The meeting was called to order at '1:30 P.M. with the followinf present:. Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest and Edwards; Town Attorney Terry and Town Clerk Boot4, and Supt. of HighwayssPrice. Moved by Justice Clark; secohded by Justice Tuthill: RESOLVED: That the minutes of the meeting of Dec. 3 , 1957, be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark, Demarest and Edwards. Moved by Councilman Albertson; seconded by Justice Tuthill: RESOLVED: That the Organization meeting and the regular monthly Audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, January 7, 1958, at 1.:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark, Demarest and Edwards . The Supervisor read the call of the hearing and called upon any person who wished to speak either for or against the proposal. No person spoke against the change in the ®rdinance and Howard Terry spoke in favor of the change in the Ordinance. The hearing was duly closed at 2:35 P.M. Moved by Councilman .Albertson; seconded by Justice Demarest: WHEREAS , the Southold Town Planning Board has prepared an official report and recommendation on the proposal to amend the Building Zone Ordinance of the Town of Southold, Suffolk County, New York, by rescinding and repealing Section $01 of said ordinance and substituting a new Section 901 so as to provide that the printed notice of a public hearing on a proposed amendment be given, pursuant to the provisions of the town law, and WHEREAS , the Town Board , after due consideration of the matter, has concluded that it is in the public interest to call a hearing, pur- suant to the provisions of the town .law and said ordinance for the pur- pose of considering such proposal, I I EI EA 'sRE�OR , E a IT R1 S0LV D T-jr_T a public hearing be held by the Southold Town Board at the office of the Supervisor, 16 South Street, at 2:00 P.M. at which time all persons desiring to be heard in favor of said proposal, and also all those desiring to be heard in opposition thereto, were- given an opportunity to be heard and thereafter the public hearing was closed and decision reserved: NOW, THEREFORE, BE IT RESOLVED: that the Building Zone Ordinance of the Town of Southold, Suffolk County, N.Y. be amended, rescinding and. repeal- ing Section 901 of said Ordinance and substiuting therefor the following: ' Section 901:- The Town Board by resolution adopted at a stated meeting , shall fix the� time and place of a public heat-ing on the proposed amend- ' ment and cause notice thereof to be given pursuant to, the provisions of the Town Law. The Town Board, before advertising for a public hearing, shall, in a written request, instruct the Town Planning Board to pre- pare an official report defining the conditions described in a petition and determine the area so affected with their recommendations ." Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark, Demarest and Edwards . Moved by Councilman Albertson; seconded by Justice Demarest: RESOLVED: That a permit for a Trailer Camp be granted to Charles and Florence Zeigler. Vote of Town Board: .Ayes-Supervisor Klipp; Councilman `llbertson; Justices Tuthill, Clark, Demarest and Edwards . *58 Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, the Town Trustees, of the Town of Southold at a meeting held Nov. 25 1957, recommended to the Town Board that the following areas (11 Gidds Bay (2) Orient Dock to Pete Neck Point (3) Goose Creek (4) Indian Neck (outside) ( 5) Cedar Beach to Paradise .Point be opened for the taking and possessing of scallops not having a clearly defined annual growth line in the amount of 5 bushels per person per day 5 days per week, and WHEREAS , it is the feeling of the Town Board that if scallops in the above mentioned areas are not saltaged they wil ultimately die, now, therefore, .be it RESOLVED: that the Town Board of the Town of Southold requests that the New York S+ate Conservation Commission make a study of the .situation and grant the request for the taking of scallops as mentioned above. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark, Demarest and Edwards . Moved by Justice Clark,; seconded by Councilman Albertson: RESOLVED: That Supervisor Norman E. Klipp be and he hereby is authorized to insert an advertisement on the two center pages of the Advertising Journal of the North Fork Boat and Sprotsmen's .Show sponsored by the Burton Potter Post No. 185, Greenport, New York, at a cost not to exceed $150.00. Vote of Town Board: Ayes-Supervisor Klipp; Uouncilman Albertson; Justices Tuthill, Clark, Demarest and Edwards . Moved by Councilman Albertson; seconded by Justice Clark; WHEREAS, THE accounts of Supervisor Norman E. Klipp were audited and the annual report of Norman E. Klipp for the fiscal year 1957 was filed, NOW, THEREFORE, BE IT RESOLVED: That the annual statement be entered in detail in the minutes of this meeting by the Town Clerk as required by Section 105 of the Town Law. Terry, Building Inspector, were audited and the annual report of Howard M. Terry for the fiscal year 1957 was filed, NOW, THEREFORE, BE IT RESOLVED: That such annual statement be entered in detail in the minutes of this meeting by the Town Clerk, as, required. by Section 105 of the Town Law. Vote of Town Board: Ayes-Supervisor Klipp; "ouncilman Albertson; Justices Tuthill, Clark, Demarest and Edwards. Subject: .Annual Report of the Building Inspector, Town of Southold. Gentlemen: For the year 1957 I have issued 12 multiple residence law building permits with a total in fees of $487.00. There are several out- standing violations in the. process of being corrected. I have successfully Prosecuted one court case , Henry Zabohonski of Fishers Island. He was fined $200.00. Prospects are good that there will be several new Mult- iple Residence Structures built in 1958. There were 191 Zoning building permits issued with a total in fees of $1,480.00. There are 5 applications pending before the Board of Appeals or for an action by the Town Board creating "Open Developement Areas"before they can be issued. Two permits were granted to Churches with no fee charged for a total of 198 permits . There have been 41 appeals to the Board of Appeals with fees of $615.00. There is one case held open until certain conditions have been met by t1me land owner, and one case to be heard January 9th, 1958, all others have been settled promptly and efficiently by the Board. Many people have been before the Board to discuss their problems informally and to get advice and information, they were all treated courteously and fairly. I would recommend the adoption of the proposed amendmentstto the zoning ordinance sumitted by the Planning Board and the Appeals Board at the earliest possible time . I would further recommend a study be made by a citizen's committee or the planning Board on the adoption of a building code for the Town. I have seen many cases or jobs where inferior materials were used and poor workmanship is practiced. The petition of Charles .A . Cornibert, relative to change of zone , was received from the Planning Board. The Town Attorney was instructed to return the petition to Mr. Cornibert 's Attorney for further consideration and consultation with the Planning Board. Mrs. Ann Montgomery, Mr. Robert Seh, and Mr. John Devine attended the Board meeting. Mrs . Montgomery stated that she represented the Democratic Party and she then launched into a blasphemous tirade against the members of the Town Board and- in an apparent lack of ability to fully comprehend the constitution and the Town Law, she accused the Board of Communistic tactics in the adoption of a zoning ordinance and the procedure followed in amend- ing it.
