Drum /s/ James Homan /s/ Martin Suter A special meeting of the Southold Town Board was held on Tuesday, September 19, 1978 at the _Southold Town Hall, Main Road, Southold , New York. Supervisor Martocchia opened the meeting at 10: 00 A.M. with the following . present:-, Supervis or ,Albert M. •Martocchia Justice Martin Suter Councilman James Homan Councilman Henry W. Drum ;Councilman William R. Pell, III Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean - , Deputy Town Clerk, E:lizabeth A. Neville Absent: Justice ,-Francis T: :Doyen Superintendent -of Highways , -Raymond Dean, ;informed the Board that in regard to ,landfill operations , he .has .been ..trying:. to. find out. exactly what the state would approve on-an incinerator or compactor .and exactly what -funds .are available, Federal Revenue Sharing or State, to us for this undertaking. Mr. Dean said that he asked `Robert E. Acier-no of Walter Industries , Inc to check on this matter as he is up in the. Albany area. : .-He asked him to check on it if we go to a compactor whether or not the State -will accept it? Are there any grant from om the State to help us do this -.work? Mr. Acierno went to the State at Albany and also to, -the,-DEC at Stonybrook. He had several meetings with them during which he explained exactly what our situation is out here; what our population is; .and -what water problems we have here. Mr. Acierno stated that the State indicated to him that they would like to see a regional _situation take -place. at,-Riverhad. But they do not know when this. could. ,take.-place, sometime in the unforeseen future.- Mr . Acier-no .pointed -out to -the state, that a baili-nq_type of operation would work very well because of the number of small communi- ties in this area . They agreed that this type of operation would be 10 2 $EP . 93T very beneficial in this area . The state regional office brought up the possibility of Southold Town taking in the refuse from Shelter Island Town. In doing this, Southold, could, become a regional facility. In certain instances, regional facilities are allowed 50/ funding. They suggested that the Town write them an informal letter and that they would then respond back in an informal manner advising the Town what technical aids would be available, what funds would be available and whether in fact a regional facility at Southold would be possible. They recognize that they have a problem with Shelter Island because they really can' t put any type of facility over there, they are burying their refuse. - The small' amount'. of revenuers that they generate over there really cannot produce the capital outlay to put in required landfill operations. So they recognize Shelter Island as a problem and they would like to see the refuse come off of Shelter Island. Mr. Acierno said that he felt that the Town of Southold could benefit from this situation. If we calculate the amount of refuse that Shelter Island generates -'it is a very small amount compared to what Southold could gain. - Mr. Dean 'said that he thought that the State is looking for a leader in this area , the Town of Southold could be it. Mr . Acierno said that we are in for more stringent landfill operations in the future. Mr. Dean asked by what date? Mr. Acierno said he did not know exactly. Mr. Acierno stated that it is his opinion that Southold will never be in a better position to have so much cooperation from the state. He read a rough draft of a letter that the Town could send to the State. Mr . Acierno stated that this letter in an informal manner would bring more information to us then we would otherwise have available. Mr. Acierno welcomed questions from the Board members. Supervisor Martocchia said that this is really just a way of reaching out to see what is available to us . Mr•. Acierno said that if the Town can get a 50/ funding by taking in Shelter Island at this point, they should do it. ' If someone else does it, the Town w.:Lll never have this opportunity again. Supervisor Martocchia asked how the Village of- Greenport .,,oeiu'ld fit in. They are now using our disposal area, could they become ,part of the regional package. Mr. Acierno said "yes" , "absolutely" , it would be a question to the state as to whether it would mean extra funding. Councilman Homan stated that both the Town of Shelter Island and Village of Greenp'ort should be contacted prior to sending this letter to the state. Mr. Homan asked what the price of the facility would be without the funding., Mr. Acierno stated about a half a million dollars . Mr. Homan asked that if we are fortunate enough to receive the 50/ funding from the state, does Mr . Acierno know of any other funding that is available, Federal or otherwise? Mr. Acierno said that he didn' t•. They would have to check around. Mr. Homan asked what the operational costs of such a facility are . Mr . Acierno, stated that he did not have operational costs becase they haven' t gotten to 'that point yet. Mr. Homan stated that they had to have an idea of how much manpower, how much machinery, etc. would be necessary. In relation to our present system, what would be operational difference? Mr. Dean stated that all it would require would be a small fork-lift to lift the bail, a small front-end loader to push the material that is dumped into the hopper. Mr . Acierno said that if we are operating with 3 people now, it would not require additional manpower. Mr. Pell asked how placing all the cement blocks under the earth will affect water filtration. Mr . Acierno stated that it will naturally 'be less . But with a regular landfill operation, you will be required to line the entire area, whereas with the(--bailing operation, you will only have to line the container. . Mr. Homan asked how long he could operate as we presently are before the state will require us to go to the compactor?-- Mr . Dean said he thought about 5, 6,. or 7 years . If we go compactor, it would be extended to approximately 25 years. Mr.. Dean stated that we mine our own sand, it is the most economical way of getting it; we don' t have to buy it. It also gives us a continuous 25 ft. hole, which is very unique. Mr . Dean has asked Mr. Acierno to inquire if we to compactor whether we would have to use theliner because he does not want to put out thousands of dollars to install and maintain it. Mr . �s C 7 e Pell stated that if we initiate this, we will be doing two things: (1). a stop gap by :going to the compactor; . (2) if they do go to in- cinerators., we will already. be a,,reg, gional compacting station. Town Attorney .Tasker asked if the state goes, to incinerators, would they accept this. type of. bail. Mr. Acierno. said ,that they would have to break the bail down. Mr . Tasker asked that if they were accepting the bales and it were costing, them money to break them down wouldn' t, the. Town -have to pay for them. Mr . Acierno stated that it takes a great deal of equipment to put the bale together, but it' doesn ' t take that much to break them apart. Mr. Pell stated that if we have to transport it, this would be the most economical way to transport it. Mr. Acierno said that they recognize this fact that it could switch into a transportation system. Supervisor Martocchia asked what type of .system Riverhead and Southampton is Jointly working on. Mr'. Ao,ierno stated that they have no solid proposals at this time. . Supervisor Martocchia said that this letter to the state would be an exploration letter to find out what would be available to us. -Mr. Pell asked about, HUD funds. Supervisor Martocchia stated .that , . difference monies are available, we will have to explore all possibili- ties. The Board discussed cost with available funding and thought that the least amount it could cost the Town would be $ 100, 000. Mr. Homan asked where there is a facility such as this already constructed. Mr. Acierno stated that Smithtown has such a facility.' Supervisor Martocchia asked if they were satisfied with their facility. Mr. Acierno said yes, they did have some unique problems with their landfill area, but he understands that has been resolved with the state. Supervisor Martocchia asked if anyone would have any ob- jections to a letter of inquiry going out tothe State. Mr. Pell stated that the Mayor of the Village of Greenport and the. Supervisor of Shelter. Island should -be contacted prior to, it being sent out... Supervisor Martocchia said that they would be sent a' copy of the rough draft -letter and an.:explanat.ibn -and asked if ,they_ ,would concur with such a proposal. Mr.•:Dean. s.tated . that he felt that the earlier we go with this , the_ more benefits we will get from th.e_ state. Councilman Drum and Councilman Pell will visit the Smithtown site . On- motion.�of Councilman- Homan, Councilman .Pe.11, it was . Supervisor Martocchia 'reported ' that he attended a count meeting g on 104 the,,,Farm •Preservation Program of which -Dennis Hurley is chairman. It seems that the Suffolk County Planning Commission wants to put in a 13, 000 acre exemption in Southold Town. We now have on an individual basis an-exemption of 2, 650 acres . - They have ap,olication forms from our local farmers for a- 2, 900 acre district: Councilman Homan asked if the assessment could be raised 'if we go along with this . Town Attorney Tasker stated that=they- could 'and`- shoiilc3 raise the assessment. The landowners already have one tax exemption from the Town Assessors, this new program -would' entitle themeto another one,. Our assessment on- agricultural land is now- far -below what is predicted by the -Farm Bureau -now. - Mr. Tasker stated that- it-was his uiiderstanding -that -the district could not be created without the consent: of the landowner and he has heard- that a; lot of our farmers do not want it. Supervisor Martocchia stated that- the county is-*proposing, to- make a .13 , 000 acre exemption available` to the landowners. Mr: Pell stated-that-our problem--would be if the speculators went into it.. If they get 'a 50/ exemption on their taxes , then we= would have to make up the 50/ in our town assessment-.- ' Mr. Tasker stated tl-Et our assessors are supposed to properly assess' the property•and ,he.' does -not think that $250. per acre plus an 'agricultural district on' top of it; to cu.t it in- half is right. Mr .- Tasker stated- "that the agricultural land : shou.ld, be -assessed at around $1, 000. - $1, 500'. per'' acre and then give them half of that. - . Mr.' Pell stated that our' farmers should realize that what they are being-'assessed at now is less than what they would pay in this district. Supervisor Martocchia stated that Dennis Hurley has asked that the Bo_a�rd_make``a- re'commendation toy himj and -he- will •honor their position and fight- for it. On motion of' Henry-'Drum, seconded by. Councilman Homan, it was RESOLVED that the Southold Town-Board recommend - to- the- Suffolk County Legislature a- 2, 900 acre exemption under the Farm Preservation Program. Vote of the Town 'Board:' ' 'Ayes': Counc ilman Pell, Councilman Drum, Councilman Homan, Justice Suter , Supervisor Martocchia. Absent: Justice'Doyen.- = - Supervisor Martocchia reported that he and Superintendent Dean attended a meetinn-won the-'HUD program funds at Ke:rron'Barnes office at the Labor Department. We have rec'eive7a .letter that they had - $700, 000. +-'on hand because of the towns thatodid not apply and qualify by sending in the amended Year III- resolution with all the conditions . However , the Town of Smithtown has began litigation against this .- Their grant was supposed- to be $500, 000-. - So; now with the- court proceedings starting against -it by the Town of Smithtown you do 'not have $700, 000. to divide .up'. The money- now- becomes conditional. You must sign a paper'- stating that if you get your share of the $700, 000. and the court rules in favor of Smithtown, you must give back -your share. Nobody wanted to sign that. If the court reules in favor of Smithtown and sets precedent, Lindenhurst .will them come into the picture.' Thendid not, sure, but if there is a­ precedent set, they will. Then, ` there wouldA,'st. be anything. left of the, money anyway. • So they decided to hold it up by setting conditions on it. Some of the things you could apply for the money for are road improvement, road drainage, and expansion of your recreation center and street: lighting. The most the Town could get out of this, i-s -$20, 000. under their formula The- litigation by the Town of Smithtown could hold the: funds up for several years or more ,- if they- ruled against them-and they appealed. Supervisor Martocchia reported that Kerron Barnes is going to� develop something for us to consider on small cities monies . The Town of Southold would •qualify as a small city, he understands there is quite a bit of money available under this . Supervisor Martocchia announced that he is having a_ meeting with Peter Jones from_ CATV and anyone who would like to attend,. is invited. 1!7, �® Supervisor Martocchia announced that he would like to meet with the finance committee in regard to the budget. On motion .by Councilman Drum, seoofided by Justice Suter, it was RESOLVED that there being no further business to come before this Town Board meeting adjournment be called at 11: 45 A.M.
