HomeMy WebLinkAboutTB-12/04/1956 9948 MEETING OF DECEMBER 4, 1956. The Southold Town Board met at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday? December 4, 1956. The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest; Superintendent of Highways Price;- Town Attorney Terry and Town Clerk Booth. The Board sat at once as a committee on Audit to examine Claims against the Town concluding the Audit work at 2:00 o 'clock P.M. J Moved by Justice Demarest; seconded by Justice Tuthill: RESOLVED: That the minutes of the previous meeting be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Clark and Demarest; Councilman Albertson. Moved by Justice Demarest; seconded by Justice Tuthill: RESOLVED: That the Annual Audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on Friday, December 28, 1956, at 1:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Clark; seconded by Justice Demarest: RESOLVED: That Bond No. SM178332-1, issued by the American Motorists Insurance Company, in the sum of One Thousand Dollars ($1,000) on behalf of Ralph W. Tuthill, be and the same. is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Clark and Demarest. Moved by Councilman Albertson- seconded by Justice Tuthill: RESOLVED: That Bond No. F63.65A, issued by The Fidelity and Casualty Company of New York, in the sum of Fifty Thousand Dollars (650,000) on behalf of Austin C . Burt, be and the same is hereby approved as to its form, manner of execution and sufficiency- of sureties therein. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Councilman Albertson; seconded by Justice Demarest: RESOLVED: That the Police -Report for the month of November be accepted by the Town Board and placed on file . Vote of Town Board: .Ayes-Supervisor klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Councilman Albertson; seconded by Justice Demarest:- RESOLVED: That Otto L. Anrig., Chief of Police, be authorized to . order a Dumont Conabrad Unit Receiver if he heems it necessary. Vote of Town Board: Ayes-Supervisor Klipp; Councilman ilbertson; Justices Tuthill, Clark and Demarest. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That General Bills in the amount of .$4,959.83; Lighting District Bills in the amount of $1,404.29; Fishers Island Ferry District Bills in the amount of $6,748. 59, be and the same are hereby ordered paid. Vote of Town Board: Ayes-Supervisor Klipp; Councilamn Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Tuthill; seconded by Councilman Albertson: RESOLVED: That Charles Coutts , Sr. be and he hereby is appointed School Traffic Officer to serve in such capacity at the intersection of Pike Street and Wickham Avenue , Mattituck, New York, at the rate of pay of $5. 50 per day for each school day worked, effective as of November 26, 1956. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Councilman Albertson; seconded by Justice Demarest: RESOLVED: That Supervisor Klipp be authorized to enter into a contract to purchase certain property now owned by Alfred C. Teves, fronting on Long .Island Sound and adjacent to Hortons Lane at a cost not to exceed the sum of Thirty two Hundred dollars ($3200)in accordance with the local Finance Law. Vote of Town Board: Ayres-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. 349 Moved by Councilman Albertson; seconded by Justice Demarest: WHEREAS, Sergeant (Constable) Theodore B. Howard was heretofore re- quested to use his private automobile in connection with his official duties from'February 20, 1956 to May 11, 1956, during the time which the Town automobile customarily assigned to him was unavailable, now, there- fore be it RESOLVED: That in addition to his regular compensation there be paid to said Theodore B. Howard in an amount not to exceed the sum of five cents ( 50) -per .mile for the. use of his own automobile- for each mile actually and necessarily traveled by him in -the performance of his duties during such time. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Demarest; seconded by Councilman Albertson: RESOLVED: That the Superintendent of Highways of the Town of Southold be and he hereby is authorized to advertise for and purchase from the lowest bidder, One Flink Hydraulic-drive and control Tail-gate Spreader. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest: Moved by Councilman Albertson; seconded by Justice Tuthill:" WHEREAS, the Town Board of the Town of Southold has heretofore by resolution. duly adopted on .August 9, 1956opposed the granting of a permit -to the Long Island Lighting Co. from the Corps of Engineers of U.S.Army for the installation of an aerial cable crossing Mattituck Creek and WHEREAS , upon. further consideration of the application, it appears that the application is for an aerial cable across Howard 's Branch of Mattituck Creek at a point where the proposed 56 foot clearance would het, in the . , opinion of this Board, be detrimental to navigation, NOW, THEREFORE, BE IT RESOLVED: That Supervisor Norman E. Klipp be directed to withdraw the protest hereinbefore made relating to the grant- ing of such permit. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Clark; seconded by Councilman Albertson; WHEREAS, by resolution duly adopted on November 19, 1956, the Board of Trustees of- the Village of Greenport did respectfully memorialize the Town Board 6f the Town of Southold to take such proper and approp- riate action as will declare that 'the Village of Greenport is no longer subject to rent control and Whereas., the Town Board of the Town of Southold is desirous of acceding to the wishes of the people of the Village of Greenport, as expressed by their duly elected representatives , who have found that the oper- ation of the rent control law is causing a hardship to many landlords and that the rent control program is having -a deleterious effect on rental property so far as upkeep and appearance is concerned, and that it is not conducive to the maintenance of assessments , NOW, THEREFORE BE IT RESOLVED: That the Town Board of the Town of. South- old , in accordance with the request of the Board of Trustees of the Village of Greenport, does hereby consent to the abolition of rent con- trol within the limits of the Incorporated Village of Greenport and be it further . RESOLVED: .That the Temporary State Housing Rent Commission be requested to terminate the provisions of the rent control law within the limits of the Incorporated Millage of Greenport. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and -Demarest. Moved by Justice Clark; seconded by Councilman Albertson: WHEREAS, It has been determined by' the Board of Trustees of the Town of Southold, said Board having jurisdiction of the lands underwater in the Town of Southold, that scallops not having a clearly defined annual growth line in danger of being destroyed by natural causes in the following areas:Gidds Bay, Orient Goose Creek, Southold Laughing Waters , Southold and 350 WHEREAS, It has been recommended by the Board of Trustees of the Town of Southold that the New York State Conservation Department issue special permits for the taking of these scallops from the above ment- ioned areas fora period from the present date to April 1, 1957, in amounts not in excess. of 5 bushels per person per day from Monday to Friday only, both days inclusive, and WHEREAS,It ahs been further recommended by the Board of Trustees of the Town of Southold that the New York State Conservation Department be requested to investigate similar conditions that exist in the out-. side bays , and consideration be given to the taking of scallops not having a clearly defined annual growth line in such areas where they are in danger of being destroyed, now, therefore , be it RESOLVED: That the Supervisor of the Town of Southold be and he hereby is instructed to take whatever steps he deems necessary and respectfully request the New. York State Conservation Department to give serious consideration to the recommendation of the Board of Trustees of the Town of Souhold, and be it further RESOLVED: That a copy of this resolution be sent the Commissioner of the New York State Conservation Department and the Superintendent of the Marine District.
