The meeting was called to order at L;30 P.M. with the following present: Supervisor Klipp; Justices Tuthill, Clark, Demarest and Edwards; Councilman Albertson; Sup't of Highways Price; Town Attorney Terry and Town Clerk Booth. Moved by Justice Clark; seconded by Councilman Albertson: RESOLVED: That the minutes of the two previous meeting s , March 6 and March 7, be and hereby are duly approved as corrected. Vote of Town Board :.Ayes-Supervisor Klipp; Justices Tuthill, Clark, Demarest and Edwards and Councilman Albertson. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the regular monthly Audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, April 10, 1966, at 1:30 P.M. Vote of Town Board:Ayes-Supervisor Klipp; Justices Tuthill, Clark, Demarest and Edwards , Councilman Albertson. Moved by Justice Edwards; seconded by Justice Tuthill: RESOLVED: That the Town Clerk be and he hereby is directed to request the Fishers Island Electric Corporation to install one additional 60 c.pc aerial street light in the Fishers Island Lighting District, said light to be placed on Pole No. 201 .in front of the Doctor °s Clinic on Montauk Avenue, Fishers Island, N.Y. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill , Clark, Dmmarest' and Edwards, Councilman .Albertson. Moved by Justice Edwards; seconded by Justice Tuthill: WHEREAS , the Fishers Island Fire District has recommended that William H. Pyle be appointed Fire Department Inspector NOW, THEREFORE , BE IT RESOLVED: That William H. Pyle be and he here- by is appointed Fire Department Inspector to serve in such capacity in the Fishers Island Fiae District until 3anuary 1, 1957, in accord- ance with Article 8, Section 303 , sub-division 4 of the Multiple Resident Law, and be tt further RESOLVED: That the above mentioned person serve in such capacity without compensation. Moved by Justice Demarest; seconded by Justice Clark: RESOLVED: That the Town Clerk be and he hereby is directed to request the Long Island Lighting Company to remove three (3) aerial street lights in ti-ie East Marion Lighting' District on Poles # 217, 220, and 223. Also remove two (2) aerial street lights -in the Orient Lighting District on Poles # 212 and 215. , Vote of Town Board: Ayes-Supervisor Klipp; ,Justices Tuthill, Clark, Dmearest, and Councilman Albertson. Boo Moved by Justice Clark; seconded by Councilman Albertson: RESOLVED: That the Town Officers be closed on Good Friday P.M. The matter of closing was left to the discretion of the head of each department. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Clark and Demarest and Councilman Albertson. CERTIFICATE OF SUPERINTENDENT OF HIGHWAYS DETERMINING THAT AN EMERGENCY EXISTS I , HAROLD D. PRICE, Superintendent of Highways of the Town of Southold, Suffolk County, New York, do hereby certify that as a result of the two unprecedented and excessively severe snow storms occurring on Friday, March 16, 1956, and Sunday, March 18, 1956, coupled with the accidental destruction and failure of certain Town highway equipment, there existed a grave emergency, attested to by the declaration of a state of emergency by the Sheriff of Suffolk County, and I made the determination that the emergency was so great as to warrant the immediate purchase of a Walters snow fighter at a price of $18,910.00 in order to immediately and adequately cope with the emergency. Moved by Justice Demarest; seconded by Justice Tuthill: WHEREAS , the, Superintendent of Highways of the Town of Southold has determined that as a result of the excessively severe snow storms occurring on March 16, 1956 and March 18.th, 1956, there existed a grave emergency, so great as to warrant the immediate purchase of a Walters snow fighter at a price of $18,910.00 in order to immedately and adequately cope with the emergency, and WHEREAS , it is the considered opinion of the members of the Town Board of the Town of Southold that such an emergency did in fact exist , NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Southold does hereby determine that a state of emergency did in fact exist , and BE IT FURTHER RESOLVED that the Town Board ratify and approve the acts of the Town Superintendent of Highways and authorize the purchase of one Walters snow fighter at a maximum cost of $18,910.00, subject to. the approval of the County Superintendent of Highways , and BE IT FURTHER RESOLVED That $17,.000.00 of such cost be paid from the proceeds of obligations to be paid pursuant to the Local Finance Law. CERTIFICATE OF SUPERVISOR The undersigned does hereby certify that pursuant to the powers delegated to him as Supervisor of the Town of Southold, N.Y. , in and by a resolution of the Town Board of such Town adopted on March 27, 1956 he has this day 1. Fixed the date of the serial bonds authorized in such resolution as of the 27th day of March, 1956. 2. Fixed the date upon which such bonds shall become due , as follows: No. 1 on April. lst, 1957; No. 2 on .April lst, 1958; No. 3 on .April 1st, 1959; and No. 1+ on April lst, 1960. 3. Fixed the interest rate of such bonds at 2 1/2 per centum per annum to be paid semi-annually on the lst day of October and .April in each year during the life of the bonds. Southold, N.M. 310 Moved by Justice Tuthill; seconded by Justice Demarest: SERIAL BOND RESOLUTION dated March 27, 1956, authorizing the issu- ance of SERIAL BONDS of the TOWN OF SOUTHOLD, Suffolk Counts New York, in the amount of $17,000.00. for the purchase of one (�) Walters Snowfighter. WHEREAS, the Town Board of the Town of Southold, N.Y. , by a reso- lution duly adopted on the 27th day of March, 1956, authorizing the Town Superintendnnt of Highways to purchase certain machinery for highway maintenance and snow removal at a total cost of $18,910.. , subject to the approval of the County Superintendent of Highways, and provided .that $17,000. of such cost was to be paid from .the-` proceeds of obligations to be issued pursuant to the Local Finance Law. NQW,' THEREFORE,, BE IT RESOLVED: 1. The specific object or purpose for which obligations are to be issued pursuant to this resolution is to finance the cost of ,one (1) Walters Snow Fighter. 12. The maximum cost of such machinery is $18,910. ,' and the plan of financing such cost is as follows: By current funds in the amount of- $1,910. to be paid from the machinery fund. The balance of the cost is to be provided by the issuance of serial bonds in the amount of $17,000. pursuant to this resolution. 3. The following determinations are hereby made: (a) The period of probable usefulness of such machinery is five years . (b) The subdivision of paragraph a of Section 11.00 of' '-. the Local Finance Law which is apblicable in the circumstances is subdivision 1128". (4) The proposed maturity of the obligations authorized by this resolution- will not be in excess of five years. 4. That the Town .of Southold issue its serial bonds in the. amount of $17,000. to finance such cost in accordance -with the financial plan set forth above. The power to fix and determine the exact date of such bonds is hereby delegated to the Supervisor. 5. Such bonds shall be numbered I to 4, inclusive, shall be in the denomination of $4,250. each and shall mature in numerical order in annual installments in the years and amounts as follows: 1957 - $49250 1958 - 41250. 1959 - 49250. 1960 - 4,250. The power to determine the date upon which such installments shall become due is hereby delegated to the Supervisor. The bonds shall be issued in bearer form without coupons , and shall no't. contain a power to convert to registered form. The bonds shall bear interest at a rate not exceeding two and one-half (24%) per centum payable semi-annually. Payments of such interest shall be evidenced by notation thereof on the bonds at the time of the pamment. ,The bonds shall be in substantially the following form: NO. UNITED STATES OF AMERICA $41250.00 STATE OF NEW YORK COUNTY OF SUFFOLK TOWN OF SOUTHOLD SERIAL BOND OF 1956. The TOWN OF SOUTHOLD, in the County of Suffolk, a municipality of the State of New York, ;hereby acknowledges itself indebted and for value received promises to pay to. the bearer of this bond on the lst day of April, 1957, the sum of Four Thousand Two Hundred and Fifty ($4,250.00) Dollars and to pay interest on such sum at the rAte of 2* per centum (22%3 per annum, semi-annually on the lst day of October and April in each year from the date of this bond until it matures, upon presentation of this bond for notation of such inter8 est payment thereon. Both principal of and interest on this bond will be paid in lawful money of the United States of America , at the office of The First National Bank of Greenpor t, New York, This bond may not be converted into a registered bond. This bond is one of an authorized issue, the aggregate principal amount of which is $17,000. , the bonds of which are of like tenor except as to number, maturity, and denomination, and are issue. pursuant to a bond resolution entitled "Serial Bond R'1soiution" duly adopted by 311 the Town Board of such Town of Southold, New York on March 27th, 1956. The faith and credit of such Town of Sou hold,, New York, are hereby irrevocably pledged for the puntual payment of the principal of and interest on this bond according to its terms. It is hereby certified and recited that all conditions , _ acts and things required by the Constitution and statutes of the State of New York to. exist , to have happened and to have been performed pre- cedent to and in the issuance of this bond, exist , have .happened and have been performed, and that .the issue of bonds of which this .is one , together with all other indebtedness. of such Town of Southold, New York, is within every debt and other limit prescribed by the Constitution and lams of such State. The Supervisor is hereby delegated the power to prepare such bonds and to sell such bonds at private sale at not less than par and accrued interest, and at such sale to fix the interest vate to ' be borne by such bonds within the limitations set forth in this resolution. The Supervisor' shall deliver such bonds to the purchaser thereof only against cash or a certified check. The proceeds of sale of the bonds shall be deposited in a special bank account as required by Section 165.00 of the Local Finance Law. The powers delegated to the Supervisor by this resolution shall be exercised in conformity with the provisions of the Local Finance Law. 7. This . resolution shall take effect immediately. Upon the question of adoption of the foregoing resolution, the following each voted .Aye in favor of 'the resolution: Supervisor Klipp; Justices Demarest, Clark, and Tuthill, and Councilman 'Albertson. The Supervisor informed the Town Board of the Following situation in regard to: the Welfare Account being practically depleted. Moved by Councilman Albertson; seconded by Justice Demarest: WHEREAS, The State of New York has delayed in reimbursing the. Town of Southold for the months of December 1955 and January and February 1956 for.'moneys advanced by the Town for Welfare purposes , and WHEREAS , the delay by the State has caused the Welfare Account to become practically depleted, now, therefore, be it RESOLVED: That the Supervisor be and he hereby is directed -to take the necessary steps to borrow Five Thousand Dollars ($5,000) on a budget note to cover the emergency. Moved by Couh633man Albertson; seconded by Justice Demarest; BUDGET NOTE RESOLUTMON DATED MARCH 27th, 19569 AUTHORIZING THE ISSUANCE OF .A BUDGET NOTE OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK., , IN THE AMOUNT OF $59000.00 FOR HONE RELIEF. ' BE IT RESOLVED this 27th day of March', 19561p by the Town of Southold, Suffolk County, New York, as follows: Section 1. That, pursuant to the provisions of Subdivision 2 of paragraph .a and paragraph a of Section 29, and 'Section 108 of the 812 Local Finance Law, Section 93 of the Social Welfare Law and Section 114 of the Town Law, . for the purpose of paying the cost of home relief expenditures for which insufficient provision was made in the annual budget for the year 19%, there is hereby appropriated as .a supplemental appropriation for home relief the sum of $5,000.00 and there is hereby authorized to be issued a budget note of the Town of Southold to the principal amount of $5,000.00 which} is the maximum cost of such object or purpose, which note shall mature on March 27th, 1957. Section 2. That, except as herein specifically prescribed, said note shall be of the date, terms , form, contents and place of payment, and at a rate of interest not exceeding three per centum per annum, as may be determined by the Town Supervisor, consistent, however, with the provisions. of said Local Finance Law of the State of New York, and shall be executed in the name of the Town of Southold by its Supervisor and the seal of said Twwn shall be attached thereto. Section 3 . That said note shall be sold at private sale by the Town Supervisor at a price of not less than par; value and accrued interest, if any? and upon due execution and sale of said note the same . shall be delivered to the purchaser upon payment by. him to the Town Supervisor of the purchase price in cash; and the receipt of such Supervisor shall be a full acquittance to such purchaser who shall not be obliged to see to the application of .the purchase money. Section 4 . The full faith and credit of the Town of Sothold, New Yor4, are pledged to the punctual payment of principal and interest on said note. Section 5. P. 540 Cu. In Disp. , 34,000 G.V.W. 12.00 x 24 tires , Walter Snaow Fighter - 4 Point Positive Drive, with Hydraulic front lift and right wing control and one # 430 One- way plow, for a maximum price of Eighteen Thousand Nine Hundred Ten Dollars and no cents ($18,910.00) , delivered at Peconic, N.Y. and to be delivered on or about March, 1956.
