SOUTHOLD TOWN BOARD
December 27, 1979
WORK SESSION
Anthony Taromina, NYS, DEC, and Albert Kunanz, Suffolk County
Planning Department addressed the Board concerning the proposed
Peconic/Flanders Estuarine Sanctuary. Mr. Taromina stated that
the purpose of the estuarine sanctuary is to establish an area
that will have a secure status for future research of estuarine
processes. The NYS DEC has received a grant from the federal
government for 18 million dollars to buy wetlands. They feel
they can obtain an additional 2 million dollars in a federal
grant for the purchase of Robins Island. Robins Island became
the focus of the discussion. Jack Driscoll, Peter Drew and
Mr. Ranginella were alos present and expressed their opposition
to the acquisition of Robins Island.----Supervisor Homan said that
the Town is distrubed that they did not receive notification of
the proposed project until yesterday, December 26th. That notifi-
cation stated there will be a hearing on Thursday, January 3, 1980
at the Riverhead Town Hall from 2 : 00 - 5 : 00 P .M. and 7 : 30 -10: 00
P.M. to receive comments from all interested parties on: 1) the
choice of the Peconic/Flanders Bays area as New York' s candidate
for the federal Estuarine Sanctuary Program, and 2) the proposed
boundaries of this area. ---Supervisor Homan stated he is reluctant
to see Robins Island taken off of the tax rolls. The upland area
is not of any wildlife value. The freshwater marsh, however, is
unique.---Mr. Frank Bear spoke on safety measures and. --services
that must be provided if Robins Island were developed.--Mr. Doug
Hardy, also present, stated he attended a State meeting on this
subject, along with Paul Stoutenburgh, and spoke in favor of the
project. ---The Board advised Mr. Taromina and. Mr. Kunanz that they
would consider the proposed Peconic/Flanders Estuarine Sanctuary
but did not wish to comment on the acquisition of Robins Island
at this time.
GRIEVANCE HEARING William Januick
Mr.. William Januick appeared before the Board and presented a
written grievance concerning his entitlement to longevity. The
Board immediately gave consideration' to the grievance.
Justice Tedeschi, at the request of Supervisor Homan, reviewed
Mr. Janu�ck" s payroll records for the past ten years and reported
favorably.
Supervisor Homan reviewed the 1975-1976 CSEA contract and it
stated an employee of ten years may receive longevity. A full
time employee is one who works thrity hours a week, five days
a week.
After due consideration Mr. Januick was granted his longecity
request for the years 1976 and 1977 amounting to $842. 53.
WORK SESSION
Mr. George Mellas, Receiver of Taxes, asked permission of the
Board to sell to the North Fork Bank and Trust Company for a
sum not less than $1, 000. 00 the Burroughs F5700 Billing Machine
which he paid $1, 000 . 00 for four or five years ago. He stated
that since the Bank is now handling the Receiver' s mail and he
stil has two additional receipting machines in his office, the
billing machine is surplus equipment. Further, the service
agreement for 1980 will cost $641. 00 . The Board felt the request
was reasonable and a resolution will be proposed at the regular
meeting.

George Stankevich, Esq. appeared before the Board to discuss
a parcel of land directly b.eh. n.g the Town Hall on Horton Lane.
which he will take title to on' December. 2:8th.; He. .- proposed to:
the Board that he 'enter into a long term lease: with. the :Town for
the Town' s use of a 15 ft. strip along the :southerly line. .of` the

also discussed the possibility of constructing a J'ustce 'C.ourt

Trustee Robert Webb, Village of Greenport, .appear.e.d before. the
Board to discuss the $7,.410..01 which has been reserved .for the
Town of Southold in the Suffolk County .Consortium Hdgh. Riisk .:Loan
Program. Mr. Webb, and Mayor Hubbard in a letter dated be:cembe:r

3. Hearing announcement from.,the Department of State - The
Coastal Management Program of New York State Department of State
will be holding a public hearing on New York' s proposal of the
Peconic/Flanders Estuarine Sanctuary Program at the Riverhead Town
Hall on Thursday, January 3, 1980 from 2 :'00 to 5 : 00 P.M. and 7: 30
to 10 : 00 P.M.--Supervisor Homan stated that the Town Board did
meet With Mr. Taromina and Mr. Kunanz concerning this matter this
morning and a map of the proposed project is in the Board room.
Mr. Homan stated he feels a little aggravated about receiving the
notice just yesterday when there has been so much talk about this
lately. He replied to the Department of State that he took issue
with the fact that inasmuch as Southold Town is one of the principle
municipalities in the proposed program the information should have
been available much sooner to the Town.
COMMUNICATIONS
1. Notification from the Suffolk County Department of Labor
that Gerald King, cook at the Nutrition Program, has received an
extension of service.
2. Letter from the Suffolk county Department of Health
Services stating that they have granted an extension to August 31,
1980 of compliance at the Town of Southold Scavenger Waste Disposal
Site.
3. Notice from the N.Y.S. - D.E.C. that they will monitor the
test wells around the area of the Disposal site and will submit
the results to the Town.
4 . Letter from the N.Y.S. - D.E.C. which was transmitted to
the federal government along with the funding application of the
Fishers Island Sewer District.
5. Receipt of three letters from individuals on Wells Road,
Peconic who have a serious complaint about the severe dust storms
they have been experiencing. --Their comments are well founded
but the Berard does not know what they can do about them. A file
will be started and possibly the Board of Health can help them.
6. Receipt of two new resumes for the vacancy on the Board
of Appeals - Gerard P. Goehringer and Nancy M. Hartge.
7. Letter from Minnesota Construction Corp to Greenmen-
Pederson Associates, architects of the Town Hall Addition concerning
incomplete items of work on the addition.
8. Letter from the Federal Emergency Management Agency
reminding the Town that March 18, 1980 is the dead line for Southold
Town to enact the required flood plain management measure in order
to maintain the eligibility in the Naional Flood Insurance Program----
A proposed local law has been drawn by the Town Attorney for the
Board members to atudy, and it is certain that before the March 18th
deadline the Town will have enacted the proper legislation.
9 . Letter from the -Southold Town Fire District Officers
Association relative to what could possibly be a communication
problem between the fire departments, rescue squads and police
department. ----It is Supervisor Homan' s belief there will be a
meeting with all parties concerned sometime shortly after the
first of the year.
10 . Correspondence from the Suffolk County Department of
Health Services, Division of Disease Control and Environmental
Health Services in reply to Supervisor_ Homan' s request for further
information on the intrusion of petroleum in the wells in the
Mattituck area. They have supplied all of the latest data on
the subject and Supervisor Homan has forwarded copies to all of
the people in the Mattituck area who have made inquiries of the
Town.
11. Letter from the Southold-Peconic Civic Association, Inc.
concerning the proposed fire code for the Town of Southold. Thye
say that a fire code if and when adopted should be as simple as
possible and perhaps could be included in the present building
code. --The letter will be included in the fire code study. file.
12 . Receipt of Christmas and New Year greetings from the
Town Mayor and Mayoress Councillor and Mrs. Eric Hurren, Southwold,
England to the Supervisor and all members of the Town Board.
13. This morning Supervisor Homan sent a telegram to Washington,
D.C. stating that the Town has learned that the New York area Office
Small Cities-metro allocation to be cut 60%. Mr. Homan urgently
requested immediate efforts to restore initial funding levels as
made public in accordance with H.U.D. regulations. He will follow
the telegram with a letter.

Moved by Councilman Nickles, seconded by Supervisor Homan,
WHEREAS, Goose Bay Civic Association, Inc. applied to the Southold
Town Board for a permit under the provisions of the Wetland Ordin-
ance of the Town of Southold, application dated September 19.,. 1979, and
WHEREAS, said application was referred to the Southold Town Trustees
and Southold Town Conservation Advisory Council for their findings
and recommendations, and
WHEREAS, a public hearing was held by the Town Board with respect
to said application on the 18th day of December, 1979, at which !
time all interested persons were given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED that the Goose Bay Civic Association,
Inc. be granted permission under the provisions of the Wetland
Ordinance of the Town of Southold to maintenance dredge the
channel at Goose Creek and place the fill along the beach at
the end of Cedar Avenue, Goose Bay, Southold, New York under
the following conditions: 1. the grasses be removed and replaced
after the spoil is placed in areas desingated on the map accompanying
the application; and 2. project not commence until after March 1,
1980.

On motion of Councilman Pell, seconded by Councilman Drum, it was
RESOLVED that pursuant to the provisions of Section 284 of the Highway
Law, the Town Board of the Town of Southold agree that moneys levied
and collected for the repair .and improvement of highways, and
received from the state for the repair and improvements of highways,
shall be expended as follows : General Repairs. The sum of
$721, 000 . 00 may be expended for general repairs upon 178 . 89
miles of town highways, .including sluices, culverts and bridges
having a span of less than five feet and boardwalks or the renewals
thereof.

RESOLVED that the Town Board of the Town of Southold authorizes
the action of the Board of Commissioners of the Fishers Island
Ferry District in awarding a contract in the amount of $4950. to
Whaling City Dredge and Dock Corp. of Groton, Ct. for repairs to
the main ferry loading ramp at New London, Ct.

the action of the Board of - Commissioners of the Fishers Island
Ferry District in awarding a contract in the amount of $4950. to
Whaling City Dredge and Dock Corp., Groton, Ct. for repairs to the
main ferry loading ramp at Fishers Island, New York.

Supervisor Homan explained that the Board - had a meeting with
a Trustee of the Village of Greenport today. Sometime ago the
Town of Southold was offered $7, 410 . 01 for a High Risk Loan
Program. The Village has asked that the Town recommend to the
Suffolk County Consortium that these funds be transferred to the
Village of Greenport. so they can use them in their ongoing program.
On motion of Councilman Pell, seconded by Justice Tedeschi, it was
RESOLVED that the Town Board of the Town of Southold recommends to
the Suffolk County Consortium that Southold Town' s share of
$7,410 . 01 in the High Risk Loan Program be transferred to the
Village of Greenport.

Law State Environmental Quality Review and 6 .NYCRR Part 617, Section

hereby given that the Southold Town Board, as lead agency for the
action described below, has determined that the project will not have
a significant effect on the environment.

Proposal of the Town of Southold for the excavation and removal
of material from proposed recharge basin on Boisseau Avenue, Southold,
New York.
The project has been determined not to have a significant effect

WHEREAS, there is a drainage problem on Hill Road West, resulting,
in a collection of surface water on Hill Road West adjoining the

WHEREAS, SOUTHOLD GARDENS is willing to grant the TOWN a limited
easement over .the above-described premises to help solve the problem
by the installation and maintenance by the TOWN of surface water.

described property of SOUTHOLD GARDENS for the purpose of installing
and maintaining surface water drainage facilities within the above-

1. All drainage facilities are to be completely underground,
covered with top soil and graded to the natural contour of the land,
at the expense of the TOWN, and
2 . The graded area shall be seeded with grass comparable to the
grasp on the remainder of the open space area of SOUTHOLD GARDENS,
at the expense of the TOWN.
3. The above work shall be completed on or before February 1,
1980, with the exception of final grading and. seeding which will be
completed in the Spring of 1980.
4. SOUTHOLD GARDENS agrees to mow said area and otherwise maintain
the appearance of the area.
5. The TOWN shall be responsible for all maintenance of the
drainage facilities and connection to the Town drainage system.
6. If it is necessary for the TOWN to enter upon the property to
maintain, repair and/or replace said facilities, the TOWN will preomptly
restore the area, including reseeding, to the condition that existed
prior to any such entry. In the event that said maintenance, repair
nad/or replacement requires excavation of all or any part of said
premises, the TOWN shall give prior written notice thereof to SOUTHOLD
GARDENS at the place as may from time to time be designated by
SOUTHOLD GARDENS .
7. In the event that the surface water runoff from Hill Road WEst
results in standing water on the easement area, the TOWN agrees to take
such steps as may be required to correct the condition.

at Cutchogue, New York.

WHEREAS, Martin Suter, a most esteemed member of the Southold Town
Board will retire from public service effective December 31, 1979,
after faithfully serving the Town of Southold as Town Justice
since January 1, 1968 and Deputy Supervisor since July 24, 1979 , and
W4EREA.S the Town Board wishes to .express their sincere appreciation
to Martin Suter for his diligence to duty and dedication to serving
the people of Southold Town as an outstanding public servant,
NOW, THEREFORE, BE IT RESOLVED that the Town ,Board of the Town of
SOUTHOLD extends their thanks and appreciation to Martin Suter and
wishes him much happiness, success and good health in the years
ahead, and be it further

Councilman Drum stated, that as we all know, Supervisor Homan
was a Councilman back on January 1, 1972 and 'he has been Supervisor
since July 24, 1979. What many do not know, however, is that he
has spent long hours, Saturdays Sundays from early in the
morning until late at night, seven days a week on the job. Council-
man Drum has personally known Supervisor Homan as a friend and he
has done an outstanding job.

HWEREAS, James Homan, a most valued member of the Southold Town
Board will retire from public service effective December 31, 1979,
and
WHEREAS, James Homan has given generously of his" time and talents
in his faithful service to the Town of Southold residents as a
Councilman since January 1, 1972 and Supervisor since July 24, 1979,
and
WHEREAS, his record of fine service to the Town of Southold and
its people deserves the sincere gratitude of those with whom and
for whom he worked, and
WHEREAS, the Town of Southold will be deprived of his wise
counsel and judgement as a member of the Southold Town Board, now,
therefore be it
RESOLVED that the Town of Southold hereby expresses their most
sincere appreciation to James . Homan for his unselfish and whole-
hearted cooperation and untiring efforts on behalf of the Town,
especially at a time when his expertise was needed most, and accept
with sincere regret his decision to retire, dnd extend their best
wishes for the years ahead, and be it further

Supervisor Homan thanked the Town Board and the public for
extending to him:, the privileges and obligations of the office
of Supervisor. In his years on the Board there have been a
number of people leave the Board for various reasons; Justice
Rich, Justice Demarest, Supervisor Martocchia and Justice Suter.
All of them in their own way have set standards which he has tried
to follow and Supervisor Homan hopes in some small way he has set
a standard for the Board which will follow him. He recognizes
that in assuming the Supervisor' s position that, as Harry Truman
said, "The buck stops here, " and no truer words were ever spoken
because at the Supervisor' s office it does. 'He spologized to the
press because he recognizes he has not been good copy and perhaps
that was of his own choice. He felt that actions speak louder
than words and it has always been his theory. However, in the
office of Supervisor more consideration should have been given

to the press than he did. Supervisor Homan said that to the Town
Board that follows the present Board he only asks that they be
governed by action and not reaction. That they consider the
silent majority as well as the. local minority. Supervisor Homan
thanked the Town of Southold for allowing him to be Supervisor.
Mrs. Gladys Csajko said that she does not recall anyone before
that she addressed this way: Mr. Supervisor, thank you, you have
done a fantastic job. The whole Town owes you a big thank you.
On motion of Councilman Nickles, seconded by Councilman Drum, it was
RESOLVED that there being no further business to come before this
Town Board Meeting adjournment be called at 3 : 45 P.M.
