Cr'on, Attorney for the Town in certiorari proceedings, to discuss several cases now pending,, WORK 77 SESSION 9:4.0 A.M. - Merlon Wiggin made a presentation to the Board concerning co-generation waste management plan vs. electric generation. The cost of the proposal would be covered 100% by 'Lo'yisa, and would be . located wherever the study indicates would be most advantageous. The steam generation proposal would be dependent upon steam cusomters, and Mr. Wiggin looks- to the town and county to encourage industry that would be steam users. 10: 10 A.M. - The Board began reviewing the agenda. 10: 25 A.M. - Sybil -.Mitzi and Paul Fink of Pan Tech, Management .appear.ed before the Board t., discuss the proposed cooperation agreement for fiscal years 1982, 1983, 1984. The Town will receive approximately 200, 000. 00 in each of those fiscal years. It was pointed out that if the Town is in the consortium they may not apply for Small Cities Grants.--The progress of the weatherization 'project at the Senior/ Youth Center, Peconic was discussed. EXECUTIVE SESSION 10: 50 A.M. -' Richard ' J. Lark, Attorney for -the :Town in Code enfor�.e- ment met with the Board to. discuss certain revis'ions' to the Code he feels urgent to aid the Building Department arid,:::Board of _Appeal s. WORK SESSION 11 : 35 A.M. - Mr. Harold Reese, owner and. developer of the proposed subdivision known as "Grandview Estates met with the Board to discuss the amount of the proposed performance bond., Town Engineer Lawrence Tuthill has prepared a bond estimate in the amount of $400, 000. 00 and Mr. Reese has obtained numerous estimates on various items and feels the actual amount of the bond '.should be approximately $200, 000. 00. The Town Board will request Town Engineer Tuthill to meet with Mr . Reese and review the bond estimate. 11 : 50 A.M. - John Kanas, President, North Fork Bank and Trust Co. and Don Deerkoski, Manager of their computer center, made an informal presentation relative to the process of receiving t'ax.monies by North Fork. During the past tax collecting season, North Fork received approximately $2, 000, 000. 00 in tax monies through the bank by mail . They then issued a check to George Mellas, Receiver of Taxes, who deposited the check in Chemical Bank where it is held approximately six days. Mr. Mellas then draws a check to the Supervisor who then writes checks to the various districts. Approximate time span is 11 days . If the Receiver and Supervisor had their accounts in the North Fork, credit would be- given within two days and for monies 41 received in the mail, credit could be given within two hours on the day of receipt. There was approximately $50, 000. 00 in lost earnings under the procedure used last year. If the process were handled by North Fork, there would be no charge to the Town for the services provided. ---Speeding up the process of distributing monies to the special districts had been discussed as far back as 1979, and it was the decision of the Board to place a resolution on the agenda directing the Supervisor and Receiver of' Taxes to transfer their tax accounts- to the North Fork Bank and. Trust Co. ..12 : 20 P.M. Recess for lunch. NOVEMBER 24, 1981 439 EXECUTIVE SESSION .t 1 : 35 P.M. - Pending zoning decisions were discussed. 1: 55 P.M. - P.B.A. President Henry Stepnoski and Patrolman 'Edward Sidor met with the Board to discuss the proposed 1981-82 P.B. A. Contract . WORK SESSION 2 : 10 P.M. - Board resumed reviewing the agenda. 2: 40 P.M. - Mr. Frank Bear addressed the Board relative to 'the Suffolk County Legislature meeting he attended at which time he had a discussion with Legislator Mrazek concerning the North Fork water study resolution proposed by Legislator� Blass. Legislator Mrazek told Mr. Bear he was afraid authorization for such a study would make it possible for other municipalities to come to the Legislature and request funding for special projects. Mr. Bear made a very brief statement to the Legislature on the subject of the proposed water study resolution . On December 8th a vote will be by the Legislature and Mr. Bear told the Board he felt it would be most helpful if the Board adopted a resolution at their regular meeting, urging the Suffolk County Legislature to adopt the resolution for the water study, at a cost of approximately .$105, 000. 00, proposed by Legislator Blass. Councilman Murdock pointed out that the Suffolk County Department of Health Services has recommend- ed the study due to the seriousness of the water problem on the North Fork. EXECUTIVE SESSION 2 : 50 P.M Discussed personnel . REGULAR MEETING r- A regular meeting of the Southold Town Board was held on Tuesday, November 24, 1981 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Pell opened the meeting at 3: 00 P .M. with the Pledge of Allegiance to the Flag. Present : Supervisor William R. Pell, III Councilman Henry W. Drum 'Councilman John J. Nickles Councilman Lawrence Murdock, Jr. Councilman Francis J. Murphy Town Clerk Judith T. Terry Town Attorney Robert W. Tasker Absent: Justice Francis T. Doyen On motion of Councilman Drum, seconded by Councilman Murdock, it was RESOLVED that the minutes of the November 10, 1981 meeting of the Southold Town Board be and hereby are approved. Vote of the Town Board: Ayes : Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. - On motion of Councilman Murphy, seconded by Supervisor Pell, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 7: 30 P.M. , Tuesday, December 8 , 1981 at the Southold Town Hall, Main Road, Southold, New York. Councilmen' s report, Councilman Murdock. 440 NOVEMBER 24, 1981 COUNCILMAN MURDOCK: As you know, last night we had a hearing with the Village Board of Greenport and the Town Board and H2M pursuant to handling sludge treatment. They also discussed the possibility or probability of bringing water from the outfall pipe down .to Cutchogue . . ) On last Tuesday we had a seminar sponsored by the Cooperative Extension Service in the New York State DEC building on capping landfills. Unfortunately I think very. few people realize what landfill we have in Southold and it upsets me a little when I keep going.-'.to these seminars and they keep talking about how you cap the la-ndfill that is 100 to 200 feet in height above the -ground and has these millions of tons of debris and they are existing landfills and acceptable and Southold Town is classified ) as an open dump and we have a very nice looking, very well graded piece of property that may -be six inches above ground level. The seminar was and the problems capping, landfills. I don't think it had very much to offer the Town of Southold. I don' t know whether the reply that I got for a question was facetious or whether. it was serious, when I asked one .of the people there what the process they were talking about, how it would apply to Southold Town and he said, "You have to put more garbage on your already closed 'part of the dump to bring it up higher" . I don 't know if that was a facetious remark or a serious remark. Marty things I' ve learned that come out of the DEC that I think are facetious at first, they're dead serious about. I certainly hope we don' t have to start spreading more garbage on the existing 15 acres - to bring it up so we can make a hill. for them to look at. That ' s all, Bill. SUPERVISOR PELL: Thank you. Councilman Drum? (No report. ) Council- man Nickles? COUNCILMAN NICKLES: I ' d just like to report that last week after all the heavy wind and high. tides it was brought to my attention that the parking lot at Kenney' s Beach had fallen into the Sound and was a dangerous condition and I called the Highway Department and they very expeditiously pub up guard rails and flashing lights so no one would drive off there into what probably is very deep water and subsequently they fenced off the entire area to keep people out of that area. SUPERVISOR PELL: Thank you. Councilman Murphy? (Nothing. ) Supervisor only has one thing to report. I attended 'a rr.,eting in Huntington concerning the railroad and perhaps the forma-cion of a Long Island Transportation Authority to make Long Island get away from MTA. I 've never seen so many people up in arms- in a long time over one specific thing. The county legislature was represented there, the county exec was there, everybody, just a lot of people there. There was two gentlemen from Southold Town there and it was really seeing people up in arms. If you read the papers in the last few days, the governor is even beginning to jump on the band wagon. Something might be done, something should be done. That 's the only thing I have to report. There will be a meeting held on the 30th with the MTA in Riverhead Township, which your Town Board will attend, with the railroad, with the problems that they have out here. II . PUBLIC NOTICES - COUNCILMAN NICKLES: 1. From the Department of Conservation, Notice of Complete Application by David M. Levitt to reconstruct existing stone jetties . and dredge and construct open pile dock, ramps, floats and "T" float at North Dumpling Island off Fishers Island. Comments by December 9th. 2. From the Department of Conservation, a public hearing notice on application by Energy Development Corporation to construct a _ municipal solid waste plant here at our town dump in Cutchogue. Hearing is 10: 00 A. M. , December 16, 1981. 3. Application for the Department of Conservation by Fred Cowan to construct deck with boat storage shed, catwalk, dock, ramp and floating dock at Mattituck Creek. Comments by December 16th. All of these notices are filed with the Town Clerk if you wish to examine them closely. , III . COMMUNICATIONS - SUPERVISOR PELL: 1. From the Department of State. It ' s fairly. thick. Last . -;June I wrote and asked them to come out and make a study of our NOVEMBER 24 , 1981 441 bookkeeping system here and see.,wha,t,, they,would recommend, and this is their report. It will be reviewed during the next six months by. myself and -the Town Board. They recommend in here, they come out with some sort of mini-computer, but there is no money in the budget for 1982 . So if the Town Board does see fit to go along this way, it will have to be in the 1983 year. So it will give us six months to study this and see what we want to do with it. 2. From the East End Art ' s Council asking us to put a member on their board, an ex officio representative from Southold Town. Board to their board. We will do this when we have our organization meeting in January. 3. From the Department of Public Works (Suffolk County) asking the Town Board how they felt about having a fishing walkway put on the bridge that will be built on New Suffolk Avenue (West Creek) . The Town Board has a petition here signed by a great many folks recommending it. Later on we will go back to that subject. IV. HEARINGS SUPERVISOR PELL: We have three hearings. At the proper time we will go to them. Right now we will jump over to resolutions. V. RESOLUTIONS . ; 1. On motion of Councilman Murdock, seconded by Councilman Drum, WHEREAS, in 1931 in the community of Mattituck in the Town of Southold, New York, a group of people did assemble for the purpose of establishing a church in the community, and WHEREAS, these people did establish the Advent Lutheran Church, and WHEREAS, the Advent Lutheran Church of Mattituck, New York under the pastorship of the Reverend George Summers will celebrate their Fiftieth ( 50th) Anniversary on December 17, 1981, now, therefore, be it RESOLVED thatthe Town Board of th,e Town of Southold does hereby extend sincere congratulations and best .wishes to the Advent Lutheran Church of Mattituck, New York. Vote of the Town Board: Ayes : Councilman. Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. SUPERVISOR PELL: Number 2, the zoning change for Mr, and Mrs . DeMaula, the Town Board has decided not to rule on this today. We still would like further information and all the members of the Board have not been up to review it yet . 3. On motion. of Councilman Drum, seconded by Supervisor Pell, it was RESOLVED .that the Town Board of the Town of Southold appoint Margaret Coulter as a part-time Clerk in the office of the Receiver of Taxes, effective when needed, at a salary of $26. 00 per day. Vote of the Town Board: Ayes : Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. SUPERVISOR PELL: Number 4, a gentleman has asked us to waive, which the Town Board has the right to do, his permit he would be required to get to remove soil from one piece of land he owns to another piece of land. The Town Board did discuss this and we decided not to waive the permit requirements. He must get the permit and he will be so informed. (E. M. Kontakosta) 5. On motion of Councilman Murphy, seconded by Councilman Nickles, it was RESOLVED that the Southold Town Board declare itself lead agency in regard to the State Environmental duality Review Act in the matter of the application of Enconsultants, Inc. for Neil 'Simon for a wetland permit on certain property located at the terminus of Harbor Lights Drive, on man-made basin off Southold Bay, Southold, New York. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. SUPERVISOR PELL: We decided on Number 6 to wait until we sit down with our Planning Board Chairman next week and this will be back on the agenda on 12/8 . (Proposed subdivision entitled "Richmond Creek Farms" approve .)r disapprove as being developed in the cluster concept . ) 442 NOVEMBER 24 , 1981 Number 7, the man that owns this development (Harold Reese) came in to the. Town Board today requesting the amount of the bond be reviewed by the Town Board and Town Engineer again. It seems that his estimate and the Town Engineer' s estimate does not come to close together. Therefore the Town Board is going to direct the Town Engineer to sit down and go over this. (Grandview-Estates) with the owner and resubmit it after they joinly review it. 8. Moved by Councilman Murdock, seconded by Councilman Drum, WHEREAS, the Southold Town Board would like to weatherize the Peconic Lane Senior/Youth Recreation Center, and WHEREAS, the insulation of the walls was publicly bid pursuant to an October 29, 1981 notice to bidders, and WHEREAS, Federal Conservation Group was the selected bidder, and WHEREAS, General Information Condition 3a calls for performance and payment bonds in the amount of 100% of the bid price, and WHEREAS, Lin Jacinto-, President of Federal Conservation Group has applied for these bonds, but desires to commence work prior to receiving them, and WHEREAS; in order to proceed expeditiously until such time as the above referenced policies are delivered to the Town, Lin Jacinto shall place in the custody of the Town Clerk a Certificate of Deposit in excess of the bid price, now, therefore, be it RESOLVED that the Town Board agrees to accept from Federal Conservation Group a Certificate of Deposit as temporary security in lieu of the specified performance and payment bonds, upon the condition that all of the right , title and interest of the owner of said Certificate of Deposit shall be assigned to the Town of Southold, and that the bank issuing the same shall consent to such assignment. . Upon the filing of the required bonds, said Certificate shall be reassigned to the original owner thereof. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. 9. On motion of Councilman Murphy, seconded by Councilman Nickles, WHEREAS, on September 23, 1980, the Southold Town Board elected to join with the Suffolk County Community Development Consortium in order to apply for 1981 and 1982 CD Funds; and WHEREAS, HUD regulations for grant eligibility.- have since changed, requiring new cooperation agreements for 1982 through 1984 funding , now, be it therefore RESOLVED that _Supervisor William R. Pell, III be and he hereby is authorized and directed to execute a contract between the Town of Southold and the County of Suffolk for Southold Town' s participation in the Suffolk County Community Development Consortium. This agree- ment to commence on December 1, 1981 and to continue in effect for Fiscal Years 1982 , 1983 and 1984 Community Development Block Grant . Funding. Vote of the Town Board: Ayes: . Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. 10. On motion of Councilman Drum, seconded by Councilman. Murphy, it was RESOLVED that --;he Town Board of the Town of Southold accept, with regret , the resignation of Jean H. Tiedke, Southold Town' s representative on the Suffolk County Solar Energy Commission, effective November 24, 1981, and be it further RESOLVED that a letter be forwarded to Mrs . Tiedke thanking her for her untiring and conscientious efforts on behalf of the Town as a member of the Suffolk County Solar Energy Commission. Vote of the Town Board: Ayes : Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. SUPERVISOR PELL: We -will be trying to find a replacement between now and the next Town Board meeting on December 8th, so if anybody has anybody they would like to recommend, if they would send their in to. my office or the Town Clerk, it can be reviewed and a replace- ment will hopefully be named on December 8th. They are meeting the next time on December 17th. 11 . On motion of Councilman Nickles, seconded by Councilman Murphy, it was RESOLVED that the Town Board of the Town of Southold accept, with regret , the resignation of Joan Dors , part-time Clerk Typist in the Building Department, effective November 27, 1981, and be it further RESOLVED that a letter be forwarded to Mrs . Dors extending the Board' s best wishes for the future. This resolution was declared duly adopted. SUPERVISOR PELL: Number 12�'we are not ready to move on. We will have to wait on that one also .' (Hire a part-time Clerk Typist in the Building Department . ) Number 13, Mr. Muir has made other arrangements. He does not need the money -at this time, he is going to go through the regular voucher system that people get paid by the Town. (Reimbursement of Robert Muir, Beach Manager, $480. 00 for purchase of surf boards. ) 14. On motion of Councilman Murdock, seconded by Councilman Drum, it was (a) RESOLVED thatthe Town Board of the Town of Southold authorizes the transfer of the following funds , necessary to pay legal services rendered by Smith, Finkelstein, Lundberg, Crimmins and Yakaboski: From: General Fund Whole Town Contingent Account-----$3,275. 00 To: General Fund Whole Town Trustees, Contractual--$3,275. 00 Vote of the Town Board: Ayes : Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. 14. On motion of Councilman Murdock, seconded by Councilman Drum, it was (b) RESOLVED that the Town Board of the Town of Southold authorizes the transfer of the following funds, necessary to pay legal services rendered by Smith, Finkelstein, Lundberg, Crimmins and Yakaboski : From: General Fund Part Town Planning, Contractual---$6, 000. 00 To: General Fund Part Town Zoning, . Contractual-----$6, 000. 00 Vote of the Town Board: Ayes : Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum; Supervisor Pell. This resolution was declared duly adopted. 14. On motion of Councilman Murdock, seconded by Councilman Drum, it was (c) RESOLVED that the Town Board of the Town of Southold authorizes the payment of $12, 062. 92 to Smith, Finkelstein, Lundberg, Crimmins and - Yakaboski for legal services rendered, from the following accounts: General Fund Whole Town----$ 3, 375. 00 General Fund Part Town-----$ 8, 687. 92 12, 062. 92 Vote of the Town Board: Ayes : Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. SUPERVISOR PELL: Numbers 15 through 21 you do not have, so I will ask the Town Board members to explain them as they go along. Number 15 the fishing pier on the bridge. 15. On motion of Councilman Murphy, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southold request the Suffolk County Department of Public Works to incorporate provisions for a fishing platform on the south side of the proposed West Creek Bridge on New Suffolk Avenue,, Town of Southold, New York (C.P. No. 5821) . Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. 16. On motion of Councilman Drum, seconded by Councilman Murdock, it was RESOLVED that Supervisor William R. Pell, III be and he hereby is authorized and directed to execute the 1981-1982 PBA Contract when it is approved by Town Attorney Tasker. Vote of the Town Board: Ayes: ' Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. COUNCILMAN DRUM: This is a new contract which will contain several changes commencing in January of this year, this past year, January 1, 1981, and one of the changes does give them a 7. 7% pay increase effective in January of 1981 and then effective in July 1 of 1982 there will be a 10. 6% increase. 17. On motion of Supervisor Pell, seconded by_ Councilman Drum, it was RESOLVED that Receiver of Taxes George Mellas be and he hereby is directed to transfer the Tax Receiver' s Tax Account from Chemical Bank to the North Fork Bank and Trust Company, Mattituck., New York, and be it further 4.44 NOVEMBER 24, 1981 RESOLVED that Supervisor William R. Pell, III be and he hereby is directed to transfer the Supervisor ' s Tax Account from the Chemical Bank to the North Fork Bank and Trust Company, Mattituck, New York. Vote of the Town Board: Ayes : Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. SUPERVISOR PELL: The North Fork Bank came in today and I requested them to, and made a presentation to the Board on how we could expedite the funds that are collected from your tax bill to give to the proper municipalities in a way so they could invest them and make more money on tax money. Right now the funds, some come in to the North Fork Bank, some come in to Town Hall, then they go into the Chemical Bank. The North Fork Bank would hold the checks for three or four days, five days' for them to clear and Chemical Bank would hold the checks for three or four days while they cleared, in. the mean time then they would give them to my account and I moved my account, last year, into the Chemical Bank so the day the Chemical Bank check issued to my account I could sit down that afternoon and give Southold School, Greenport School, Mattituck Park District the money we collect for them. I asked the bank if they could not come up with a faster day to do it to save anywhere from six to eleven or twelve days in some cases. The North Fork Bank came today and said they could speed it up to about three days. By speeding this money up to three days turn over, the municipalities in Town involved could get the money faster and get it out to make money for themselves. I 'm going to be a conservative, from what the banker said today, it is approximately they could make $40, 000. 00 in interest by cutting off the length of time it takes to get the money around. So with this information the Board decided to direct me and the Tax Receiver to work with the North Fork Bank. The North Fork Bank has many branches in Town and most of these checks are drawn on the North Fork Bank, so therefore, they could clear them if ..the checks are drawn on their own local bank and do not have to wait the time for clearance. This is one of the reasons why they say they clan give us this quick turn around. 18. On motion of Councilman Murdock, seconded by Councilman Drum, it was RESOLVED that Supervisor William R. Pell, III be and he hereby is authorized and directed to execute a Maintenance Agreement between Mayday Communications and the Town of Southold for the ECHO Rapid Recall Recorder and Magnasync/Moviola Recorder at the Southold Town Police Headquarters, effective September 1, 1981. through August 31, 1982 at a total cost of $1, 286. 00. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. 19. On motion of Councilman Murphy, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southold hire Rose Jacobi as a Relief Traffic Warden effective immediately. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. 20. On motion of Councilman Drum, seconded by Councilman Murdock, it was RESOLVED that Supervisor William R: Pell, III be and he hereby is authorized and directed to enter into a contract between Bruce A. Norris and the Town of Southold for the purchase of a parcel of land containing approximately 37 , 091 square feet on the north side of Sound Avenue, Mattituck, New York, bounded north by North Fork. Bank and Trust Co. , east by other lands of Norris , south by Sound Avenue and west by property of the Episcopal Church. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. COUNCILMAN DRUM: I might make comment that this is just under an acre of property located in the Village of Mattituck across from the Presbyterian Church and just east of the Er;�.scopal Church.. As some of you may or may not know, there have beeii traffic problems, not only during the busy summer season but also creates a parking hazard for the churches when there are services . This would provide the parking facilities. Part of it would be used for parking facilities and to a great extent alleviate the present parking problems. One behind the Coffee Pot and one by the railroad. Both of them are owned by the North Fork Bank and the municipality uses them as public, but they are not--- COUNCILMAN DRUM: I believe one is owned by the bank, Bill, and the other is owned by the Mattituck Park Commission. COUNCILMAN MURPHY: We own that on the other street down towards the firehouse. COUNCILMAN DRUM: Yes, but the bank owns the one across near the railroad tracks. SUPERVISOR PELL: The bank owns both of them and the Mattituck Park District owns to the east. They 've got three parking lots in Mattituck and none of them are owned by the Town. There is no municipal parking there and we have a chance to pick this up and our Town Board so desires to do it . Number 21 and the last one is to' support a study that was recommended by the Suffolk County Water Department . Mr. Frank Bear, is he here? He asked to speak on that one on my way in. Then we will offer a resolution, Frank. FRANK BEAR: When I went to the County- Legislature, I made a state- ment to the County Legislature urging them to approve a resolution which is being presented by Legislator Gregory Blass calling upon the legislature to approve a study that costs $105, 000. 00, of the water problem here on the north fork. Now this water problem, of course, has been studied many many times and the purpose- of this study is to bring together the information that is already available, not to make a new study on the problem, ,but to make recommendations on how the water problem can be resolved here on the north fork in the Town of Riverhead and Southold. The County Legislature needs 12 votes in order to approve this resolution and therefore there ' s, of course, a need to get this study approved because our water problem here on the north fork I don' t need to tell you is critical and something needs to be done immediately. I have written out_� here in my own typing, the likes of which I 'm sure you may never have seen before, and I have written a resolution which I cleared with the Town Attorney, Mr. Tasker, who made some suggestions and I ' d like to present it to you for your consideration. (Mr. Bear read the following resolution which was moved and seconded as follows : ) 21 . On motion of Councilman Nickles, seconded by Councilman Murdock, WHEREAS, the sole source for drinking water on the North Fork of Long Island, in,:..luding the Towns of Southold and Riverhead, is critically polluted, and WHEREAS, it is urgently necessary to find and implement methods by which a continuing source of safe drinking water can be assured for the residents of the North Fork, and WHEREAS, the water problem on the North Fork could have an impact on the drinking water supply in other areas of Suffolk County, and WHEREAS, the Suffolk County Department of Health Services has recommended that a study be made at once to identify methods by which a safe and potable supply of drinking water can be assured for the residents of the North Fork, and WHEREAS, County Legislator Blass has proposed a resolution that the County Legislature approve such a study and its funding at a cost of '105, 000. 00, now, therefore, be it RESOLVED that the Southold Town Board requests and strongly urges the Legislature of the County of Suffolk to approve such a resolution at its meeting on December 8, 1981. Meeting reconvened at 3: 45 P .M. SUPERVISOR PELL: At this time I ' d like to go back to the regular Southold Town Board meeting we have and reopen that one. We left off where we usually go along and say that ends the prepared agenda we had for today and does any Councilman at this time have anything they wish to add? Councilman Murdock? (Not I. ) Councilman Drum? (Not-hing. ) Councilman Nickles? COUNCILMAN NICKLES : Yes. I see there are some people here from Kenney ' s Beach and earlier today Mr. Markel mentioned something about concrete at the Town Dump. Over the weekend one of our contractors had pointed out to me that we have large pieces of concrete there. I called the Highway Department . They went up and inspected it and they find that there is a significant amount of large pieces of concrete which we could consider dumping over the edge of the parking lot at Kenney' s Beach to make some attempt to break the wave action and I guess the matter will have to be reviewed. He also gave me a figure on hiring a couple of trucks. The Town would load it on the trucks and the private contractor would deposit the material along Kenney' s Beach.. ,This is 'something the Town Board has not--hasn' t been discussed with`, the Town Board. It will be discussed probably later in the day with, the Town Board to see (1) if we have the wherewithall to do this, (2) when we get the price do we wish to do it and is it something that would be effective. I know Mr. Markel has used it in front of his property and finds it is something worthwhile. SUPERVISOR PELL: Councilman Murphy? (Nothing, Bill. ) At this time who wishes to address the Board? Mr. Markel. MR. SAMUEL MARKEL: I wish to address the Board in what John Nickles has just said. When you said whether or not you have the wherewithall. Do you have the wherewithall to perhaps build a new parking lot next spring which will cost many many times the cost of hiring to have that concrete brought up from the dump and put in place. At my own expense a few years ago I had Mr . Latham truck in hundreds and hundreds of tons of broken concrete and place it in front of my porch and was well up to the water line and it did break the ice and wave action which happens in the winter time. In subsequent years it has settled and been covered by sand and there is no unsightly concrete to be seen. As a conclusive point to this, you used to have a boat ramp down there which was constructed of concrete and it did serve as a barrier for the waves for a long time. It has completely disappeared from view. It has settled. I 'm sure it 'does some good, but has completely disappeared. What I suggested to Mr. Nickles was to day this concrete as close to the parking lot as possible and preserve what you have until you deci what you're going to do in the future, which I'm sure by spring yowl" have a very good idea of what you' re going to do up there. If you don' t do this you might have to consider putting a bridge across Leeton Drive because that ' s what ' s going to happen. You're going to get a cut out and it' s going to go right back to Leeton Drive and cut off that area completely. This is your alternative, and it might not happen in this one coming year. I 'm sure you're going to lose a lot of parking lot but I would say in three, four, five years you can perhaps be building a bridge across Leeton Drive. COUNCILMAN NICKLES: Well, I think Sam' s points are well taken. Maybe I didn ' t make myself clear. This is what the Town Board will consider when it ' s brought to their attention. We have not had an opportunity to discuss it yet, and I 'm sure we have the money, it ' s just. a NOVEMBER 24 , 1981 447 question of do we have the money`wYiere we can get it. There would have to be a surplus somewhere where we can take the money from. MR. MARKEL: As the gentleman on the right knows (Town Attorney Tasker) , !a most contracts there is a term that says, time is of the essence. I believe in this case that time "is of the essence. One good storm tomorrow, the next day, would do enough damage to cost twice as much. It happens. It only took one good storm to do what you saw there now. COUNCILMAN NICKLES: Sam, it will be discussed later tod-<.y, MR. CHARLES HICKEY: My wife and I were down there last Tuesday just before it was closed and this is something else you should have on your mind. The school bus came down loaded with kids, no more than ten or eleven years old and they were brought out of the bus to see this and the driver of the bus was explaining about about it, what was happening and we were glad we went away before they did because we didn' t know what was going to happen. Now the next day I went down again it was closed which I was very happy to see becuase it could have been something else for you to think about if something happened that day while it was open, COUNCILMAN NICKLES: I indicated earlier that as soon as -it was brought to the Town' s attention there was serious caving in of the parking area, it was closed off with flashing lights and if you' ve been down there lately, the whole entrance from the outer barriers is now fenced off which snow fence. SUPERVISOR PELL: The Town Board met first thing Monday morning, as soon as it occured, all the Town Board, except Frank who was sick, got together here and discussed this and instructed Mr. Jacobs to close it off immediately permanently for the time being. Anybody else wish to address the Town Board? (No response. ) If not, I will ask the Town Board to recess at this time. I have some personnel matters I have to discuss with them and after I discuss them the Board might move on some of them. 'scheduled bus transportation between the Town of Southold and New York City which read as follows: WHEREAS, the Town Board of the Town of Southold is aware of the need for scheduled bus transportation from the Town of Southold to New York City on a daily basis, and WHEREAS, Sunrise Coach Lines, Inc. has instituted such 'sc:hQduled bus transportation, which'-has-'.been found to be extremely necessary for those residents of Southold Town, who commute daily to employment in New York City, now, therefore, be it 448 NOVEMBER 24, 1981 RESOLVED that the Town Board of the Town of Southold does hereby go on record as fully and wholeheartedly supporting Sunrise Coach Lines, Inc . in maintaining daily scheduled bus transportation from the Town of Southold to New York' City. AND BE IT FURTHER RESOLVED that the Town Board of the Town of Southold, in view of the existing competition for a Permanent Certificate for this bus route, urge New York State Department of Transportation Commissioner' William C.' Hennessy 'to 'award a Permanent Certificate to Sunrise Coach Lines, Inc. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell . Councilman Murphy advised the Board he would like to arrange a meeting with Paul Flagg concerning the institution of a Program for the Raft Culture of Seed Clams so the Town can get set early in the season. He said that East Hampton Supervisor Mary Fallon is supposed to be sending a letter reaffirming East Hampton' s support of the program. Science classes. in two or three schools and 4-H leaders are interested in helping to. build the rafts. Councilman Murdock questioned the cost of the entire program. Councilman Murphy stated that the fee for Paul Flagg would be $1, 200. 00 per year for two years, material for the rafts would be approximately $800. 00, and the cost of the seed would be about $2, 000. 00 per year. A meeting will be arranged with Paul Flagg to discuss the details of the proposed program. The erosion problem at Kenney' s Beach was discussed by the Board. It was felt that the placement of concrete along the drop-off would be ' the best solution, and there is ample pieces of concrete at the Disposal Area. Deputy Highway Superintendent Raymond Jacobs is in the process of obtaining prices for 4-wheelers. to transport this cement to Kenney' s Beach. In. the meantime,,, Supervisor Pell will contact the D. E.C. to arrange a meeting. and inspection of the site with the hope of obtaining an emergency ` permit . The Corps of Army Engineers will also be contacted. The Board will recess this meeting and reconvene on Tuesday, December lst':so' an­-resolution can be adopted authorizing the hiring of the 4-wheelers. The Board met with Mr. Raynor and Mr. Orlowski to discuss the proposed official road map for the Town of Southold. Concerning the erosion problem at Kenney' s Beach, Supervisor Pell stated the D.E.C . has inspected the site and has given verbal approval.
