HomeMy WebLinkAboutTB-09/11/1957 "12 MEETING OF SEPTEMBER 11, 1957. A public hearing and Board Meeting was held by the Southold Town Board at the office of Supervisor Norman E. Klipp at Greenport, on Wednesday, September 11, 1957, with the following present: Supervisor Klipp; , Councilman .Albertson; Justices Tuthill , Clark and Demarest; Superin- tendent .of Highways Price; Town Attorney Terry and Town Clerk Booth. This hearing was on the proposal to amend the Building Zone Ordinance of the Town of Southold by changing from "A" Residential and Agricult- ural District to "B" Business District on a prcel of land in East Marion, and a parcel of land neat the Village of Greenport. The Supervisor opened the hearing at 7:00 o 'clock P.M. and read the call upon any person present who wished to speak either for or against the proposal to amend the Building Zone Ordinance on the aforesaid parcels of land. The hearing was duly closed at 7:30 P.M. The minutes of this hearing were recorded by George T. Lederle. Moved by Councilman Albertson; seconded by Justice Demarest: WHEREAS, a petition was received from John A . B. Muir , George Muir and A . B. Rosenberg relative to change of zone, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Sotkth- old be and he hereby is directed to transmit this application to the Planning Board in accordance with Section 1X of the Building Zone Ordinance of the Town of Southold; Suffolk County, New York. Vote of Town Board: Ayes-Supervisor Klipp; Coucnilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Tuthill; seconded by Councilman Albertson: WHEREAS , a petition was received from James Wasson, relative to change of zone, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to transmit. this application to the Planning Board in accordance with Section 901, subdivision C of .Article 1X of the Building Zone 0rdinance of the Town of Southold, Suffolk County, New York. Moved by Justice Clark: Seconded by Justice Demarest: WHEREAS , the Southold Town •Planning Board has prepared an official report and recommendation upon the petition of William Beebe for a change of zone from "A" Residential and Agricultural to "B" Business District certain real property situated at Cutchogue, Town of South- old, N.Y. , NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor 's Office in Greenport, on Wednesday, October 2, 1957, at 7:00 o 'clock P.1,4. on the proposal of WilliamBeebe for a. change of zone from "A" Residential and Agricult- ural District to "B" Business District. Vote of Town Board: .Ayes-Supervisor Klipp; Coucnilman Albertson; Justices Tuthill, Clark and Demarest. Moved by 'Councilman Albertson; seconded by Justice Clark: WHEREAS, the Southold Town Planning Board has prepared an official report and recommendation upon the petition of Robert H. Preston and LaGrant Chapman for change of zone from "A" Residential and Agric- ultural District to "B" Business District, certain real property situate near the Village of Greenport, and WHEREAS, upon considering the application of Robert H. Preston and LaG ant Chapman the attention of the Town Board was called to the fact that the necessary legal requirements had not been completely complied with inasmuch as no service of notice had been made upon the Greenport Village Clerk which service was a prerequisite to the hearing since the property has been determined to . be within 50Q feet of the Village of Greenport, NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board , at the Supervisor's Office in Greenport, on Wednesday, October 2, 1957, at 7:00 P.M. on the proposal of Robert H. Preston and LaGrant Chapman, for a change of zone from "A" REsidential and Agriculturalto "B" Business District. Vote of Town Board: Ayes-Supervisor Klippp Coucnilman Albertson; Justices Tuthill, Clark and Demarest. . 426 Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the regular monthly meeting of this Board will be held at the office of Supervisor Norma.n. E. Klipp at Greenport, on Tuesday, September 24, 1957, at 1:30 P.M. Vote of Town Board:. Ayes-Supervisor Klipp; Councilman Albertson; -Justices Tuthill, Clark and Demarest. Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED: That the Town Clerk be and }fie hereby is directed to request the Long Island Lighting Company to install one additional 400 c p aerial street light on an eight (8) foot arm on Long Island Lighting Pole No. 410, replace with new 400 c p aerial street light on an eight (8) foot arm on New York Telephone Pole No. 408, replace with- new 400 c p aerial street light on an eight (8) foot arm on New York Telephone Pole No. 411-5 in Mattituck, Lighting District No. 1 on Route 1 on Route 25. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Councilman Albertson;. seconded by Justice Demarest: RESOLVED: That Harold Price, Superintendent of Highways , Town of South- old, be and he hereby is authorized to advertise for and purchase from the lowest bidder one Pickup Street Sweeper. Vote of Town .Board: Ayes.-Supervisor Klipp; Coucnilman .Albertson; Justices Tuthill , Clark and Demarest. Moved by, Councilman Albertson; seconded by Justice Tuthill: RESOLVED: . That Harold' Price , Superintendent of Highways , Town of South- old, . be and he hereby is authorized to attend the New York State High- way Superintendent Association Convention to be held at Rochester, N.Y : on October 2-3 and 4, 1957, and be it further RESOLVED: That the necessary expense incurred while attending said convention is a legal charge against the Town. Moved by Councilman Albertson; seconded by Justice Demarest: WHEREAS ,, the Town Superintendent of Highw5r5rs did, on the llth day of Sept. , 1957, duly recommend the purchase of certain equipment pursuant to the provisions of Section 142 of the Highway Law, NOW, THEREFORE, BE -IT RESOLVED: that pursuant to Section 142 of the Highway' Law the Town Superintendent of Highways is hereby authorized to purchase, in accordance with the provisions of Article 5-A of the General Municipal. Lae, with the approval of the County Superintendent of Highways , the following: One (1) South Bend Model "E" Gutter snipe Pickup Street Sweeper with sweeping width of 6 ft. , hopper cap. of 2 yaks , 4 cylinder industrial engine with starter , generator, heavy duly battery, air cleaner & oil filter,, full hydraulic controls , water supply with centrifical pump & spray bar full width of broom, 2 head lights , 1 spot light , 1 rear flood light, one stop light, 1 tail light & 2 clearance lights , 1 extra gutter, and 1 extra pickup broom 1 metal cab eith windshield and wipers for a maximum price of Eight Thousand Four Hundred Fifty & 00/100 Dolllars ($89450.00) delivered at Peconic , N.Y. and to be delivered on or about 2 days after receipt of order. The Town Superintendent of Highways is hereby authorized, subject to the approval of the County' Superintend- ent of Highways , to surrender to the vendor Check drawn on Machinery Fund $8,450.00. A1429DYIENT NO. 7 Moved by Justice Demarest; seconded by Councilman Albertson; WHEREAS', the Southold Town Planning Board has prepared an official report and recommendation upon the petition of Cove Beach Estates Inc. , to amend the Building Zone Ordinance (including the Build- ing Zone Maps) , and WHEREAS, the Town Board, after due consideration of the matter, decided it was in the publics interest to call a hearing pursuant to the provisions of the Town Law and said Ordinance, and WHEREAS, such hearing has held (pursuant to notice duly given) at a meeting of the Town B-oard at the Office of the Supervisor, 16 Sout Street, Greenport, X.Y. , on September llth, 1957, at V:00 PM, at which time all persons desiring to be heard in favor of said amendment and also all those desiring to be heard in opposition thereto were given an opportunity to be heard, and thereafter the public hearing was closed and decision reserved: NOW, THEREFORE, BE IT RESOLVED BY THE TO1,JN BOARD that the Building ZONE ORDINANCE (Including the Building Zone Maps) of the Town of Southold, Suffolk County, New York, be amended by changing from "A" Residential and Agricultural District to "B" Business District the following described property: PARCEL ONE: ALL that tract or parcel of land, situate, lying and being at East Marion, in the Town of Southold, County of Suffolk, and Stqte of New York, bounded on the North by Long Island Sound; on the East by land of Cove Beach Estates Inc. ; on the South by %he several lands of Spencer Terry and Irving Latham; and on the West by land of Arlin deGuimaraes. PARCEL TWO: ALL that tract or parcel of land situate, lying and being at East Marion, in the Town of Southold, in the County of Suffolk and State of New York, bounded on the North by land of Cove BEach Estates , Inc. ; on the East by land of Fred T„bor; on the South by land of Joseph Boken; and on the West by land of Cove Beach Estates, Inc . PARCEL THREE: ALL that tract or parcel of land situate, lying and being at East Marion, in the Town of Southold, County of Suffolk and State of New York, bounded on the North by Cove Beach Estates , Inc. ; on the East by land of Joseph Boken; on the South by State Highway #25; and on the West by land of William Boken, and it is FURTHER RESOLVED: That the necessary changes be made upon the Zoning Maps of the Town of Southold so as to indicate the location of said properties as being located in "B" Business District , and it is FURTHER RESOLVED: That the Town Clerk be and he hereby is author- ized andc?directed to give the necessary notice of such changes in zoning to the departments and agencies hsrving juriddiction in the matter.
