RESOLVED- that- the -minutes of the regular meeting of ,the •Southold
Town Board held December 19, 1972 , and the minutes of the special
meeting- of the -Southold Town Board-held -December 27•, 1972, be
hereby approved.

WHEREAS Town- Justice E. Perry 'Edwards has submitted his- resignation
to the Town Clerk effective December 31, 1972 , and
WHEREAS E. Perry Edwards has faithfully served- the -Town. of Southold
as Justice of the Peace -s-ince June 16, 1951, 'and
WHEREAS his- record of fine service to the Town of Southold and -its
people deserves the sincere gratitude of those with whom and for
whom he worked,
NOW, THEREFORE, BE IT RESOLVED that the Town Board accepts the
resignation of E. Perry Edwards with deepest regret, and expresses
its appreciation to him for his long record of fine service, and its
best wishes for the years ahead, and
BE IT FURTHER RESOLVED that this resolution be made a part . of the
permanent records of the Town, -and that a copy be sent to E. Perry
Edwards.

RESOLVED that the Town Board accepts the resignation of Dr. Barry
H. Hellman, a faithful, member of the Southold Town Narcotic Guidance
Council since March 23 , 1971.

RESOLVED that Francis T. Doyen, Fishers Island, New York, be
appointed Town Justice to serve in that capacity until the next
general election in November 1973 .

RESOLVED that Otis Horn be appointed Town Constable on Fishers

RESOLVED that the Town Board set 7 :30 P.M. ; Tuesday;--January 23,
1973 , Supervisor ' s Office; 16 South Street, Greenport, New York
as time and place for hearing upon application of Henry F. Praus
for a permit under the provisions of the Wetlands Ordinance of the
Town of Southold for the purpose of placing fill on premises- of
said Henry F. Praus located in Cutchogue, Lot 29 and part of Lot
30 at Nassau Point, known and designated as "Fishermarls Beach" ,
subdivision map of "Peconic Bay Properties, -Inc. "

RESOLVED that the Town Board of the Town of Southold approves the
following proposal to amend Sections 4 and 7 of the act governing
the affairs of the Fishers Island Ferry -District: -
"An Act to amend chapter six hundred ninety-nine of the laws of
nineteen hundred -forty-seven entitled -"An -Act -author-izing
the acquisition, construction, equipment and operation of a
public ferry for hire from Fishers Island -across waters of
Long Island Sound; authorizin g the creation of Fishers Island
Ferry District in-the- Town of -Southo.ld,- Suf-fol-k County and
providing for the election of its officers and management of
its affairs; authorizing the collection of ferriage charges;
authorizing -the -issuance and -sale of obligations of said- Town
and providing for their payment; authorizing the levy and
collection of- taxes; and providing for other- related matters, "
in relation to payment of acquisition and equipment of ferries
for said district and'-comperisation of commissioners.
The People -of the -Stateof- New -York, represented in Senate and Assembly,
do enact as follows :
Sect-ion 1. Section four of chapter six hundred ninety-nine
of the laws of nineteen hundred forty-seven entitled -"An Act -
authorizing the acquisition, construction, equipment and operation
of -a -public ferry for hire from -Fishers Island across -waters -of
Long Island' sound; -authorizing the, creation of ;Fishers -Island ferry
district- in -the Town of- Southold, Suffolk County and providing for
the election of its officers and management of its affairs;
authorizing- the -collection of ferriage •charges;-- authorizing- the-
issuance and sale' of obligations- of -said town and -providing for
their payment; authorizing the levy and ,collection of taxes; and
providing for other -related matters"is hereby amended to read as
fol lows:.
"S 4.- The cost of acquisition,- construction and equipment of
the ferry, including lands and- rights - or- easements in lands, shall
be paid from taxes levied, for'-the fiscal year in which such expenditure
is-made; from surplus funds, orfrom the- proceeds of town'- obligations
to be issued and , sold in the- manner provided by the- local finance
law-. '--The town board of the Town'-of Southold• may borrow the amount
needed for such purposes and issue town obligations therefor in an
aggregate principal amount not exceeding - (-one) three hundred thousand
dollars. Upon the adoption of a resolution by the town board, subject
to a permissive referendum by the owners of taxable real property
situate within the ferry district as shown by the latest completed
assessment roll of said town, such aggregate principal amount, wh1bh
the town board may borrow and .for which obligations may be issued
may be increased to any amount up to but not exceeding the sum of
(two) five hundred thousand dollars.

S 7 . The annual meeting for the election of commissioners shall
be held on the second .Tuesday in August. At the first annual election
one ferry commissioner shall be elected for a term of one year; one
for a term of two years, one for a term of three years, one . for_ a
term of four years and one ferry commissioner shall be elected for
a term of five years, to commence on the date of this election.
Successors to -.such. ferry commissioners shall be eleetdd for terms
of .five years each. The commissioners shall organize by the election
from their number of a 'chairman who shall preside at all meetings
Of' the board of commissioners. The commissioners shall meet monthly
on the second Tuesday -in each month for the transaction of the
business of .the district. . Special. meetings may be held at the
call of the chairman. Each commissioner shall receive for his
services the sum of (ten) twenty-five dollars for each meeting of
the board actually attended by him, provided that the aggretate
compensation which any such commissioner may receive for services
rendered during any year shall not exceed the sum of (three) five
hundred dollars. In addition thereto each commissioner shall receive
_ his expenses actually and necessarily incurred in the performance of
the .duties of his office. Such expenses shall be paid from the funds
of the ferry district after addit and approval by the town board.
S 3. This act shall take effect immediately.

RESOLVED that the Town Clerk be and he hereby is directed to request
the^ Long Island Lighting Company to install a 175 MV light on
Pole #3 , Griffin Avenue, .Cutchogue, New, York.

RESOLVED that the Southold Town Board accept passbooks in the
amount of, $55 , 000 as bond in connection with subdivision knower as
Petty' s Bite, :Orient, New York, as .previously approved by- the
Planning Board and Town Board.

Board of Housing Appeals for a term of three years,. effective

WHEREAS it is required by Section 27, Subdivision 1 of the,

appointed, and,,determine when the same shall be payable and that
the salaries of the members of the Town Board and elected Town
Clerk and an elected Superintendent' of Highways shall not be fixed
in an amount in excess of the amounts respectively specified in the
notice of hearing on the. preliminary budget published, pursuant
to Section 108 of the. Town Law,
