Executive Session
Mr. Wilbur Klatsky_ of Leon H.-Weiner &4ssociates , Inc. appeared
before the Board requesting a letter approving Mr. Weiner ' s applica-
tion for a state subsidy for building multi-family dwellings_ on
Youngs Avenue, Southold (Hellman-Ahlers property zoned "M-1" on
May 9, 1972) . Mr. Klatsky stated Weiner proposes to build 154
units of 1 bedroom efficiency and some two bedroom efficiene.y
apartments. All building construction would meet the New York State
Code and they would seek site plan approval from the Planning Board,
however, at. the present time, they have no architectural drawings for
the project. Mr .. Klatsky asked for a letter from the Town Board for
submission to the State assuring them that subject to meeting all regu-
lations and requirements they would receive Building .permits and certi-
ficates of occupancy. The Board advised Mr .. Klatsky that he is ,asking
for appr-oval_ of an application that they have not seen. Furthermore,
they cannot tell the Building Department to issue or -not issue -a permit,
nor the Planning Board to approve or not approve a site plan. To write
such a_;letter would appear as preferential treatment over other appli-
cants. Since this matter is out of ,the jurisdiction of the Town Board,
Mr. Klatsky was told to deal directly with the departments concerned,
the Building Department and Planning Board. If Mr. Klatsky. desired, a
letter could be secured from the ,Town Clerk stating the property in
question was zoned "M-l" in--1972 and still is "M-1" , and a copy of the HUD
resolution could be supplied to him as well.
A regular meeting of the Southold Town Board was held on .,Tuesday,
August 22,,__ 1978 at the Southold Town Hall, Main Road, Southold, New
York. Supervisor Martocchia opened the meeting at 3: 00 P.M. with the
following present:

1. I have submitted copies pf,;the proposals of -the CSEA
employees to Councilman Pell and Justice Suter to review, and prepare
for a meeting with the Supervisor for a counter-,proposa"l.
2. Letter from Jody Adams relative to the Code of the Town
of Southold. Miss Adams feels this book should be made availableto
the libraries : This matter will be discussed with the different
libraries to -arrive at a decision as to how they may make them avail"
able to the public . -
3 . Letter from the Village of Greenport notifying the Town
there will be a public hearing on Wednesday, August 23 , 1978 at 6: 00
P.M. at the Greenport Village Hall concerning the Site Development,
Plan, WetlandsiPermit Application and Environmental Impact- Statement of
Xascony Transport & Ferry Service , Inc.
4. .S6metime in early September the Southold Chapter, NSDAR_
will present the Town of Southold with an American Flag.
5 . The Town of Southold has been selected again for ,an
award by the Automobile Club of New York, a Pedestrian Safety Cita-
tion, for achieving a record of having no pedestrian fatalities in the
last four years . The presentation will be made on Wednesday, September
20th at the Tavern-on-the Green, Central Park West, New York City.
Generally the Chief of Police attends.
On motion of Justice Suter, seconded by Councilmen Pell, it was
RESOLVED that the Southold Town Fire Chiefs Council be and hereby -
are granted permission to charter" a bus to New York City in October
for a fireman' s tour and drill. This is the last time the Town of
Southold will pay this transportation cost for the Fire Chiefs
Council.

(Supervisor Martocchia explained that the Board has discussed the
matter of funding transportation for the Fire Chiefs Council, which
they asked for once before, two years ago, and since budgets are
getting tighter, they will be asked not to request the Town to fund
such transportation again. )

6 . Letter from the Suffolk County Department of Public Works.
informing the Town that the traffic signal installation at C.R. 27 ,
Middle Road and Wickham Avenue, Mattituck has been completed in
accordance with the plans and specifications and becomes the responsi-
bility of the Town as of Noon, August 22, 1978 .
7. The Town is in the process of talking with 3M Business
Products Sales Inc,: relative to copy machines. The contract with
Zerox ends September 30th. There will be further discussion with
Zerox relative to their machines . A study must be made as to cost
and quality of the product.
On motion of Councilman Homan, seconded by Justice Suter,
WHEREAS the Sacred Heart R.C. Church, Cutchogue, New York has applied
to the Town Clerk for a Bingo License, and
WHEREAS the Town Board has examined the application, and after inves-'
tigation, duly made findings and determinations as required by law.
NOW, THEREFORE, BE IT. RESOLVED that the Supervisor be and he hereby

Town of Southold . the findings and determinations as required by law,
and it is further
RESOLVED that the Town Clerk be and she hereby is directed to issue a
Bingo License to the Sacred Heart R.C. Church, Cutchogue, New York.

RESOLVED that the Town .Board of- the Town of Southold approve the
$2600.00 bond and accept a Passb�_ for -that amount from Mr . Charles
Rand for roads and improvements in the ..subdivision known as "Brion-
ctloid-by-the Sea"., , as recommended by the .Southold Town Planning Board and
Town Engineer Lawrence Tuthill, and be it further
RESOLVED that the ,inspection fee for lBriongloid-by-the-Sea" be based
on the original bond estimate of $3500.00.

,,.,trailer renewal - on property located on the east side Elijah' s Lane,
Mattituck, be and hereby is renewer for .a period of six months .-

.8: The, Town' s Senior Citizen Bus for transportation is now
in operation., Supervisor Martocchia . has spent considerable time with
the senior citizen groups setting up schedules, recruiting drives , and
volunteers to receive telephone calls for scheduling the pick-ups.
Eligibility requirements are: Residents over 60 years -of age, hold
a Suffolk County I .D: card, -have no access to public transportation,..
have no car or. access to..a ,car;. unable ..to afford ,-.taxi fare. Essential
transportation service i.s provided for: medical and -health care,
shopping assistance, governmental agencies (Social Security, Social
Services., County._;:Cen ter..) To ..arrange for. .pick-ups, appointments are
between, the hours of -.9AM and. 3PM- on. the day the -van, is- scheduled in. . .
the user' s area. Call 765-1100 between lPM and 3 PM the day before
the bus is scheduled in the area . All :workers - are volunteers and unsal-
aried. Volunteers are needed for _receiving telephone calls two hours. a
day and. for dispatch purposes . ., The following routes.;have .been arranged:
Monday - -non.-scheduled, . Tuesday- -. Greenport., East :Marion, Orient,
Wednesday.-.Southold, . Thursday-Cutchogue, New Suffolk, Peconic, Friday-
Mattituck, Laurel.
9. Notification from the Department of the Army, Corps of.

RESOLVED that the Town Board . of the,Town of. Southold, will;h.old a
public hearing at the Southold Town. Hall, Main. Road, Southold, New
York on the -5th -day of - September, 1978 at 4: 00 P.M. , . at which time
and place all interested persons will be given an opportunity to be
heard upon the following matter: "A Local Law .Providing for the
Increasinq _of Dog License Fees, in the . Town .of, Southold" which reads
as follows:

fee for dogs, in addition to other statutory charges,

RESOLVED that the Town Board of the Town of Southold supports � Section
208 of the Federal Water Pollution Control Study,,undertaken by the
N ssau-suffo•lk Regional Planning -Board.

being made available to the Cutchogue •Free Library,' the matter will
be discussed with all the- local -libraries. .
12'. " There is still a vacancy on the Suffolk County Select
Committee on Land Acquisition of Development Rigits of Farmland.
This vacancy was announced two weeks ago and -no one has applied.
13 . 7: 30 P.M. this evening there will be a' hearing upon
the application of Long I51and Cablevision Corporation for- an increase-
in rates .
14. • ' A petition has -been received -from Judy G. Dumas, Mill
Colony, -and Eveyln Varvitsiotes-, -Kenny' s Road, containing 541 signs=
tures on 24' pages. The petition "reads as -follows:
"For the past several years, the jelly fish situation and
resultant swimming has been progressively worsening.
_ We, urge, therefore , 'that immediate' action -be undertaken to
restore safe swimming at our public• beaches on .the Long Island Sound.
Through inquiry we have learned that Brookhaven Township has
effectively utilized,nettina at four of their beaches, namely, Blue
Point, Shirley; Davis Park and Sands Point. -Mr.• william Gahwiller,
Park Supervisor (516-732-5610 or --5645) , has- informed us -that netting
has been used during the last three or ,four years and that result has,
been most rec:tarding.
It is our understanding that the Town of Islip has also
undertaken such-- measures .
In view of the continuing danger -to public health; safety
and 'welfare and in keeping with responsible town leadership,• we hereby
respectfully urge that action be initiated immediately to provide
for' such netting' at both Southold Town Beach and :Kenney' s Beach. "
An attached letter also indicates West Meadow .Beach in Port Jefferson
(Brookhaven Township) 'and Bar Beach in North Hempstead have al-so used
netting successfully. Mr. Malone is the Commissioner of Parks in
North Hempstead.---Supervisor Martocchia will contact those areas that
are being netting to determine how successful it was this year and in
past years. There is no question it 'is an annoyii•g situation.

RESOLVED that Town -Histor-ia,n Magda:line Goodrich�be and- hereby is
granted permission to attend the semi-annual meeting of the Municipal
Historians Association to be held at .the Americana Inn, Albany, New
York on Septembd-r �29=30, 1978, and -that all necessary costs for meals,
lodging and transportation be a legal charge against the .Town of
Southold.

On motion of Justice Suter , seconded by Councilman Pell,
WHEREAS Robert L. -Bergen; a most valued member of the Southold
Town Board of Appeals has retired from public service effective
July 31, 1978, ,and
WHEREAS Robert L. Bergen has faithfully served as a member of the
Southold Town Board of Appeals since its establishment on April
19, 1957, and
WHEREAS his record of fine service to the Town of Southold and its
people deserves the sincere gratitude of those with whom and for
whom he worked,-
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of
Southold expresses its appreciation to Robert L. Bergen for his
long record of fine and dedicated service, and its best wishes for
the years ahead, and
BE IT FURTHER RESOLVED that this resolution be made a part of the
permanent records of the Town of Southold, and a copy be sent to
Mr. Bergen.

Mrs. Gladys Csajko asked what the proposed local law on dog fees is
about.---It was explained that the hearing is to increase the fees
from $2.35 for a male or spayed female to $5.00 for a male or unspayed
female and $10.00 for an unspayed female, effective October 1, 1978.
Effective October 1, 1979 the fees will be $5.00 for neutered male or
spayed female and $10.00 for an unneutered male or unspayed female.
---Mrs.' Csajko asked if they are going to cut down on the holding time?
---It was stated it is just fees .
Mr . David Driscoll, Southold, asked if it is not mandatory or standard
practive where a Town road enters or intersects with either a State
or County road that a stop sign is required?---Highway Superintendent
Dean stated that where any Town road enters onto a State or County road the
State or County is obligated to erect a stop sign.---Mr. Driscoll stated
that the reason for the question is that there is no stop sign on Queen
Street entering onto the North Road in Greenport.---Mr . Dean stated he
was not aware there was not a stop sign, and he would contact the County
immediately about the matter.
Mrs . Csajko requested a copy of the CATV financial statement.---This
will be supplied to Mrs . Csajko.

Supervisor :Martocchia noted that Mr.-John Pontino,and Mr. Frank Kull
are in the- audience, and assume they -must be at the meeting relative
to their drainage problem on• Indian Neck, Lane. He• stated that the
Pontinos- and. ;Kulls -were .con ta-c-ted,- several :years ag:o:,with. a • proposal
for the .Town -to purchase- adjoining, parcels ,of. lend -from them. :The Town
had appraisals and surveys made of the property and made an offer for the
purchase of the land. The Kulls .were willing. to sell, but the.-Pontinos
were not satisfied with the amount of the offer, and the matter came
to--a -stands-till.; ; -,Supervisor Martocchia• -admitted, there is -a serious
problem in, that area cause by severe -rain storms ; and as indicated by Mr .
Pontino by ice- problems .als-o in -the -wintertime :-.-=Mr. Kull -stated--they
lost four acres -of potatoes in the rain storm of two weeks ago:---Mr .
Pontino.•stated .there -are new parties involved ,now, and �they-would
like to again negotiate -for ,the sale of the property.---Highway-
Superintendent Dean and Supervisor Martocchia agreed to meet with
Mr . .Pontino and -Mr . Kull this week to discuss the situation -and. try
to work out a settlement:
