League- is.-Interested in-hearing what the Town Board ' ss reaction 'is to
the letter they received from- the Corps`-of 'Engineers. ' The Corps of -
Engineers letter stated that their regulations, ` 33 -CFR 326.5, permits
a property owner-'-to, apply-for an after-the-fact permit''in those
instances where= the District Engineer has determined that the'" uh "
authorized work does • notiwarrant legal action.---Supervisor' Martocchia
stated the matter was discussed in the morning session for about
fifteen minutes and there was a variety of- opinions from the Board
members', no •solid'=feeling%- of' the Board.---Councilman. Pell confirmed
that the Board -did discuss the matter but had mixed emotions on it;'
no. .f.ixed- -stand:.----Councilman Homan stated that it is a federal matter,
and not a matter for the Town Board to decide what they should do '
or not do.---Mrs :' Mar'ie Johnson stated she feels the Board should

Mrs. Marie Johnson said it appears the, -Town 'Board draws 'the ' line-
on opposing only'Federal legislation, but don ' t mind opposing State
bills.---Councilman Homan said that if the decision she asked of
this Board is going to make a drastic change in .what the federal
government did then he ":thinks the Board would be very very much
remiss if they did not consider and debate it, but since this Board
is not going to ' change the position of the federal government .one
bit, he thinks Mrs. Johnson is doing a disservice to the Towri Board
to ask them to comment on it. That is Mr. Homan' s opinion and his
only. Justice Suter stated that these are bills affecting the Town -
of Southold because the Town is bargaining under the Taylor Law.
Those changes in the Taylor Law is weakening it and the Board is
opposing those changes,. so it does affect the Town .-and he ,thinks
they are involved and have' a right to object.----Justice .Suter
said the "federal ..rules affect navigation, not the Town of Southold,
the Town has their own rules under 'the Town Trustee's. If they
were trying to take rights of the Town Trustees away, they •would
oppose it.

13 The-)Board has received- from the New York State- Commission
On Cable Television a Preparation and- Evaluation of Rate-•I„crease -
Applications. The`Supervisor had a =telephone call from the. chief ,
Accountant of Cablevision, Les Dryden, Albany, who -will send him
the guidelines of the changes taking place.---He 'also learned that
Long Island Cablevision did not get permission from the N.Y.S.
Cable Television Commission to put homebox on Channel 2, a matter
they neglected to do with the Town either.---Mr . David Driscoll
asked what the position of the .Board' is on the change back to
channel 1.2?---Supervisor Martocchia stated that Mr. .Jones indicated.
to the Board that the. reason they took. 2 away and put 2 on 12 -was
that 12 was not strong enough to use for home box office, -but they
must get permission- to do that. There was' a very heate' d' discussion
at the last meeting and both Mr.-Jones-and the 'Board walked away
annoyed. The figures Mr . Jones gave the Board for the increase
is 804., plus the cost, pro=rated• out to everyone;;,of any new section
they develop. Mr . Jones said the line extension policy is not
working, the people do -not want to pay the cost as it is running too
high. They will have to get back together again on this matter.---
Mr. Driscoll asked if the first step wouldn' t be to .demand they respect
the franchise which was granted to them and they should put 2 back
on 2.-=-Supervisor Martocchia stated that Mr . Jones told the Board
they failed. to get the permit from the Board, what is the penalty
for not doing- it? Supervisor Martocchia sa.id he felt the fair
penaity would. be- to d_o 'the new areas without any cost to the subscribers,
which, of-course, he didn' t buy.---Mrs. Gladys Csajko stated- that
in' the original franchise -it stated the franchise could 'not be
transferred or assigned without Town approval, and she never found
anything to indicate that the Town gave approval when it was changed
over to the Times-Mirror.---justice Suter stated that Mr. Jones '
answer -to the Board on that was .that when they got the new franchise
it was under the new name; they did it inbetween.----Mrs. _Csajko
stated thee, original morithly hook-up was $5.00, and somewhere along
the line it went to $6. 00, but there ' s nothing to indicate a hearing
40 ,SUN 2. 01979
was held on it, could this have, been- in between_-when,,there, was:.no.
contract?----Town Attorney Tasker stated 'that. he believes .it. started
at $5. 00 and the original cable company applied for a rate increase
and he is pretty sure they-held..a hearing on:;that_.---Mrs. C-sajko
said she could not:- find._:where . it went:.from .$5: 00 --to _ $6 .00 in the. .
files, and if they possibly!;did_that.:illega,lly. ---Mrs: Csajko asked
how the Board knows-.how many actual-,subscribers--C.ATV ;has?=--Supervisor
Martocchia said Mr. Jones stated at._the .last meeting' there:_were.
approximately 4, 000 subscribers . They must file with the Cable
Commission the- number of.-actual subscribers..---Mrs . esajko stated
that- in 1976 CATV.-.stated-_ they had 3184 subscribers, at $7 :00, . they v
grossed approximately $252, 000.. •.They, only. pay=_the .Town.-on. the gross

less 1/ which is _paid to;,the :State •and. that--brings;.it-down•'to $5; 000.
The annual. report shows,-that ..the -Town only..received. $4.,:000..Oot.---
Supervisor Martocchia stated that this--year .they_received :a- check:
for $10, 000.---Town Attorney Tasker stated that they are entitled
to deduct :from ,this franchise fee; they pay, the Town the, real. property
franchise taxes they pay to Southold Town, the state -law requires
this, it, requires _ that CATV be-.given„the credit for. the;;real!,property.
taxes -:against the franchise tax_ they- pay.,-and the ,franchise tax which
they, pay,' the upper limits fixed: -by-the-State which they take ;l/:
off the top,. so the Town really doesn ' t have much flexibility in
what- they.-get.:paid. ::The:,Town is charging .them: the .maximum -and they
are entitled under -,the,..law to: :deduct the -real '-property tax. '

Supervisor Martocchia:
19 . Upon the request of Anita Quinn,. Leeton Drive, .Southold,'-
Supervisor Martocchia requested Chief Cataldo and members of his
staff to make: a study -of the traffic conditions at L•eeton Drive.
Just prior to the meeting the -Board received Chief Cataldo '.s
report. The Chief indicated that he. has talked to the people in the
neighborhood and they have had additional enforcement, -and two
tickets have been given out, one to a resident .of the -road'. The
Chief, proposes to make further improvements in, the area:.---A copy of
the letter will be supplied- to Mrs. Quinn,'.following the meeting.
----Mr. .Quinn asked if the Board has taken any action on the speed
limit?---Supervisor Martocchia stated- Chief. Cataldo, indicated- the
Town could not change it.---Mr . Quinn said he realized that, but the
residents of .the area are- prepared to go to the New York State
Department of Transportation in.-Albany to petition for a reduced
speed. limit, but feel their position would be. greatly strengthened
if the Town Board and Chief of Police would .agree -that there is. a -
need for the reduced speed limit. The Chief. was. there one day and
there was an unmarked. ,car there. which gave out two tickets• on .a rainy
night:, which gives the-.Board-.some idea of .the problem. , Informally,
just looking out the Quinns saw 16 violations and told -the Chief :
about them. There are children .running across the street, ped-
estrians using the public beach, and the road itself is simply a
loop from Kenny' s Road and .the kids strip race :on :that-. -All
twenty-five homes on: Leeton. Drive. have been -contacted:_on. this.
matter -and. twenty-three °subscribed Ito .thei.petition.---Councilman
Pell stated that he went down to Leeton Drive the past weekend,. .. .
and they have a unique problem there with the loose sand on the road
which is another problem. The Board just received the Chief' s :
report today and none. of the Board members.- have had a.-chance to
read'. it or .digest it. It. is his opinion. that the--request to.::the
State -contain- the items mentioned, speed-, kids , loose sand-, •whether
it be from. .the.sown :beach or private property, he thinks,.- personally,
they have a - unique:.situation, on-.Leeton: Drive._--Supervisor .Martocchia
said he spent a half a day there on Saturday morning, but did not
see any speeding problems, but the street does have a. problem, ,kids
in the road who refuse to move, throw things at the .cars. The
Board will. -study.-the report•. If.-stop signs are' required, they
cannot be put .up'.:overnight.- -They. must be incorporated into the
Vehicle and Traffic Ordinance and a hearing must be held before- i
.they can be erected.---Mrs. Barbara Schriever.:suggested macadam.
bumps=being placed in the road to slow traffic.----Supervisor
Martocchia•-stated- this,•can be done on private .roads, .trailer•-park
roads;. but on public roads. it would only.. be ,a .possible cause -of,.
accidents :ands the Town :would -be liable.:for damage:- Councilman:_.
Homan stated::that having:. been in slat area _for :a cons.iderabl•e.-:'..
amount o-f time when :they --were.--having_'the-erosion problems:;-it. -is. .his
observation; tha;t::Leeton. .Drive .should: never have -become. ;.a Town road.:

Drum, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:
Justice Doyen.
This resolution was declared adopted: -
Councilman -Pell stated he wished the 'record to show that he voted '
"no" due to the lack of time given for notice of the recommendation
for the 'raise •and lack of time to do research on it. It 'is not
against the job or performance the . two, men are doing.---Supervisor
Martocchia stated he wished it noted Mr. Pell had the same notice
that the rest of the members have- had'.
Mr. Quinn 'o'f Leeton Drive, requested that before the `meeting is
brought to" -a close, they would like to know what action, if any;
is to be taken bn the problem at Lee-tone Drive. They would 'at
least like suppbrt 'bf the Board when- they petition Albany for a
change in the speed limit.---Councilman Homan stated that a couple
of years ago, the people of Southold High School area, requested
a 15 mph speed limit- in front of Southold High School on Oaklawn
Avenue. However, the State refused to reduce the speed limit to
15 mph. If Mr. ' Quinn 'would" like a' resolution from the Board
supporting a -1-5 'mph speed 'limit ''on Leeton- Drive he will be glad to,
make- the resolution, but feels it is fruitless.---Mr. Quinn stated
he is a professor- of law, he has worked with th-e governor -in 'Alb"any
and he is not the least bit reluctant to move on this in Albany,'
but feels the position is -much stronger if the people- in the
community say it is necessary and with that' support he is .more
than prepared to go to Albany.
On motion of Councilman Homan, seconded by Councilman Pell, it was
RESOLVED that the .Town BoardIof the- Town-of Southold supports the

,Miss Jody 'Adam 'asked what' Item 26 on the agenda, 'polluted clams
refers to?---Supervisor 'Martocchia explained that the Town has
been involved for the 'Just severa'l' years in- clam transplants'. '
$1500.0-0 is budgeted for this purpose and' a matching amount is "
received from the State of New York. $3, 000.00 worth of clams is
ordered -and' relying` upon the Southold Town BayMen' s Association,
sites-are selected for planting the clams. This year the Baymen
selected Hallock' s Bay and Mill Creek. In turn, the Town Trustees
are 'asked -fora resolution that these creeks be closed for 30 'days
as they 'are polluted clams and 'it takes 'that long- for them to clear.
Mr. -William Weinhe'"imer" asked if something is going to' be' done about-
the ruts' and holes in the` parking area new' Chinam?---Supervisor
Martocchia stated that 'the' Highway Superintendent be taking care of-
that` area' soon, it was discussed this morning.
Mrs . Csaiko asked -whether there weren't provisions for a special
meeting of the Board, which could be" called at a later date, to
avoid the hassle they had on the building -inspector ' s salaries?-=
Supervisor Martocchia said there •is such a provision, but sometimes
it costs a day' s work. The Board members come in more than he ever
expected them to.---Councilman Homan stated that the request for
the salary increases is not news to the Town Board, it was discussed
at the, first o f -the year when Mr. Fisher. was' appointed Acting Building
lJuN Bat ® M.
Inspector. It was discussed again when Mr. Fisher was appointed
Senior Building Inspector and Mr. Hindermann was appointed Building
Inspector. It was also discussed again when Mr. Horton was appointed
a replacement Building Inspector. The only thing new -about it was
it was not on the agenda and no one here knew it 'was going to be on
the -agenda.— Mrs. Barbara Schrievgr said she does not think it is
in the best interest of the Board to have it seem as though it was
expected to be •a rubber stamp, she does not think it i-s n. the best
interest of the Supervisor, and she realizes that things can come
up at the last minute, but with a little consideration and forethought
something like this could be avoided..----Supervisor Martocchia stated
that he believes the Supervisor is closer to things in the Town Hall
than anyone else, and he has been evaluating this for at least three
months and he did indicate to the two building inspectors that he
would try to effect the change for them on July lst, and then it
occurred to him around 2:45 that there will be no meeting before
July 1st, and decided he should move on it today. He does not feel
what he ,asked for is unfair to the taxpayer, the taxpayer is getting
their money' s worth from these two people and he has no shame in
recommending that salary.
