Meeting of February 11, 197.3
The Southold Town Board met at .the office of Supervisor Albert .M.
Martocchia., 16 South Street, Greenport, New York, at 3 :0.0; P.M. ,
Tuesday, February 13 , ,1973, with the following present: -
Supervisor Albert M. Martocchia;' Councilman James -H.
Rich, Jr. , Councilman- James F, Homan, Justice Martin .
Suter, Justice Louis, M. ;Demarest,. Town Attorney Robert
W:. Tasker, Superintendent Raymond C. Dean, and Town
Clerk Albert W. Richmond. .
Absent: Justice Francis T. Doyen. .
Moved by Justice Suter, -seconded, by .Councilman Homan, it was
RESOLVED that the minutes of January 23 , 1973 be and they hereby
are approved.

Moved by Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that the next meeting of the Southold Town Board will be
held at 3 :00 -P.M. ; Tuesday, February 27 , 1973: at the office of
Supervisor Martocchia, 16 South Street, Greenport, New -York.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman Rich, seconded by Justice Suter, it was
RESOLVED that the repotts of the Supervisor, Building Inspector,
Police, Planning Board, Fishers Island Ferry District, Justice
Suter and Town Clerk for the month of January 1973 be accepted by
the Town Board and placed on file.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Suter, seconded by Councilman Homan,
WHEREAS the Cutchogue Fire Department requests a release on the
District parking lot, under lease of the Town of Southold, for
two dates, July 21, 1973 for the annual parade and drill, and
August 25 , 1973 for the annual chicken bar-b-cue,
NOW, THEREFORE, BE IT RESOLVED that the Cutchogue Fire Department
be granted said request.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman Rich, seconded by Justice Suter, it was
RESOLVED that the Town Clerk be and he hereby is directed to
request the Long Island Lighting Company to install four 100 CP
lights, one on Colony Road and three on Bayview Avenue, as per
a sketch to be sent to the Lighting Company.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Councilman Homan,
WHEREAS by a resolution duly adopted by the Southold Town Board
on December 27 , 1972, the Building Zone Ordinance was amended, and
WHEREAS it appears that inadvertently one distance was incorrectly
stated as being "280 feet, more or less ", instead of "680 feet,
more or less ", and
WHEREAS, the intent of the Board was obvious, since the be4inning
of the line was described as being at the ordinary high water_?line
of Gardiner ' s Bay at the southeasterly corner of the B-1 General

Business Zone, and the end of the line was described as the southerly
line of the Main Road at the point or place of beginning (which was
described as the northeast corner of said Zone) , and
WHEREAS, the inadvertent substitution of "280" for' the figure given
by the survey, "680 " has prompted an inquiry of the Town Attorney
who expressed it as his opinion that the Zone was to- be considered
as being bound as though the correct figure for the length of the
particular line had been used, i.e. 680 feet; and
WHEREAS the Board supports counsel ' s opinion and wishes to ratify
its original ,intent,
NOW, THEREFORE, IT IS RESOLVED that the .Zoning Amendment Resolution
duly adopted December 27 , 1972, be deemed to have been adopted to
read as set forth below and that all notices, publications and
proceedings had in connection therewith be similarly _deemed to have
been given, published and had as though the description at all times
read as set forth below, to wit:
WHEREAS the Southold Town Board on its own motion
proposed a change of zone from "A" Residential and
Agricultural District to "B-1" General Business District
on certain property situated at Orient, New York, and
WHEREAS the said petition was referred to the Southold
Town Planning Board for official recommendation and
report, and
WHEREAS the Town Board, pursuant to due notice, held
a public hearing thereon on the 19th day of December,
1972, at 3 :30 P.M. , at which time all interested persons
were given an opportuiUj�y to be heard,
NOW, THEREFORE, be it
RESOLVED that the Building Zone Ordinance of the Town
of Southold, including the Building 'Zone Maps be amended
by the Southold Town Board on its own motion by changing
from "A" Residential and Agricultural District to "B-1" .
General Business District, the following described property
at Orient Point:
BEGINNING at a point on the southerly line of Ma:h Road
(Route 25) at the northeasterly corner of .the existing B-1
General Business Zone, from said point of beginning
running thence along the southerly line of Main Road,
North 76 degrees 26 minutes 40 seconds East 93. 64 feet
to a concrete monument of land now or formerly of Pappas;•'
running thence along land last mentioredthe following
five courses and distances , to wit:
(1) North 26 degrees 33 minutes 20 seconds West, 13 .48
feet; thence
(2) North 75 degrees 55 minutes 40 seconds East, 95 . 69
feet; thence
(3) South 13 degrees 49 minutes 10 seconds East, 14. 0
feet; thence
(4) North 76 degrees 26 minutes 40 seconds East, 68. 0
feet to land of Latham; thence
(5) Along land last mentioned South 19 degrees 58 minutes
40 seconds East, 575 feet, more or less, to the ordinary
high water mark of Gardiners Bay; thence in a southwesterly
direction along said ordinary high water mark of Gar diner ' s
Bay, 190 feet, more or less to said existing B-1 General
Business Zone; thence along said B-1 General Business Zone,
North 26 degrees 45 minutes 50 seconds West, 680 feet,
more or less to the said southerly line of Main Road and
the point or place of beginning.
and it is further
RESOLVED that the physical amendment of .the official Zoning
Map in accordance with the foregoing is hereby ratified and approved.

WHEREAS Lawrence T. Waitz, Cutchogue, New York has been a faithful
and conscientious employee of the Town of Southold since May 15, 1968,
and

WHEREAS Lawrence T. 'Waitz has been Town Historian and has diligently
and faithfully performed the duties in connection with this position,
NOW, THEREFORE, BE IT RESOLVED that it is with deep regret that the
Town Board of the Town of Southold accept the resignation' of Lawrence
T. Waitz effective February 1, 1973 , and be it further
RESOLVED that a copy of this resolution be forwarded to Lawrence
T. Waitz and a copy be recorded in the minutes of the meeting of
the Town Board:

Moved by Councilman Homan, seconded by Justice Suter; it was
RESOLVED that Bond No. 73-S-12139 BCA issued by the Aetna Casualty
and Surety Company in the name of Otis Horn, Town Constable, Town
of- Southold in the amount of $4, 000.00 be and the same is hereby
approved as to its form, manner of execution and sufficiency of '
sureties therein.

Moved by Justice Suter, seconded by Justice Demarest,
WHEREAS the Senior Citizens , Mattituck, New York, request the
use of a bus for transportation to Longwood Gardens, Pennsylvania
on June 14, 1973 ,
NOW, THEREFORE, BE IT RESOLVED that the Town of Southold furnish
said transportation to the Senior Citizens , Mattituck, New York
at a cost not to exeeed $350.00.

At 3 :00 P.M. , February 9, 1973 , in accordance with notice published
according to law, bids were opened for five (5) new 1973 special
police cars, and trade-in of five (5) presently owned police cars,
less special equipment on said cars . Three bids were submitted:

(no certified check accompanied the bid, therefore

Moved by Justice Demarest, seconded .by Councilman Rich,
WHEREAS the Board reported that the lowest responsible bidder to
meet specifications was submitted by Greenport Ford-Mercury,
Greenport, New York, now, therefore, be it
RESOLVED that Albert Martocchia, Supervisor, be and he hereby
is directed to enter into a contract with Greenport Ford-Mercury
for the purchase of five (5) police cars as advertised in the bid,
for use by the Southold Town Police Department, at a cost of
$15, 849. 98.

At 2 :00 P .M. , February 9, 1973 , in accordance with notice published
according to law, bids were opened for one (1) new 1973 1/2 ton
pick-up, two wheel drive or equal. Three bids were submitted:

O'Keefe Chevrolet----------------$2 , 690.00
Tryac Truck & Equipment----------$2 , 894.45
(all prices delivered, including box covered with windows)

WHEREAS the Board reported that the lowest reponsible bidder on
the 1/2 ton pick-up was submitted by O' Keefe Chevrolet, now,
therefore, be it
RESOLVED that Albert Martocchia be and he hereby is directed to
enter into a contract with O'Keefe Chevrolet for the purchase of
one (1) 1/2 ton pick-up as advertised inthe bid for use by the
Southold Town Dog Warden, at a cost of $2, 690. 00 .

WHEREAS two bids were received for repowering the Mystic Isle, as
advertised according to law, as follows :
Newport Ship Yard, Inc. ----------------------$54, 200. 00
Thames Shipyard & Repair Company-------------$47 , 612 . 63
NOW, THEREFORE, BE IT RESOLVED that the Southold Town Board
approves the action of the Fishers Island Ferry District in
accepting the bid of Thames Shipyard & Repair Company at
$47 , 612. 63 for repower the Mystic Isle.

Ribh, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Councilman Homan, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to sign a contract with Frederick P. Weidersum Associates ,
architects for a new Town Hall.

Moved by Justice Suter, seconded by Councilman Homan,
WHEREAS Sherley Kate withdrew her appointment by the Southold Town
Board to CAST, and .
WHEREAS the Town Board asked Sherley Katz to reconsider her with-
drawal,
NOW, THEREFORE, BE IT RESOLVED that Sherley Katz -be reappointed
to represent the Town of Southold in CAST.

Moved by Councilman Rich, seconded by Justice Suter, it was
RESOLVED. that _the _Southold Town Board .approves the action of the
Fishers Island Ferry District relative to engaging . Ione Norton
as a clerk at the rate of $3 . 00 per hour and to work a maximum of
four hours per day, five days a wehk with a maximum earnings ndt
to exceed $2, 500 per year. Appointment effective February 5, 1973.

WHEREAS the Knights of Columbus , Marian Council #3852 , Cutchogue,
New York applied to. the Town Clerk for a Bingo License, and
WHEREAS, the Town Board has examined the application and after
investigation, duly .made findings and determinations as required
by... law, -
NOW, THEREFORE, BE IT RESOLVED_that .the .Supervisor be -and he
hereby-is authorized and directed to execute .on .behalf of the
Town Board, the findings and .determinations as required by law,
and it is further
RESOLVED that the Town Clerk be and he hereby is directe d to
issue a Bingo License to the Knights of Columbus, Marian Council

#3852, Cutchogue, New York.

WHEREAS a petition was received from Edward Gilles, Box 393 ,
Sound Avenue, Mattituck, New York, requesting a change 'of zone
on certain property at Mattituck, said petition for a change� of
zone from "A" Residential and Agricultural District to "C" Light
Industrial District, now, therefore, be it
RESOLVED that the Town Clerk of the Town of Southold be and he
hereby is directed to transmit this application to the Planning
Board in accordance with Article XVI, Section 1600 of the
Building Zone Ordinance of the Town of Southold.

Moved by Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the Supebintendent of Highways of the Town of
Southold be authorized to advertise for bids and to purchase from
the lowest responsible bidder, the following:
Item 1. - One New 1973 Mobil Sweeper, Mode TE 4 (or equal)
with the trade-in allowance on a 1967 Mobil Sweeper.
Item 2 : - One New Mobil Sweeper, 1973 , Motel TE 4 - (or equal)
without any trade-in.

WHEREAS Stanley and Helen Staron have applied for a renewal of
the former John Klein trailer permit, application dated February
15, 1973, location of the property - private road off east - side
Main Road, Mattituck, New York,
NOW, THEREFORE, BE IT RESOLVED that the application of Stanley and
Helen Staron to locate a single trailer on the property of John
Klein, private road off east side Main Road, Mattituck, New York,
be granted for a period of six (6) months.

WHEREAS W. Edgar Worthington applied to the Town Board for a single
trailer renewal permit dated January 15, 1973,
NOW, THEREFORE, BE IT RESOLVED that the application of W. Edgar
Worthington to locate a single trailer on his property at the
south side of Sound Avenue, Mattituck, New York, be and hereby is
granted for a period of six (6) months.

An application for a tempprary trailer permit was received from
Edmund Bokina, requesting permission to locate a single trailer,
on the property of Edward Buchak, . Main Road, Laurel. The -applica-
tion was held for study.
A delegation was present to discuss, pro and con, the renaming of
Skunk Lane back to Bay Avenue in Cutch.ogue, New York. Mr. Winston
Davids asked the Board if they had made a decision on said road.
Mr. Martocchia stated that the Board had, and that the resolution
of September 12 , 1972 changing the name of Bay Avenue to Skunk
Lane would stand. The Board had studied the petitions and letters
from residents, as well as the Cutchogue Fire Department and ,
Cutchogue-New Suffolk Historical Society Directors and are holding
to their decision of September 12, 1972 .
There was a discussion between Joseph Sullivan and Supervisor
Martocchia relative to the appoitrtment of Sherley Katz to CAST.
Mr. Robert Witherspoon brought up the ,subject of the Southold
school, and he was informed it did not come under the jurisdiction
of the' Southold Town Board.
Moved by. Justice Demarest, seconded by Justice Suter, it was
RESOLVED that a recess be called from 4 :00 P.M. to 9 :00 P.M.

The meeting reconvened at 9 :00 P.M.
Moved by Justice Suter, seconded by Councilman Homan, it was
RESOLVED that Supervisor Martocchia be and he hereby is. authorized
to permit the withdrawal of accrued interest on Southold Savings
Bank .Passbook No. 51223 in the names of Genevieve T. Daly and
Katheryne D. Hoey. . .Passbook being. held as a bond for roads and
improvements on the subdivision known as "Town Harbor Terrace. "

Moved by Councilman Rich, seconded by Justice Suter,
WHEREAS Henry F. .Praus applied to the Southold Town Board fora
permit under the provisions of. the Wetland Ordinance of the
Town of Southold, application dated November 30 , 1971, and
WHEREAS a public hearing was held on said application on June 6,
1972 at 7 :30 R.M. and published according to law, and
WHEREAS after said public hearing, and due deliberation, the Southold
Town Board on June 20.,. 1972 .denied the application of Henry F. Praus
to .f.ill wetlands under the provisions of the Wetland Ordinanee, and
WHEREAS the Southold Town Board, . on a court order, held axe-hearing
on said Henry F. Praus application on January 23 , 1973 at 7 :30 P.M. ,
now, therefore, be it
RESOLVED that the application of Henry F. Praus for a permit under
the- provisions , of .the Wetland. Ordinance be granted.

Supervisor Martocchia declared the resolution defeated.
Moved by Justice Suter, seconded by Councilman Homan, it was
RESOLVED that General Bills in the amount, of .$24, 979. 11, Fishers
Island Ferry District bills in the amount of . $23 ,444.59, Highway
bi_1.1s.._in the_ amount of $13 ,287 . 18, and Special District bills' in
the amount of $38, 559. 19.. be .and the. same are hereby ordered paid.
