SOUTHOLD TOWN BOARD
December 26, 1978
Work Session
10: 45 A.M. -_ Mrs. Sherl_ey Kai . and Dorothy Faucon, ' along with
seven other individuals, appeared before the- Board representing
the Fanny Behlan Health Center, proposed for Greenport. Mrs. Katz
brought the Board up to date on the progress made toward building
this center. . They have received their federal grant, and have
building plans. The center will be staffed by eleven employees,
„including two doctors.
11: 30 A.M. - Mr. Vincent Wieczorek of the ,Southold Town Fire Chief' s
Louncil appeared before the Board at the invitation of Supervisor
Martocchia to discuss the proposed Fire Prevention Code. The Board
members were not prepared to. go into detail at this time and said
they felt a date should be set aside for a meeting with the Fire Chief' s
Council, The Town Board, and a representative of the State. .
11: 45 A.M. - Mr. David Spohn and Mr. John Duell met with the Board
to discuss various locations for -a Town Airport. Mr." Spohn showed
slides of various sites in the Town 'he feels might be suitable for
an airport.
2 : 30 P.M. - Mr. To Williams and Mr. George Proferes of the Suffolk
County Probation Departmen _ met with the Board to explain the,Youth
Community Conservation and .Improvement_ Project which is .presently
in operation in the Town. They assured the Board that this program
is not strictly for youth on probation, but any eligible youth from
16 years of age to under 20 years of age. There are presently
seven employed by the Southold Town Highway Department, two of
which have been on probation. They are paid by the Suffol County
Department of Labor and are under the supervision of a crew chief
also paid by the &'.C. Dept. of Labor. .
A regular meeting .of the Southold Town Board was held on Tuesday,
December 26, 1978 at the Southold Town Hall, Main Road, Southold,
New York. Supervisor Martocchia called the meeting to order at
3 : 00 P.M. with the following present:

RESOLVED that the following audited bills be and hereby are ordered
paid: General Fund Whole Town bills in the amount of $9 , 413. 92;
General Fund Part Town bills in the amount of $84. 77; Fishers Island
Ferry District bills in the amount of $21, 590. 45; and Highway Depart-
ment bills in the amount of $8, 458. 62.

Supervisor Martocchia asked Mr. Tom Williams and Mr. George Proferes
of the t to explain the Youth
kCommunity Conservation and Improvement Project (YCCIP,) There seemed
to be some misinformation in one 'of the newspapers stating that this
program is only for youth on probation. Mr. Proferes and Mr.
Williams explained that the program is to provide jobs for umemployed
youth ages 16 through 19 in the Town of Southold. The youth perform
a variety of work assignments. The youth will earn $3 . 01 per hour
for a th::rty-five hour week. There are ,presently seven youth employed
by the Southold Town Highway Department, two of which have been or
are on probation, and one adult supervising the operation. This is
a CETA VI Special Protect. These youth are also involved with the
<'BOCES on-the-job training. -program. °.They are currently negotiating
with BOCES to award high school credit of somewhere between one and
two credit hours to the youth who participate in this program if
they will take 45 minutes of schooling a week given at the job site
after work hours by a BOCES instructor. All the participants must
be Southold Town residents.

RESOLVED that the application of Maddie Miles dated December 16 , 1978
for permission to renew her trailer permit at private road off
of the north side Main Road, Mattituck, Newyork be and hereby is
granted for a six month period.

Moved by Councilman Homan, seconded by Justice Suter,
WHEREAS the Town Board of the Town of Southold, on behalf of the
residents of Southold Town wish to honor George L. Gaffga on this
day, January 6, 1979, the celebration of his diamond anniversary as
New York State' s oldest active fireman, and
QHEREAS, a great sense of pride is felt in the service of all volunteer
firemen in this township, it is with. true gratitude that we look to
George L. Gaffga for his- spirit and dedication to the safety of his
community for the past" 75- years,
NOW, THEREFORE,- BE IT RESOLVED, that the Town Board of the Town of
Southold hereby extends best wishes and congratulations to George L.
Gaffag on this happy occasion, the celebration of his diamond anniv-
ersary as New York State' s oldest acitve volunteer fireman.

recently announced that $1 million in state assistance is available to

for assistance in completing their., beach reservation project along
Leeton Drive.
On motion of Councilman pell, seconded by Justice Suter, it was
RESOLVED that pursuant to the provisions of Section 284 of the
Highway Law, the Southold Town Board Agrees that moneys levied and
,coIlecte or the-repair and improvement of highways, and received
'from the State for the repair and improvement of highways, shall be
expended as follows: General` Repairs - the sum of $589 , 500. 00 may
be expended for general repairs upon 177 . 71 miles to town highways,
including sluices, culverts and bridges haveing a span of less than
five feet and boardwalks or the renewals thereof.

RESOLVED that the Town of Southold enter into an agreement with
Telecom Equipment Corp. for full service and maintenance agreement
of telephone eq�ipment'; parts and-labor included, for one 'year
commencing Octok�er 30, 1978 at an annual fee of $744. 00

RESOLVED that the Town Board of the Town of Southold hereby,_ accepts
a bond in the amount of $35, 000. 00 to insure the completion of roads
and improvements in the subdivision known as. "Sea-.dire Estates"
owned by Theodore Dowd.

RESOLVED that the performance bond being held by the Town of
Southold to insure completion of roads and improvements in the
subdivision known as ".Orient-by-the-Seal SectionIII." in the amount .
of $97, 750. 00 be and hereby will be released upon the posting of
a performance bond in the amount of $22 , 000. 00 to insure the repair
of Plum Island Lane in Section II of Orient-by-the-Sea.

RESOLVED that a renewal permit is hereby issued to Leander Glover,
Jr. residing at Cox' s Lane, Cutchogue, New York, for the excavation
of sand, gravel, stone or other materials from premises located north
of Middle Road (Route 27) , ,Cutchogue, New York, generally described
as follows, to wit:
Parcel I - Northerly by lands of Glover, easterly by
lands of Glover and McBride; southerly by lands of
Pietrewicz and the Town of Southold; and westerly by
lands of the Town of Southold.
Parcel II - Northerly by lands of L. Glover, easterly

4. Notification by attorney for Paul' W. Gabbert, Jr. that
Mr. Gabbert has received, a settlement on his claim against the
Town of Southold and the claim is withdrawn.
5. Letter from the_Orieat Fire District, stating they are
interested in .obtaining five Mobile Units for the Fire Chiefs Cars
and one truck and three walkie talkies, .and understand that the
Police Radio System is to be changed in the near future.---It is not
clear what the Orient Fire District proposes, whether they want to
buy the equipment or just hook into the -Town' s . system. This must
be clarified.
Supervisor Martocchia announced there will be several vacancies
in different units of town government, on the ' Southold Town
Conservation Advisory Council, three positions; two on the Board
of Assessment Review, and one on the Board of Housing Appeals: "

'RESOLVED that the Town Board of the Town of Southold will hold a
.pub.lic,).heari.nd at the Southold Town Hall, Main, Road, Southold, New
York, on the 23rd day of. January 1979 at 3: 30 P.M. , at which time
and place all interested persons will be given an opportunity to be
heard upon the following matter: "ALocal Law Providing for Environ-
mental Review of Actions in the Town of Southold" which reads as `
follows:
Be it enacted by the Town Board of the Town of 'Southold.
Section 44-1 Chapter 44 of the Code of the Town of Southold,
constituting the Environmental Quality Review Law of the Town of
Southold, is hereby repealed and re-enacted to read as follows:
Section 44-2 The purpose of this local law is "to implement for the
Town of Southold SEQR and Part 617.
Section 44 -3 (.a) The terms and words used in this local law shall
have the same meaning as such terms and words are defined in Article 8 of
the Environemtnal Conservation Law and Part 617, unless the context
requires� a. different meaning.
(1) SEQR - the State Environmental Quality Review Act as set ;
forth in Article 8 -of the Environmental Conservation Law;
(2) Part 617 - thel:rules and regulations set forth in 6 NY CRR 617;
(3) EAF - Environmental Assessment Form;
(4) EIS - Environmental Impact Statement.
(5) Town - the town of Southold.
Section 44-4 No action, other than an exempt, excluded or Type II
action, shall be carried out, approved or funded by any agency, board, body,
or officer of the Town, unless it 'has complied with SEQR, Part 617 to the
extent applicable and this local law.
Section 44-5. (a) An EAF shall be .prepared by or on behalf of any
agency, board, body or. officer of the Town in connection with any Type I
action -such agency, board, body or-.-officer comtemplates or proposes to
carry out directly. For an unlisted action an EAF in a short or long form
may be prepared to facilitate 'a preliminary determination of environmental
significance.
(b) An application for permit or funding of a Type I action shall
be accompanied by an EAF, and for an unlisted action maybe accompanied
by a short or long form EAF as may be needed to assist the lead agency in
making a preliminary determination of environmental significance. An
applicant may prepare a draft EIS to accompany the application in place
of the EAF. In lieu of an EAF :the Town Board or a lead agency having
authority to adopt its own regulations may adopt different procedure for
reviewing environmental significance of unlisted actions. The lead agency
shall make a preliminary determination of environmental significance of

the action of the basis of the EAF, draft EIS or with respect to unlisted_
actions. in accordance with its own procedures, as the case may be, and
such other information it requires. Such determination shall be made
within 15 days of its designation as lead agency or within 15 days of
its receipt of all information it re quires, whichever is later. For
Type I actions , a determination of non=significance shall be noticed and
filed as provided in Part 617. 10 (b) ; for unlisted actions a determination
of non-significance shall be sent to the applicant and maintained in
accordance with Part 617. 7 (e) and 617. 10 (f) . After a determination of
non-significance, the action including one involving a permit or funding
shall be processed without further regard to SEQR, Part 617 or this local
law.
(c) The time of filing an application for approval of funding of an
action shall commence to run from the date the preliminary determination
of environmental non-significance is rendered, or if in lieu of an EAF
thepplicant prepares a draft EIS, from the date the applicant files
a draft EIS acceptable to the lead agency.
Section 44-6 If the lead agency determines that an EIS is required,
it shall proceed as provided in Part 617. 8, 627. 9 and 617. 10. Commencing
with the acceptance of the draft EIS, the time limitation for processing
the EIS shall run concurrently with the time limitations applicatble to
processing the application for approval or ' funding of the action, and
a public hearing on the draft EIS, if any, shall be held concurrently with
any hearing to be held on such application. The draft EIS Shall be
prepared by the applicant. Failure by the applicant to prepare an EIS
acceptable to the lead agency shall, at the option of the lead agency,
be deemed an abandonment and discontinuance of the application.
Section 44-7 The lead agency shall 'bedetermined and designated as
provided in Part:1617 . 6 and 617. 7,�-except that in the following Type I
unlieste d actions the lead agency shall be as provided herein:
(a) adoption, - amendment or change in zoning regulations not requiring
a federal or state agency permit or approval - the Town Board;
(b) Construction or expansion of Town buildings, structures and
facilities within the town not requiring a federal or state agency permit
or approval - the Town Board;
(c): .variances and special exceptions not requiring a federal or
state agency permit or approval - the Zoning Board of Appeals;
(d) Purchase, sale and lease of real property by the Town, not
requiring_ a. federal or state agency permit or approval--- the Town Board;
(e) planned unit development or cluster zoning not requiring a
federal or state agency permit or approval - the Town Planning Board;
(f) site plan review and' special 'use permit not requiring a federal
or state agency permit or approval - the Town Planning Board;
(g) construction or expansion of nonresidential facility not
requiring a federal or state agency permit or approval - The Building
Inspector;
(h) parking lot not requiring a federal or 'state agency permit or
approval - the Building Inspector. .
Section 44-8. The building Inspector shall act as the town
clearinghouse for lead agency sdesignation. Such clearinghouse shall assist
agencies and applicants to identify other agenciesq including federal and
state, that_.may be involved in approving, funding or carrying out Type I
and unliested actions. The clearinghouse shall also make recommendations
on the dseignation of a lead agency.
Section 44-9. Environmental review of actiona involving a federal
agency shall be processed with Part 617. 16 .
Section 44-10. The fees for review ro preparation of an EIS involving
an applicant or funding of an action shall be fixed from time to time by
a resolution of the Town Board: If the applicant prepare. the EIS, the Town
may charge a fee for actual expenses -of: reviewing it, but if a Town agency
prepares an EIS on' behalf of an applicant, it may charge a fee, for the
cost of preparing including publication of notices, but not for the
cost of professional review.
Section 44-11 Critical areas of, environmental concern may be
disignated by resolution of the Town Board in .accordance with Part 617 . 4
Section 44-12 This local .1aw:' shall take effect immediately.

Supervisor Martocchia stated- that there was some discussion on
Cablevision at the morning session, but the Board is not ready
for a hearing as there are some items that will require additional
information.
Mrs. Gladys Csajko, Greenport asked what the SEQR hearing is about?--
Supervisor Martocchia stated we have that law now, but it is being
repealed as our Local Law must adhere to the rules and regulations
of the-D.E.C. and we must reenact a new Local Law.
Mrs. Csajko asked what the transfer of funds into Recreation from
Federal Revenue Sharing Funds is?---Supervisor Martocchia said he
must. check that one with the bookkeeper and let Mrs. Csajko know
after the meeting.
Mrs. Csajko asked if the Town Hall Annex has gone over the allocated
funds?---Supervisor Martocchia stated they are staying within the
cost, but they are paying bills that have come due and are going to
be short roughly $1, 600. 00 of the monies on hand.
Mrs. Csajko stated that last spring the Animal Lea_ ue asked that
a committee be set up to look for land. for i for a ;
shelter,
what has happened on that?---Supervisor .Martocchi.a said that they
have looked into some land, but since that date they have had some
contact with Mrs. Marie Tejo who is considering building a shelter
on Sound Avenue in Riverhead Town. With that thought in mind he
did not know whether to pursue the matter any further in the Town
of Southold.--Mrs. Csajko asked if the Town actually knows how much
land they own?---Supervisor Martocchia said that by the end of this
month the firm of General Appraisals will have prepared for us an
inventory of everything the Town of Southold owns, including land,
furniture, equipment and so forth, _and the information Mrs. Csajko
asked for will be available.
Mrs. Csajko asked if the Board has heard anything as to whether
Plum Island is still going through with the research on Rift Valley
Feev rr .on January lst?---Supervisor Martocchia stated he has been
over to Plum Island several times recently, and all information that
has been supplied.:to him has been transmitted to Dr. Callis on Plum
Island. Dr. Callis has also met with the County Executive and the
DirPntnr of the S_ffolk County Department of Health, and Dr. Callis
has agreed to make available to those individuals what projects they
will be working on from time to time.--Dr. Harris of the Health
Department sent a letter to Dr. Callis stating he is- quite 'satisfi:ed
with their operations and security. The Town offi.cia.ls- have made.
available this hall for any meetings- he wi.shes= to hold relative to

ment, and Dr. Callis does not seem ready for a meeting. He will
contact Dr. Callis again on this matter.
Supervisor Martocchia introduced David Spohn and John Duell, local
individuals involved in aviation, who met with the Town Board in
the morning session, relative to a site for a small community
air2ort.--4Mr:.%,.Spohn stated�'that their project is to establish a

small air ort, general avaiation airport, .with ful service, that
is oper4tlonal after dark. The present situation is such at the
Base., ih_ a goodMattituck Air' part of the 'econ:om .off. th
Town, has a national and international reputation for overhauling
aircraft engines. Their location is in close proximity to houses
and is noise sensitive. When the lease with the Town was signed
the Air Base put in restrictions that there would be no night
operationsm no training:, no touch and goes and no ait taxi operations.
The goal of Mr. S ohn and his group is to find an open area, to
establish an airport, not much bigger than what exists in an area
that will allow these operations. - It would be to the benefit to
all. Mr. Spohn further detailed their objectives and answered
questions posed by individuals in the audience. Mr. Spohn stated
they are presently putting together a slide presentation of areas
that do exist that would. be adaptable for a _small community aprport.--
Councilman Drum stated that the facility at the Mattituck Air Base
as it exists today, in his- opinion, it not adequate for night flying
for everyone, expert pi.lo,ts, yes, but as a town airport it could be<.
limited. Also there are homes on ' the 'northern end of the runway
that are in the flight pattern and homes near the runway on the
southern end. For this reason he has recommended to the Town Board
in the renewal of the contract he does not fee-1- that that airport
is adeugate as: town sponsored, perh.ap-, private., Fot that reason
along, if aviation is expanding in our community we must look
elsewhere for ' an airport. I:t' is not all personal of the present
operator and owner, Mr. Wi.ckh.am. The report` of Councilman Drum
should be- available by Ma.rch. lst. -.--Mr. David Driscoll, Southold,
asked if there would be a public h.earing .on the' 'matter of a new
airport?---Councilman Drum said there would be.
Driscoll stated he thought the Board was remiss, as far as the
matter of the owrk program for youth.-'on the Highway Department.,
is not knowing how the program was- being developed.---Councilman
Homan stated they did know- what they were &ntering into, but they
did not enter into what .the paper said th.ey. were entering into.
There was erroneous information in one of the. newspapers. The
Program they knew- about because 'thd .Board passed a resolution for the
Highway Department to go into. i.t.---Supervisor Martocchia. stated
the paper said it was a Probation Department, program, which they
did not know- about, they knew about the program as. a Department of
Labor program, and did not have all the facts at the last meeting.
