HomeMy WebLinkAboutTB-12/19/1957 450 MEETING OF DECEMBER 19, 1957. The Southold Town Board met at the office of Supervisor Norman E. Klipp at Greenport, on Thursdpry, December �9, 1957. The meeting was called . to order at 7:30 P.M.- with the followinf present: Supervisor Norman E. Klipp; CouncilmanAlbertson; Justices Tuthill Clark and Demarest and Town ,Attorney Terry. In the absence of Town Clerk Booth, the minutes were taken by Council- man Lester M. Albertson. Florence Ziegler appeared before the Town Board regarding the application for renewal of a Trailer Camp permit. After a lengthy discussion, it was further decided that permit would not be issued until such time as all provisions of existing Trailer Camp Ordinance be complied with. Moved by Justice Clark; - seconded by Justice Tuthill; RESOLVED: That the petitton .of .Arthur Mehl for a change of zone from . ".A" Residential and Agricultural District to "B" Business District be and hereby is granted. Vote of town board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Demarest; seconded by Justice Clark; RESOLVED: That the petition of Jack and Irving Levin for a change of zone from "A" Residential & Agricultural District to "B" Business District be and hereby is granted. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Councilman Albertson; seconded by Justice Demarest: WHEREAS , the Southold Town Planning Board has prepared an official report and recommendation upon the petition of (1) Henry G. and Ivy C. Stenson (2) Veronica Frohne and (3) Charles M. King tot change of zong from "A" Residential & Agricultural District to "B" Business District , NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Superviosr's Office at Greenport, on Tuesday, Jan. 21, 1958, at 7:30 P.M. on the proposals of Henry G. Ivy C. Stenson, Veronica Frohne and Charles M. -King. Vote of Town Board: .Ayes-Supervisor Klipp; Councilman .Albertson; . Justices Tuthill, Clark and Demarest. Moved by Justice Tuthill; seconded by Justice Demarest: WHEREAS,. Winifred and Ellsworth Grathwohl have made application to the sown Board for the establishment of an open developement area pursuant to the provisions of Section 280-2 of the Town Law, and WHEREAS, the Town Board has heretofore referred the matter to .the Plan- ning Board for its advice, and WHEREAS, the Planning Board has recommended . that the application of Winifred and Ellsworth Grathwohl be granted, NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town' of South- old does hereby establish an open developement area over the premises of Ellsworth and Winifred Grathwohl as shown forth on the map attached to the application. Vote of Town Board: .Ayes-Supervisor Klipp; Counnilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Clark; seconded by Justice Demarest: WHEREAS, Robert L. Hyatt has made application to the Town Board for the establishment of an open developement area pursuant to. the provisions of Section 280-a of the Town Law, and WHEREAS, the Town Board has heretofore referred the matter to the Planning Board for its advice , and WHEREAS, the Planning Board has recommended that the application of Robert L. Hyatt be granted, NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of South- old does hereby establish an open developement area over the premises of Robert L. Hyatt as shown forth on the map attached to the application. Vote of Town Board: Ayes-Supervisor Klipp; Uouncilman Albertson; Justices Tuthill, Clark and Demarest. 456 Moved by Justice Clark; seconded by Justice Demarest: RESOLVED: That the application of L. Barron Hill and Adelaide Hill for the establishment of an open developement area be denied by the Town Board on grounds that it does not provide for 50 foot width right of way and that the map does not contain dimensions and other sufficient information, and was directed to be returned. Vote of' Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Clark; seconded by Juutice Demarest: WHEREAS, A petition bearing the signatures of non-resident property owners and petition bearing the signatures of resident property owners of Fishers Island has been presented to the Town Board requesting that necessary action be taken to amend a section of the Fishers Island Ferry District Act that qualifies voters so that only non-r-esident and resident property owners on the last completed tax assessment roll be allowed to vote at the annual District Election, now, therefore, . be it RESOLVED: That Norman E. ' Klipp, Supervisor, be and he hereby. is directed to transmit to the Honorable Irving L. Price , Jr. , State Assemblyman, the above mentioned petitions , and be it further RESOLVED: That the Honorable Irving L. Price , Jr. State Assemblyman, call this matter to the attention of the Honorable Elisha T. Barrett, State Senator, and be it further RESOLVED: That they be requested to take whatever action they deem necessary to incorporate the request in the Fishers Island Ferry District Act . Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill Clark and Demarest. AMENDMENT NO. 3 Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED: That the Building Zone Ordinance (including the. Building Zone Maps) of the Town of Southold, be amended-as follows: 1. By changing from "A" Residential and Agricultural District to "B11 Busin- ess District the following described property: ALL that tract or parcel of land, situated at Cutchogue, Town of Southold, Suffolk County, New York, bounded and described as follows: BEGINNING at a point on the westerly side of a proposed road known as Griffing Street at the smuthwesterly corner of the premises herein des- cribed, said point being 200.0 feet northerly as measured along the easter- ly side of Griffing Street from its intersection at the n&therly side of Main Road tfrom said point of beginning, running thence in a northerly direction along the easterly side of Griffing Street, 100.0 felt to other land of Mehl; running thence in an easterly direction along said land of Mehl, 130 feet to land of K611mer; running thence in a southerly direction along said land of Kollmer, 100 feet to other land -of Mehl; running thence in a westerly direction, 130.0 feet to the point or place of beginning. 2. By changing from "A" Residential and Agricultural District to "B" Busin- ess District the following described property: ALL that tract or parcel of land situate , lying and being at Arshamomoque near Greenport, Town of Southold, Suffolk County, New York, bounded and described as follows: BEGINNING at an iron pipe set on the northerly line of Middle Road (CR 27) about 200 feet westerly from Chapel Lane at the. southwest corner of land of Eva Bang and the southeast corner of premises herein described; running thence along said northerly line of Middle Road , South 62 degrees West 300.0 feet to an iron pipe; running thence along other land of Levin North 24 degrees 33 minutes 30 seconds; West about 440 feet to ordinary highwater mark of Long Island Sound; running thence along Long Island Sound about 315 feet to said land of Eva Bang; running thence South 21+ degrees 33 minutes 30 seconds East about 523 feet to point of beginning, containing 3.2 acres , more or less. r, Vote of Town Board: Ayes-Supervisor Klipp; �'ouncilman lbertson; Justices Tuthill, Clark and Demarest.
