JONATHAN REBELL & NOAH LEVINE requests a Wetland Permit and a Coastal Erosion Permit
to cut back a section of the top of bluff totaling 15 cubic yards of material resulting in an angle of
repose of 35 degrees; add three 2"x12" erosion control terracing structures planted with Cape
American beach grass within the disturbed area; construct ±65 foot long bluff stairs to beach
consisting of 4' wide stairs with railings on both sides plus two (2) 4'x6' platforms, two 4'x5'
platforms, two 4'x4' platforms with last set of stairs to be retractable aluminum stairs; elevation of
bluff stairs to be at least 3' above grade; support posts and support materials to be constructed with
treated lumber with all stair treads and railings to be untreated lumber; establish and perpetually
maintain a 4' wide non-disturbance buffer area along the top crest of the bluff with pressure treated
beams anchored into the ground along landward edge of non-disturbance buffer; and establish and
perpetually maintain a 25' wide non-disturbance buffer area along the landward edge of the top of
the bluff with a 4' wide access path to the bluff stairs. Located: 4790 Blue Horizon Bluffs, Peconic.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the LWRP.
Traditionally, beach stairs in this area are at risk of loss due to the high erosion of the bluff
and the action is recommended as inconsistent. The bluff restoration and stabilization plan
mitigates loss concerns.
It is recommended that the 25' Non-disturbance buffer is shown on the survey and that the
use of CCA treated materials be minimized.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Dear Trustees:
1 am respectfully submitting to you a revision to the July 19 application packet for a wetland
permit for the Jonathan Rebell and Noah Levine beach access stairs located at 4790 Blue
Horizon Bluff, Peconic, NY. Trustee permit#9755 for this project expired. We have a NYDEC
permit.
We have amended the scope of the project which triggers the requirement of a Coastal Zone
Erosion Hazard permit.We are proposing to cut back a small portion of the top of the bluff,
hence reducing that angle of repose of the bluff from about 42 degrees to 35 degrees. We will
add limited retaining structures in the area and plant the area with cape American beach grass.
These efforts will support the growth of vegetation, hence stabilizing the bluff to allow for the
installation of beach access stairs. We have included a non-disturbance buffer and access
path. Enclosed you will find:
Revised plans which includes a revised project description. Please note that the plan has been
certified by Joseph Fischetti of Fischetti Engineering. .
