SOUTHOLD TOWN BOARD
August 7, 1979
WORKING SESSION
Mr. & Mrs. Gary Lillis and Mrs. Gregory Cahill, Old North Road,
Southold, appeared before the Board to discuss the flooding problem
on Old North Road which occurs during heavy rains throughout the
year. It was determined that the water that flows onto the road
probably flows from as far as Youngs..,:Avenue to the west. Highway
Superintendent Dean will have Road Inspector John Davis do an
engineering study of the area and make recommendations for a
solution to the problem.
Gail Wickham, Esq, representing the owners of the subdivision known
as "Southold Gardens" appeared before the Board to discuss the ease-
ment area off .of Hill Road West which has been offered to the Town.
The developers wish the drainage work on the easement corlpleted by
August 30th., The Board would like the dedication of Hill Road west
by Developer George Ahlers before agreeing to the easement; they
won't take the road without the easement. Ms. Wickham stated she
would discuss this with "Southold Gardens" developer Mr. Babcock.
Mr. Frank Bear ?~yet with the Board to discuss solid waste management.
He recommends public input prior to final recommendations from the
DEC. When a firm is selected to make the study, he suggests that
a meeting of concerned individuals be held at the outset of the
study. He would also like to make alternative suggestions as to the
selection of a firm. The Board asked Mr. Bear to submit specific
recommendations and they will be sent to Mr. Middleton of the DEC.
?!'r . 1 .:ichard Tuthill of Long Island Cablevision Corporation met with
the Board relative to CATV' s request for an amendment to their
franchise allowing Capt. Kidd Estates to be serviced from their
Riverhead tower rather than the Greeriport tower. He stated that
to serve Capt. Kidd Estates from the Greenport tower would mena
adding ' 10 t0. 15 amplifiers to the system and .they are almost at
maximum now. Transmission from Riverhead would be much better.
The Board asked Mr. Tuthill to prepare an east-west boundary line
for service from Greenport and Riverhead towers and submit it to
them prior to the .public hearing on the frriachise amendment.---
The expansion program was discussed at some length.
A regular meeting of the. S.outho.ld .Town Board was held on Tuesday,
August 7, 1979 at the Southold Town Hall, Main Road, Southold, New
York. Supervisor Homan opened the meeting at 7.; 30 P.M. with the

Island 'School, Fishers Island, Newyork.

On motion of Councilman Drum, seconded by Councilman Pell, it was
RESOLVED that the following audited bills be and hereby are ordered
paid: General Fund Whole Town bills in the amount of $32,585. 78;
General Fund Part Town bills in the amount of $7, 994. 67; Highway
Department bills in the amount of $20, 931. 24; and Fishers Island
Ferry District bills in the amount of $63, 051. 23

On motion of Justice Doyen, seconded by councilman Nickles, it was
RESOLVED that the following July 1979 reports be and hereby are

District, Building Department, Assessors, Justice Suter.

COMMITTEE REPORTS:
Councilman Henry W. Drum spoke about grants in the form of
federal funds that Town have been receiving in the past few ' years
for comprehensive and single purpose grants. Present indications
are that federal funds for the fiscal year 1980, which commence in
October of this year, will only be available under the single purpose
grants.. Councilman Drum and Councilman Pell have met with several .
firms for advice, this would be competitive bidding. Namely, Raymond,
Parish and Pine and Pan-Tac advised them about how to go about applying
'for--:the funds. They discussed various approaches and within....the next
ten days they will submit their proposals. hey discussed certain
aspects, such as getting funds for street lighting, health, and
safety, economic conditions and/or housing. These are the general
areas that would come under the single purpose grants.
Councilman Pell spoke about the 100% committee. Mr. Pell and his
co-member Councilman Drum met last week with Supervisor Smith of
Riverhead to see what pitfalls Riverhead has become involved with,
to see if Southold town could prevent some before they become involved.
They then met with the firm of Finnegan Associates who is doing the
100 % reappraisal for Riverhead Town and also did the, work for Islip
Town. They went over Finnegan" s methods of work and tried to get
the facts behind the project. It seemed to be more 'confusing than
before they went into the meeting. Councilman Pell ' s recommendation
and Councilman Drum.l�s recommendation is that Finnegan Associates
meet wi.th. the entire Board next week to discuss their proposal for
Southold Town' s reappraisal.
Deputy Supervisor Suter met with representatives of Chemical Bank
to discuss their proposals for the work that is now being done in
the Town by Belmil and ADP. They met with George Mellas and
Councilman Nickles on Wednesday mroning at 8 : 30 P.M. and spent the
entier day until 4.: 30 meeting with all department heads in the
Town of Southold for input. Chemical Bank will get back to him
with- an analysis and report and hopefully specifications for bids
for at least two departments, the Assessor' s and Tax Receiver' s Office
which are the two critical ones where there is a deadline.
Councilman Nickles reported that Councilman Pell, Officer Howard,
Highway Superintendent Dean and he toured all of the town beaches,
inspected the premises, the washrooms and spoke to various beach.
attendants. They found that at Town Beach, specifically, there was
a problem with refuse on the beaches which they believe has been
corrected. It was really the responsibility of the tenant in the
concession. They also came up with the recommendation,. as the
police department is going into a new telephone system and the ' ca11-
boxes will be removed, that in some way the callboxes should remain
there as they are necessary in the event of emergency. This is
being looked into. In spite of the tenant at the Town Beach ,on the
Sound Highway Superintendent Dean has put down refuse containers
which seems to have alleviated the problem in regard to the refuse
on the beach. It was also suggested by one of the beach attendants
that our stickers are not holding up too well and it is very difficult
to identify whether it is this years or last years sticker. Council-
man Pell is looking into a more vivid type sticker to be applied.
There have been some problems, .as far as: bathrooms being abused by
the public and they have come up with ':.a way of keeping them clean
on the weekends.

Supervisor Homan resported that Thursday, July 26th he attended a
meeting at Westhampton with the Lieutenant Governor of the State
at which time he aired several problems concerning Southold Town,
number one being the gas crisis. In the afternoon there was an
East End Supervisor ' s meeting at which time they formulated the
agreement with the DEC to go into a five town recyKing study.
The following day, because of a conflicting date with 'the Attorney,_-
General, the Deputy Supervisor signed the formal agreement on behalf
of the Town. ---With reference to the meeting with .the Attorney
General last Friday, it was a very informative meeting, but Supervisor
Homan cannot go into it much more than that. They will he having a
follow-up meeting and hopefully there will be some affirmative action
from the meeting. --The other day he went over with_.the .accountants_ s,,:
the entire Town Budget and tried to pinpoint the problems they may be
running into for the balance of the year. They also briefly touched
on how they should begin to think about the 1980 budget.--Yesterday
morning Supervisor Homan and Deputy Supervisor Suter had a meeting
with the senior citizen-youth people as a progress report for the
Senior Citizen/Youth Center on Peconic Lane. --Yesterday afternoon
Supervisor Homan attended the grant meeting with Raymond, Parish,
Pine, and Pan-Tec.
PUBLIC NOTICES:
1. Receipt of a notice of complete application for non-minor
projects upon application of Robert A. Clements for permission to
construct a one family dwelling on lot no. 10, Map of Bayview. Set-
back of the home is to be 50 ft. Variance is requested for the cess-
pool. Project site is located on Little Peconic Bay, Southold.
Comments may be submitted until August 22, 1979.
2. Notice from the Department of the Army, Corps of Engineers
.upon application of K.. 'M. Kontokosta for permission to construct
stone groins and sand fill on Long Island Sound at Greenport. This
does not fall within the jurisdiction of the Town Trustees or Conserva-
tion Adivsory Council, therefore the Town is leaving it entirely up
to the Corps of Engineers and DEC.
3. On August 23rd from 2 : 00 P.M. to 4 : 00 P.M. there will be a
meeting at the Southold Town Hall with John ' Behan relative to the
establishment of Peconic County.
COMMUNICATIONS :
1. Letter from Mattituck Presbyterian Church pointing up
some possible deficiencies in the Zoning Ordinance. It seems that
if a church falls within a business zone and it decides to have a
yard sale, etc. they do not need a yard sale permit. If they are
not in a business district they do need a permit. The Church feels
this is wrong, all non-profit organizations should not be required
to pay for a lermit. This is something the Board will consider
when they. get their review of that section of the Code.
2. , Letter from the Southold Town Conserviation Advisory Council
questioning whether the Town' s wetland permit process is working
correctly. They. comment that of the last three permits the work
was either begun or completed prior to inspection.--Supervisor
Homan stated that if there is knowledge that work is being done
without a permit it is in clear violation of the Town Code. If
such information is given to the proper authorities in the Town
an.-information will be filed and prosecution is obtainable under
that : system.
. 3. Letter from the Southold Town Conserva.ti.on Advisory
Council relative to underground fuel storage tanks and recommendations
in that area. ---Supervisor Homan stated that the recommeridati.ons are
well founded and there has been one problem he;:;ia aware of in the
Town in relation to underground tanks and he is. sure as tanks get
older and as time goes on there will be more problems: but in
researching this matter he feels the DEC will be the. lead agency
in. these problems and will have a predominent say in it, so at this
point in time the letter is being filed for future reference.
4. Receipt of additional correspondence from the. Gull Pond
area. There have been a few problems down there, but between
Supervisor Homan, Councilman Pell and Councilman Nickles the
problems have been alleviated hopefully to everyones satisfaction.
5. Letter from Congressman William Carney relative to the
ongoing battle the Town has with the Flood Insurance Administration
about where the flood line should be .located in Southold own.
6. Receipt from the Suffolk County Traffic Safety Board the
High Accident Locations for 1978. Southold Town is not on the list.
There are no high accident locations in Southold Town. Although
there are several areas in Southold where there have been accidents
and they are listed in no -one single case has a Town road been listed

as an accident predominent area. The accident areas, and there are
nine of them, are on State or County roads.
7. Receipt of a petition from seven property owners in the
Indian Neck Lane area at Peconic. They are suggesting that the
speed limit in that particular section of the road immediately
south of Route 25 be lowered to 35 mph. A copy of the petition
has been sent to the Police Department for their recommendations.
The Town of Southold cannot set the speed limits on Town roads
without State approval.
8. Letter from Assemblyman John L. Behan relative to the :
gas crisi.s..-$upervisor Homan stated he can only speak most highly
of John Behan, Kenneth LaValle, William Carney and John Klein. He
calls from the Town of Southold to complain about what the Town think
are deficiencies in gas allocation system and thinks everyonels'
getting tired of talking to him, When he 'feels he 'is not getting
the proper response he goes to these other. elected officials and they
begin where he left off and somehow he-feels weare 'getting somewhere.
9. Letter from Rothfeld, Ostrow & Lawrence,' Lynbrook stating
they have had occasion to secure the services of the Town of Southold
Building Department twice within the past year and it was extremely
refreshing to be able to obtain all the necessary information needed
to secure .the several certificates of occupancy for their clients.
They comment about the Building Department''s. .courteous and expeditious,
handling of the several matter.
10,:. Letter from John Baglivi who concurs with. Mr. Suter's
contention on naming the new Senior Citizen/Youth `Center after
the later Supervisor Albert Martocchia.--Supervisor Homan is :sure *
the Board is taking that under due consideration:.
. 11. Letter from the North. Fork Environmental Council, Inc. ,
Franklin Bear, President relative 'to=:the:_-:solid waste. study that the-::
Town of Southold is entering into .with the other four. eastern towns..
Mr. Bear suggests that perhaps there can beaa meeting with the firm
theDEC selects to do the study so the Town may have input at that
time. Mr. Bear feels, and rightly so, that when a public hearing
is held on a fact that is already accompli..sh.ed the inp.tu generally
amounts to very little..--The. Board is in agreement and will .work
towards that end, that when a firm is selected Supervisor Homan will
request a meeting be held with proper Southold Town residents prior
to the in depth.. study.
Supervisor Homan reported that the Board had a bri..ef meeting with.
Long Island Cab.l.evision Corporation. rep;res:enta.t.i.:ve today. ' They
wish to schedule a. .publit: hearing to amerid .their franchise. A
hearing date will be scheduled in the near future.'
Moved by Councilman Drum, seconded by Supervisor Homan,
WHEREAS Thomas Fox applied: to the 'Southold .Town Board .for a .permit
under the provisions of the Wetland Ordinance 'of the Town of
Southold, application dated May l,. 1979, and
WHEREAS, said application was referred to th.e: wouthold Town. Trustees
and Southold Town Conservation Advisory Council for their findings
and recommendations, and
WHEREAS; a public hearing was held by the 'Town .Board with respect
to said application on the. 10th day of-July 1979, at which tiem.
all interested persons were given an opportunity to be heard,
NOW, THEREFORE BE IT RESOLVED that Thomas F6x,. 3.65 Freeman Road,

the. Wetland Ordinance of the Town of Southold to fill in the back-

Supervisor Homan stated that Item 2 under resolutions: on the agenda
has been deleted:.... He thought he needed a change .in wording to
property spend money that is in rev enue 'sharing. He has been adivsed
by Town Attorney Tasker and the accountant that it.:.is not necessary
to have a resolution. Cons.i.derable''money has been spent on some 'of
the grants and the money' to pay for the grants domes out of revenue.

RESOLVED that the application`"`of''Edmond B'okina dated July 25 , - 1979
for a trailer renewal on the property of Aldrich Lane Realty, rear
of a storage building on a right-of-way. off the north side of
Main Road, Laurel, New York be and hereby is granted for a six
month period.

to the Town Clerk for a Bingo License, and
WHEREAS, the Town Board has examined the application, and after
investigation, duly made findings and determinations as required
by law, and it is . further.
RESOLVED that the ' Town Clerk be and she hereby is directed to issue
a Bingo License to Sacred Heart R.C. Church, Cutchogue, New York.

Moved by Councilman Drum, seconded by Councilman Nickles,
WHEREAS, Martin Weglicki has made application to the Town Board of
the Town of Southold to dedicate certain roads in Laurel, New York,
to be known as _"JLaurelwobd Drive" ; '-_Heather Place' , "Woodside Lane"
and' 6 - 25 ft. by 10 ft. parcels at end of adjacent streets as shown on
subdivision__map entitled "Laurelwood Estates" , situate at Laurel,
Town of Southold, Suffolk County, New York" , filed in the Office of
the Clerk of Suffolk County on May 17, 1971 as File #5595, together
with the release executed by the owner thereof, and
WHEREAS, the Southold Town Highway Superintendent has inspected
the said highways and has advised the Town Board that said proposed '
highways comply in all respects with the specifications for the
dedication of highways in the Town of Southold,
NOW, THEREFORE, BE IT RESOLVED that in accordance with Section 171
of the Highway Law of the State of New York, consent be and the same
is given to the Superintendent )of Highways ' to make an order laying
out the aforesaid highway, to consist of lands described in said
application as shown on certain maps attached to said application, and

Supervisor Homan explained that the $6, 162. 4.4 to Adult Recreation
was to pay for the chairs and tables for the Senior Citizen/Youth
Center.
On motion of Councilman Nickles, seconded by Councilman Drum, it was
RESOLVED that the Supervisor be and he hereby is authorized to pay
to Roland' s Electric the sum of $2 , 410. 00 from EDA, funds for work
on the Southold Town Hall Addition.

On motion of Justice Doyen, seconded by Councilman Drum, it was
RESOLVED that the Board of Commissioners of the Fishers Island
Ferry District be and hereby are authorized to advertise for bids
for drydocking for periodic inspection, necessary repairs and re-
furbishing of .the M/V Olinda' s underwater body.

Councilman Drum, Justice doyen, Supervisor Homan.

On motion of Justice Doyen, seconded by Coucilman Nickles, it was
RESOLVED that the Board of Commissioners of the Fishers Island Ferry
District be and hereby are authorized to advertise for bids for the
installation of a holding tank for the containment of effluents- on
the M/V Olinda.
Vote of the Town Board: Ayes: Councilman Nickles, Councilman Pell,
Councilman Drum, Justice Doyen, Supervisor Homan.
This resolution was declared duly adopted.
On motion of Justice Doyen, seconded by Councilman Pell, it was
RESOLVED that the Board of Commissioners of the Fishers Island Ferry
District be and hereby are authorized to advertise for bids for a
second radar as a backup system on the M/V Olinda.

Councilman Drum, Justice Doyen, Supervisor Homan.
This resolution was declared duly adopted.
On motion of Councilman Pell, seconded by Councilman Drum, it was
RESOLVED that the Town Board of the Town of Southold hereby engages
the services of Elaine F. Kaldor, C.P.A. , P.C. , to audit the books
and .records of the Town' of Southold for the year ended December 31,
1979 for a fee of $2, 200. 00; said audit to be conducted in conformity
with generally accepted auditing standards and rules and regulations
as set forth by the State of New York.
Vote of the Town Board: Ayes: Councilman Nickles, Councilman Pell,
Councilman Drum, Justice Doyen, Supervisor Homan.
This resolution was declared duly adopted.
(.Councilman Pell noted that the fee of Elaine F. Kaldor, C.P.A.
P.C. is $200. 00 higher than last year. )
On motion of Councilman Drum, seconded by :8upervisor Homan, it was
RESOLVED that Frederick J:' Tedeschi be and he hereby is appointed
Town Justice effective August 8, 1979 to fill the unexpired term
of Martin Suter until December 31, 1979 .
Vote of the Town Board: Ayes: Councilman Nickles, Councilman Drum,
Justice Doyen, Supervisor Homan. No: Councilman Pell.
This resolution was declared duly adopted.
On motion of Councilman Nickles, seconded by Councilman Drum, ;it was
RESOLVED that Cynthia Kaminsky be and she hereby is appointed Town
Trustee effective August 8, 1979 to fill the unexpired term of
John J. Nickles until December 31, 1979.

Justice Doyen, Supervisor Homan. No. : Councilman Pell.

(Councilman Pell thanked the Board. These appointments .were discussed
with the Board during the working session. He 'voted 'ono" because
he does not believe condidates seeking office at this time should be.
appointed to the office they are seeking. )
Supervisor Homan stated there is an additional vacancy on the
Planning Board. The appointments will be held- until the next meeting
the Town Board holds in Southold.
Mrs. Gladys Csajko, Greenport asked what item I11 (.10. on the agenda,
Resume of William.-LB. Smith is about?--Supervisor Homan stated that Mr.
Smith informed him that he had submitted a resume for the Planning
Board to Supervisor Martocchia and inas much. as the Board said they
would not accept resumes after the 'last meeting but they would
reactivate any that had been submitted prior, ' they did, at Mr.
Smith.1s request reactivate his resume and it is on file with the.
Board members for their consideration when they do make the. '
selection for the Planning Board.
Mts. Csajko asked about Item I.V., (.2) on the agenda, date for public
hearing re: wetland application of Thomas & Jacqueline, Occhiogrosso.-
Supervisor Homan stated that the date has already been set for a
, public hearing on August 21st but was put on the agenda by error.
Mrs. Csajko asked if it would be 'possible to. explain transfers before
voting . on then?- -$upervisor Homan explained that traffic. control
basically has to do rrith: the blinker lights and perhaps one or two

Traffic lights which the Town owns and require maintenance from
time to time. The amount in�'tfie, budget was basically for bulbs
but occasionally the Town has to call Broadway Maintenance out to
repair the controls. Town employees have worked with them so
hopefully if.::::there is a problem in the future _Town employees can
correct the problsm- -----Examining Board has to do with the necessary
funds for the Board of Assessment Review and apparently there was
not enough money in the budget for the time spent and additional
expenses.---Adult Recreation refers to the chairs and tables for
the Senior/Citizen/Youth Center which were bought under the State
Contract by Mr. Martocchia.---Environmental Control and Disposal
Area all has to do with the actual operation of the Disposal Area.
A machine broke down there and it is costing $4, 50040 a month to
rent a replacement while the Town machine is being repaired. The
budget at the beginning of the year was marginal and we have begun
funding these studies and then the various problems and the various
mandates the Town has had to comply with for the State,the Disposal
Area is a budget the Town is going to be in trouble with the
public will see it on there evert month.
Mrs. Csajko asked about the use of Broadway Maintenance for repair
of lighting equipment. She said Broadway Maintenance has a very bad
reputation in the City.---Supervisor Homan said he is not even sure
it is Broadway Maintenance that they call. ---Highway Superintendent
Dean said the Town calls Comstock, not Broadway Maintenance.
Miss Jody Adams, Peconic asked what machine is broken down at the
Disposal Area?---Highway Superintendent Dean said it is the payloader.
Mr. Smauel Markel, Southold asked how soon the individuals are
notified whether their application on Grievance Day is approved
on denied?---Mr. William Weinheimer a member of the Board of Assess-
ment Review said the notices would go out before the end of August.
Miss Jody Adams asked where Justice Tedeschi will have his office?--
Supervisor Homan sakd he does not know whether he will use the
recently vacated office of Martin Suter or he will set up in his own
office. Miss Adams asked about Justice Suter' s secretarial help. ----
Supervisor Homan said that he assumes when they get finished clearing
up former Justice Suter' s papers his secretarial help will either be
dismissed of will be used by Justice Tedeschi.--Miss Adams asked when
Justice Tedeschi will officially take office?---Supervisor Homan said
that as soon as he is sworn in and the affidavit is filed with the
County Clerk. He will have to resign ,as' Village Justice before he
can be sworn in as. Town Justice. After he is sworn as Town Justice
he can them take the position of Acting Village Justice, as Justice
Suter was when he was Town Justice for Southold Town.
On motion of Councilman Nickles, seconded by Councilman Drum, it was
RESOLVED that there being no further business to come before this
Town Board meeting adjournment be called at 8 :20P.M.
Vote of the Town Board: Ayes : Councilman Nickles, Councilman Pell,
Councilman't-.:Drum, Justice Doyen, Supervisor Homan.
This resolution was declared duly adopted.
