SOUTHOLD TOWN BOARD

Executive Session
Herbert Shaffron, TECC Resource Recovery Systems, made a presenta-
tion on solid waste management. (1175 Walt Whitman Road, Melville,
11746, Suite 200, .427-6400. )
Representatives of Lockwood, Kessler, Bartlett made a presentation
on solid waste management. They will submit a written proposal.

A regular meeting of the Southold Town Board was held at 3: 00 P.M. ,
Tuesday, June 6, '1978 'at the Southold Town Hall, Main Road, Southold;'
New York. . Supervisor Martocchia opened the meeting with the
following present:

RESOLVED that the minutes of the May 23 , 1978 Southold Town Board
meeting and May 31, - 1978 special Southold Town' Board meeting be
and hereby are approved as submitted.

Councilman Henry W. Drum made a report of the first meeting of
the Technical Advisory Group (TAG,) held on June 1, 1978. The
meeting was chaired by the Deputy Commissioner of Transportation,
John Sheridan, _wi th representatives from State, County, -Town,
Community and business in attendance. -The purpose of TAG is to
provide technical input into development of the master plan for

the County Airport. The airport study commenced in February 1978
is 90/ Federal funded, for a twelve month period. Included in the
study will be the impact of the airport becoming an International
Airport as approval of the "Free Trade Zone" application is antici-
pated. The Zone is adjacent to the airport, not the airport itself.
It is planned that the airport will provide services to both, the
south and north forks as well as Western Suffolk.
Supervisor Martocchia:
1. The committee of Supervisor Martocchia, Councilman Pell,
Councilman Drum has been formed to discuss with Frank Csajko an
approach .to handling the request of the North Fork Animal League
for 'a location for their shelter .
2. Letter from the Suffolk Developmental Center, Alan R.
Sutherland, Acting Director, relative to the program of .the Office
of Mental Retardation and Developmental Disabilities for Community
residences. When they were before the Board on March 21st they
asked that a person or group,be designated to work with them as
liaison in the selection of sites for this program so that .the
community could have its input. Councilman. Homan and Councilman
Pell have been designated to work with this group.
3. Letter from the Department of the Army, Corps of
Engineers stating they will conduct the survey requested by the
Town Board at Mattituck Inlet beginning on May 28th and furnish
-the Board with several copies of the survey results when they
become available.
4.. Letter from Shepard M. Scheinberg, attorney for the
Fellinger-Ihars relative to an arrangement the Board is trying to
arrive at for a serious drainage- problem on. Duck Pond Road, Cutchogue.
The owners of the property are in controversy with the Planning
Board relative to the per bond., The Supervisor has been
authorized to call a meeting between the property owners and their
attorney to try to resolve the situation -of the drainage parcel.
which was supposed to be turned over to the Town.
5. Letter from Minnesota Construction Corp. , general
contractor for the town hall addition, asking that the old town
hall be -moyecl ;from its present location. as it is .hindering the
progress of their work. The sale papers with Southold Equities,
Inc., will be signed ,today. The specifications state that within
15 days arrangements must be made to move the building and 6.0
days to complete.
6. Letter from Schriever Construction Company, Inc. , William
W. Schriever, President, giving notice to the Town under the "Notice
of Highway Defects," with respect to a ,large evergreen tree located
on the west side of Tabor Road approximately 100 feet. south of the
Main Road in the hamlet of Orient. "The tree severely obstructs
the view at 'the entrance to our. shop ,property a,nd, has already
resulted in several incidents 'in which accidents were narrowly
avoided:. " Highway Superintendent Dean will look into the matter...
7. Notification to the Town upon application of Kathryn
Robedee, Pine - Tree Road, Cutchogue, to. the New-York - State Depart-
ment of Environmental Conservation_ for permission to dredge in
Little Creek. Comments will .be received until June 15, 1978. .

RESOLVED that $10.85.77 be and hereby is transferrdd from the
Operation of the- Ferry Account, Fishers Island .Ferry District - to
New York. State Retirement Account.

Supervisor Martocchia:
8. Notice, from the Long Island Lighting Company stating
they have filed new rate applications with the Public Service

Commission, The new rates would increase gas 'revenues.by .13 .1%
and electric .revenues would increase by-,18. 5/. They state May
1978 is .their target date for the new rates.-=-Mr. James Bitses
asked if they would entertain discussion - from the-floor-at thi's
time? Could he make, a suggestion ,by which the town -could take
it into •their -own Viands and decide it themselves?---Supervisor
Martocchia stated he knows Mr. Bitses feelings, having discussed
the matter with him,. and feels at this time discussion on this
matter would impede ' the meeting.
9. Supervisor Martocchia announced, for the benefit of the
Cutchogue-Mattituck and Greenport-Southold Senior Citizen groups,
that the transportation van has arrived. He would like to meet "
with the officials of both groups so a program may be set up for
the use of the van.- He -will write to the individual groups re-
questing such -a .meeting. Presently there is a van' for the' Nutri-
tion Program which works out of St. Agnes 'Hall. ' There is another
one belonging- to the RSVP which is brand new, unused, sitting at
the Highway Department. Initially the Supervisor did not want to
go along with the program as there were buses which were unused,
but he- was cr-iticized highly for not going into the program
immediately: For the first year this van will cost the Town
nothing,- : however in the -following years the situation will change
drastically. The program is only funded for- one year . The
following years dravers, 'if necessary; - must be "paid- for, insurance,
maintenance, eta. -Supervisor Martocchia, personally, feels this
is a waste, that the need is not there for an additional van
in Town; however, the people spoke and- the van has arrived.---
A letter has been "received from the Greek Orthodox Church; Matti-
tuck, giving their reasons for feeling this new van is, vital, 'and
outlining their proposed uses for it.
10. A letter has been received from the Suffolk County
Department of Transportation •stating theirTransporta-tion Plan.
has been completed.-' ', This: is a study `of ,the needs of Suffolk County
for the next several years:) by --rail, over land; =air, ' etc and would
like- to come to Zoutho:ld Town and make :a---presentation. ' They will
be invited.
11. Letter from the Laughing Water Property Owners Associa-
tion Inc. requesting the dredging of- the entrance to Corey Creek,
Supervisor Martocchia has applied to the Suffolk County Department
of Public- Works for. a. study. - -
12. Several weeks ago, the Town Board took a stand on the
funds appropriated to the various school districts for sum miner-
programs . $12, 000 a year is divided among several school districts.
A problem arose with the Greenport school; .they are in =the midst
of an alteration . program• 'and cannot put the-'program -on this summer.
They asked if the money could be used for a fall or winter program,
and- the Board decided against this request.. However, Greenport
appealed and cited many conditions they are being faced with.
The contractor for -.the 'a'lteration project does notiwant anyone in
or aroundi. the building during the summer• months; there could, b'e ' a
problem with insurance. The Board discussed -the•:matter at length
this morning and is inclined to approve the appropriation'-- of the -
money., fo.r a fall_ or, 'winter ,program du e -to- the -particular, circumstances.
On motion of Councilman Pell, seconded by Justice Suter, it was
RESOLVED that the Greenport Public School be allocated funds for
a recreational program to be held in the fall and winter: It - is --the
intent of- this Board to, carry out a summer program throughout the
Town, but- due to the construction at, the Greenport School' this year,
we will grant the request present to us by' th•e Greenport School
Board -to ,.let.._them use--thee funds this year ,for- a winter program
on a one year basis" only.

-13 . The Board has been -notified that on June lst -bids were
opens d' by 'the Suffolk -County `Department of Public 'Works four clreda-
inn projects at_Gul1, Pond, :Greenport, Halls Creek, Wickham-Creek
and Cedar Beach. It is not known whether the contracts have been
awarded, .as„yet.----In..years; past, when,.-there was,: a dredging pro-
ject in a certain. creek--, the .Town would, put in :.a request. and :the.
County,;would. come .down .and do it. . Now,-..the projects .are put out
in cluster bidding,,... This eliminates the smaller .contractors, but
does secure bids from the larger contractors. i -There are . some county
dredge :meetings go ng • on ,now. to decide .what to do about- the dredge
and the.-,-Supervisor will keep the public informed on .what is happen-:
ing.

.14. Receipt of: a letter from Greenman-Peder.sen: Eng. , - relative
to the. town hall, addition.; Some of the delays in the. construction
have occurred- due to the_ fact they. cannot always meet the require--
ments of a:.certain percentage. of minority workers on this project.
The most there have been at any time has been two carpenters:, one
electrician, two_:.plumbers . : . ,
15. Letter -from residents of, Leeton .Drive;, Southold, re.la
tive to speed problems they have been having. The Chief: of Police

met with the Board today and discussed those problems and feels
there is nothing legally the Town can do about. the problems out-
lined by the residents of Leeton Drive except more enforcement.---
Mr. Thomas Quinn a resident of Leeton Drive addressed the Board.
He -stated the request is simply a reduction in the speed limit..
The limit is 30 mph and 'they have been traveling 'through there'
much ' faster than that. They suggest 15 mph. The 'area is alive
with 'small children and something serious is going to 'happen.
They understand the Town of Southold doe's "not "'have'a'nything to' `say
about the speed limit, they could go to the State Ieve1, 1f the
Town would only say'.'thelre are grounds for reducing the. speed "limit
from 30 mph to 15 mph. --Supervisor -Martocchia. stated Chief `Cataldo
stated he did'not' feel -he could get, a 15 ''mph approval from the
State for teeton Drive.---Town Attorney' Tasker ..stated the ,,,,Town
does not Piave 'authority to regulate speed zones , the most they
can do is make recommendations to 'the Department of Transportation..
Usually this recommendation is sent to the Department of Trans-
portation by the police: The 'Chief believes it is almost `impossible
to have a speed"limit of 15 mph, they will not reduce the limit"
to 15 mph. The -Chief also believes that' a 'reduction to' 15' mph
would `riot solve the problem...- Mrs. Anita Quinn "stated she has
signatures of almost all of the 'residen'ts on Leeton Drive and
does not know why the- Town cannot send their request of 15 mph
on to the' State Department of Transportation. She has called the
police many times , "but' `cannot 'get the' license plate number to
report it as' they going too fast." Mrs . Quinn suggested that .
speed bumps be in Attorney Tasker stated that if they
instctlled' 'speed bumps they would have moree accidents for which the
Town would be sued. They have a difficult enough time now getting
insurance coverage; if they create hazards on a public 'highway
they are just opening themselves to: 'problems.----Mrs. Quinn said
that Leeton Drive is not a public -highway, it .is `a secondary
road.--=Mrs: Quinn 'was . adv sed '"it is' 'still a 'public town highway.
Speed bumps are seen on private roads , butnot on public highways.
Chief .Catsldo -.advised `the Board today -that he would pursue the
matter further with "pat ro1,s: The Su"pervisor will also refer this
matter to the Police Committee, Councilman Homan and Councilman
Drum, .and they will talk with the chief ^again to 'see if there are
other angles that can be pursued.'---Mrs. Quinn stated that twenty-
five families on the street aan represented on the petition and
they are all upset about the . situation and would like it changed.
---Councilman "Pell advised Mrs: 'Quinn that the rQquest .was just
received 'today: The Chief spoke to them about/and lie will inVes-
tig.a to it, a long. with the Police Committee, ' and when the Board
meets again in two 'weeks .they will make a recommendation to the
Board, and the Board will act 'on the recommendation. '. The�; ,request
was just received today and Councilman Pell himself would Pike to
ride down and look at it. - If 'he had it last -week he could have
already investigated . i:t prior 'to the meeting.----Mr. James Bitses
stated that there is another' "means by'whch this can be solved,
quite `often communities that have small secondary roads of this
type build into the road itself a small "'S" turn "at the' very
beginning ,of the road. Very .often" in town planning they use these
in order to discourage thru traffic and 'also to'- slow down the traffic
that does come through. T his is commonly done through out the
country.---Supervisor Martocchia advised Mrs. Quinn, the' Board -
would "get back --to her after further investigation.
On "motion of Councilman Drum,- seconded by Justice -Suter,. it was
RESOLVED that "a recess,, ' for 15 minotes,. be `called at this time,
3: 30 P.M. , for the' purpose of" holding a" public hearing on a proposed
Local Law entitled "A Local Law Providing for the establishment and
pperation of Recreational Vehicle Parks in the Town of Southold. "

Supervisor Martocchia':
.16. There has been some' discussion relative to 'the Mattituck
Airport not providing enough service. There is less than a year
to go on the Mattituck Airport lease, and although a renewal is
pretty well assured, . Supervisor Martocchia appointed Councilman
Drum,and he to appoint his own committee,' to make a study among
the Southold Town residents , to determine the cost to lease ,or
purchase land. If a .purchase is involved, the loss of income
from taxes, the cost to the town, cost of a building and staffing
and equipping an airport to _make it operational. , Councilman Drum
was appointed because :of his 30 years in' the Navy, many of which
were in an administrative position, .retiring as a Captain, and
Supervisor Martocchia felt he would be the most qualified to gather
these statistics. There are many items which may come into the
picture, such as state or federal aid. This report will be sub-
mitted three months prior .to the expiration of the .Mattituck "
Airport` lease in March of 1979.
17.. Another request .has been. received for extension. of - .
CATV into the Indian Neck area in Peconic'. The Board is -meeting
with representatives of CATV at 4: 30 this afternoon. The 'Board
was quoted increased figures and given four suggested areas for
the extension of CATV, namely Nassau Point, Captain Kidd area in :
Mattituck, Bayview, Southold and Orient. Supervisor Martocchia
has since added Beebe Drive, 'Cutchogue and Laughing Waters,
Southold. It was his thoughts on the rate increase that possibly
a 25� or 50� increase would be .acceptable 'if the. new areas were
included. However, CATV is looking for an increase. from $7.25
to $8.05 which is an 801� increase, plus the cost of the new areas
for service. He assured the public that the Board will fight
all the way to try .to get 'the best deal they can.----firs . Gladys
Csajko asked the Board to keep in the back of their minds that a
lot of people are .tied into contracts '.on this.----Supervisor
Martocchia stated that further increases CATV is looking for is an
increase from $30.00 to $40.00 for -installation and "a second
connection from $1.50 to $2 .50.---Mr.' David Driscoll asked if
there will be a hearing on the rate increase?---Town Attorney
Tasker stated there must be 'a public hearing.
Councilman Pell made a report on .a study he has made on the
Mattituck Inlet. Sometime ago a group f .Mattituck residents took
him on a tour of the -Mattituck Creek and submitted to him a .list
of eight recommendations which they would like the Board to consider.
This list was received today and is as follows: . The residents
feel: (1) The Mattituck Creeks: is our largest commercial and
residential creek in Southold Town, (2) , It has over 150 tourist
boats using the area each weekend, (3) they are -very much concerned
with the dumping of human waste overboard, (4) The Mattituck Park
District that once provided some control now has backed out' and
there is no permanent patrol.---(8) The last suggestion they made
is that the Town Board .employ someone over the summer and have them
based out of the Mattituck Creek and could be called elsewhere
when needed.----This report was. turned into the Town '-Board today
and Councilman Pell hopes by two weeks from not when the Board
meets again there will have been further time to study and evaluate
the request.---Supervisor Martocchia made some observations on the
list from .the residents----they claim it is the largest residential
and commercial creek in Southold Town-=-he .questions that.., They
indicate 150 tourist boats, he questions that unless they are
talking about the weekend of the Strawberry Festival. They talk
about pollution----there is a report on that. ----Justice Suter
stated that. a couple of years ago this same question was raised,
and at that time Paul Murphy and a group of residents from 'Browers

Woods .questioned the pollution in the creek and. the Board asked
the DEC to make a. study of it, which they.,did, and their report
showed that the pollution is not affected on the weekends when
the boats are in, in ,July and August, particularly, but. is affected
very..strongly by the run off of .sewage and rainwater after a storm
from the_ roads, and; properties.---Chief Cataldo was brought into
'this discussion earlier in the day and, ,it was pointed out that
where the residents indicate the Mattituck Park District. ,provided ;
the patrols, they were wrong, it was the Town of Southold that
provided the patrols,. In the Chief.' s opinion, the ,patrols were
not. warranted, except occasionally'.` The Town .works along the
lines of having the , residents call the police and they will. respond.
However, as far as patrols in the summer, that is no problem;, they
do hire seasonal bay constables for that purpose.---There.. will be
a full report for Mr. Pell to take back to the Mattituck residents
by the next Board meeting.

RESOLVED that the Town Board of the Town of Southold set July 11,
1978, 3 : 30 o ' clock P.M. , Town Hall, Main Road, Southold,New York
as time and place ..for a public hearing ,for the purpose. of con-
sider,ing. a ,proposed. c.ontra,ct with the. Village .of Gree.npor.t,
Suffolk County, , New York, for, the furnishing of water for fire
protection purposes. by said Village to, the_.Fire, Protection
District established. in said Town and known as "East-West
Greenport Fire Protection District, Town of Southold, N.Y. 
upon the following teneral terms, to, Wit: ,
(a) The contract, shall be for a term of five years.
(b) For such service the Town. of Southold shall pay the
. village of Greenport the annual sum of $70. Q0 for each fire-
hydrant.
(c) Such other incidental terms as may be necessary or
proper in connection with such contract-.
All persons interested in this matter should appear at
the- time and place ..above stated.

is authorized to _enter into an agreement with .the New York State
Division of State Police, - a Use and Dissemination Agreement for
Nationalcrime _ Information Center (NCIC/CCH) ,. National Law Enforee-
ment .Telecommunications System (NLETS/CHRI) .and Di4sion of Criminal
Justice Services, State-Wide Summary Case History_ (DCJS for the
Exchange of Criminal History Data Through- NYSPIN Terminal Access.

Supervisor. Marto cchia .explained that .the ,prior resolution is
`necessary to obtain data from the Sheriff..' s Office or State Police.
There is no cost. It is something that has always been available,
however, now the federal and New. York State rules have changed
which .now .require that there be a written contract with them before
they will give.-.out the information they have always given them.
Supervisor Martocchia:
18. This is the last day for receiving resumes for the
Board of Appeals ' vacancy. Hopefully .there will be an. appointment
at the next-Board meeting.

Mrs-, Csajko asked what' Agenda Item 8 (e.) .Northville Industries
Corp. re:- - Mattituck Inlet referred t'o?---Supervisor Martocchia -
-stated that tied in with_ the study being made at Mattituck Creek.
Northville Industries' had lodged a complaint that things looked
pretty.bad . there and what was the disposition of -the study. ' The
Supervisor has. no " disposition,.. it is' in 'study and they are staking
out areas not.. As soon as the information is available, Northville
will receive a copy, of it.
Mrs . Csajko asked.. about Item 8 (f). James M. Huntley, R.L.A.
proposal---Supervisor Martocchia stated that is a' consulting firm
offering their services for a fee "to aid in subdivisions, planning,
etc. The Town is presently tied in with several local consulting
- firms at the present time.
Mrs. Csajko asked about Item 8 (g) Judy and Walter Mengeweit re:
Cablevision Channel 12---Supervisor Martocchia stated that is a
letter relative to moving channel " 2 to 12 and putting homebox on
channel 2.
. Mr. David Driscoll asked how much is in' -the budget for the services
of the 7th Squad?---Supervisor Martocchia stated the Town pays
about $225, 000 to"the County for the Town of Southold -share. , Need-
less to say that town does not- make use of all the services that
are available to them. There is a multitude. of services. This"
includes the office of the Medical Examiner, the' service of any
number of back-up men for the Town Police should there be . ap
emergency incident. .. Many legal services are availab..le. However,
the Town prefers to' inaintain their own Police Department and in
effect that means, the Town' is paying for a duplication of services,
many of which are not used. The County. Charter mandates that the
various towns pay their share for County Police protection and
services and there is no way of. getting out of it.
Mrs. Csajko asked who owns the RSVP'bus?---Supervisor Martocchia
stated it .is a County bus; RSVP is a County project.,---Mrs . Csajko
asked, with reference to the Senior. Citizen Van, wha'; . was- the
mention about transportation at the Greek Orthodox Church?---
Superkisor Martocchia stated that there are senior citizens in
that area who know the bus will be available and asked for trans-
portation to the business community.
_Mrs. -Csajko asked if there is . a size in mind for an air_ port?---
Supervisor Martocchia said not at the present time. The matter . of
the airport study has come about because the lease will be
coming due and Mr. Parker Wickham would prefer not to negotiate a
lease if the Town wanted him to expand in various ways. At the
present time, other than resurfacing the runways approximately
every five year and snow removal and` sweeping, there is not.much
more cost to having the lease at .the airport.---Mr . James Bitses
and Mrs. Csajko asked several questions - of Councilman 'Drum relative
to what he would be looking for in the way of land and- facilities
for a town airport.---Councilman Drum indicated that is what .the
study- is all about and he can make no determination at the present
time, . without such 'a study.
Mr. Bitses said he understands the Town Board has an .interest in .
the use of garbage to generate electricity and steam. -Would the
Town Board expand 'discussionto include preliminary study and analysis
of the possibility of the Town taking over or purchasing LILCO
electric distribution in this Town and creating a Southold''Power
District in oonjunction with the Southold Sanitary District which
will probably have to be established?' Each would produce revenue
for the other and lower taxes by paying a 'higher percentage 'of taxes
than is presently being paid by either LILCO or, the Town Dump

facility itself.--- Supervisor Martocchia stated. that today they
had two more presentations, one from TECC Corp. and the other from
Kessler, Lockwood and_. Bartlet_. They will both present a program
of their services. Prior -there have been presentations by three
or four other firms along' those same 'llnes. The Town is preparing
for the future in looking into what plans are available. There
is one- more presentation to come, with the Grumman Corporation,
involving the Southampton Town Board, Southold Town Board and
Riverhead Town Board.---Mr. Bi'tses asked what about the Southold
Power -District?---Supervisor Martocchia feels that Town may be
rath r small for that, Greenport Village is having a problem
surviving with their light and power plant.
On motion of Councilman Homan, ' second-ed by Justice Suter, it was
RESOLVED that a recess be called at this time, 4: 25 P.M. , meeting
to reconvene at 5: 00 P-.M.

At 4: 30 P.M." the* Board met with Peter L. Jones, Vice-President
of Long Island Cablevision and Tom Robbins, chief engineer for
CATV. Mr . Jones stated the reason for the requested increase in
rates is- that the investors are not earning a reasonable rate of
return on their investments .----Town Attorney Tasker and Justice
Suter, after examining the financial statement submitted by Mr .
Jones, insisted that it does not show a breakdown for Southold
Town. . Mr. Jones said- such data did not exist, showing Southold
Town alone. After much discussion Mr. Jones said he. could prepare
an allocated financial statement for Southold. The Board said
they would look forward to seeing this, as sucha request-has been
before CATV since 1965 and has never been received.---The matter
of putting channel 2 on channel 12 and using channel 2 for home
box office ;was discussed at length. CATV made this switch without
approval of the Town_ Board, a stipulation which is in their con-
tract. Mr. Robbins said they sent out 800 questionnaires to cus-
tomers asking their opinion on the proposed change, but received
Tittle response. Mr. Jones agreed they were in error in making
the switch and asked how he could resolve this matter. The
response was, put channel 2 back where it was. Mr. Jones said
this would be virtually impossible at this point, without removing
home box office entirely.----Supervisor Martocchia stated there
will certainly be a lot more discussion on the matter of the
proposed rate increase, and more meetings with Mr . Jones before
this matter will reach the point of a public hearing.. At the
present time, he is unwilling to support such an increase.

On motion of Councilman Pell, seconded by Councilman Homan, it was
RESOLVED that the Town Board of the Town of Southold opposes the
adoption of Assembly Bill A-11929 and Senate Bill 8987, with
reference to changing New York State Law to make possession of a ny �
striped bass _less than 26" in length illegal in the State of New
York.

The Town' Board discussed the need. for additional uniformed police
officers to handle -traffic during the tourist season. -The Town
Clerk was instructed to write a letter, to_ Ch!t.ef Cataldo directing
him to put the two newest . detectives, Joseph Reiter , a.nd Joseph
Conway, back in uniform immediately, and further stating .that, this
action is taken due to the need ,for additional - uniformed officers
in the field .to handle the additional; traffic being generated by
the,. .upcoming tourist season.
