HomeMy WebLinkAboutTB-08/09/1956-S MEETING OF AUGUST 9, 1956. A special meeting of the Southold Town,. Boar.d was held at the office of Supervisor Norman E. Klipp at Greenport, on Thursday, August 9, 1956. The meeting was called to order at 7:30 P.M. with the following present: Supervisor Klipp; Councilman Albertson; Justices Tuthill, Clark and Demarest and Town .Attorney Terry and Town Clerk Booth. The purpose of this meeting was pertaining to the Zoning Ordinance. Moved by Justice Henry A . Clark; seconded by Justice Talph W. Tuthill: RESOLUTION WHEREAS , the Town Board of the Town of Southold, in the interest of community welfare , is considering the adoption of a zoning ordinance;; and WHEREAS , the Zoning Commission heretofore appointed by the Town Board of the Southold Town has filed with the Town Board its final report and map, NOW, THEREFORE, be it RESOLVED: That a public hearing on the proposed building zone ordin- ance be held at Southold Hi h School, Southold, Suffolk County, New York on August 31? 1956 at 9:00 o °clock (Daylight Saving Time) in the evening of said Day, at which time parties in interest and citizens shall have an opportunity to be heard; and be it further RESOLVED: that the Supervisor be and he hereby is instructed to pro- ceed with the requirements of the Town Law in' providing the necess- ary and proper publication of notice of the time and place of the hearing; and be it further RESOLVED: that the Town Board express its grateful appreciation to the members of the Zoning Commission for the exhaustive and self- sacrificing work performed by them in accomplishing their work as members of the Zoning Commission; and be it further RESOLVED: that the Town Board of the Town of Southold express its undying gratitude to Hohn M. Muddeman, without whose unselfish services the final report of the Zoning Commission would not have been accomplished in such satisfactory manner. Vote of Town Board: Ayes-Supervisor Klipp; Justies Tuthill , Clark and Demarest and Councilman Albertson. Moved by Councilman .Albertson; seconded by Justice Clark: RESOLVED: That the str-et lighting contract between the Totem of Southold and the Village of Greenport covering the .West Greenport Lighting District for a period of five years beginning with the 1st day of September , 1956 and terminating on the 31st day of August 1961, be and the same is hereby approved by the 'Town Board. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Clark and Demarest and Councilman Albertson. The Supervisor reported that he had received Public Notice No. 3 580 from the Corps of Engineers of the U.S.Army relative to the applic- ation of the Long Island Lighting Company for a permit to install an Aerial Cable crossing Mattituck Creek. After some discussion the following resolution was offered ' by Justice Tuthill and seconded by Justice Clark: RESOLVED: That 1upervisor Norman E. Klipp be directed to protest against the installation of an Aerial Cable over Mattituck Creek as per the application of the Long Island Lighting Company, on the grounds that the proposed clearance of 56 feet would be detrimental to navigation. An underground cable was recommended. Vote of Town Board: .Ayes-Supervisor Klipp; Justices Tuthill, Clark and Demarest and Councilman Albertson. Moved by Councilman Albertson; seconded by Justice Tuthill: RESOLVED: That the Town Board nake its official visit to Fishers Island on Tuesday, August 21, 1956. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Clark and Demarest and Councilman Albertson. "39 Moved by Councilman Albertson; seconded by Justice Demarest: CAPITAL NOTE RESOLUTION DATED AUGUST 1956, AUTHORIZING THE ISSUANCE OF .A CAPITAL NOTE OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, IN THE .AMOUNT OF $25000.00 FOR THE PURCHASE OF ADDIT-4 IONAL LAND FOR TOWN PURPOSES. BE IT RESOLVED this 9th day of .Aug-&st , 1956, by the 'Town of Southold, Suffolk County, New York, as follows: Section 1. That, pursuant to the provisions of Section 28 of the Local Finance Law and Section 64 and 220 of the Town Law, for the purpose of paying the cost of purchase of real property for Town purposes , which property is bounded and described as follows: ALL that tract or parcel of land situate in the IBillage and Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the Easterly side of Horton' s Lane at the Southwedterly corner of land of Hedvig P. Terry and running thence Easterly along land of Hedvig P. Terry to land of the First Church, Congregation or Society mn Southold; running thence Southerly along the .westerly line of land of the The First Church, Congregation or Society in Southold and land of. the Town of Southold a distance of 80 feet to a point; thence running along land of Alice McLean Thomp- son on a line parallel with the Southerly line of said land of Hedvig P. Terry and at all points distant 80 feet therefrom to the Easterly side of Horton's Lane ; running thence Northerly along the Easterly side of Horton's Lane a distance of 80 feet to the point or place of beginning. TOGETHER with all right , title and interest of the parties of the first part in and to Horton's Lane in fromt of and adjacent to said premises, . there is hereby authorized to be issued a capital note of the Town of Southold in the principal sum of $21000.00 which is the maximum cost of such object or purpose , which note shall mature on August 1st , 1957. Section 2. That, except as herein specifically prescribed, said note shall be of the date , terms, form, contents and place of payment, and at a rate of interest not exceeding three per centum per annum, as may be determined by the Town Supervisor, consistant , however, with the provisions of said Local Finance Law of the State of New York, and shall be executed in the name of the Town of Southold by its Supervisor and the seal of said Town shall be attached thereto. Section 3 . That said note shall be sold at private sale by the Town Supervisor at a price of nit less than par value and accrued interest , if any, and upon due execution and sale of said note the same shall be delivered to the purchaser upon payment by him to the Town Super- visor 6f the purchase price in cash; and the receipt of such Super- visor shall be a full acquittance to such purchaser who shall not be obliged to see th the application of the purchase money. Section 4. The full faith and credit of the Town of Southold, New York, and pledged to .the puncual payment of principal and interest on spid note . Section 5. This resolution shall take effect immediately. The question of the adoption of the foregoing resolution was duly put to a vote which resulted as follows: .Ayes-Supervisor Norman E. Klipp; Councilman Albertson; Justices of the Peace Louis M. Demarest, Ralph Tuthill and Henry A. Clark. Absent---- Nores-----None The Supervisor thereupon declared that the resolution was duly adopted. 330 UNITED STATES OF AMERICA STATE OF NEW YORK COUNTY OF ,SUFFOLK TOWN OF SOUTHOLD CAPITAL NOTE OF 1956. The TOWN OF SOUTHOLD, in the County of Suffolk, a municipality of the State of -New York, hereby acknowledges itself indebted and for value received promises to pay to the sum of TOW THOUSAND ($2,000.00) DOLLARS , on the 1st day of August , 1957, together with interest thereon form the date hereof at the rate of per centum ( %) per . annum, payable semi-annually. Both principal of and interest on this note shall be paid in lawful money of the United States of America , at the office of the Super- visor , Greenport, Suffolk County, New York. The Town of Southold shall hove the privilege of pre-paying the whole or any part of the unpaid balance of the principal sum at any time prior to maturity without penalty. This note may not be converted to registered form. This note is the only note of an authorized issue in the amount of TWO THOUSAND ($2,000.00) DOLLARS , for the purpose of paying the cost of purchpse of real property for Town purposes . This note is issued pursuant to the provisions of a .resolution entitled "Capital Note Resolution" duly adopted by the Town Board of such Town of Southold on August 9, 1956. The full faith and credit of such Town of Sou hold are hereby irrovocably pledged for the puncual payment of the principal of and . interest on this note according to its terms. It is hereby certified and recited that all conditions , acts and things required by the Constitution and statutes of the State of New York to exist, to have happened and to have been performed pre- cedent to and in the issuance of this note , exist, have happened and have been performed, and that this note, together with all other indebtedness of such Town of Southold is within every debt and other limit prescribed by the Constitution and Laws of such State. IN WITNESS 14HEREOF, THE TOWN OF SOUTHOLD, New York9 has caused this Note to be signed by its Supervisor , and its Corporate seal to be hereunto affixed and attested by its Town Clerk, and this Note to be dated as of the day of August , 1956.
