Hussie,Councilman William D. Moore, Councilman Brian G. Murphy, Town Clerk Elizabeth A. Neville, Town Attorney Gregory F. Yakaboski. Absent: Justice Louisa P. Evans (due to inclement weather) . Councilman John M. Romanelli. 10:00 A.M. - The Board met to review and finalize the resolutions to be voted at the 1:00 P.M. Organizatinal Meeting. 11:25 A.M. - Work Session adjourned. 1 :00 P.M. A Organizational Meeting of the Southold Town Board was held on January 4, 1999, at the Southold Town Hall, Main Road, Southold, New York. Supervisor Cochran opened the meeting at 1:00 P.M. with the Pledge of Allegiance to the Flag. Present: Supervisor Jean W. Cochran Councilwoman Alice J. Hussie Councilman William D. Romanelli SUPERVISOR COCHRAN: Resolution Number one? I .-Moved by Councilman Murphy, seconded by Councilwoman Hussie, it was WHEREAS, Section 64 of the Town Law requires the Town Board to designate, by resolution, banks in the State in which the Supervisor of other officers of the Town shall deposit moneys coming into their hands by virtue of their office; and WHEREAS, the Town Board may require any bank, so designated, to deposit with such Board bonds or certificates of the United States, of the State of New York or any county, town, city; village or school district of the State of New York or any county, to city, village or school district of the State of New York, such security for such funds so deposited, but such bond or certificate shall be subject to the approval of the Town Board and shall bedeposited in such place and held under such conditions as the Town Board my determine; now, therefore, be it JANUARY 4, 1999 RESOLVED that the following banks are designated for fiscal year 1999 as depositories, and the following securities are hereby-re uired as collateral for such cash balances in said banks: Bridgehampton National Bank $ 5,000,000.00 Bridgehampton National Bank $ 5,000,000.00 (Tax Receiver's Account) Fleet Bank $ 5,000,000.00 North Fork Bank $ 5,000,000.00 North Fork Bank $ 5,000,000.00 (Tax Receiver's Account) Suffolk County National Bank $ 5,000,000.00 Suffolk County National Bank $ 5,000,000.00 (Tax Receiver's Account) AND BE IT FURTHER RESOLVED that the Town Board hereby authorizes Supervisor Jean W. Cochran to execute Collateral Agreements between the Town of Southold and the above designated banks and their Third Party Custodial Institutions, all in accordance' with the approval of the Town Attorney; and be it FURTHER RESOLVED that authorization for increase and decrease of securities shall be subject to the approval of the Supervisor. 1 .-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 2.-Moved by Councilman Moore, seconded by Councilman Murphy, WHEREAS, Section 11 of the General Municipal Law, requires that the Town Board may authorize the Supervisor, chief fiscal" officer of the Town, to invest moneys not required for immediate expenditure; now, therefore, be it RESOLVED that the Supervisor is hereby authorized to deposit or invest moneys not required for immediate, expenditure in special time deposit accounts or certificates of deposit issued by a bank or trust company locate and authorized to do business in this State, provided, however, that such time deposit accounts or certificates of deposit shall be payable within such time as the proceeds shall be , needed to meet such expenditures for which such moneys are obtained, and provided further that such time deposit accounts or certificate of deposit shall be payable within such time as the proceeds shall be needed to meet such expenditures for which such moneys are obtained, and provided further that such time deposit accounts or certificates of deposit be secured An ` the manner provided in Section 11 of the General Municipal Law. 2.-Vote of the Town Board: Ayes:. This resolution was duly ADOPTED. 3.-Moved by Councilwoman Hussie, seconded by Councilman Murphy, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the use of a facsimile signature to pay all checks, drafts, and other instruments for payment of money drawn upon the accounts of the Town of Southold by Supervisor Jean W. Cochran, except those third party checks, drafts or other instruments ` in amounts in excess of $5,000.00 drawn upon the following checks. This resolution was duly ADOPTED. 4.-Moved by Councilman Murphy, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to Supervisor Jean W. Cochran to travel within New York State on town business, as required throughout the year, and the necessary expenses for travel, meals and lodging; shall be a legal charge to the 1999 budget. 4.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. -lit -JANUARY 4, 1999 33 5 SUPERVISOR COCHRAN: Number 5 we are holding, . because we have had request from Suffolk Life to also be considered as the official newspaper of Southold, so we are doing some research on that. This does not take effect until February 1, so we do have time to look at this. I really haven't heard from the other paper, that they are interested, so we will be dealing with this probably in two weeks at the next Town Board meeting. We do have a meeting tomorrow, but it may not provide us with adequate time to get the information we need. 6.- Moved by Councilwoman Hussie, seconded by Councilman Moore, it was RESOLVED that pursuant to Section 64(1-a) of the Town Law, a petty cash fund hereby established in the following amounts for the following individuals: Supervisor Jean W. Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 7.- Moved by Councilman Moore, seconded by Councilman Murphy, it was RESOLVED that Supervisor Jean W. Cochran be and she hereby is designated to represent the Town of Southold at the annual meeting of the Association of Towns of the State of New York, to be held in New York City on February 14, 15, 16 E 17, 1999, and to cast the vote of the Town of Southold pursuant to Section 6 of Article III of the Constitution and By-Laws of the Association of Town; and be it FURTHER RESOLVED that Councilwoman Alice J. Hussie be and he hereby is designated to act as the alternate delegate, to cast the vote of the Town of Southold at the annual meeting of the Association of Towns in the absence of Supervisor Cochran. 7.- Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 8.- Moved by Councilman Murphy, seconded by Councilwoman Hussie, it was RESOLVED that those officers and employees of the Town of Southold attending the annual meeting of the Association of Towns of the State of New York be and hereby are allowed a maximum of $700.00 per officer and employee for the actual and necessary expenses for registration, travel, meals, and lodging incurred while attending said meeting. 8.- Vote of the Town Board: Ayes: Councilman Murphy, Councilman Romanelli, Councilman Moore, Justice Evans, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 9.- Moved by Councilman Moore, seconded by Councilwoman Hussie, it was RESOLVED that any Town official, elected or appointed., who is required to use his own automobile in the performance of his duty, shall be compensated for travel expenses necessarily and actually incurred in . carrying out the duties of his office, at a rate not exceed thirty cents ($.30) per mile. 9.- Vote of the Town Board: Ayes: Councilman, Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. JANUARY 4, 1999 10.-Moved by Councilman Moore, seconded by Councilwoman Hussie, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law, that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable, and that Superintendent of Highways shall not be fixed in an amount in excess of the amount respectively specified in the notice of hearing on the preliminary budget published pursuant to Section 108 of the Town Law; now, therefore, be it RESOLVED that the annual salaries of the following elected Town officials shall be as follows, to wit: Supervisor Jean W. This resolution was duly ADOPTED. 11 .-Moved by Councilwoman Hussie_, seconded by Councilman Moore, it was RESOLVED that pursuant to Section 142(1-A) of the Highway Law, the Southold Town Superintendent of Highways be and hereby is authorized to purchase equipment, tools, snow plows and other implements and devices without prior approval of the Town Board in an amount not to exceed $10,000.00 for any one item during the period from January 1, 1999 through December 31, 1999. 11 .Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 12.-Moved by Councilman Murphy, seconded by Councilman Moore, it was RESOLVED by the Town Board of the Town of Southold that the Commissioner of Public Works be and he hereby is authorized to purchase the necessary supplies and equipment, without prior approval of the Town Board, in an amount not to exceed ,$10,000.00 for any one item during the period from January 1, 1999 through December 31, 1999. 12.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 13.-Moved by Councilwoman Hussie, seconded by Councilman Moore, it was RESOLVED that the Town Board of 'the Town of Southold hereby approves the payment of 1999 Suffolk County, New York State and other related association dues for elected and appoint officials, and expenses incurred by these Southold Town elected and appointed officials with respect to said associations: New'York State Association of Towns New York State Association of Large Towns New York State Planning Federation New York Association of. This resolution was duly ADOPTED. 14.-Moved by Councilman Moore, seconded by Councilwoman Hussie, WHEREAS, Section 22B of the Town Town Law,,.a'ilows the Town Board of any town having more than one Assessor to establish the office of Chairman of the town Assessors, who in addition to his regular duties, shall perform such services in connection with assessment and taxation of property for state, county, and town purposes as the Board shall direct; now, therefore, be it RESOLVED that Assessor Scott A. Russell be and hereby is designated to hold the office of Chairman of the Board of Assessors until the 31st day of December, 1999, at the pleasure of the Town Board, all in accordance with Section 22B of the Town Law; and be it FURTHER RESOLVED that the compensation for such appointment be fixed at $2,000.00 per annum, payable in regular biweekly payments. 14.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 15.-Moved by Councilman Murphy, seconded by Councilwoman Hussie, it was RESOLVED that pursuant to Section 272 of the Town Law, Bennett Orlowski, Jr. is hereby designated Chairman of the Southold Town Planning Board for the term of January 1, 1999 through December 31, 1999; and be it FURTHER RESOLVED that the Chairman of the Planning Board shall be paid a salary of $2,000.00 per annum, in addition to his regular salary, effective January 1, 1999 through December 31, 1999, and the same shall be paid in regular bi-weekly payments. 15.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussle, Supervisor Cochran. This resolution was duly ADOPTED. 16.-Moved by Councilman Murphy, seconded by Councilwoman Hussie, it was RESOLVED that pursuant to Section 267(1) of the Town Law, Gerard P. Goehringer, Jr. is hereby designated Chairman of the Southold Town Board of Appeals for the term of January 1, 1999 through December 31, 1999; and be it FURTHER RESOLVED that the Chairman of the Board of Appeals shall be responsible for furnishing to the Town Board a detailed monthly report of activities within his department; and be it FURTHER RESOLVED that the Chairman of the Southold Town Board of Appeals shall be paid a salary of $2,000.00 per annum, in addition to his regular salary, effective January 1, 1999 through December 31, 19999, and the same shall be paid in regular bi-weekly payments. 16.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 5 JANUARY 4, 1999 17.-Moved by Councilwoman Hussie, seconded by Councilman Moore, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of the. officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable; now, therefore, be it RESOLVED that the 'annual salaries 'of the members of the Planning Board and the Board of Appeals of the Town of Southold be and hereby are fixed as follows for the term January 1, 1999 through December 31, 1999: PLANNING BOARD William Cremers $7,348.00 Kenneth L. This resolution was duly ADOPTED. 20.-Moved by Councilwoman Hussie, seconded by Councilman Moore, it was RESOLVED that the Town Board of the Town of Southold hereby sets the compensation of the members of the Southold Town Board of Assessment Review, effective January 1, 1999 through December 31, 1999 at $1,000.00 per member per annum, payable on May 27, 1999, total compensation for all five members of this Board not to exceed $5,000.00 for 1999. 20.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. , This resolution was duly ADOPTED. 21 .-Moved by Councilman Moore, seconded by Councilman Murphy, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Dr. Edward Broderick, Superintendent of the New Suffolk Common School, as Attendance Officer for the year 1999, subject to the written approval of the District Superintendent of Schools; and be it FURTHER RESOLVED that the compensation of the Attendance Officer be fixed at $5.00 per hour when working in this capacity, he to pay his own expenses; and be it FURTHER RESOLVED that the Town Clerk be and she hereby is instructed to notify Dr. Broderick and the District Superintendent of Schools of this appointment. 21 .Vote of the Town Board: Ayes: , Councilman Murphy, Councilman Moore, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. JANUARY 4, 1999 3 4,1 22.-Moved by Councilman Murphy, seconded by Councilman Moore, it was RESOLVED that the ' Town Board of the Town of Southold hereby appoints Supervisor Jean W. Cochran as Emergency Preparedness Coordinator for the Town of Southold for the term of January 1, 1999 through December 31, 1999, at a compensation of $1,684.00. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Councilwoman Hussie; Supervisor Cochran. This resolution was duly ADOPTED. 23.-SUPERVISOR'S APPOINTMENT Supervisor Jean W. Cochran hereby appoints Chief of Police Joseph A. Conway as her Deputy Emergency Preparedness Coordinator for the Town of Southold for the term of January 1, 1999 through December 31, 1999, he to serve in said capacity without compensation. 24.-SUPERVISOR'S APPOINTMENT Supervisor Jean W. Cochran hereby appoints Public Safety Dispatcher III John Raynor as Chief of Police Joseph A. Conway's Assistant Deputy Emergency Preparedness Coordinator for the Town of Southold to the term of January 1, 1999 through December 31, 1999, he to serve in said capacity at a compensation of $2,000.00 25.-SUPERVISOR'S APPOINTMENT Supervisor Jean W. Cochran hereby appoints Alan . Thibodeau as her Deputy Emergency Preparedness Coordinator for Fishers Island, at a fee of $2,000.00, for the period of January 1, 1999 through December 31, 1999. 26.-SUPERVISOR'S APPOINTMENT Supervisor Jean W. Cochran hereby appoints Norman A. Reilly as her Fire Coordinator for Disaster Preparedness for the Town of Southold for the term of January 1, 1999 through December 31, 1999, he to serve in said capacity without compensation. 27.-Moved by Councilwoman Hussie, seconded by Councilman Moore, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Luis F. Horn and Michael Conroy as Bay Constables, and authorizes and directs Supervisor Jean W. Cochran to execute agreements between the Town of Southold and Luis F.
