SOUTHOLD TOWN BOARD
November 20, 1979
WORK SESSION
Mrs. Barbara Albertson appeared before the Board requesting a donation
to the Long Island Nautical Heritage Foundation to offset a deficit
incurred when the Young America visited 'Greenport in October. Mrs.
Albertson was the local coordinator and is personally responsible for
the $1, 031. 58 deficit. The Board will examine the budget at the end
of the year to see if there are surplus::funds, in .the' mean time they
suggested she approach- local service organizations for donations.
Mrs. Albertson asked the Board to also consider an end-of-the year
donation to the Custer Institute. .
Mrs. Jean Tiedke appeared before the Board requesting permission to
prepare an oral .-_argument for presentation before the State Board on
Eelctric Generation Siting and the Environment in the matter of the
application of LILCO-Jamesport. si.te, Case 80.003.. Mrs. Tiedke stated
the Town of Southold has been allocated 10 minutes on November 28th.
Mrs. Tiedke stated she will review the position of the Town from the
four previous briefs and propose alternatives.
EXECTUIVE SESSION
The Board discussed the new P.B.A. contract with Town Attorney
Tasker and Chief Cataldo.
The Board discussed summer employees for the Police Department.
A regular meeting of the Southold Town Board was held on Tuesday,
November 20, 1979 at the Southold Town HaLL, Main Road, Southold,
New York. Supervisor Homan opened the meeting at 3: 00 P.M. with
.the following present:

RESOLVED that the minutes of the November 7, 1979 meeting of the
Southold Town Board be and hereby are approved as submitted.

Councilman Pell, Councilman Drum, Supervisor Homan. Absent: Justice
Doyen.
This resolution was declared duly adopted.
On motion of Councilman Pell, seconded by Councilman Drum, it was
RESOLVED that the next regular meeting of the Southold Town Board will be
held at 7 : 30 P.M. , Tuesday, December 4, 1979 at the Southold Town
Hall, Main Road, Southold, New York.

Department be and hereby is received and ordered placed on file.

PUBLIC NOTICES
1. Notice of a Complete Application for Non-Minor Project from
the DEC upon application of Lillian S. Morris, Inlet Lane, Greenport,
for construction of a one family dwelling and timber catwalk over the
marsh at Gull Pond inlet.
2. Notice from the Suffolk County Department of Land Management
that farmland belonging to John Wickham has been placed in the Suffolk
County Farmland Acquisition Development Rights Program.
COMMUNICATIONS
1. Letter from residents .of Laurel Country Estates relative
to the use of motorcycles or trail bikes in their area. These vehicles
are not being used on the public highway but on the farmland in the
area surrounding Laurel Country Estates. They, do create a nuisance
Supervisor Homan has been down there on several occasions as well as
the Police on numerous occasions. They are hard to control because
they are on private property and breaking no laws even though they
are extremely noisy. The letter has been referred to the Police
Department asking them to survey the situation again.
2. Letter from .Scott J. Burney, Greenport _requesting a street light
on the bend in the road of Gull Pond.
.11 Letter from Mrs . Janet G.McLean regiiesting. a street light
be installed on the corner of Jockey Creek Drive and Route 25, Southold.
Letter from John P. .Krupski requesting a street light in
Cutchogue.
Letter from Walter H. Preston requesting a street light on
Gillette Drive, East Marion.
The street light requests will be studied, but it is unlikely
they will be implemented until after the first of the year when there
is more money available.
. 3. Receipt of a news release from the 'U.S. Department of Agri-
culture, Plum Island Animal Disease Laboratory, concerning their Foot-
and-Mouth Disease Vaccine study; selection of a construction management
firm to supervise completion of the construction of certain buildings
on Plum Island; and a release stating a newly developed vaccine for
Rift Valley Fever will. be tested at Plum Island.---The news release.
were sent to Supervisor Homa,n._:as._.past of an agreement he made with.
the late Supervisor Martocchia that when new projects. were started on
Plum Island they would notify. the press and various muriIcipalities,
State and County.
4 . Receipt of a resume from Vincent W. Annabel for the vacancy
on the Board of Appeals.
5. Item (5) on the agenda concerns a matter in litigation and
cannot be discussed publicly at this time.
6. Letter from Robert and Kathleen Gerdts concerning the proposed
trailer information center at Laurel. Mr. & Mrs. , Gerdts are opposed.---
The Board discussed the matter this morning and is in agreement that
the proposed site is probably not the nest location for an information
center.
7. Thank-you letter from the Incorporated Long Island Chapter,
New York State Archaeological Association, Main Bayview Road, Southold,
for the Town' s support of their program.
8. Copy of a letter from Chief Carl Cataldo to the Real Estate
Officer of the U.S . Postal Service concerning a Police Department
study made of the possible relocation of the Southold Post Office.
Mr. James Gray, the owner of property where Chinam was located, has
brought to Chief Cataldo ' s attention the fact that the Postal Service
is again considering a relocation of the Southold Post Office. The
Chief makes comments concerning the possible proposed site and the
problems that exist at the present site.
9 . Letter from El Wilson Campbell, Director; Planning Division,
N.Y.S . Dept of Transportation acknowledging receipt of. the Board' s
resolution opposing the siting of a bridge across Long Island Sound
in the Town of Southold.
10. There is a meeting this afternoon at the Quogue Wildlife
Refuge at 2 PM which is being attne.ded by the Deputy Superintendent
of Highways Raymond Jacobs on behalf of Supervisor Homan. This meeting
has to do. with the East End Solid Waste Energy and Resource Recovery
Study contract finalization.

11. Receipt from the Long Island Regional. Planning Board a copy
of th64-r comments. on the Town* s.'A-.95 Grant which is the .S l Cities
Grant. The Long Island Regional Planning Board does support the Town' s
program and recommends approval of the project. Hopefully that will
have an impact on the Town' s success in obtaining the grant.
12. Letter from the N.Y.S . D.E.C. , permit to harvest 'and relay
legal and sub-legal size bay scallops. The project was completed
November 18, 1979. ---The Baymen and Town Bay Constable were able to
move a considerable quantity of scallops off of the shallow beaches
in East Marion to the outside. waters. Supervisor Homan thanks both
the Baymen and DEC for allowing the Town to participate in this
program.
h. Letter concerning HUD ' s concern that the Town' s Senior
Citizen Center be utilized primarily for the Town' s elderly residents.---
To that end the Board is researching the possibility of moving the RSVP
group to the building and giving the office space there when the build-
ing is completed. It is felt this would be to the Town' s benefit as
the building would then have a daily occupant and since their vehicle
is based at the Highway Department it would be of benefit to RSVP also.
14. Letter from John Wickham who advises the Board of his plans
to do extensive dike work in New Suffolk.
(There will be a hearing at 3: 30 P.M. on the application for a change of
zone by Raymond and Anna Ciacia. )
RESOLUTIONS
On motion of Councilman Drum, seconded by Councilman Pell, it was
RESOLVED_ that the application of Zdzislaw Mikolajczyk dated October
24, 1979 for the renewal of a trailer permit on the south side of
private road off east side Main Road, Mattituck, New York be and
hereby is granted for a period of six months.

Councilman Pell, Councilman Drum, Supervisor Homan. - Absent: Justice
Doyen.

RESOLVED that the following resolution adopted by the Southold Town
Board on November 7, 1979 be and hereby is rescinded:
"RESOLVED that the Town Board of the Town of Southold set

P.M. , Tuesday, December 18 , 1979, Southold Town Hall, Main Road,
Southold, New York as time and place for hearing upon application of
Goose Bay Civic Association, Inc. for a permit under the provisions
of the Wetland Ordinance of the Town of southold.

On motion. of Justice Tedeschi, seconded by Councilman Pell, it was
RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review and 6 NYCRR Part 617 , Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project will
not have a significant effect on the environment.
DESCRIPTION OF ANION
Application of Kurt A. Keohler, a/c Mr. & Mrs. Arthur David for
a Wetland Permit. Permission ti requested to construct a stationary
36ft by 3 ft. wooden catwalk over grass area at Stillwater Avenue
on Eugene Creek, Cutchogue, NewYork.
The project has been determined not to have a significant effect
on the environment for the following reason:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment are likely to

occur should the project be implemented as planned.
Vote. 'of the. .Town Board: Ayes: Justice -Tedeschi, Councilman Nickles,

This resolution was delcared duly adopted.
On motion of Justice Tedeschi, seconded by Councilman Drum, it was
RESOLVED that Supervisor Homan be and he hereby is authorized to
enter into an agreement .with IBM for .the lease of a Model 75 electronic .
typewriter at a cost of $99. 00 per month for a four year period.

This resolution was declared duly adopted.
Supervisor- Homan stated that the Board discussed the 1980 -Biidget at
lepgth this morning. He had done considerable work on it last week-
end to see if there had. been any last minute adjustments the Board
cared to make in it. He could find no adjustments to make inthe
area, of expenditures., however two months ago when he formulated the
budget he was a little conservative on interest and earnings and the
Board did revise them on their own a month .ago. However, interest
and earnings continue to accelerate, therfore after research of the
budget he -:.did:.:come up._:several minor. changes, all of them in the
area of income for the Town. He suggested to the Board that they
adopt--a resolution amending the Preliminary Budget as follows:
A2401 - Whole : Town - Interest & Earnings - $20, 000. to $30, 000.
70001 - Whole Town - Per Capita - $120,000. to $130, 000.
B2401 - Part Town - Interest. & Earnings - $20, 000. to $30, 000.
DR2401 - Highway I - Interest & Earnings - $20, 000. to $30,000.
DM2401 - Highway 3 = Interest & Earnings - $550. to $10, 000.
Total Amount of Increased Revenues - $44, 500.

RESOLVED that the 1980 Preliminary Budget of the Town of Southold be
and hereby is amended to show the following chanes:

This resolution was declared duly adopted.
Moved by Councilman Drum, seconded by Councilman Nickles,
WHEREAS, the Town Board of the Town of Southold, New York has met at
the time and place specified in the notice of public hearings on the
preliminary budget and heard all persons desiring to be heard thereon;
now, therefore, be it
RESOLVED that the Town Board of the Town of Southold does hereby
adopt such preliminary budget as amended this date, as the annual
budget of this Town for the fiscal year beginning on the lst day of
January 1980, and that such budget as so adopted by this Board be
entered in detail in the minutes of the proceedings of this Town
Board, and be iJ7 further
RESOLVED that the Town Clerk of the Town of Southold shall prepare
and certify, in duplicate, copies of said annual budget as adopted
by the Town Board of the Town of Southold, together with the estimates
if any, adopted pursuant to Section 202a, subdivision 4 of the Town
Law, and deliver two copies thereof to the Supervisor of this Town
to be presented by him to the County Legislature of the County of
Suffolk.

RESOLVED that .the Town Board of the Town of Southold approves the
action of the -Board of Commissioners of the' Fishers Island Ferry
District in awarding the bid for the dry-docking of the M/V Olinda
to Hitchcock Gas Engine Co: , Bridgeport, Connecticut in the amount
of $9, 845. 00, and to accomplish other supplemental work depending
upon conditions found at time of dry-docking.

Councilman Pell, Councilamn Drum, Supervisor Homan. Absent: Justice
Doyen.

On motion of Councilman Nickles, seconded by Councilman Drum, it was
RESOLVED that. Antionette Berkoski, a civil service employee on leave
of absence from the County of Suffolk, be and she hereby is employed
as a Clerk-Typist for the Southold -Town Police Department, effective
December 3, 1979 at a salary of $5,500. 00 per annum.

RESOLVED that Supervisor James Homan be and he hereby is authorized
and directed to enter into a:.:.Consultan.t Contract between Holzmacher,
McLendon and Murrell, P.C. and the Town of Southold for a Solid Waste
Management Study. (The Towns of Southampton, Riverhead, East Hampton
and Shelter Island are entering into similar contracts for this Five
Town Study. )

RESOLVED that Supervisor James Homan be and he hereby is authorized
and directed to enter into a contract between the 1714 House Associates
and the Town of Southold for a one year least, January__ 1, 1980 to
December 31, 1980 for Justice Chambers for Justice James H. Rich, Jr.
on the south side of the North Road, Southold at a cost �of $1451. 50
per year.

and directed to enter into a contract between Douglas F. Creighton
and the Town of. Southold for a one year lease, January 1, 1980 to
December 31, 1980 for Justice Chambers for Justine Frederick J.
Tedeschi on the north side of the Front Street, Greenport at a cost of
$1620. 00 per year.

RESOLVED.' that Supervisor James Homan be and he 'hereby is authorized
and directed to execute the 1979-1980 contract between the Town of
Southold and the Southold Town Police Benevolent Association, Inc. as
drawn by Town Attorney Robert W. Tasker.

Supervisor Homan stated that the 1979-80 PBA contract calls for,
basically, a 6% salary increase dated January 1, 1979 and 4. 5%
increase effective January 1, 1980 and a 3. 6% increase July 1, 1980.
Also encompassed is the award, effective January 1, 1980 is a $200. 00
yearly night differential.
Councilman Nickles stated that on October 25th there was a public
Information Hearing held at the Oysterponds School by the N..Y.S.
Department of -Transportation relative to the repair of the seawall
at East Marion. While there Councilman Nickles inquired about the
effects .of highway runoff into .Gardiners Bay, and whether the State
had approval from the DEC. The DOT responded to Councilman Nickles
stating: "We are aware that storm water runoff carries: some potentially
polluting materials including deposits from passing vehicles as well as
the paving itself. While these materials might have a potential long
range impact there is little or no evidence we are aware of, that these
pollutants have had an adverse effect on water quality. Therefore, in
our opinion, this project is not likely to have any significant impact
on water quality. " What bothers Councilman Nickles is that whenever
the Town wants to run road water off into the creeks we are not
permitted. The DOT did not answer his question as to whether they
had DEC approval. He will pursue the matter with the DOT.
On motion of Councilman Nickles, seconded by Councilman Drum, it was
RESOLVED that a recess be called at 3: 30 P.M. for the purpose of holding
a public hearing on the matter of the application of Raymond and Anna
Ciacia for a change of zone. Meeting to reconvene following the public
hearing -

to appear.

RESOLVED that authorization be and hereby is given to make final
payment to Metro Plumbing East for work completed on the Town Hall
Addition. Payment to be made from EDA funds in the amount of $1, 846 . 40.

Mr. Henry Lytle asked if the Town Board had taken any steps or action
on the approval or disapproval of the post office relocation in
Southold.--Supervisor Homan stated that the Town Board has not. There
was a request for a traffic study some four or five years ago. The
Chief.--'of Police did the study, but at that time the present site was
retained by the Postal Service. At this point in time there seems to

be interest in relocating the post office toi,the area of the service
road from Traveler Street to Main Road. The Pollce Department has
recommended the location off of the Main Road due to the traffic
conditions in the area and pedestrians crossing the Main Road.

RESOLVED that there being no further business to come before this
Town Board meeting adjournment be called at 3: 50 P.M.
