HomeMy WebLinkAboutTB-03/26/1957 MEETING OF MARCH 26, 1957. The Southold Town Board met at the office of Supervisor Norman E . Klipp at Greenport ' on Tuesday, March 26, 1957. The meeting was called to order at 1:30 P.M. with the following present: Supervisor Norman E. Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest; Superintendent of Highways Price; Town Attorney and Town. Clerk Booth. Moved by Justice Clark; Seconded by gxstixx Councilman Albertson: RESOLVED: That the minutes of March 5th and March 13 be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Jus-tices Tuthill, Clark and Demarest. Mov.nd by Justice Clark; seconded by ftitice Tuthill: RESOLVED: That the regular monthlyaMing of this board will be held at the office of Supervisor Norman E. Klipp at Greenport , on Tuesday, April 9, 1957, at 1:30 P.M. Vote of Town Board: .Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest . The following Bonds were presented to ty-f`e Board for approval: Moved by Councilman Albertson; seconded by Justice Demarest: RESOLVED: That Bond No . SM178365-1, issued by the American Motorists Insurance Company on behalf of Otto L. Anrig in the sum of Five Hundred Dollars ($500.00) be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; 'Justices Tuthill, Clark and Demarest . Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That Bond No. SM178366-1, issued by the American Motorists Insurance Company on behalf of Henry Y. King in the sum of Five Hundred Dollars (4500.00) be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Moved by Councilman Albertson- seconded by Justice Clark: RESOLVED: That Bond No. SM17�3 51-1 , issued by the American Motorists Insurance Company on behalf of James P. Kelly, in the sum of Five Hundred Dollars (9500.00) be and the save is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. A request was made by the Mattituck Chamber of Commerce for some financial assistance from the Town Board in placing channel marking buoys in the Mattituck Creek. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That Supervisor Norman E. Klipp be and he hereby is author- ized to appropriate a sum up to but not in access of $475.00 towards the cost of placing channel marking buoys in Mattituck Credk. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Tuthill; seconded by "Councilman Albertson: RESOLVED: .That all cars , which are left at the Southold Town High- way Department and the owners are unknown, the Superintendent of Highways be and he hereby is authorized to store said cars at the Cutchogue Storage area . Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices. Tuthill, Clark and Demarest. In accordance with the provisions of Section 103 of the Municipal Law a notice was published in the newspaper of the town requesting sealed proposals for the purchase of one new T6 International Cuawler type tractor or equal, with 6D4 Track mounted Hydraulic Bulldozer or equal, said proposals were opened at 2 o 'clock P.M. on Mar .26, 1957. Only one bid was bubmitted which was by Edward Ehrbar Inc. 386 Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED: That Supervisor Norman E. Klipp be authorized to enter into a contract with the s611d Edward Ehrbar Inc. for the purchase of one new International crawler ti3pe tractor with 6 D-4 track mounted Hydraulic Bulldozer at a costjof $7,815.00 with a trade-in allowance of $2500.00 on the old International Model T6 Tractor. Vote of Town Board: .Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill , Clark and Demarest. Moved by Justice Clark; seconded by Justice Tuthill: BUDGET NOTE RESOLUTION DATED MARCH 26th, 1957, AUTHORIZENG THE ISSUANCE OF A BUDGET NOTE OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, IN THE AMOUNT OF $5,315.00 FOR AN EXPENDITURE FOR WHICH NO PROVISION WAS MADE IN THE .ANNUAL B�DGET. BE IT IESOLVED this 2 th day of March, 1957, by the Town of Southold, Suffolk County, New York, as follows : SECTION 1. That, pursuant to Subdivision 2(b) of Paragraph a of Section 29.00 of the Local Finance Law, for the purpose of paying the cost of purchasing a new International Model T-6 Crawler Type Tractor with 6D-4 Tractor Mounted Hydraulic Bulldozer, for use at the Southold Town Dump, for which no provision was make in the annual bedget for the current fiscal year, there is hereby authorized to be issued a budget note of the Town of Southold in the principal amouiht of $5,31 5.00, which is the maximum cost of such object or purpose, which note shall mature on April lst , 1958. Section 2. That , except as herein specificaally prescribed, said note shall be of the date , terms , form, contents and place of payment, and at a rate of interest not exceeding three per centum per annum, as may be determined by the Town Supervisor , consistent , however, with the pro- visions of said Local Finance Law of the State of New York, and shall be executed in the name of the Town of Southold by its Supervisor and the seal of said Town shall be attached thereto. Section 3 . That said note shall be sold at private sale by the Town Supervisor at a price of not less thaft par value and accrued interest, if any, and upon due execution and sale of said note the same shall be delivered to the purchaser upon payment by him to the Town Supervisor of the purchase price in cash; and the receipt of such Supervisor shall be a full acquittancq to such purchaser who hhall not be obliged to see to the application of the purchase money. Section 4. The full faith and credit of the Town of Southold, New York, are pledged to 'the punctual payment of principal and interest on said note . Section 5. This .resolution shall take effect Immediately. The question of the adoption of the foregoing resolution was duly put to a vote which resulted as follows: Ayes-Super-fisor Norman E. Klipp, Councilman Lester M. Albertson; Justices of the Peace Louis M. Demarrst , Ralph W. Tuthill and Henry A. Clark. Absent-Justice of the Peace E.. Perry Edwards. Noes-None. The Supervisor thereupon declared that the resolution was duly adopted. Moved by Justice Clark; seconded by Councilman Albertson: WHEREAS, the Vehicle and Traffic Law .of New York, Section 71-a as amended , concerning the subject of Chemical Tests , provides among other things , as follows: "Any person who operates a motor vehicle or motor cycle in this State shall be . deemed to have given his consent to a chemical test of his blood, for the purpose of determining;:Ithe alcoholic content of his blood pro- vided that such test is administered at the direction of a police officer having reasonable grounds to believe such person to have been driving in an intoxicated condition and in accordance with the rules and regulat- ions established by the police force of which he is a member. " and WHEREAS , it is the recommendation of Otto Anrig , Town of Southold Chief of Police that Rules and Regulations of the Southold Town Police be amended so as to provide that the provisions contained in said Section 71*a , relating to the subject of examination of persons of whom is reasonable grounds to believe that they are operating or have recently operated a motor vehicle while such person or persons are or were in an intoxicated condition, be adopted as part of the Southold Town Police Rules and Regulations , IT IS REGULARLY MOVED BY JUDGE CLARK AND-SECONDED BY ,COUNCILMAN ALBERTSON, that the Southold Town Police Rules and Regulations be amedded forthwith to provide that the provisions of S ction 71-a of the Vehicle and Traffic Law of New York relating to the subject of Chemical Tests , as hereinabove more particularly set forth, be and the same are adopted by and as a portion of the Rules and Regulations of the Town of Southold Police: Ayes-Supervisor Klipp; Justices Tuthill, Clark and Demarest and Councilman Albertson. District Attorney John P. Cohalan, Jr. , Chief Investigator Theodore Donnelly and Zone Chief Gardner were present at the meeting to meet with the Southold and Shelter Island Town Justices and Constables for the purpose of assuring them of the cooperation of his office , in the despatch of their work and he discussed the proposed forms which he would appreciate being used in order to keep, his office informed as- to matters in which the servides of his assistants will be required.
