On motion of Justice Suter, seconded by Councilman- Homan, it was
RESOLVED that the minutes of the _'May 9, 1978 Southold Town
Board Meeting be and hereby are approved as submitted.

On motion of Councilman Homan, seconded by Councilman Pell,
it was
RESOLVED that the next regular meeting of the Southold Town
Board will be held at 3: 00 P.M. , Tuesday, June 6; 1978 at the
Southold Town Hall, Main Road, Southold, New York.
Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:
Justice Doyen.

Supervisor Martocchia:
1. The Board has received the Audit Report for the
_Fishers Island Ferry District for the year eneed December 31,
1977 from Doherty and Company, P.C. , Certified Public Account-
ants, New London, . Connecticut. The Supervisor has requested
the accountants to supply further details to the report.
2. The Board has received an assessment and evaluation
on the -audio-visual equipment purchased during the Bi-Centennial.-
This assessment was prepared by Donald G. Fisher of Sound
Productions, Southold.---It is the feeling of the Board that
all units of Town government should be notified of the existing
equipment, to determine if there is a need for them, before
disposing of the equipment.
3. Letter from Children ' s Bible :Fellowship for per-
mission to use town beaches for bible study.---They have been
notified that there are beach parking permits available for
parking at the town beaches.
4. Item 8 on the agenda, "Appraisal . of property on
Boisseau Avenue, Southold" , must be discussed further before
bringing to the public.
5. Information Memorandum received from the ,Suffolklt
County Office for the Aging, stating Suffolk District Attorney
Patrick Henry is urging the county' s senior citizens to be-
ware of the "stranger at the door" . The elderly are the prime
target for the "Spring-time racketeer" as well, who offer
cut-rate home repairs. The' District Attorney suggests Do '-s and
don`ts. for their protection..---Copies of this memorandum will be
sent to `the local senior citizen organizations and to the local
newspapers.---Justice Suter stated that in the last couple of weeks
he has- had cases where local 'people have been getting judgments .
against outside contractors, only to find they 'are bankrupt. People
should see that 'the contractors have a local license and know
who- they "are doing business with.
6. Copy of `a' letter from the League of Women Voters of-
Riverhead/Southold to Col: Clark H. Berin, Department of the Army.,
N. Y. District, Corps of Engineers., concerning notice of .applica-
tions to the Corps of Engineers with the statement "The work applied
for has already been accomplished without prior authorization and
the .Corps declines to initiate legal proceedings at .this time."
'The League objects to the granting of permits after the fact.
They feel legal proceedings should be :instituted and appropriate
penalties :,considered'.-'-=-=The Board ;will await the comments of the
Corps of Engineers.
On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED- that the Town Board of the_ Town' 'of Southold accepts the
amount of $35, 000 bond estimate for improvements in the subdivision
to be known as "Col. Ted Dowd as recommended by the Southold Town
Planning Board and Engineer Lawrence M. Tuthill.

On motion �of Councilman Pell; seconded by Justice Suter, it was
RESOLVED that Supervisor Albert.- M. Martocch'ia be and he hereby is
authorized` to .execute a lease between the Town of Southold and
David Rothman for a parking field in 'Southold. This lease is for
a term of one year 'commencing June 1; 1978, with an automatic
extension for five consecutive ohe year terms.

7. Letter from Charlotte Gadomski, 455 .Summer Lane,
Southold, including a signed petition by nine residents of Bayside
Terrace, . requesting that Summit Drive and Summer Lane in Bayside
Terrace -be accepted as town roads'. ' =-Supervisor Martocchia stated
this matter could be handled as a road. -improvement district, whereby
the road's -"are' improved. to town specifications and the cost, of .this
improvement is assessed to the property owners along the roads in
question and paid over an approximate five year period— Highway
Superintendent Dean will discuss the matter with Mrs. Gadomski.-
8. Letter' from the Slo-Pitch League requesting funding
to help cover some of their expenses for the 1978 .season.---Some-
time soon the' Board will sit down with the managers of the various
leagues and work out the disbursemerit "of approximately $6, 000 which is
available for this purpose.
9. - Receipt of a letter from T.E.C.C. Corporation (Total
Environmental Concepts and .Capabilities.) regarding solid waste
management. This company will be ' invited to make a presentation
as has been done with three previous Icompanies.---Another _proposal
Supervisor "-Martocchia' heard 'about is by -the Grumman Corporation
for a study covering Southold, Riverhead and Southampton. After
T.E.C".C-: has made their presentation, -Supervisor Martocchia will
get in 'touch- with Grumman and request a "representative to meet
witYi" "t:he- Board and "give a presentation of' their proposal.
10. A letter has been received from the Suffolk County
Department of Environmental Control stating they have received an
opinion on open burning in Southold ToWn �from _the New York State
Department of Environmental Conservation, which . states _the "real"
population of Southold Town is over 2.0, 000,, even though the LILCO .
.
survey states 19, 805. Southold Town is a r-esorttarea and the
population increases during the summer months, 'and Towns with
population over 20, 000 are not permitted open burning.---The D.E.C..
submitted -an application which can be ,used for applying for a burn-
ing permit, even though it will undoib tedly be denied.
11. The annual Memorial Day Parade' will be hosted .by, the-
Griswold-Terry-Glover Post No. 803 and .l-e ld on Monday, May 29,_
1978 at 10: 00. A.M. All members of the Town Board have been , invited
to participate.
On motion of Councilman Homan, seconded by Councilman brum, . it was ,
RESOLVED that the bid :of Southold Equities', Inc . in the amount of
S8', 117.00 'for '_th_e old Southold Town Clerk' s building, be accepted,
and the Supervisor be and he hereby is authorized to execute all
documents to affect the transfer o,f title from the- Town of Southold
to Southold` Equities, Inc.

12. On Thursday, June 1, 1978_ at 10: 00 A.M. in Hauppauge,
County-Executive Conference Room, there will be a meeting to .
discuss the comprehensive youth plan and the relation of the state
to the ,county and� the county to the towns. . A representative. of
the INew York State Division. for Youth will be present.---Someone
from the , Town Board will be present at this .meeting..
13 . . Mr. Peter Jones aid a representative of,- the home office
of L.I . Cablevision Corp. met with Supervisor Martocchia. to discuss :<:
several areas . of' line extensioni.n_ Southold Town,. namely Nassau
Point, Bayview, Southold, Orient, Capt. Kidd, area, Mattituck. He - .,
also indicated that if any individuals had areas they wish extended-,
those areas would be incorporated in the study. One area mentioned.
today was Laughing Waters . Mr. -Jones will be invited .to the next
Town Board meeting to discuss these extensions.---Mr. David Driscoll
asked if it wasn't correct that when the franchise .was renewed
channel _2 'was to revert to 'channel .2 rather than remain on 12.---
Councilman ' Homan stated it was not a point of discuss at the re-
newal -of -the contract.---Town Attorney Tasker stated that when the
contract was renewed channel 2 was on channel 2. After the con- .
tract was signed, and without Board approval,. they switched 2 to

discussion with CATV at the present time.
14. Receipt of letter from Nassau Point Property Owner,
Association relative ' to CATV.---This is one of the areas marked
out for consideration.
15. "The matter of, "lead agency" under the State Environmental
Quality .Review Act was discussed------Town Attorney Tasker stated
that under the law, when an application is received .it is. then
decided who will be the lead agency; whether it be .federal, state,
county or town,- depending upon which one will. be most , vitally,
involved with the process of 'the application,. That .is ,when a
determination is made as to who the .lead agency is, in each case..
---Supervisor Mattocchia 'state' d they have received a letter from
Ecological Analysts, Inc. , Middletown New York indicating they have
developed a -staff of experts ready to assist the town in ,fulfilling ,
its responsibilities under SEQR .'in a prompt and cost-effective
manner, and to aid in selecting 'critera:a that are most appropriate_
to local environmental conditions . They can also assist the Town
in making the "initial determination" of whether an action would
have- significant effects on .the local environment.

WHEREAS the said petition was referred- to the Southold ,Town Planning

bid, but. no :one bid. If anyone wishes to discuss such a lease, ,
they should see - the- Supervisor on-:this .matter. : ,
The . Town. Clerk was instructed to write,- a letter to the Southold
Town Trustees .requesting that Hallock.' s Bay, Orient; and , ill,
Creek, Southold, .be plosed when the clam transplanting begins.
The..Southold Town .Baymen''s Association suggested these-.two sites.
and feel , these ,creeks should be closed for 30 days.

Supervisor Martocchia mentioned .the Fishers Island Ferry District
Audit report for the year 1977;- the -appraisal of the sound ' equip-
ment.
Mr. Driscoll asked whether the Supervisor was going to make a
report. on their meeting last week? Sup'e visor -Martocchia stated
there wa-s- no meeting- Yield Ias't week, the last meeting- was May ' 9th.
---Mr. Driscoll said there• was a special meeting.---Supervisor "
Martocchia asked • if Mr. Driscoll was referring 'to 'a contemplated
specia-17meeting "re-lative to a bill in Albany. amending the Highway
Law_ changing the limitation of expenditures on hiahway• machinerv'
in certain towns from $100, 000 to $200, 0'0'0-. He had a call 'from
Assemblyman Bianchi that the bill they had approved was defective; -
the article and 'd'ate Was' wrong. They were' going to try to correct
it. 'Supervisbr, Martocchia said -hey would ' like the corrected bill
sent to him before the Board acts on it., Mr. Bianchi said he-
wanted it for Monday, May 22nd and could not get it from Albany
to Southold in time, but to call Southampton and reque'st' a- c'opy
from 'them.- Southampton -said they did not have- it. Since 'Council-
man .Pell was -going to be away -at the' 'ehd of- Flast week, he '"was
asked to -=sign. a -waiverfor a special meeting in ' the event" one
had to be called' for ``this special purpose. The- special 'meeting
wa.s' not called because the•ne�ce'ssary material was not' received.
---Mr: Driscoll stated he stands corrected.
Mrs. Gladys Csajko asked if a referendum is required to make
this change from 5100, 000 to 5200,000?---Town Attorney Tasker
stated what they are talking about is a provision in the Highway
Law which -says • in towns of certain- sizes you cannot spend more
in any one year for highway machinery than $100, 000 unless you
submit a proposition. to 'the people 'and' they approve of it. What
was submitted to the Board was a bill 'in' the State Legislature
to change- that state law to raise' •'it from $100, 000 to $200, 000.'
This bill did not" only affect Southold; there 'were several other
eastern towns involved in -the bill. - Such a� law, because it applies
to less than"a-ll the towns, requires a local home' rule' inessage.
OUr constitution' says 'if you- change 'a law which applies to some
municipalities and not� all, it is a' special''law and the legislature
can't pass it without the consent of those municipalities affected
by it. 'Apparently 'after all -this was done, '"they looked at the bill
they had and found there were some technical errors, probably
references to wrong chapter numbers or section numbers in= the law.
That:-meant- they had to amend it, and'=when they ;amend it, it is in
effect a new law and they must start all over again, 'resubmit- it
back to the municipalities. That was what the special meeting
would- -have been- for had they submitted to us the amended bill.---
Mrs. Csajko 'thought that ' the first time around they 'were acting
on something the' legislature had already done. Councilman -Homan
stated, to clarify this further, many- people think that ,if this
law is -passed the- Boardwill have`the automatic 'approval to go
out and spend this money. They budgetted $88, 000 this year -and
that is how much they can spend, they can only spend what they`
budget. What this bill does is • raise 'the amount that' can.be put
in the budget. For the $88, 000 this year, they are not going to
buy any new major equipment. If a payloader at the 'disposal area
breaks -down' .you are 'talki' g about '$75, 000, 'or a smaller piece of
equipment-at $35, 000*. ' The' thing is, is the Town better off going
for a bond issue for -five or six -years or trying to jockey the
budget around and getting the one piece of equipment and buying it
outright and not paying interest. They would then have the --
latitude to buy orie' iarge piece of equipment by budgetting -the
money. This would allow them to raise the amount and maintain
their equipment without having to go to bond issue which he thinks
is a much better way -of running a town, than''going to bond issue
and putting the' town in debt.

WHEREAS, this Board has learned with deep sorrow of the death,
of James Maimone, member of the .'Zoning Board. of Appeals. .Southold ,
Town, and
WHEREAS, in his service to the people of the Town of Southold as
a member of the Zoning Board of Appeals Mr . . Maimone has been a

NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town
of'. Sou.thold hereby gives formal expression of .its loss in the ,
death of James Maimone; and be. it further
RESOLVED that when. the Town. Board adjourns this day.•, it do so
out of respect to ' the memory, of James Maimone, and that a copy of
this .resolution be transmitted .to the family of Janes Maimone
that we may extend to them our sincere sympathy.
Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:
Justice Doyen.
