for open space and
farm preservation within the Town of Southold on the behalf of the
residents of this community. We are saying, thank you, on behalf of the
community, and we hope this gives you another shot in the arm to get

terminal for Fishers Island District.

District to expand existing ferry terminal and . modify existing ferry
docking. Comments to be received by July 31, 1999.
Ill. COMMUNICATIONS.
SUPERVISOR COCHRAN: Communications, we received a thank you from
the Amateur Radio Club. They had a field day up at Horton's Point. They
went for two days to see how many areas they could contact all over the
United States, Mexico and Canada. The people in those countries were
doing the same, trying to contact all of us. Also, Alix Wipf in
relation to the LIPA high tension wire support the position of either
burying them, or not. We did meet with LIPA today, and I will report to
you more on- that.

session during the day, and at the night we pass the resolutions as a
result of our Work Session, and if there is any input if you would like to
address the Board at this time on any of the resolutions we will be acting
on, please, now is the time. If you -have general business, Town business,
you will be afforded the opportunity later on to address the Board. So, at
this point is there anyone that would like to address the Town Board on
any of the resolutions? If you don't have an agenda there ' should be some

authorizes and directs the Town Clerk to advertise for bids to construct a
four (4) foot wide timber stairway to the beach at the end of Rocky Point
Road, East Marion, New York. Councilman

RESOLVED that the Town Board of the Town of Southold hereby
authorizes Supervisor Jean W. Cochran. to execute a service agreement with
Simplex Time Recorder Company for hardware and software, support for the
Time Management System; said agreement subject to approval by the Town
Attorney.

.the proposal of EEA, Inc., 55 Hilton Avenue, Garden City, New York
11530, to complete the analysis of the Mattituck Inlet Watershed, at a cost
not to exceed $24,000.00.

RESOLVED that the Town Board of the Town of Southold hereby declares
the reconstruction of the Fishers Island Silver Eel Cove Wharf a Type II
action under the SEQR rules and regulations pursuant to Section 617.5
C(1) of said SEQRA rules and regulations, 6 NYCRR617.
RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs Supervisor Jean W. Cochran to execute an agreement
between the Town 'of Southold. and the New York State Department of
Transportation to provide funding to rebuild the Fishers Island Wharf at
Silver Eel Cove all in accordance of the Town Attorney.

environmental statement. No, action can be taken on this impact statement
for ten days. No action can be taken with regard to anything without a
public hearing. If there should be any confusion on that, this is only on

County under the County's Land Preservation Partnership Program, the

SUPERVISOR COCHRAN: That ends our resolutions for this evening. We
do not have any public hearings scheduled, so we will continue on, and
take any comments from the audience on any Town business. Would anyone
like to address the Town Board?-
ROD NEUMANN: Good evening. My. name is Rod Neumann. A own
property in., -Mattituck, and specifically I own property upon which the
L.IPA lines. do pass over. I attended the meeting that you all had with
their representatives today, and I applaud the Board for it's position that
the power lines should be placed underground. However, I sense a rolling
over of some. of the members, when it was mentioned by the representative

of LIPA that there was a tremendous cost involved. I think you should
challenge that rather general claim that was made. Specifically I, talked to
one of the representatives after the meeting, and the number that. he - had
included the cost of burying every one. that they have throughout this
system, obviously a tremendous undertaking. In the Town of Southold, as
you well know, their .power lines .pass over mostly farmland. I did a very
quick survey, and by my recollection about 990 of their lines pass over
entirely over land, so the cost to bury line, bury those power lines in
Mattituck, would reduced by that factor. In essence, they would have to
put a trench in, and put the cables in. To trench that the expense they
would have putting in new poles and demolishing .or bringing down the old
poles, so, I think you should demand from LIPA a analysis of what it
would take in terms of money to bury those lines in the Town of Southold.
It is- perfectly reasonable. I don't think it is a difficult request, and
think you should do it. I, also, think they gloss over 'the health hazard
that some people believe from the electric magnetic field. I have a letter
from LIPA, which is probably ten years old, in which they state that all
the studies they have seen to date, ten years ago, the studies were
inconclusive, and I believe they still are inconclusive, but nobody has said
that there is not a,, problem to the extent that they are going to increase
the voltage from, I, believe, it is 23,000 up to 69,000. That is increase
whatever problems exist, if indeed some health problems do exist. I am
going to, as a property owner, over which these lines. pass,. I am going to
insist from LIPA that ' they ,provide me with more detailed information on
that particular aspect. You all touched very clearly on the aesthetics.
There is nothing uglier in the Town of Southold than those stanchion, and
they are going to make them higher, and I know I can speak from personal
observation. In Mattituck Inlet as you come into the Inlet from the Sound
one of the first things you. see are the .existing stanchions. They are not
attractive, and now the proposal is to raise them by ten feet. Well, they
are going to be more obvious, and they are obtrusive. There was a
statement made by LIPA that there is a possibility that they could bury
the lines in selected areas. I certainly think the Town of Southold should .
be one of those - selected areas., and specifically, more specifically the
Mattituck Inlet. 1 observed. personally quite. awhile ago, probably fifteen
years ago, a sailboat with a very high mast coming in striking the power
line, and there was. a ball of fire that rolled down the mast. It did not
injure anyone, but it was a scary, scary sight. Every once in awhile a sea
plane comes into' the inlet. Those power lines are a menace to this kind of
airplane. They are a menace 'to crop dusters, so there are plenty of
reasons why those kind of lines should be buried, and I urge you again to
use your leverage since you have .to grant the permits, or the town has to
grant permits to LIPA. Use your leverage with LIPA, and continue your
efforts to get the lines buried. Thank you.
COUNCILWOMAN HUSSIE: Did the representative give you any idea as to
the cost per mile for, burying underground?
ROD NEUMANN: No, he didn't. I gathered that they did not have
specifics. The gentleman said that the cost for the entire system would be
about three times, triple what it would cost if the lines were to remain
above ground.
COUNCILWOMAN HUSSIE: The cost would be anywhere from a $100.00 a
foot. .
ROD NEUMANN: I. don't know, but again I think we should demand an
analysis of the cost from the. Town of Southold.
SUPERVISOR COCHRAN: They will be ,sending that. That was one of the
things I asked for. . I was not happy 'entirely with the answer. I have read
many articles, pro and con, on the effects of power .lines on neighborhoods
and area that develop problems. We also asked. for funds that they received
for the usage of their poles, Cablevis ion, and Bell-Atlantic. We also have
to send them information. This is only the beginning. We also have to send
them information in: relation to three sensitive areas, Mattituck, that you .
brought to. our attention, and Arshamomaque where the flood-,. pla- forest
is, and also the causeway in Orient when we have storms. So, there is still
going to 'be a back and forth, and by no means it has been brought to a
conclusion.

COUNCILMAN ROMANELLI: I also want to say that, you know I think you
brought up some good points that I didn't realize until after the meeting.
One of the reporters pointed out after the meeting that in their
conversation with LIPA that all the poles from East Hampton to Montauk,
they buried everything.. That is a long distance, so after that was pointed
out to me I thought to myself, hey, if they can go from East Hampton to
Montauk. they can certainly do something better in this town.
SUPERVISOR COCHRAN:, Anyone else like to address the 'Town Board?
MARIO FASARO: My name is Mario Rasaro. I live at.; 12 Gilder Court,
Northport. When resolution #11 was tabled, could someone explain to me
why, and give me some background on exactly what is happening?
SUPERVISOR COCHRAN: We had a special Board meeting the other day,
and it was on the Environmental Impact Statement, and there was a feeling
of some that their questions had not answered. The consultant that
developed these recommendations came into the Town Board this morning,
and answered any questions that were presented to him. At that point the
resolution was put on for passage tonight, and first we had to remove it
from the table, because it was tabled the other day. Then we were able to
take action on it. Now, what this is, is an environmental review of
concerns that were offered at the hearing in relation to the moratorium on
Route 48. There will certainly be an environmental impact, so we go
through this process which is required by the DEC. I don't know if I am
answering your question or not. What else do you need from me? So, this
evening all we have acted on is the environmental aspects. It is generic.
We haven't started looking at specifics in relation to any of the property
along the North Road. Do you own property up there?
MARIO FUSARO: Yes. Some of what you are saying is brief, but I
wanted to point out that we have had some property on 48 for a number of
years, and it was originally zoned CB. In the 80's it was changed to LB.
We were never told of this. We found out from the tax bill, and now I
understand they want to change the zoning to R80. Personally I bought the
property, . well my Dad -bought it actually, and we had certain ideas about it
way down the road. Many of the others who live in this area feel the same
way, and a lot of people are very upset about this. Some people don't own
any land. They don't care. They figure, oh, fine. I can see both sides,
but when you buy something, and you have it for so long if I told you,
oh, we are going change the zoning on your house, ' and you are not
allowed to sell that house, you know, that's it. -A lot of 'these people don't
want this. I don't want it. I bought the property. It was already changed.
The value has gone down. LB is worth less that CB. The area where we
have the property they are increasing the width of the road to three or
four lanes, so for somebody to buy a house in this area the value is very
low, very low. I think it is very unfair, and the people behind me feel the
same way. I have a partner who went to the town and she basically through
the Freedom of Information Act asked to see what was in the file, what has
been done with this moratorium. The moratorium has been in effect for
something like six months or so, and she was told nothing has been done
yet. You know, there is nothing there, and my attorney told that six
months there has got to be something there. These people are being paid
from tax money, which comes from my pocket. You people are there. You
are being. paid from tax money, that I pay to this town. Now, we don't
want any changes, very few, and we would like to be told when these
changes will- brought up for vote, because we don't agree with everything.
We .have that right according to the Constitution. At any rate, I had a
potential buyer for the property. They are waiting to see what will happen
with the moratorium, which was extended three more months. Now, in the
meantime I am paying taxes on this property, can't do anything with it,
nothing with it, and anyone elsewhere. I am stuck here, and I really don't
feel that it is fair. If you people were in my shoes, I don't know what
properties you own or whatever, but look at the other person's side instead
of just one side only. . I can see some of your points but not totally. I
think it is terribly. unfair, and I want to know what is happening, and
When, because I want to voice my opinion, and there are many others
behind me on this. Also, if you guys feel so strongly about changing
certain areas of :the town that is fine and good, but buy the property. I
will put, a. price on it. We. will go into contract, and buy it from me. You
can do what you want with it.

SUPERVISOR COCHRAN: You will be notified as the Town Board moves
ahead. The Town Board has made no decisions at this point on the
specifics. We will be reviewing it, and we will begin to either accept
recommendations or reject recommendations.
MARIO FUSARO: How will I hear, contacting the town for an agenda, or'
personally?
SUPERVISOR COCHRAN: As we go through the zone changes, if that is
what the Board has decided, there will .be a hearing held of which you will
be notified for personal input. If you would like, notification of any of
our Work Session in relation to this, we can certainly can arrangements to
notify you. I don't see that as a problem.
MARIO FUSARO: How would you go about it?
SUPERVISOR COCHRAN:. Give me your name and address, and I will see
that you get a notification.
MARIO FUSARO: Another thing, l would like to see what is being done
in the file. There must be something. It has been .six months or more. This
group is being paid tax money, and they certainly should have a work
sheet on what they come up.
SUPERVISOR COCHRAN: It would be available in the Town Clerk's Office.
The one with the specifics is $17.00.
MARIO FUSARO: How much longer can this go on? Legally how long. can
you?
COUNCILMAN ROMANELLI: September.
SUPERVISOR COCHRAN: We hope to be finished with our work by then.
Thank you for your comments. Anyone else like to address the Town
Board?
JIM DINIZIO: Jim Dinizio, Greenport. I got three things. I was in
attendance at the pool meeting that you had the other night, and I
regretted not getting up and saying something, because what Mayor
Kapell had to say made a lot of sense to- me. It is certainly . something
that I believe in.
SUPERVISOR COCHRAN: Jim, may I share with you that the Board this
morning agreed that if the Mayor in two of his statements was that he could
do a pool with no cost to the taxpayer, that would certainly behoove us to
see what the man had to say, so we' called the Mayor today, and he will be
at the next Town Board meeting at 11 :00 o'clock.
JIM DINIZIO: I just regretted not saying that, because I did think it
made a lot of sense. I am glad you are going this way, because $4,000,000
is something to save. Number two, I also attended the bus ride and I am
somewhat disappointed in the consultant. It seems to me like, you know,
either we should require better of the people that work for us, I think we
should hold them to a standard that we hold to all our employees. This
gentleman has been late every step of the way. He was late with the
report. So, we had to extend the moratorium. He was late for the bus, so
we had to stay on there for a little longer. He didn't have any, he was not
prepared to give us any information so we could follow along with the
study. Whether it was on purpose or not, I really don't care, but if that
person worked for me, I believe I wouldn't , have *let him on the bus. Let
alone let, him try and fumble through explanations extremely important to
the taxpayers, and - certainly the people that this is .going to affect. Now,
the $17.00 is okay: to charge for a report. I think when . a person has
$50,000 or $60,000 on. the line we should be doing something more for them
except charge for that report. I understand that it cost the taxpayers
something, but you know that is part of the expense of doing business.
You do a study, you pay for it. You know, when you come up with the
results, -and you want to share that information, that information should be
available to everybody in the town equally. The gentleman 'that spoke
before me gave an idea of perhaps they are thinking of the .town, but
don't know. It was- also written by one of the consultants. It 14 written on

Suffolk County letterhead. It is signed by the Director of Planning, a
person we hired to do a study for us. I am assuming that when you hire
someone to do a study you hire someone who is unbiased, ;that will give you
an honest opinion, and not their opinion, or rather the result of their
study. That is what we. hire them for I am assuming. This 'gentleman, and
will just read a little bit, at the risk of engaging in.' a battle of wits
with unarmed men, the Southold Business Alliance, these are your
taxpayers. These are the people that pay the bills. .
SUPERVISOR COCHRAN: Jim, may I say?
JIM DINIZIO: No, you may not.
SUPERVISOR COCHRAN: I am going to. I am going to, Jim. I • did not
write that letter, nor did any member of this Town Board.
JIM DINIZIO: - I believe I said who wrote it.
SUPERVISOR COCHRAN: We have all received a copy.
JIM DINIZIO: I would like to read it.
SUPERVISOR COCHRAN: It was in the newspaper, -I thought. Was it not?
JIM DINIZIO: It certainly was. .
SUPERVISOR COCHRAN: Read it if it makes you happy.
JIM DINIZIO: I am assuming this is the official word of our Town
consultant, because it is written on Suffolk County letterhead.
SUPERVISOR COCHRAN: Yes, but he was not speaking on our behalf. He
was speaking on his volition.
JIM DINIZIO: I don't believe so, because if he is doing personal
business on County time, on County stationary. .
SUPERVISOR COCHRAN: Deal with the County. Please, finish your
comments.
JIM DINIZIO: My comments are that if you had not become aware of this,
and I am assuming that you are aware of it, because you .just commented on
it, if you are not going to make a comment to this gentleman in public,
then I have to assume, and other people have to assume, that you agree
with his comment: Now, I would like to have this made part of the record.
If you don't have a copy I will furnish you with a copy, but to me, the
gentleman who writes, Mr. Jones, who would write and imply that people
are ignorant, uninformed, gray animals lead by Napoleon' the pig, is not a
.person I want working for me.
SUPERVISOR COCHRAN: That is his responsibility, Jim.
JIM DINIZIO: Jean, if it were written at the desk of Steven Jones, fine.
It is not'. It is written on Suffolk County letterhead. I am assuming that
was at some official meeting. If not, why is this gentleman doing this? I
think you ought to ask that question. I think you ought to get that
answer in writing, that's all. 1 am just merely stating my surprise that
this could be allowed to happen in this town. I realize I am taking up your
time, but it is something that is very important to me. Now, if. Mr. Jones,
and we couldn't really comment during the last time he did the study.
When he came here and presented it he wouldn't let us ask any questions,
can't allow us to comment on his study, which by the way was fairly
thorough. No way would I agree with it without resorting to this. I do want
to at least see my Town Board stick up for it's taxpayers in some way,
shape, manner, or form. I thank you for your time.
SUPERVISOR COCHRAN: Thank you, Jim. Anyone else like to address the

JACK WILLIAMS: Jack Williams from East Marion. At the next Town Board
meeting it will 91 days until election from August 3rd. I did my homework .'
partly in gratitude for you all having been so nice as to put dollar figures
on the budget modifications. That means, I presume, that there will
insufficient time due tb' the necessity of public hearings, and one thing or
another, or there could be a referendum on the Southold Electric Company,
and therefore I presume this is the appropriate time to say, alas, of the
fact that the electric company will not come into being this year. It is too
bad because first of all it offers the opportunity for substantial savings
in the future for everyone who pays LIPA bills. Secondly, it allows the
possibility of a statement being made with regard to the Public Service
Commission, and it's rather strange rulings around the question of how
electric should be billed to the consumers anyway. Governor Pataki's
people in the Public Service Commission have decided that of, we will say
$.10 worth of delivered power to one's home something close to $.07 should
be distributed to the intra-structures, to the wires and poles, and the
junction boxes, and only about $.03 to the generation of the power. This
means independent power generators are not terribly attracted to New York
State, and are taking their business elsewhere. However, hell has no fury
like a New York consumer, who finds that another state is getting a
bargain, and it may very well be that there will come a time when the
Public Service Commission will be prevailed upon to change It's rule, and to
make it possible for electric generation to result in savings for the people
of New York State. Specifically if there were a Southold Electric Company
in place we would be ready when that time came. As it stands now because
of some politics of timidity , why we have nothing, and on our tombstones
may be written, they couldn't try. I thank you for your time.
SUPERVISOR COCHRAN: Thank you for your comments. You can tell he
is running for office.
