SOUTHOLD TOWN BOARD MINUTES
Meeting of March 6, 1973
The Southold Town Board met at the office of Supervisor Albert M.
Martocchia, 16 South Street, Greenport, New York, at 3: 00 P.M. ,
Tuesday, March 6, 1973 , with the following present:
Supervisor Albert M. Martocchia, Councilman James H.
Rich, Jr. , Councilman James F. Homan, Justice Martin
Suter, Justice Louis M. Demarest, Town Attorney Robert
W. Tasker, Superintendent of Highways Raymond C. Dean,
and Town Clerk Albert W. Richmond.
Absent: Justice Francis T. Doyen.
Moved by Justice Suter, seconded by Justice Demarest, it was
RESOLVED that the minutes of February 27 , 1973 be and they
hereby are approved.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman Homan, seconded by Justice Suter, it was .
RESOLVED that the next meeting. of the Southold Town Board will be
held at 10:45 A.M. , Tuesday, March 13, 1973 , for the audit of bills,
at the office of Supervisor Martocchia , 16 South Street, Greenport,
New York.
Vote of the Town Board: Ayes: Supervisor Martocchia , Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman Homan, seconded by Justice Demarest, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3: 00 P .M. , Tuesday, March 27 , 1973 at the office
of Supervisor Martocchia , 16 South Street, Greenport, New York.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Suter , seconded by Councilman Rich, it was
RESOLVED that the reports of Supervisor Martocchia, Building
Inspector Terry, Justice Suter, and Town Clerk Richmond be and
they hereby are accepted by the Town Board and placed on file.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman Homan, seconded by Councilman Rich,
WHEREAS Robert D. Halikias by petition dated October 20, 1972,
petitioned the Town Board for a change of zone on certain property
situated at Cutchogue, New York, from "A" Residential and
Agricultural District to "B" Light Business District, and
WHEREAS the said petition was referred to the Southold Town
Planning Board forofficia 1 recommendation and report, and
WHEREAS the Town Board, pursuant to due notice,held a public
hearing thereon on the 13th day of February 1973 at 8: 00 P.M. ,
at which time all interested persons were given an opportunity
to be heard,
NOW, THEREFORE, BE IT RESOLVED that the relief demanded in said
petition be and the same is in all respects Denied.

Moved by Councilman Homan, seconded by Justice Demarest,
WHEREAS Russell A. Stassen has requested the Town Board to reconsider
their decision on his wetland apL3lication, and
WHEREAS the Town Board on -e�r—�-, 1972 granted Mr. Stassen a
wetland permit on the following conditions:
"A.-That the Town Clerk shall withhold .the .issu.ance of such
permit until applicant has. removed the .fill-, recently placed
on said wetlands . ;
B. -That the approval of the permit herein and the construction
proposed by applicant shall be subject to any and ,all rights
which other prope,rty,_'owners_ in the . vicinity may have in, on
or over the premises in question. "
WHEREAS Russell Stassen has not fulfilled those conditions,
NOW, THEREFORE, BE IT RESOLVED that the Southold Town Board firmly
holds to their decision of..Nia- _ , 1972 .

WHEREAS Edmund Bokina applied to the Town Board for a single
trailer permit for farm labor , application dated March 5, 1973 ,
NOW, THEREFORE, BE IT RESOLVED that the application of Edmund
Bokina to locate a single trailer on leased, land on the Main
Road, Laurel , New York, for housing farm labor be and hereby is
granted for a period beginning June 1, 1973 through November 1,
1973 , subject to the approval of. the Board of Appeals under -
Section 300, Subsection B, 8 (a) .

RESOLVED that the Town Clerk be and he hereby is instructed,, to
request the Long Is land Lighting Company to:. remove .the present
light. and install ;a 175 MV light- on the corner.",of Main Road.,and
Champlin-,Place,,.Greenport, Ndw. York". ,- - (NYTel. -Pole._#$"877,5)

Moved by Councilman Rich, seconded by Councilman Homan,
._WHEREAS the Southold American Legion, Griswold-Terry,-Glover Post
applied to the Town Clerk for a Bingo License ,, and
WHEREAS the Town Board has examined the application, - and after
investigation, duly made findings and determinations_as .required
by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor .be and he
hereby is author ized. and directed to execute .on beha lf . of the
Town Board, the findings and determinations required by law, and
it is further
RESOLVED that the Town Clerk be and he hereby is directed to
issue a Bingo License to the Southold"American" Legion, Griswold-
Terry9Glover Post.

Mrs. Jean" Tiedke, President .of. the League of Women :Voters of
Riverhead , read the following letter to the Board:
"To Mr. Martocchia and Members of the Town Board: , The .
League of Women Voters is pleased. that. Town officials are revising
the Zoning .,Ordinance. We support the concepts stated on behalf of
the North Fork Environmental Council, Inc. by. their .Zoning Reform
Committee and would like to stress certain points.
1. - A detailed environmental impact statement should .be_.
required from every applicant for site development. Such , .
ra statement should cover the plan,_s relationship ,to the
Town Development Plan. and the .Bi-County Development Plan
and other' items including but. not limited to: ,
Open space provision (whether private, Association
owned, or deeded to the Town. )
Pond and wetlands protection (both salt and fresh)
Extent of dredging , filling ,or leveling

Traffic patterns
Water tests
Effect on Town services , including schools
Provision for leaching fields and dry well`s for water
recharge.
Underground utility wiring
General environmental and architectural consistency
with the area'.
We believe tha"tthe Town Advisory Council should consider _
and comment on such an impact statement and that the impact
statement and comments should-be .part of the Preliminary
Public Hearing held by the Planning Board.
2. Moderate and low-income housing should be continuously
provided for. Although there are building lots now available
in �4- and 2 acre size, we believe that future developments
should apportion a percentage _of the acreage for moderate
and low income, ownership while maintaining the over-all
density requirement .
We would encourage a limited use of mixed housing in a
devetlopment particularly, near existing hamlets . . A percentage
of the allowable units to .be built in the form of multiple
dwellings woul'd''help to provide much-needed choice, particularly
for the young or elderly who want a pleasant environment with-
too much property to take:care of and witYiiH walking distance
of a business center. Therefore, higher density development
should be located close to existing population centers . Lower
density development should be located in more remote- areas .
3 . The' question-of water supply is. increasingly serious. 46
urge ' the 'Tbwn` Board to have the ".P"irnie Report up-dated.
4. Cluster zoning should not only. be permitted but encouraged.
5. Health Department' Approal: ^ Prior approval must be 'required
. before any building is commenced.
The league offers some additional suggestions for"zoning
reform for your consideration.
1. Performance bonds: At present, performance bonds cover
roads and drainage. They can and should be required for
such items- as the following:
preservation of natural drainage patterns, trees over
a certain size, woodlands, pofds , ravines , natural under-
growth where it is important for erosion control and/or
natural recharge.
2 2.. Set-back for bluff sites: Buildings erected on a bluff
or bank should be required "to have a sizeable " set-back
from the edge to avoid erosion damage.
3. Set-back from high-water mark: Requirements for set-backs
from high water mark should be at least as strict as set-
back from streets .
The League of Women Voters is aware that the Town Board and-Town
Planning Board are implementing many of the concepts of the Town 's
Development Plan. In order to allow time to study and further refine
present zoning regulations we suggest a planned postponement on new
developments . waaould "be advantageous at this time. Also, there are
many people` in 'this_ Town whou�, o�ufLd' be available for"'discussion with
Town officials , and whose expertise should be tapped.

Moved by Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that giperintendent of Public Works Raymond C. Dean be
and he hereby is authorized to sign the'`'following agreement between
the Southold Fire District and the Town. of Southold, and drawnup •
by Town Attorney Tasker:
THIS AGREEMENT made this day of March, -1973 , of the SOUTHOLD FIRE
DISTRICT, a fire district of the State of New York, having its
office and principal place of business at Main Road, Southold, New
York, hereinafter called the District, and the TOWN OF SOUTHOLD, a mu-
municipal corporation of the State of New York, having its office
and principal place of business at 16 South Street, Greenport, New
York, hereinafter called the Town.
WHEREAS, the District has recently acquired a parcel of land lying
immediately east of other. District property on the' north side of Main
Road, Southold ' New York, ` upon which there is presently erected a
two story wood fram dwelling `hou's'e-;`� and
WHEREAS, the District wishes to= remove said dwelling house from
said property, in order to devote said property to District uses , and
WHEREAS, the District wishes to have the Town Department of Public
Works perform the necessary work to' razessaid dwelling house and
remove the debris from said premises , and
WHEREAS, the Town is willing to perform said services for the
District in accordance with the terms and conditions hereinafter
set-forth:
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. That the Town does hereby agree to per-form all work
required for the destruction and removal of said dwelling from the
premises of the District including the filling of the cellar to
ground level. and
2 . The District hereby agrees to* pay/the Town hereby agrees
to receive for the prformance of said work the sum of ONE THOUSAND
FIVE HUNDRED and No/100 ($1, 500.00) DOLLARS which said sum is to
be paid by the District to the Town upon the completion of all work
provided for- Ym rein.
3. The District ,does hereby. lagree' to procure- and keep in
force during the term- of- this agreement public liability policies
of insurance naming both the 'District- and the. Town of Southold as
named insureds which-said policies shall be in the limits of not
less than $100; 000/$300, 000 bodily inJury and $50, 000- property damage.
IN WITNESS WHEREOF, the parties hereto have set their hands
and seals the day and year first abbiib written.
