'SOUTHOLD TOWN BOARD
December 18 , 1979
EXECUTIVE SESSION
Chief Carl Cataldo discussed with the Board the conduct of a
certain member of, the public with relation to town officials.

Chief Carl Cataldo and the Board discussed the request of PBA
President Stepnoski for a meeting with the January 1, 1980 Town
Board concerning the manpower situation in the Police Department
Chief Cataldo presented his November 1979 report.---Further dis-
cussion included the filling of the Bay Constable vacancy, grant
for a logging recorder, teletype system.
A regular meeting of the Southold Town Board was held on Tuesday,
December 18 , 1919 at the Southold Town Hall, Main Road, Southold,
New York. Supervisor Homan opened the meeting at 3 : 00_. P.M. with
the following present:

On motion of Councilman Pell, seconded by Councilman Nickles, it was
RESOLVED that the minutes of the December 4, 1979 Town Board meeting
be and hereby are approved as submitted.
Vote of the Town Board: Ayes: Justice Tedeschi, Councilman Nickles,
Councilman Pell, Councilman Drum, Supervisor Homan.
This resolution was declared duly adopted.
On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3 : 00 P.M. , Thursday, December 27, 1979 at the Southold. , :. .
own Hall, Main Road, Southold, New York.

This resolution was declared duly adopted.
On motion of Councilman Drum, seconded_ by Justice Tedeschi, it was
RESOLVED that the 1979 report of Town Justice Martin Suter and the
November 1979 report of the Police Department be and hereby are
accepted and ordered file .

PUBLIC NOTICES
1. Notice from the Department of the Army, Corps of Engineers
upon application of Harold Reese to excavate,, bulkhead and fill at
Southold Bay, Shelter Island Sound, Southold, New York. Comments
by December 30, 197.9 .
2. . Notice from the Department of the Army, Corps of Engineers
upon application of Charles Levien for permission to maintenance
dredge at East Creek, Cutchogue. Comments by January 6 , 1980.
3. Notice from the NYS DEC of complete 'application for non-
minor project by Coastal Dock Building Company for permission
to construct 80 lin. ft. of bulkhead plus return and 10 lin. ft.
retaining wall. Dredge in front of proposed bulkhe.ad .to. 5 ft..
below mean low water and use resultant 200 cu. yds-. of spoil a's -
back fill. Create a...200 st. ft. wetland area north of proposed
structure to mitigate loss of water column. Project site is
located on west side of Manhassett Avenue, south. of Champlin Place,

4 . Notice to bidders for furnishing sanitary landfill
equipment for the Town of Southold. Bid opening December 27,. 1979
at 11: 00 A.M.
COMMUNICATIONS:
1. Memo from the Suffolk County Department of Emergency
Preparedness concerning home heating emergencies, and what
steps are to be taken should there be a problem in Southold
Town of either a fuel oil shortage or heated shelter is needed, ,
2. Memo from the County of Suffolk, Department of Emergency
Preparedness concerning Local Emergency Preparedness in the event
of a disaster.
3. Letter from Supervisor Homan to Sacco & Ahlers concerning
the finished and unfinished contracts for the Southold Senior
Citizen/Youth Center. A meeting was held on December 17th with '
tye contractors and the architect. As of this point in time
the Town expects the exterior doors and necessary work that is
to be done by the general contractor to be completed by this
weekend. If that is the case the Town will probably take
possession either this weekend or some time early next week,
subject to the architect' s approval.
4. Receipt of application from Paul A. Hunter for the
position of Bay Constable.
5. Receipt of SPDES Schedule of Compliance Reminder from
the DEC relative to the Scavenger Site (.Disposal Area) , Cutchogue,
and the 201 Wastewater Report. The Town is in compliance pending
approval of the DEC of the report.
6,: Advertisement for bids for space from the U.S'. Postal
Service. They are interested in relocating the Southold Post
Office. The location should be in the following general area:
Main Street with boundary of Hortons Lane and Youngs Avenue.
7. Letter from the North Fork Taxpayers Association, Inc.
giving their views on the proposed New York State Fire Prevention
Code. They have voted unanimously to oppose the adoption of
the New York State Fire Prevention Code.
8 . Notice from the Suffolk county Department of Labor that
Gerald King, chef at the Nutrition :.Center, has been placed on a.
waiver list in the Handicapped category, for continuation of
CETA personnel.
9 . Application of George L. Penny IV for a position on the
Board of Appeals.
10. Letter from the North Fork Environmental Council, Inc.
relative to application for a wetland permit by Goose Bay Civic
Association, Inc. This letter will be read at the public hearing
which will be held at 3: 30 P.M. this date.
11. Notification from Chief Cataldo of the names of the
individuals who will be attending the Police Academy for training
in relation to part-time summer-special policemen.
12 . Letter from the Southold Town conservation Advisory
Council recommending that Frank Cichanowicz III be appointed
chairman of the Council effective January 1, 1980. This will
be turned over to Mr. Pell for action after the first of the. year..
13. Letter from the New York State DEC concerning a. meeting
which was held by the Long Island Groundwater Coordinating Comm-
ittee on December 14th at 10 AM at Stony Brook. They have asked
that the Board appoint someone to act in behalf of the Town on
this committee.
RESOLUTIONS
On motion of Councilman Pell, seconded by Councilman Drum, it was
RESOLVED that the Town Board of the Town of..Southold approves the
addition of six (6) new street lights in needed areas throughout
the village on Fishers Island at an increase of $38. 50 per month.

Councilman Pell, Councilman Drum, Supervisor Homan.

On motion of Counc~_lman Nickles, seconded by Councilman Pell, it was

RESOLVED that the Southold Town Board declares itself lead agency in
regard to the State Environmental Quality Review Act in the matter
of the application of Maidstone Development, Inc. for a change of
zone from "A" Residential and Agricultural District to "M-1" General
Multiple Residence District on certain property located on the North
Road, Greenport, New York.
Vote of the Town Board: Ayes: Justice Tedeschi, Councilman Nickles,
Councilman Pell, Councilman Drum, Supervisor -Homan.
This resolution was declared duly adopted.
On motion of Councilman Drum, seconded by Councilman Nickles,
WHEREAS, a petition was received from Maidstone Development, Inc.
requesting a change of zone on certain property at Southold, New
York, said petition for a change of zone from "A" Residential
Agricultural District to "M-1" Multiple Residence District,
now, hterefore, be it '
RESOLVED that the Town Clerk of the Town of Southold be and she
hereby is directed to transmit this application to the Planning
Board in accordance with Aritcle XV, Section ' 100-150 (B) . of the Code
of the Town of Southold.

Councilman Pell, Councilman Drum, Supervisor !Homan.

On motion of Councilman Nickles, seconded by Justice Tedeschi, it was
RESOLVED that the Town Board of the Town of Southold accepts the
resignation of Frank Kujawski, Jr. as a member of the Southold
Town Conservation Advisory Council, and expresses their appreciation
to Mr. Kujawski for his dedicated service to the Town as a member
of the Council since July 6 , 1971.

Councilman Pell, Councilman Drum, Supervisor- Homan.

On motion of Councilman Nickles, seconded by Councilman Pell, it was
RESOLVED that the Town Board of the Town of Southold approves the
action of the Board of Commissioners of the Fishers Island Ferry
District in setting the salary of Secretary-Manager of the Ferry
District Robert P. Knauff at $19, 000. 00 effective January 1, 1980.

Councilman Pell, Councilman Drum, Supervisor Homan.
This resolution was declared duly adopted.
On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that the application of George A. McCarthy dated November
16, 1979 for a trialer permit renewal on 1900 Any Street, Laurel,
New York be and hereby is granted for a six month. period...

Councilman Pell, Councilman Drum, Supervisor Homan.

On motion of Councilman Pell, seconded by Councilman Nickles, it was
RESOLVED that the bond in the amount of $90, 000. 00. for roads and
improvements in the subdivision known as "Crown Land Lane" at
Cutchogue, New York be and hereby is released in. accordance with
the recommendation of the Town Engineer, Planning Board, Highway
Superintendent and Town Board Highway Committee.

On motion of Councilman Nickles, seconded by Justice Tedeschi, it was.
RESOLVED that the bond in the amount of $25, 000. 00 for the roads
and improvements in the subdivision known as "Elijah' s Land Estates,
Section I" at Matittuck, New York be and hereby is released in accord-
ance with the recommendation of the Town Engineer, Planning Board,
Highway Superintendent and Town Board Highway Committee.

On motion of Councilman Nickles, seconded by Justice Tedeschi., it was
RESOLVED that the voucher of A. John Gada, General Contracting, Inc.
for work done on the Fishers Island Ferry District Theatre be and
hereby is ordered paid in the amount of $1, 148. 93.

Councilman Pell, Councilman Drum, Supervisor Homan.

Moved by Councilman Drum, seconded by Justice Tedeschi,
WHEREAS, the Sacred Heart R.C. Church, Cutchogue, New York has
applied to the :Town Clerk. for a- Bingo Licens.6,,'`.and
WHEREAS, the Town Board has examined the application, and after
investigation, duly made findings and determinations as required
by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be. and he
hereby is authorized and directed to execute on behalf of the
Town Board of the Town of Southold the findings and determinations
as required by law, and it is further
RESOLVED that the Town Clerk be and she hereby is directed to::. issue
a Bingo License to the Sacred. Heart R.C. Church, Cutchogue, New York.

On motion of Councilman Nickles, seconded by Councilman Drum, it was
RESOLVED that the voucher of Pace Auto Shop, Peconic, New York for
work done on a damaged Police car be and hereby is ordered paid in
the amount of $2, 468. 53.

On motion of Councilman Drum, seconded by Councilman Pell, it was
RESOLVED that the Town Clerk be and she hereby is authorized and
directed to advertise for bids for the purchase of heating fuel
oil for the buildings of the Town of Southold for the calendar year
1980.

Councilman Pell, Councilman Drum, Supervisor Homan.

On motion of Councilman Nickles, seconded by Justice Tedeschi, it was
RESOLVED that the Southold Town Board declares itself lead agency

of the application of David S. Strong for a wetland permit at Strong's
Mattituck Marina, James Creek, Camp Mineola Road, Mattiituck., New- York.

Moved by Councilman Nickles, seconded by Councilman Drum,
WHEREAS George Ahlers and Barbara Reynolds have made application
to the Town Board of the Town of Southold to dedicate a certain
road in Southold, New York, to be known as "WEST HILL ROAD'.' as
shown on Map of Claves Neck, filed in the Office of the Clerk of
the County of Suffolk on February 15, 1972 as Map No. 56.73, together
with release executed by the owner thereof, and
WHEREAS , the Southold Town Highway Superintendent has inspected the
said highway and has advised the Town Board that said proposed high-
way complies in all respects with the specifications for the dedication
of highways in the Town of Southold,
NOW, THEREFORE, BE IT RESOLVED that in accordance wi.th. Section 271
of the Highway Law of the State of New York, consent be and the
$ame -_is .given to the Superintendent of Highways to make an order
laying out the aforesaid highway, to consist of lands described in
application as shown on certain maps attached to said application, and
BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is
authorized and directed to forthwith cause the dedication and release
be recorded in the office of the Clerk of the County of Suffolk,
New York.

RESOLVE that Highway Superintendent Dean be and he hereby is
authorized to purchase a new boiler for the Highway Department
building at a cost of $2, 915. 00.

RESOLVED that the Town of �Suuthold employ Mr. Joseph M. Jaworecki

as a. Laborer with the Department of Public Works at the Disposal
Area,. Cutchogue, New York.

This resolution was declared duly adopted.
Mrs. Gladys Csajko asked what Maidstone Development intends to
do?---Supervisor Homan stated they are requesting a change of
zone from "A" to "M-1" on property located east of the nursing
,home and west of Clark' s Beach on. the north side of Route 25,
Greenport. The parcel contains 5. 2 acres. The application
indicates they wish to build condominiums, however, the Board is
only involved in deciding whether the property should be changed
from "A" to "M-111 .
Supervisor Homan announced that today is Unity Day by declaration
of the President and asked that everyone give: ,a moment._ of thought
to those people less fortunate that we are.
Supervisor Homan wishes everyone a very Merry Christmas.
On motion of Councilman Nickles, seconded by Councilman Pell, it was
RESOLVED that there being no further business: to, come before this
Town Board meeting adjournment be called at 3: 20 P.M.
