HomeMy WebLinkAboutTB-08/14/1956 MEETING OF AUGUST 14, 1956. The Southold Town Board met at th6 office of Supervisor Norman E. Klipp at. Greenport, on Tuesday, August 14, 1956. The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest; Superintendent of Highways Price; Town Attorney Terry and Town Clerk Booth. The Board sat at once as a committee on Audit to examine claims against the Town, concluding the Audit work at 2 o 'clock P.M. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That the minutes of July 31st and August 9th be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson;. Justices Tuthill, Clark and Demarest. The following bonds were presented to the Board for approval: Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That Bond No. SM178199-1, issued by the American Motorists Insurance Company, in the amount of $%0.00, on behalf of Edward S. Brush, be and ' the smae is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Vote' of T own Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by 'Justice Tuthill; seconded by Justice Clark: RESOLVED: That Bond No. SM178290-1, issued' by the American Motorists Insurance Company, , in the amount of $500.00, on behalf of Cbarles W. Jacobs, be and "the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. '. . Sm&th be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest. Moved by Justice Clark; seconded by Councilman Albertson; RESOLVED: That Supervisor Norman E. Klipp be instructed to have 100 foot steel tapes. placed in each Police car. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarst. Moved by Councilman Albertson; seconded by Justice Tuthill: RESOLVED: That the Police Report for the month of July be accepted by the Town Board and placed on file. Moved by Councilman Albertson; seconded by Justice Demarest: RESOLVED: that General Bills in the amount of $4,911.19, Lighting District bills in the amount of $1 492.639 Fishers Island Ferry District Bills in the amount 'of $1�,1 50.63 be and the same are here- by ordered paid. Moved by, Councilamn Albertson; seconded by Justice Tuthill: RESOLVED: That the regular monthly meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on September 11, 1956, at 1:30 P.M. Tuthill: BUDGET NOTE RESOLUTION DATED AUGUST 14th, 19569 AUTHORIZING THE ISSUANCE OF A BUDGET NOTE OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, IN THE AMOUNT OF $139900. FOR EX PENDITURES FOR WHICH AN INSUFFICIENT PROVISION WAS MADE IN THE ANNUAL BUDGET. BE IT RESOLVED this 14th day of August, 1956, by the Town of Southold, Suffolk County, New York, as follows: Section 1. That, pursuant to Subdivision 2(b) of Paragraph a of Section 29.00 of the Lical Finance Law, for the prupose of paying the cost of repairs to Town Highways, for which an insufficient provision was made in the annual budget 6or the current fiscal year, there is hereby authorized to - be issued a budget note of the Town of Southold in the principal amount of $13,900. , which is the maximum cost of such object or purpose, which note shall mature on February 1st 1957. Section 2. That, except as herein specifically prescribed, said note shall be of the date, terms, forr#, contents and place of . payment, and- at a rate of, interest not exceeding three per centum per annum, as may be determined by the' Town Supervisor, consistent, however, with the provisions of said. Local Finance Law of the State of New York, and 'shall -be executed in the name, of the Town of Southold by its Supervisor and the seal of said Town shall be attached thereto. Section . That siad -note shall be sold a-t private sale by the Town .SUpervisor at a price of not less than par value and accrued interest, if any, and -upon due execution and s&le of said note the same shall be delivered to the purchaser upon payment by him to the Town Supervisor of the purchase price in cash; and the receipt of such Supervisor shall be a full acquittance to such purchaser who shall not be obliged to see to the application of the purchase money. Section 4. The full faith and credit of the Town of Southold, New York, are pledged to the puncual payment of principal and interest on said note'. Section 5. This resolution shall take effect immediately. The question of the adoption of the foregoing resolution was duly put to.,a vote which resulted as follows: Ayes-Supervisor Norman E. Klipp, Councilman Lester M. Albertson; Justices of the' Peace Louis M. Demarest, Ralph Tuthill and Henry A. Clark. Absent-Justice of the Peace E. Perry Edwards Noes-None. The Supervisor thereupon declared that the resolution was duly adopted. UNITED STATES OF AMERICA STATE OF NEW YORK COUNTY OF SUFFOLK TOWN OF SOUTHOLD BUDGET NOTE OF 1956. , THE TOWN OF SOUTHOLD, in the County of Suffolk, a ,:muncipality of . the State of New York,:.hereby acknowledges itself inddbted and -,for value received promises to pay to , ;; the sum of Thirteen Thousand..and Nine Hundred 4139900)` Dollars, on the lst day of February, 1957, together with interest thereon from the date hereof at the rate of per centum ( %) per annum, payable semi-annually. Both principal of and interest on this note shall be paid in lawful money of the United States of America, at the office of the Superviisor, Greenport, 'Suffolk County, . New York. The Town of Southold shall have the privilege of pre-paying the whole or any part of the unpaid balance of the principal sum at any time prior. to maturity. This note may not be converted to registered . form. This note is the only note of an authorized issue in the amount of Thirteen Thousand and Nine Hundred ($13,900. ) Dollars, for the purpose of paying the cost of repairs to Town Highways for which an insufficient provision was. made in the annual budget for the current fiscal year. This note is issued pursuant to the provisions of a resolution entitled "Budget Note Resolution" duly adopted by the' Town Board, of such Town of SoutholCon' August, '14th, 1956. The faith and credit of such Town of Southold are hereby irrovO- cably pledged for the puncual payment of the principal of and int- erest on this note according to its terms. It is hereby'-certified and recited that all conditions, acts and things required by the Constitution and statutes of the State of New York to exist to have happened and ,to have. been performed precedent to and In the issuance of this note, exist, have happened and have been performed, and that this note, together with all other indebtedness of such Town of Southold is within every debt and other limit prescribed by the Constitution and Laws of such S;ate.
