10: 15 A .M. - The Board met with Charles Graves concernin-g the
CSEA and PBA negotiations.
WORK SESSION
10: 55 A. M. - Richard Storz, Lovisa, Leonard .M.' 'Gr'illo,' Velzy
Associates and Merlon Wiggin, appeared before the Board to make
a presentation on a proposed refuse to energy 'cogeneration 'facility.
(A complete copy of the proposal is on file with the Town Clerk. ).
Mr. Storz and Mr. Grillo indicated that the only possible location
for their proposed facility would be at Greenport, where they -can
forsee selling steam to the hospital, .seafood ,processing plants and
other industrial facilities. They have' looked into funding and
find there is six million dollars in state bond issue--energy
recovery money for small communities. They propose that the Town
seek this funding and turn the money over to them . and at the end,
of ten years of operation the facility would be turned over to the
Town. During the preceeding ten years payments based upon the
profits of, the operation would be paid to the Town annually in lieu
of taxes.

A regular meeting of the Southold Town Board was held on Tuesday,
September 8 , 1981 at the Southold Town Hall, Main Road, - Southold,
New York. Supervisor Pell opened the meeting at 7: 30 P.M. with
the Pledge of Allegiance to the Flag.

On motion of Councilman Drum, seconded by Councilman Murdock, it was
RESOLVED that the following audited bills be and hereby are approved:
General Fund Whole Town bills in the amount of $32, 894; 23, General
Fund Part Town bills in the amount of $20, 493. 72; Highway Department
bills in the amount of $105, 528 . 26; Fishers Island Ferry District bills
in the amount of $81, 945 . 90; Federal Revenue Sharing bills in the amount
of $350. 00; and Delinquency Diversion and Prevention Project bills in
the amount of $377. 12.

10. Under Councilmen reports we ' ll start with Councilman Murdock.
COUNCILMAN MURDOCK: This morning we had a presentation to the 'Town
Board by Lovisa Construction Company on a refuse to energy cogeneration
facility. Their proposal for the Town of Southold is 70 odd pages which
the Town Board , of course, has not had 'time to read. It is another
proposal similar to Energy Development Corporation that puts the Town
in the position to have two proposals to weigh in terms of burning _
municipal solid waste and hopefully solve some of the problems that
we ' re under. The other little items we did in terms of putting the---
Highway Superintendent is going to put a little longer , or actually a
perpendicular piece of fencing at Bailey Beach Road to keep people
from obtaining access to the dunes in Mattituck. That ' s about all
for now Bill.
COUNCILMAN DRUM: I have nothing.
COUNCILMAN NICKLES: Nothing to report .
COUNC3LMAN MURPHY: Last Tuesday night we had an information meeting
on seed- clams here in the Town Hall. It was very well attended by
a lot of baymen, a lot of people who were just interested in the
program and a lot of people who wanted to find out what was going :
on with this. The program seemed to go. over very well. The baymen
accepted it, seemed to accept it very very much. They would like
to participate- in this and hopefully next Town Board meeting we ' ll
have a resolution when we set up a final agreement with the man
who' s- Paul Flacke from East Hampton who' s going to run the program.
We ' ll have a resolution authorizing this t,o establish it next year.
It holds great promise for our creeks and it ' s something worthwhile
trying out here. That ' s it Bill.
SUPERVISOR PELL: Thank you. My Supervisor' s report. I ' d just like
to report that I am working on the budget with the different depart-
ment heads. , Everybody from the White House right on down to the Town

Board is conscious of the budget taxes and one way to win friends is
to say "yes" , but the other way is to keep the budget in line, say
'.'no" and when I do present the budget to the Town Board for review
there are going to be a lot of' red lines thxough requests. It. is
something I feel has to be done to maintain status quo on our tax
rate. The county is going to lose a lot of money. If they lose it
we lose it all the way down. It will be felt down at our level.
COUNCILMAN DRUM: There may be nothing left to cut .
SUPERVISOR PELL: There might not be, Hank. On the railroad. There is a gentleman here and he can address the Board later on. We have
contacted the governor' s office to set up a meeting out here with
representatives from the railroad. There was a meeting held Thurs-
day of this past week in New York at Twin Towers on budget. Operating
budget of the railroad. They notified somebody out here who mentioned
it the other day. We were advised to write a letter to the president
of the railroad requesting that a meeting be held out here in Southold
Town Hall and we were assured that it would be done. There were some
people they wanted to send .out who were on vacation, they took the
Labor Day Weekend and, the rest of this week off and they said they
would get back to us in the very near future and they were quite sure
that meeting would be held out here. As soon as we get the date we
will give it to all the people that were there that night as well as
the Town Board.
II . PUBLIC NOTICES - COUNCILMAN NICKLES *
1 . The first notice that* you will see on your agenda regards
the Department of Conservation. ' ' It is a notice of hearing on the _
application of Rudolph DeHaan to subdivide 74, 800 sq. ft . into two
lots . The hearing is to. be held on September 17th here in the Town
Hall at 10: 00 A .M. This property is located at Cedar Beach Harbor,
south side Dryads Basin.
2 . Notice from the Long Island Regional Planning Board
sponsoring a one day seminar dealing with design, construction, and
closure of sanitary landfills. The seminar is scheduled for September
21st and I believe Councilmen Murdock and Murphy will be attending.
3. Notice that there will be' a meeting at the Suffolk County
Center at the Legislative Meeting Room on the utility rate making
process. This is a state committee chaired by Assemblyman Behan
and I believe Councilman Murdock will be attending that on behalf
of the Town Board. (September 25 , 1981 - 10 A .M. - 4 P.M. )
4. New York State Department 'of Conservation. Application by
Robert E. Lawless for John Xikis to. construct a one family dwelling
and septic system at Middle Road, Arshamomaque. Comments by September
30t h.
5 . Also from the DEC, public notice on the hearing on application
of Fred Melin to construct aluminum bulkhead and extend existing
floating dock. Hearing will be held October 5th at 10: 00 A. M. (Southold
Town H2.11. )
All of these notices are filed with the Town Clerk if you wish
to review them.
III . COMMUNICATIONS - SUPERVISOR PELL:
1. Thank you note .from Nassau Point Property Owners,thanking
us for the use of the center on Peconic Lane where they held their.
meeting which was probably attended by a hundred plus people.
2. Request from the Mattituck Inlet Advisory Committee request-
ing that the Town Board ask the Town Planning Board to work on the
idea of changing the zone down around the waterfront property in
Mattituck Inlet . Up until what I am going to call the Petersen
property from-the-Inlet into the Petersen property. They are
thinking of turning it into--recommending a passive recreational
use. The Town Board is referring this for study to the Planning
Board.
3. & 4. The Baymen' s Association president was supposed to
be with us today at 10: 00 o' clock. It is a request from them
to acquire a piece of land down in Hallock' s Bay, Pete' s Neck
in Orient and to discuss other ideas they have . They would like
to see funds put into next year ' s budget. These will be on the
agenda for the 22nd so they can be with'. us.
5. From Southold Town Fire District Officers Association
telling us, that they feel the Fire Inspectors that we have now
that enforce the Fire. Code is working out very nicely and they
would like to see it continue that way.

6. From Paterson:;I- Secr'e�tary' a ` State t� '>the State of New
York in- reference to the Coastal Zone Flood Plan. We have gone
over this 'for the last six months or a year and they informed
us of what it now looks like.
7. - Status report from Energy Development Corp, on the
progress they have made studying the landfill of Southold Town
and incineration perhaps that we might go into. It ' s a status
update of where we stand with them.
8. Letter to my office informing me that the Human Rights. ,. _
Commission is going to hold a seminar on different aspects of
training on what' s available in human rights needs and I will be
attending it.
IV. HEARINGS & DECISIONS
SUPERVISOR PELL: We had four public hearings last Town Board
meeting. We are ready to make decisions on three out of four.
1. Moved by Councilman Murdock, seconded by Councilman Drum,
WHEREAS, Fred Melin applied to the Southold Town Board for a
permit under the provisions of the Wetland Ordinance of the
Town of Southold, application. dated June 4, 1981, and
WHEREAS, said application was referred to the Southold Town
Trustees and Southold Town Conservation Advisory Council for
their findings and recommendations, and
WHEREAS, a public hearing was held by the Town Board with respect
to said application on the 25th day of August, 1981, at which time
all interested persons were given an opportunity to be heard ,
NOW, THEREFORE, BE IT RESOLVED that, Fred Melin be and he hereby
is granted permission under the provisions of the Wetland Ordinance
of the Town of Southold to install.- an aluminum bulkhead, extend
existing float and install°-�four'> pilings at his property on Mud
Creek at Skunk Lane , Cutchogue, , New. York.

2. Moved by Councilman Drum, seconded by Councilman Murdock,
WHEREAS , Enconsultants, Inc, for Howard Petersen applied to the
Southold Town Board for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated _
June 22, 1981 , and
WHEREAS, an application was referred to the Southold Town Trustees
and Southold Town Conservation Advisory Council for their findings
and recommendations, and
WHEREAS, a public hearing was held by the Town Board with respect
to said application on the 25th day of August, 1981, at which time
all interested persons were given an opportunity to be heard ,
NOW, THEREFORE, BE IT RESOLVED that Enconsultants, Inc. for -Howard
Petersen be and hereby is granted permission under the provisions
of the Wetland Ordinance of the Town of Southold to construct
retaining wall, catwalk, timber ramp extension, steel ramps, and
fill for ramp approach at property off Naugles Drive on Mattituck
Creek, Mattituck, New York.

Murdock, Councilman Nickles, Councilman Drum. Abstain: Supervisor
Pell.
This resolution was declared duly adopted.
SUPERVISOR PELL: I abstained on that decision because as far as
the unloading part of this it is for the unloading of commercial
fish boats and I am involved in the transportation of the seafood
moved off of that property.
Number 3 the Town Board is not ready to act upon yet . We
still want a little more information on that one and it is being
referred back to get more information and perhaps act upon it at
the next Town Board meeting. (Wetland application ..of Agnes. Pagnozzi.., )

V. RESOLUTIONS
1. On motion of Councilman Murphy, seconded by Councilman -Nickles, it was
RESOLVED that the Town Board of the Town of, Southold approve the
application of Martin Sidor .for the renewal of his trailer permit
for trailer located on the south side of Oregon Road, Mattituck, New
York, for a six month period.
Vote of the Town Board: Ayes: Councilman Murphy, Councilman
Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell.

2. Moved by Councilman Drum, seconded by Councilman Murdock,
WHEREAS, Radio Operator Gary M. Charters has applied to the Town
Clerk for a leave of absence for a six month period commencing
October 1, 1981 through March •31, 1982, and
WHEREAS, the Town Board has determined that the absence, of this
Radio Operator for such an extended period of time would be an
undue hardship on the operation of the Southold Town Police
Department , now, therefore, be it
RESOLVED that the Towp Board of the Town of Southold hereby denies
the request of Radio Operator Gary M. Charters for a leave of absence
of six months commencing October' l, 1981.

(Unexpended Balance) to DM5130. 2 Purchase of Equipment, Item III .

4. On motion of Councilman Murdock, seconded by Councilman Drum, it was
RESOLVED that the Town Board of the .Town of Southold set 3: 30 P .M. ,
Tuesday, September 22, 1981, Southold Town Hall, Main Road, Southold, '
New York as time and place for hearing upon application of Agnes
Pagnozzi for a permit under the provisions of the Wetland Ordinance
of the Town of Southold for permission to attach existing dock to
two new wood pilings and add . two additional pilings for a hoist for
permanent use at her property located off south side of Jockey Creek
Drive-, on Jockey Creek, Southold, New York.
Vote of the Town Board: Ayes: Councilman Murphy, Councilman
Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell.

5 . On motion of Councilman Nickles, seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of Southold oppose the
adopt-ion of ,Assembly Bill 11058-A entitled "AN ACT to amend the
public health law in relation to birth and death records," which
proposes to consolidate the"keeping of birth and death records in
one central location administered by the County Department of
Health, and be it further
RESOLVED that the Town Clerk be and.'she hereby is directed to
transmit ' a copy of this resolution to Assemblyman John L. Behan
apprising him of the Town Board' s opposition to this bill which
would be an unnecessary inconvenience' and extreme hardship for
the residents of Southold -Town if these records were filed in
a remote county facility.

SUPERVISOR PELL: Number 6 wa`S` on `the agenda tyre last time. It
went to a negative vote, did not pass at that time. We had two
abstentions . We put .it on the agenda today to see if we could
get the four affirmative votes we need to pass anything and we
still do not have the votes so it will not be passed at this
time. (Create and authorize the Southold Town Disposal Area
Advisory Committee . ) Anybody wish to comment further? ` (No response. )
Number 7 . This is a resolution in response to a request from
Mayor Hubbard of the Village of Greenport . The County has authorized
some time ago a $1, 000, 000. 00 to rebuild the railroad dock in
Greenport . It has not passed the legislature yet . In talking to
Mayor Hubbard he asked the Town at Town' Board to recommit itself
to the value of this property to the Village of Greenport and
Southold Town . So, I ' m asking the Board at this time to reaffirm
the resolution they made on December 2, 1980. -•
7. On motion of Councilman Murphy, seconded by Councilman Nickles, it was
RESOLVED that the Town Board of the Town of Southold reaffirm and
ratify their resolution no. 17 dated December 2 , 1980 which reads
as follows:
"WHEREAS, the County of Suffolk is considering an appropriation
of $1, 000, 000. 00 to finance the reconstruction of the Greenport
Railroad Dock for use as a berthing facility for commercial
fishing vessels, and
WHEREAS, the Village Board of Trustees of the Village of
Greenport fully supports said action by the County; and
WHEREAS, it has been determined that substantial positive
economic impact will result on the •.Village, Town and County
as a result of said action,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the
Town o� Southold hereby., declares its full and enthusiastic
support for the proposed`'Suffo'lk County Project to reconstruct
the Greenport Railroad Dock, and be it further
RESOLVED that the Town Clerk is hereby directed to forward
.a certified copy of this resolution to each member •of the
Suffolk County Legislature as well as the Suffolk County
Executive . "

8 . On motion of Councilman Nickles, seconded by Councilman Murphy, it was
RESOLVED that Supervisor William R. Pell, III be and he hereby is
authorized and directed to execute a service and maintenance
agreement with Telecome Equipment Corp. for maintenance and repair
service with respect to telephone equipment in the Southold Town
Hall at an annual cost of $1, 149. 72 for the period commencing`'
October 30, 1981 and ending October 29, 1982.

9. On motion of Councilman Murdock, seconded by Councilman Drum, it was
RESOLVED that the Town Board of the Town of Southold establish the
position of Senior Account Clerk for the Town at a salary of $7800. 00
per annum, 90 hours per week, and be it further
RESOLVED that Supervisor William R. Pell, III be and he hereby is
authorized and directed to request the Suffolk County Civil Service
Department to forward a local civil service list for Senior Account
Clerk- to the Town.

10. On motion of Councilman Drum, seconded by Councilman Murdock, it was
(a) RESOLVED that the Town Board of the Town of Southold transfer the
sum of $877. 50 from General Fund Part Town Item B3120. 4 Police
Contractual to General Fund Part Town Item B3120. 2 Police Equipment
for the purpose of purchasing diving equipment for the Southold Town
Police Department.

$877. 50 for -use by that department . .

SUPERVISOR PELL: I ' d like to comment on that . 10 (a) and (b) if I
can for a minute . Last winter the firemen had a group that got
together, 20 of them throughout the Town and decided that we needed
a rescue team that could dive as well as the one we have ashore.
So the firemen--we have 12 or 13 firemen that took the course at
their own expense or whatever it was and we have one police officer
that took the course also. What we just did was buy equipment for
our police department , so with the one police we have, if he has to
join the firemen within a rescue dive to look for evidence or any-
thing we have an officer who is now trained and has the proper
equipment to go out and look for evidence or whatever they might
need. We feel very strongly about this because we have approximately
200 miles of coastline in Southold Town and we have, as you all know,
we lost five or six folks within the last month to the sea around
here. This is something that I am personally pleased to see our
police department get involved with and I 'm glad the Town Board
feels as I do to .commit funds to this. I think it is a step in
the right direction.
Number 11 we are going to wait on. (Reappoint Assistant
Inspectors under the Southold Town Fire Code. ) We are not ready
to move yet , even though these dates of these gentlemen will expire
on September 9th, they will continue to serve as hold-over appoint-
ments until we have cleared with all of them that they wish to be
reappointed or else the commissioners who. recommend them to the
Town ' Board are satisfied with the job they are doing.
12 . On motion of Councilman Murdock, seconded by Councilman Drum, it was
RESOLVED that the Town Board of the Town of Southold set 3.: 35 P. M.
and 7: 30 P.M. , September 22, 1981 and 3: 00 P.M. and 8 : 00 P. M. ,
October 6, 1981, Southold Town Hall, Main Road, Southold, New York
as times and place for hearings in the 'inatter of the amendment of
the current Town Budget rela:tive' to the use of Federal Revenue
Sharing Funds by transferring and/or reassigning the sum of
$25, 361 . 00 to New Suffolk Road Improvement (CF9007. 4)--$14, 300.0°0`
and Highway Safety (CF Highway Safety)--$11, 061 . 00 from the
following accounts:

13. On motion of Councilman Nickles, seconded by Councilman Drum, it was
RESOLVED that the Town Board of the Town of Southold, pursuant to
the provisions of the Federal Revenue Sharing Law, will hold a public
hearing in the matter of the proposed use of Federal Revenue Sharing
Funds for the .fiscal 'year' beginning on January 1, 1982 at 3:40 P .M.
and 7: 35 P. 1�1. , Tuesday,' September 22, 1981 at the Southold Town Hall,
Main Road, Southold, New York, at which hearing citizens of the

Constable Thomas Czelatka his third salary increment in the amount

Farms" at Orient, New, York owned by Peter Blank.

at Fishers Island, New York in connection with the Ferry District `s
_ grant from the State of New York for said repair-work. .

SUPERVISOR PELL: The next one is another transfer of funds. I
want to explain a little bit why to a degree we are transferring
a lot of funds tonight . In Mattituck on New Suffolk Avenue we
are repairing that road. It is a 70/30 reimbursement. The Town
is putting up 300, the state and federal are putting up 707o. We
must put up up front money before we can get reimbursed. We have
to pay for it basically first , then we submit a bill and it will
be eight weeks to ten weeks before we -get paid from the state for
it . This went to contract in about 1977 I believe even before I
got on the Board. Inflation has set in like everything else and
the bid prices were received back in ' 77. The engineering fees
have exceeded, the cost of oil is up over it , but we had a commitment
to get $89, 000. 00 to ,straighten the road out from the state funds

so we are going ahead with it, but we do have to cover the expenses.
So this is why we are transferring into Highway, New Suffolk Avenue
Road you had us mention twice before and you are going to hear it
again. We are going to transfer $50, 000. 00 to put on asphalt on
it. That $50, 000. 00 will be reimbursed to the Town, but by law
before we can go to bid we must have the money earmarked and set
aside so we are making a transfer now of $50, 000. 00, but that
$50, 000. 00 will come -back to the Town, at least 707o of it will
come back.
20. On motion of Councilman Murdock, seconded by Councilman Drum, it was
RESOLVED that the Town - Board of the Town of Southold transfer. the
sum of $50, 000. 00 from Highway Item I Unexpended Balance into an
appropriation expense line Item DR 5112. 4 Iihprovements - New Suffolk
Road, in order to complete New Suffolk Road Improvement Project .

MR. ROBERT LEHMANN, Yennecott Drive, Southold : I took note of what.
you said before on the railroad. I would like to urge .that the
Board press to do whatever possible to convene that meeting next
week. Two of the women that ride the bus will lose their jobs if
something isn ' t done soon. One of the gentlemen that rides the bus
from Cutchogue won' t lose his job but he will have to move from
Cutchogue and move west . So I urge that whatever can be done to
convene that meeting no later than next week be done.
SUPERVISOR PELL: As soon as we can we will notify all. the people
that were here that night . We have their phone numbers. It will
be a night meeting and the Board will be advised. We hope it will
be in the very near future we will have a date, perhaps even tomorrow
I might have a date. We will telephone again and see what we can get .
MR. LEHMANN: Thank you.
SUPERVISOR PELL: Anybody else wish to address the Board?
MR. HENRY LYTLE: For the Southold-Peconic Civic Association. Is
there anything new on the money that we were supposed to get on
the improvement on the North Road at the end of 48 westerly to the
Town Line. Last winter or. l.early spring there was supposed to be
some money coming from the Federal Reserve .

SUPERVISOR PELL: New York State Transportation Bond. They got--
I forget the amount right now, I don' t have it. We were talking
about.,.that today and $30, 000. 00 was going. to go for street- lights
also. That is the money that the engineering--
COUNCILMAN DRUM: I think that project is the number- one project
commencing in--he ' s talking about Sound Avenue. .
SUPERVISOR PELL: Sound Avenue?
MR. LYTLE: Yes.
SUPERVISOR PELL: It ' s already approved, ' Dual-lane,-. that ' s approved.
COUNCILMAN MURDOCK: I think the problem tliat. happened, :Mr. Lytle,.
the Highway Superintendent ran into delays with the New Suffolk
project and it ' s carrying him further into the year and we don' t
want both sides ripped up at once .
COUNCILMAN DRUM: I ' d say it was this coming spring. This coming
spring I understand we ' re going to start.
COUNCILMAN MURDOCK: Ile had hoped to -start it' by. June: and--
MR. LYTLE:; Then it would be reasonable for .1982?
SUPERVISOR PELL: Yes., 1982.
MR. LYTLE: Thank you.
COUNCILMAN MURPHY: You know that .'. s not going to be a. four lane
highway.
MR. LYTLE: Oh, no, no, just the improvement of it. I understand
the county wasn' t taking the road over-.-or anything.
SUPERVISOR PELL: We will see Mr. Dean. tomorrow or -the next -day and
we will ask him that . one and- have him bring us .up to date. .
MR. BERNARD. KAPLAN: Property owner in Mattituck Inlet . . Is it
