HomeMy WebLinkAboutTB-11/07/1957 PH 445 MEETING OF NOVEMBER 79 1957® A public hearing was held by the Southold Town Board at the Town Clerk's office at Southold, on Thursday, November 7, 1957 at 7:00 P.M. with the following present: Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest; Town Attorney Terry and Town Clerk Booth® This ANeeting wads on the proposal to amend the Building Zone Ordinance of the Town of Southold by changing from "A" Residential and Agricultur- al District to "B" Business *District on a parcel 'of land being east of the Village of Greenport, also a parcel of land situate .near the Village of Greenport , aleo a parcel of land situate at Cutchogue. Also by adding thereto Section 1013 (Exceptions as to certain subdivision lots) .A ll of the lots on the following described maps shall be excepted from the provisions of Section 303 herein, to amend Article 1V Sec. 400 Subdiv- ision 14, to add Article 1V Sec. 400 Subdivision 17. The Supervisor opened the hearing at 7:00 P.M. and read the call of khe meeting. He then called upon any person present who wished to speak either for or against the proposal to amend the Building /,one Ordinance on the aforesaid parcels of land. The hearing was duly closed at 8:00 P.M. The minutes of this hearing were recorded by George T. Lederle. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, Mae Halbauer has offered to sell to the Town of Southold., for the sum of $1320. , certain real property fronting on Long Island Sound and immediately adjacent to Town property at the northerly terminus of Horton's Lane, Southold , New York, and the WHEREAS, it is/considered op&nion of the Town Board that such purchase is in the best interest of the Town of Southold, NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Southold purchase from Mae Halbauer the aforesaid parcel of real property situated at Southold, in the Town of Southold, Suffolk County, New York, having a frontage of 40 feet on Long Island Sound, a depth of 200 feet and being immediately adjacent to the easterly line of Town property at the northerly terminus of Horton's Lane, for use as a public park and bathing beach, and pay therefor the sum of $v1320.00, and BE IT FURTHER RESOLVED that the Supervisor be and he hereby is author- ized directed to enter into an agreement with Itae Halbauer for the purchase of said real property and to execute the necessary documents and pay over to her ten per centum of the purchase price out to current funds , and to finance the balailce of the purchase price , title examination costs , recording fees and adjustments out of funds to be obtained by the issuance of a capital note or notes to be issued pursuant to the provisions of the Local Fiannce Law. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Councilman Albertson; Seconded by Justice Demarest: WHEREAS, Sara L. Hyatt has offered to sell tbethe Town of Southold, for the sum of $2000.00, certain real property fronting on Long Island Sound a distance of 40 feet, immediately adjacent to premises of Mae Halbauer for a depth of 200 feet, and tereafter having a width of 80 feet and immediately adjacent to other land of Town of Southold for a depth of 150 feet (subject to a 25 foot right of way for access to the Halbauer property, and subject to a 20 foot right of way along the east- erly line extending from the northwesterly line northerly 150 feet for access to the Fischer property on the East) , in the immediate vicinity of the northerly terminus of Horton's Lane at Southold, New York, and WHEREAS, it is the considered op&pion of the Town Board that such purchase is in the best interest of the Town of Southold, NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of South- old purchase from Sara L. Hyatt the aforesaid irregular parcel of real property situated at Southold, in the Town of Southold, Suffolk County, New York, having a frontage of 40 feet on Long Island Sound, and partly adjacent to other land of the Town of Southold, for lase as a public park 446 and bathing beach, and pay therefor the sum of $2,000.00, and BE IT FURTHER RESOLVED that the Supervisor be and he-1-hereby is authorized and directed to enter into an agreement with Sara L. Hyatt for the purch- ase of said real property and to execute the necessary documents and pay over to her ten percentum of the purchase price out of current funds , and to finance the balance of the purchase price, title examination costs, recording fees and adjustments out of funds to be obtained by the issuance of a capital note or notes to be issued pursuant to the provisions of the Local Finance Law. Moved by Councilman "lbertson; seconded by Justice Tuthill: RESOLVED: That the petition of William M. Beebe for a change of zone from "A" Residential and .Agricultural District to "B" Business District be and hereby is granted. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Clark; seconded by Justice Demarest: RESOLVED: That the proposal to amend the Building Zone Ordinance to add Article 1V Section 400 subdivision 17 be and hereby is approved. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Tuthill; seconded by Justice Demarest: RESOLVED: That the Building Zone Or dinance including the building zone maps in Town of Southold, Suffolk County, New York, by amending and by adding thereto the following: Section 1013 (Exceptions as to certain subdivision lots) all of the lots on the following described maps shall be excepted from the provisions of Section 303 herein.
