MEETING OF JULY 24, 1957.
A public hearing was held by the -Southold -Town Board at the office of
Supervisor Norman E. Klipp at Greenport , on Wednesday,. July. 24, 1957,
with the following present: Supervisor Klipp; Councilman Albertson;
Justices Tuthill, Clark and Demarest; Town Attorney Terry and Town
Clerk Boo<•th. This hearing was on the proposal to amend the Building
Zone Ordinance ' of the Town of Southold by changing from "a" Residential
and Agricultural District to "B" Business District on a parcel of.
land in Southold. .Also by changing from "A" REsidential and Agricultural
District to "C" Industrial District on a parcel of. Land in Mattituck.
The Supervisor opened the hearing at 7:00 P.M. and read the .call of.
the meeting. He then called upon any person ,present who wished. to speak
either for or against the proposal to amend the 'Building Zone Ordin-
ance •on the aforesaid parcels of land.
The hearing was duly cloded at 7:30 P.ML The minutes of this hearing
were recorded by George T. Lederle.
AMENDMENT NO.2 TO BUILDING ZONE ORDINANCE
Moved by Justice Tuthill; seconded by Justice Demarest:
WHEREAS, the Southold' Town Planning Board has prepared an official
report and recommendation upon the petition of Dawn Estates , Inc. to
amend the Building Zone Ordinance (including) the Building Zone maps)
of the Town of Southold, Suffolk County, New York, by changing from
"A" Residential and Agricultural District to "C" Industrial District
certain property situated at Mattituck in said Town, •and
WHEREAS, such .hearing was held (pursuant to notices duly given) at a
meeting 'of the Town Board at the office of the Supervisor, 16 South
Street, Greenport, N.Y. on July 24, 1957, at 7:00 P.M. at which time
all persons desiring .to •b.e heard in favor of said re-zoning and also
those desiring to be heard in opposition thereto were given an oppor-
tunity and were heard and thereafter the public hearing was closed and
decision reserved;
NOW, THEREFORE, BE IT RESOLVED: by the Town Board that the following
property be re-zoned from "A" residential and Agricultural to "C"
Industrial District:
ALL that tract or parcel ,of land situate at Mattituck, in the Town of
Southold County of Suffolk, State of New York, bounded .on the north-
west by iand . believed to be of Mattituck Petroleum Corporation; on _
the north by -Mattituck Inlet; `on the East by land believed to be of
Island Asphalt Company; on the South .by Naugles Road;. and on the West
by Luthers Road; said premises being formerly part of the J.Q.A. Ward
Estate and being partly in the bed of what was known as "Old House Creek" .
Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices
Tuthill, Clark and Demarest.
AMENDMENT NO. 3 BUILDING ZONE ORDINANCE
Moved by Councilman Albertson; seconded by Justice Clark:
WHEREAS, the Southold Town Planning Board has prepared an official
report and recommendation upon the Petition of Horace Kyser• to amend
the Building Zone Ordinance (including the Building Zone maps) of the
Town of Southold, Suffolk County, New York, by changing from "A'' Resid-
ential and Agricultural' District' to "B" Business District certain
property situated at Southold in said Town and
WHEREAS, the Town Board, after due consideration of the matter, decided
it was in the public interest to call a hearing pursuant to the pro-
visions of the Town Law 'and the said Building Zone Ordinance , and
WHEREAS, such hearing was held (pursuant to notice duly given) at a
meeting of the- Town Board at the office of the Supervisor, 16 South
St. , Greenport, N.Y. on July 24, 1957, at 7:00 P.M. at which time all
persons desiring to. be heard in favor of said re-zoning add. also all
those desiring to be heard in opposition thereto were given an oppor-
tunity and were heard, and thereafter the public hearing was closed
and decision reserved:
NOW, THEREFORE, BE IT RESOLVED: By the Town Board that the following
property be re-zoned by changing from "A" Residential and Agricultural
District to "B" Business District;
ALL that tract of parcel of land situate, lying and being at Southold,
in the Town of Southold, County of Suffolk and State of New York, bounded
on the north by Main Street 150 ft; on the East by land of Annie F. Barr,
126 ft; on the South by land of Annie F. Barr, 150 ft; and on the west
by Locust Lane , 125. feet.
Vote of Town Board:. .Ayes-Supervisor Klipp; Councilman Albertson;
Justices Tuthill, Clark and Demarest.

WHEREAS, the Southold Town Planning Board has prepared an official
report and recommendation upon the petition of William J. Mills ,111
for change of Zone from "a" Residential and Agricultural District
to "B" Business District, certain property situated at Greenport, Town
of Southold, New York,
NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held
by the Southold Town Board a-t the Supervisor office in Greenport, on
Wednesday, August 149 1957, at 7:00 o 'clock P.M. on the proposal[ of
William J. Mills 11 for change of Zone from "A" Residential and Agric-
ultural District to "B" Business District.
Vote of Town Board; .Ayes-Supervisor Klipp; Councilman Albertson;
Justices Tuthill, Clark and Demarest.

WHEREAS, the Southold Town Planning Board has prepared an official
report and recommendation upon the petition of Peter _Bl&nk & Son to
amend a certain map entitled "Map of Marion Manor" situate at East
Marion in the Town of Southold, N.Y.
NOW, THEREFORE BE IT RESOLVED: That d public hearing will be held by
the Southold Town Board at the Supervisor 's Office in Greenport, on
Wednesday, August 14, 1957, at 7:0001clock P.M. on excepting each
and every lot on a certain map entitled "Map of Marion Manor" , situated
at East Marion, Town of Southold , Suffolk County, New York, surveyed
November 25, 1952 by Otto W. VanTuyl & Son, licensed surveyors ,
Greenport , n.y. owned and developed by Peter Blank & Son, East Williston,
L. I. , N.Y. " , and filed in the Suffolk County Clerk's Office on March
189 1953, as Map No. 2038, from th6 provisions of Sections 302, 303 ,
304 and 306, 307 and 308 of said Building Zone Ordinance.

Justices Tuthill , Clark and Demarest.

WHEREAS , the Southold Town Planning Board has prepared an official
report and recommendation-upon the petition of Florence Moore for
change of Zone- from "A" Residential and Agricultural District' to
"B" Business District certain real property situated at Southold
Town of Southold, N.Y.
NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held
by the Southold Town Board at the Supervisor 's Office in Greenport ,
on Wednesday, August 14, 1957, at 7:00 o'clock P.M. on the proposal
of Florence Moore for a change of zone from"A" Residential and Agric-
ultural District to "B" Business District.

Moved by Councilman Albertson; seconded by Justice Clark:
WHEREAS, upon the application of Margery D. Burns for the establish-
ment at her premises at Horton's Point, Southold, in the Town of
Southold, Suffolk County, N.Y. of xxxpxx an OPEN DEVELOPEMENT AREA
pursuant to the provisions of subdivision 4 of Section 280-a of the
Town Law, the Southold Town Planning Board has recommended that her
petition be acted upon favorably and that such open developement area
be established,
NOW, THEREFORE, BE IT RESOLVED: That pursuant to the provisions of
Section 280-a of the Town Law the' Town Board establish and it hereby
does establish an OPEN DEVELOPEMENT AREA in the following described
property:
.BEGINNING at a concrete monument set on the northwesterly line of
land of Johathon T. Overton at the southerly corner of land conveyed
by the party of the first part to Alexander T. Williams by deed_ dated
1948 and recorded in 1948; running thence along said lnad of Jonathon
T. Overton S. 510 59' 50" W. -274.03 feet to land of S . B. Fisher and
then along"Lland of Charles S . Witherspoon, N. 640 50' w.-610 feet, more
or less , to high water mark of Long Island Sound; thence northeasterly
along said high water nark of Long Island Sound 246.8 feet more or
less , to land of Alexander T. Williams; thence along said lands of
.Alexander T. Williams , S. 640 50' E.-700 feet, more or less 0o thr
point of beginning.
TOGETHER with all r&ght, title and interest of the party of the first
part , of, in and to Long Island Sound abutting said premises.
ALSO with a right of way 20 feet in width from Horton Lane to .the
premises , the southeasterly line of which is described as follows:

Moved by Councilman Albertson; seconded by Justice Tuthill:
WHEREAS, HOWARD M. TERRY, was heretofore appointed enforcement
officer for' the Multiple Residence Law and Building Inspector :
for enforcement of the Building Zone Ordinance of the Town of
Southold, all on a part-time basis , and
WHEREAS , it is the -considered opinion of the members of 'the
SOUTHOLD TOWN BOARD that the proper and efficient enforcement ,
of said -building zone ordinance and the multiple residence law
necessitates the services of a full time inspector, at least,
until December 34 1.957 9
NOW, THEREFORE BE IT RESOLVED that HOWARD M. TERRY be and he
hereby is appointed enforcement officer for both the Multiple
Residence Law and the said Building Zone ordinance on a full time
basis for a term commencing .August 1, 1957 and expiring on December
311 1957; and
BE IT FURTHER RESOLVED THAT his compensation be and it hereby is
fixed and determined to be the sum of $1275.00 per month, payable
.monthly during said term.

BEGINNING At a point on the northeasterly line of Horton Lane
25 feet,' southeasterly along said line from the point of beginning
of the curve in said. line as altered, in 1941; running thence. on a
curve to the left whose center is the point of curve in said line
of Horton Lane and whose radius is 25 feet, a distance of said
curve of 39.27 feet; thence westerly on a curve to the left and
concentric with , the northerly line of Horton Lane and at all points
distant 25 feet therefrom a distance on sadd curve of 87. 54 feet;
thence N. 140 59' 20" E. 181.95 feet to the southwesterly line of the
premises herein described, and
SUBJECT to a right of way 20 feet in width, the southeasterly line
of which begins at the terminus of. the last described right of way
and runs across the premises, two courses , as follows:-
(1) N. 220 30' W. -170 feet; thence
(2) N. 250 10' E. -130 feet to the northeasterly line of the
premises.
