HomeMy WebLinkAboutTB-05/21/1957 39 MEETING OF MAY 211 1957. The Southold Town Board met at the office of Supervisor Norman E. Klipp at Greenport , on Tuesday, May 21, 1957. The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest; Town Attorney Terry and Town Clerk Booth. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the minutes of the meetings of May 7 and May 14 be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the regular monthly audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport , on Tuesday, June 11, 1957, at 1130 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Coucnilman Albertson; Justices Tuthill, Clark and Demarest. A communication was received from the Southold-Peconic Civic Association requesting flash lights be installed at the Long Island Railroad crossings on Horton Lane and Boisseau Avenue in Southold. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That Supervisor Norman E. Klipp be authorized to contact the Superintendent of the Long Island Railroad and recommend the installation of flashing light highway crossing signals It Hortons Lane and Boisseau .Avenue in Southold, New York. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Clark; seconded by Justice Demarest: RESOLVED: That Norman E. Klipp, Supervisor, be and he hereby is authorized to make application to the New York State Youth Commission for a renewal of the Recreational Project for the Town of Southold for the year 1957-58. Vote of Town Board: .Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill , Clark and Demarest. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS , a resolution was presented to the Town Board passed by the Greenport Village Board requesting the Town of Southold to take over police protection for the Village of Greenport as they wanted to disband the present police fofee , NOW, THEREFORE, BE IT RESOLVED: That this resolution be turned over to the Police Committee for them to study for their recommend- ation to the Town Board. Vote of Town Board: Ayes-Supervisor Klipp; Councilman .Albertson; Justices Tuthill , Clark and Demarest. A recommendation was received from the Southold Town Planning Board of Margery D. Burns relative to an open developement area for her property at Southold. The Supervisor was instructed to advise the applicants attorney. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That the Southold Town Planning Board be compensated for expenses necessarily incurred to carry out the duties of their office and that they be compensated at the rate of eight cents (8¢) =per mile for the use of their automobiles , excluding trans- portation to and from meetings. Vote of Town Board: Ayes-Supervisor Klipp; Souncilman Albertson; Justices Tuthill, Clark and Demarest. At 2 o 'clock P.M. in accordance with a notice published according to law, bids were opened for proposals for covering the floors with one-quarter inch masonite and one-eighth tubber the in the Town Clerk Building , in accordance with specifications . The following bids were submitted: 398 Fashion Floors Inc. ------------$1145.00 Louis Jaeger & son------------- 936.20 1020.00 if Armstrong Rubber the is used. Richter Home Improvement Co. --- 1200.00 Moved by Justice Demarest; seconded by Justice Clark: WHEREAS , the lowest bid was hubmitted by Louis Jaeger & Son, now therefore be it RESOLVED: That Norman E. Klipp, Supervisor , be and he hereby is authorized to enter into a contract with Louis Jaeger & Son for the covering of the floors of the Town Clerks Building with one quarter inch masonite and one eighth inch rubber tile at a price of $936.20. Vote of Town Board: .Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill , Clark and Demarest. Moved by Counnilman Albertson; seconded by Justice Tuthill: WHEREAS, a recommendation was received from the Southold Town Planning Board of Margaret W. Roache of New Suffolk and Fred W. Young of Arshamomaque that their property be changed from "A" residential and Agriculture District to "B" , Business District , therefore be it RESOLVED: That a public hearing will be held at the office of the Supervisor at Greenport on Tuesday, June 4, 1957, at 7:30 P.M. on proposals to change the Building Zone Ordinance from "A" R'sidential and Agriculture District to "B" Business District on Margaret W. Roache property at New Suffolk and Fred W. Youngs Property at ARsha momaque. Vote of the Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Donald Frederick appeared before the Board complaining about the way a Trailer Camp was being conducted opposite his property on Terry Lane in Southold and wanted to know if it would be possible to have the Trailer Camp Ordinance amended. The Board stated they would give the matter further consideration. A public hearing was held at the office of the Supervisor at Greenport , on Tuesday, May 21, 1957, to consider a proposed ordinance regulating the burning of rubbish. Supervisor Klipp opened the hearning at 2 o 'clock P.M. and read the call of the meeting. He then called upon any person present wishing to speak either for or against the proposed ordinance. The following persons recommending the adoption of the proposed ordinance were: Edward F. Grathwohl , President of the Chief Council of Southold Town. Robert White ,Chairman of the Ordinance Committee of the Fire Chief Council of th Town of Southold. He stated that he had letters from the Orient and Southold Fire Depart- ments and the east-West Fire Propection District recommending the adoption of the proposed ordinance . A letter was read from Howard M. Terry, Deputy Fire CO-Ordinator , recommending the adoption of the proposed ordinance. Milton Folts of Cutchogue was the only person opposed to the proposed Ordinance . The hearing was duly closed at 2:30 P.M. Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED: That the following Town Ordinance regulating the Burning of Rubbish be and hereby is duly adopted. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. ORDINANCE SOUTHOLD TOWN ORDINANCE REGULATING THE BURNING OF RUBBISH Section 1. Rubbish Fires . No person shall set fire to , or burin, or cause to have set fire to or burned , any waste paper , rubbish or other inflammable matter or materials , outdoors within the limits of the Town of Southold , within twenty-five (25) feet of any building. Such matter may be fired and burned in safe and pribate places at least twenty-five (25) feet from any building only when it is burned or set fire to in a metal can, masonry incinerator , or a receptable made of wire and completely covered with a top so constructed, as to keep pieces of materials from blowing away. All such fires must be extinguished 399 by nine o 'clock P.M. and in all cases due regard shall be given to prevent the creation of a smoke or odor nuisance . Section 2. Plot Fires and Permits . No person shall set fire to , burn, ignite or cause the firing , burning or ignition of any grass plot , field, or any pile of f;efuse, within the Town, without first obtaining a vurning permit from the Chief of the Fire Department (or one of his Assistants) of the fire district where the burning is to take place. -- Section 3 . Supervision of Fires . Any fird. l, yVfully started shall be constantly attended and supervised by an adult and ; except as otherwise permitted by Section 1 , exting- uished by eight­,o 'clock P.M. No fires shall be started before sunrise. Section 4. Exclusions . This Ordinance shall not apply to any territory included within the limits of the Incorporated Village of Greenport. Section 5. Penalties . Any violation of this ordinance shall constitute a misdemeanor and . shall be punishable by a fine of not more than $50.00. Section 6. This ordinance shall take effect immediately.
