Supervisor Martocchia opened the meeting at 3: 00 P.M. with the following present: Super'vi.sor Albert M. Martocchia Justice Martin Suter Councilman James Homan Councilman Henry W. Drum Councilman William R.-Pell III Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Terry Absent: Justice Francis T. Doyen -Mrs . Jean Koke, Mrs . Katherine Poershke and Mrs . Margery Burns appeared before the Board and presented a 5 ft by 10 ft. American Flag to the Town on behalf of the Southold Chapter, Daughters of the American Revolution. This flag is to be flown at the site of this new town hall, and they "hope it will wave for a long time. " Supervisor Martocchia expressed the sincere appreciation of the Town Board and the people of the Town of Southold . On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that the minutes- of the Southold Towne Board meeting of August 22 ,. 1978 ^be and hereby are approved as submitted. On motion of Councilman Homan, seconded by Councilman Pell, it was RESOLVED that the next regular meeting of the Southold Town Board will be held a t 3= 00 P.M. , Tuesday, September 26, 1978 at the Southold Town Hall, Main Road , Southold, New York. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice 'Suter, Supervisor Martocchia . Absent: Justice Doyen. This resolution was declared adopted. On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that the following audited bills be approved for payment: General Fund Whole Town bills in the amount of $21,440.94; General Fund Part Town bills in the amount of $5,835. 12; Highway Department bills- in the amount of $14, 878.16; Fishers Island Ferry District bills in the amount of $34,854-.47 ; and Federal Revenue Sharing bills in the amount of $960 .65. Vote of the Town' Board:. Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor- Martocch-ia . Absent: - Justice Doyen. This resolution was declared adopted. On motion of. Councilman Homan, seconded by Councilman Pell, it was RESOLVED that the August 1978 re op its of the Supervisor, Town Clerk, Assessors, Building Department, Justice Suter, Justice Rich, be and 96 hereby are accepted and ordered placed on file. Vote of the Town Board: Ayes: ' Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter , Supervisor Martocchia . Absent: Justice Doyen. This resolution was declared adopted. Supervisor Martocchia: 1. Notification has been received from the County of Suffolk that the Year III Community Development funds in, the amount of $93 , 000. have been released to the Town of Southold. These funds will be used for the construction of the Senior Citizen/Youth Center . On motion of. Councilman Drum, seconded by Justice Suter, it was ..; RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to sign an agreement with the County of Suffolk for the completion of a Senior Citizen/YouthCenter using Year III Community Development funds in the amount of $93 , 000.00. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia . Absent: Justice Doyen. This resolution was declared adopted . On motion of Justice Suter , seconded by Councilman Drum, it was . RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to contact the firm of Sacco, Ahlers , Brown, Architects and Engineers for the Senior Citizen Youth Center_ project on Peconic Lane, Peconic, and advise them to proceed with preparation of the bidding specifications for this project, in compliance with the rules and regulations -of the HUD contract. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter , Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared adopted. On motion of Councilman Pell, seconded by Councilman Homan, it was RESOLVED that -Daniel Latham, Orient, New York, be and hereby is recommended by the Town of Southold to serve as a member- of the Suffolk County Select -Committee on the Acquisition of Development Rights, of Farmland, the position recently vacated by Henry F. Moisa. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia . Absent: Justice Doyen. This resolution was declared adopted . On motion of Councilman Homan, seconded by Councilman Drum, it was RESOLVED that the Town Board of the Town of Southold a ,,- a bond in the amount of .,$100 . 000.00 for the roads and improvements in the subdivision known. ,as '_Country C1 ib Estates, " and recommended by Town Engineer Law7`ft�ace M. Tuthill. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, , Justice Suter , Supervisor Martocchia . Absent: Justice Doyen., This resolution was declared adopted. Supervisor Martocchia: 2 . Correspondence has been received from Ron Ziel, President of the Steam Locomotive 39 Fund Committee, Inc. asking the support of the Town Board on a resolution before the Suffolk County Legisla- ture which calls for the County to supply $50, 000. to get engine No. 39 into operation to promote tourism in Suffolk County. ---The Board has discussed this proposal and feel they do not wish to support such a resolution. 3 . Letter from ratho Lic:­Charities asking that a representative of .the Town of Southold be present on September 12., 1978 at an Advisory. Board meeting. This board is being established to facilitate- communi- cation between their Community Life Centers and the community as well as to take advantage of the cansel and guidance of local citizens . ---Councilman Drum will be present at this meeting. 4. Elaine F. Kaldor, Certified Public Accountant, has sub- mitted estimates for performing a final audit in connection with the two .federal projects presently under way in the Town. Main Bayview Road, Southold approximately $560.00 and Town Hall Addition approx- imately $102000. This is all in accordance with Section IV I of the Department of Commerce 's "Audit Instruction for Local Public Works Grants Under Title I of the Public Works Employment Acts of 1976 and 1977 . " On motion of Justice Suter , ' seconded by- Councilman Homan, it was RESOLVED that the amount of ,$27 , 000. be and hereby is approved for a proposed bond for the roads and improvements in the subdivision known as "Southold Gardens" located at Southold , New York, all in accordance with the recommendation of the Town Engineer Lawrence M. Tuthill. Vote of the Town Board: Ayes: Council a:n Pell, Councilman Drum, Councilman Homan, Justice Suter , Supervisor Martocchia . Absent: Justice Doyen. This resolution was declared adopted. Supervisor Martocchia: 5 . Letter from Kerron Barnes , Community Development Director, asking for Southold Town' s participation in the Home Improvement Program. This program will provide Home Improvement Loand to eligible Southold Residents at an annual interest rate of only 3%. The County has allocated $20, 000. to the Town for this purpose. On motion of Councilman Homan, seconded by Councilman Pell, it was RESOLVED that the Town of Southold is interested in participating in the Home Improvement Program sponsored by the County of Suffolk. It is understood that participation requires no financial or adminis- trative commitment on the part of the Town of Southold. Permission is hereby granted for the County to serve the residents who have applied for Home Improvement Loans., Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter , Supervisor Martocchia. ' Absent: - Justice .Doyen. This resolution was declared adopted. Supervisor Martocchia: 6 . Letter from County Legislator Denis R. Hurley advising of a meeting of the Agricultural Districting Advisory Committee this evening, Tuesday, September 5, 1978 at 8: 00 P.M. at the Agricultural Extension Building on Griffing Avenue, Riverhead . This will be open discussion on the Farm. Program and how the Town of Southold feels about it. The Town Board at the present time is riot prepared to take a posi- tion on this matter, they are not sufficiently informed as to the rami- fications . If it is going to affect the- tax base too much by too much property going into exempt they will have to take a hard look at it, be- cause everything that goes into exempt comes back to those who pay to makeup the difference. . 7 . Notification from the Suffolk County Department of Public Works that on or about' 8/28/78 dredging operations will commence at Cedar Beach Harbor Inlet, Wickham creek.. Calall Pond, and Halls Creek. 8. A Certification of Incorporation of The Seniors Club of Southold-Peconic, Inc. , a new group, has been received . This is merely a notification to the Town Board. 9. Letter from The American National Red Cross, Suffolk County Chapter, requesting that the Town of Southold sign an agree- ment permitting the Red Cross to use the Nutrition Center , St. Agnes Church, Greenport', as a facility' in the event of disaster . Supervisor Martocchia talked to Father Rocco this morning and verbally he agreed to such an agreement. Once he has agreed in writing it will be trans- mitted to the Red Cross . 9� S E R 5 1979., 10. There will be a meeting on Thursday, September 7th at 9: 30 A.M. at the Brookhaven National Laboratory in Upton, hosted by the Town of Brookhaven on. the protection and preservation of the -under- ground water supply :in the_Nassau-Suffolk region..---There will probably be a Southold Town representative there: 11. Letter from Holzmacher, McLendon and Murrell, P.C. , Consulting engineers; environmental scientists and planners, stating they have considerable experience with _scavenger waste ,applications and permits governing the discharge of wastewater, and asking if, .,- they can be of assistance in helping the town reapply for their SPDES perm t or in providing laboratory/engineering services .---The Town has no need for their .services at the present time . - 12 . - Letter from General Appraisal Company acknowledging permission to proceed: with a detailed property record installation for the Town of Southold. This wor,k .should begin within 45 days . 13 . Letter from Jody Adams-, Peconic, New York .relative to Cablevis ion. 14. The Southold Town-Greenport Village_ contract for dooq control will be renewed automatically unless either side disagrees . , On motion of Councilman Homan, seconded by Councilman Drum, it was RESOLVED that $15,400.00 in Antirecession Funds, Public Works, Title II be allocated: a.s follows: $1, 65.0.00 to be. placed in.A1680.4, Central Data Processing- for Fixed Asset Accounting: $6, 000.00 be placed in A8160-1, Disposal Area , personal services; and $7 , 750.00 be placed in B3120. 1, Police, personal services. On motion o-f Councilman Homan,, seconded by Justice Suter , it was RESOLVED that $3 ,377 .58 be and hereby is transferred from Contingent A1990.4 to (1) Disposal Area A8160.4 - $1, 877 .58,. and (2). This resolution was declared adopted. Supervisor Martocchia: 15. A problem relative- to drainage at Indian Neck Lane, Peconic has been resolved. Supervisor and Highway Superintendent Dean met with the- owners of the property involved'. and have arrived at the sum of $7 , 00-0. for the purchase of two pieces of property. As soon as the Town Attorney has the .papers in order further action will be taken by the Board. On motion of Councilman Homan, seconded by Councilman Pell., it was RESOLVED that the following gunds be and hereby are transferred: Fishers Island Ferry District from Operation of Ferry to Insurance - $5, 500.00, .and Operation of Ferry to Repairs to Docks and Buildings - $3 , 000. 00. , Vote of the , Town Board: Ayes: - Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter , Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared adopted. On motion .of Justice Suter , seconded by Councilman Drum, it was . RESOLVED that the Southold-.Senior Citizens be and hereby are granted permission to contract for three (and possibly four) buses to take them to Bear Mountain On October 18, 1978; estimate for three buses is $1, 052 .00; provided there is enough money in their budget for this expenditure. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter , Supervisor Martocchia . Absent: Justice Doyen. This resolution was declared adopted. Supervisor Martocchia: 16 . As a result of a meeting, of the Board of Commissioners of the .Fishers Island Ferry District on September 1, 1978, Commissioner Raymond Doyen was unanimously elected as Chai�Zan,,, of the Board of Commissioners . 17 . Notification of a meeting of the Suffolk County Solar Energy Commission for Thursday, September 7 , 1978 at 9: 30 A.M. at Suffolk County Federal Savings , 2100 Middle Country Road, Centereach. Those attending the meeting will have the chance to review the pro- visions of the County legislation and discuss the activities of their Solar Energy Commission and how it affects all townships in the County. ---Someone from the Town will attend . On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that the application of Carl Frelix, Jr . dated July 26, 1978, for permission to maintain a single one family trailer on his property on a private road off the north side Main Road, Mattituck be and hereby is__granted for a period of six months . Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan,. Justice Suter, Supervisor Martocchia . Absent: Justice Doyen. This resolution was declared adopted. On motion of Councilman Homan, seconded by Councilman Pell., it was RESOLVED that a recess be called at this . time, 3: 30 P .M. for the purpose of holding a _public he aring, on the Meskouris wetland applica- tion; meeting, to reconvene following . the public hearing. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter , Supervisor Martocchia . Absent: Justice Doyen. This resolution was declared adopted. Meeting reconvened at 3: 35 P.M. A member of the audience stated there has been mention made of an application for incorporation of senior citizens . We already have one in Mattituck and one in Southold. Who is this group and are they competing or what .is their purpose?---Supervisor Martocchia stated he received a Certification of Incorporation of The Seniors Club of Southold-Pec onic, Inc . under Section 402 of the Non-Profit Corporation Law the undersigned, and so on---signed by Henry B. Lytle. Mr. Henry _Lytle stated that .if anyone would like an explanation of the reason for this it would be -obvious if they attended a few of the meetings of the Southold group which has taken in the whole eastern end -of -the Island, including Greenport to the end, this past winter particularly. They are meeting in a most unsatisfactory place from the standpoint of location especially for the people who come from the west end of the meeting area . They have had many re- quests to have a localized meeting place that would be central to the Southold-Peconic area and finally they took it upon themselves.. to incorporate a 'club for the purpose of permitting any other seniors that wish to join with them. It is not a question of competing, it is a question of additional offering because of groups that have already grown too large . The Mattituck group broke away from the Southold group quite a few years ago and they are already- being pressed both for space and wish that they could drop some of their ' members . He thinks they have, taken the bull by the horns and started this for the sole purpose of having another senior group in a .township which certainly could afford to have one. Mr . Frank Pospisil stated that twelve years ago he appeared before the Town Board and asked for permission to organize the senior— citizens . At that time, he was told that it was tried before , but 100 he had the Board ' s blessings, and to go ahead. Two years later, their group grew so much they couldn' t meet any longer in the Southold Legion Hall because the capacity at that time was only 204. So they asked . some of the members if they would like another club in Mattituck. He again appeared before the Board to ask Permission to organize another club in Mattituck. Permission was received, and that group began meeting and have been there for- ten years . He feels that it there is another club necessary it is perfectly justified.- However , they don' t think the Southold-Peconic name woul be very favorable. to them as they are registered in Albany and the County as the Southold Senior Citizens. If there is a Southold-Peconic Senior Citizens there will be a conflict with the name . Mr. Lytle stated the correct title of the club is The Senior Club of Southold-Peconic Incorporated. There is no mention -of "citizens" , it is a seniors club and open to all seniors. Mr . Pospisil said that there already -is a club In' 'S`oirthold, so Mr. Lytle is actually duplicating something. If the, want a Peconic Club it would be very nice, no problems. The Seniors of Peconic'. But the moment they say Southold they are interfering with the Southold group. Supervisor Martocchia asked if a charter had ever- been issued to the Southold group?"---Mr. Pospisil stated -that at the"'time, Mr'. Albertson was Supervisor and asked 'them to- file their by-12<ws with him and after they did that the Town Board was'­evidently suppo'sed' to have looked it over and granted them permission to start 'the' club. He ' would like the 'Board to take 'into" consideration the causing of a conflict by their using the name Southold.----Supervisor Martocchia stated they have nothing to do with the matter at. all. Private 'clubs do not need the sanction of the Town Board. On motion of Councilman Drum, seconded by Councilman Pell, it was RESOLVED that there being no further business to come before this Town Board meeting adjournment be called at 3: 45 P .M. Following this meeting, at 3:45 P.M. a public hear ing ,was held in the matter of the application of ,The North Fork Bank & Trust Company for a franchise to run an _aerial communications cable between their Love Lane office and data center on Sound Avenue, Mattituck. At 4: 00 P.M. a public hearing was held on a proposed' Local Law Entitled "A Local" Law providing for the increasing of dog license- fees in the Town of Southold. `- Ter ky Town Clerk
