Meeting of June 8, 1971
The Southold Town Board met at the office of the Supervisor, Albert
Martocchia, 16 South Street; Greenport, New York, on Tuesday, June 8,
1971, at 3 :00 P.M. , with the following present:
Supervisor Albert M. Martocchia, Councilman Howard Valentine_f
Councilman James Rich, Justice Martin Suter, Justice Louis Demarest,
Town Supt. of Highways Raymond Dean, Town Attorney Robert Tasker, and
Town Clerk Albert W. Richmond. Absent: Justice E. Perry Edwards.
Moved by Justice Suter, seconded by Justice Demarest, it was
RESOLVED: That the minutes of the meeting of May 25, 1971 be and
they are hereby approved.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Justice Suter, Councilman Valentine, Justice Demarest.
Moved by Councilman Valentine, seconded by Justice Suter, it was
RESOLVED: That a meeting of the Town Board will be held at the
office of the Supervisor, 16 South Street, Greenport; New York, on
Tuesday, June 22, 1971 at 3 :00 P.M.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Valentine, Justice Suter , Justice Demarest.
Moved by Councilman Rich, seconded by Justice Suter, it was
RESOLVED: That the reports of the Supervisor, Police, Building
Inspector Terry, Justice Suter, Ferry District and Town Clerk for
the month of May 1971 be accepted by the Town Board and placed on
file.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Councilman Rich, seconded by Justice Suter, it was -
RESOLVED: That the Town Board approves the action of the Fishers
Island Ferry District in accepting the lowest bid, Fishers Island
Utility Co. , to repair the .-Fishers Island Theatre which'- was damaged
by fire. The insurance company has approved damages in the amount
of $4,-66,1.00-.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by- Justice Demarest, -seconded by Councilman Valentine,- --it was
RESOLVED: That Supervisor Martocchia be and he hereby is authorized
to sign Agreement with Parks and Recreation Executive Department;'
Stateof New York, on the launching ramp at Gull -Pond - area--Norman E.
Klipp Marine Park.
Vote of the Town Board: Ayes : Supervisor Martocchia-; Councilman Rich,
Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Councilman Valentine, seconded by Councilman Rich, it was
RESOLVED: That Supervisor Albert Martocchia be and he hereby is
authorized to sign 'application and contract for '-gas , to 'be furhished
to the new Police Building.
Vote of the Town 'Board: Ayes : Supervisor Martocchia,` Councilman
Rich, Councilman Valentine, Justice Demarest. Nay: Justice Suter.
Moved by Councilman= Valentine, seconded by Justice Suter,
WHEREAS, a petition was received from Frank and Martin Sidor,
Mattituck, New York, requesting a change of zone of- certain property
described in said petition at Mattitu-ck, New York, from "A" Resi-
dential- and Agricultural District to "B" Business Distrpct;
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of' the Town of
Southold- be and he hereby 'is directed to transmit this application
to the Planning Board in accordance with Section 901,, Subdivision C
of Article IX of the Building Zone Ordinance of- the 'Town of Southold.

WHEREAS, Mabel Miles has applied to the Town Board for a single
trailer renewal permit dated June 8, 1971,
NOW, THEREFORE, BE IT RESOLVED: That the application of Mabel
Miles to locate a single trailer on her property at private road,
Mattituck,New York be and hereby is. granted for a period of six
months.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Councilman Valentine, seconded by Justice Demarest,
WHEREAS, Marian Council #3852 , Knights of Columbus, Cutchogue,
New York, applied to the Town Clerk for a Bingo License, and
WHEREAS, the Town Board has examined the application and after
investigation, duly made findings and determinations as required.

NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and.,he
hereby is authorized and directed to execute on behalf of the Town
Board the findings as required by law, and it is further
RESOLVED: That the Town Clerk be and he hereby is directed to issue
Bingo License to the Marian Council #3852 , Knights of Columbus.

Moved by Councilman Rich, seconded by Councilman Valentine,
WHEREAS, the Southold American Legion, Griswold-Terry-Glover
Post #803 , Southold, ,New,_York, applied to the Town Clerk for a
Bingo License, and
WHEREAS, the Town Board has examined the application and after
investigation, duly made findings and determinations;. as required
by law,
NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby
is authorized and directed to execute on behalf of the Town Board
the findings and determinations as required by law, and it is
further
RESOLVED: That the Town Clerk be and he hereby is directed to
issue a Bingo License to the Southold American Legion, Griswold-_
Terry-Glover Post #803 , Southold, New York.

Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by .Councilman Rich, it was
RESOLVED: That Police Chief Carl Cataldo be and he hereby is
authorized to attend Police Chief Conference September 20-30, 1971,
FURTHER RESOLVED: That the .sum not to. exceed $200. 00 for traveling
expenses and meals and lodging incurred while attending said
Conference be a legal charge against the Town of Southold.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman-
Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Justice Suter, it was
RESOLVED: That Albert W. Richmond, Town Clerk, Town of Southold,
be and hereby is authorized to attend Town Clerk School at Cornell
University, Ithaca, New York, on June 21, 22, 23 , 1971, and be it
further
RESOLVED: That the necessary expenses incurred while attending
said school .be a legal charge against the Town of Southold.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Councilman Valentine,
WHEREAS, by resolutionadopted by this Town Board on the llth day of
May 197,1, a public hearing, was authorized to be held in the matter
of a Wetland Ordinance, and
WHEREAS, said hearing was held by the Town Board on the 1st day of
June 1971, at which time all interested persons were given an
opportunity to be heard, add

WHEREAS, the Town Board deems it is in the best interest of the Town
of Southold that the Wetland Ordinance be adopted.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Valentine, Justice Demarest. Nays : Councilman Rich, Justice Suter.
Resolution declared lost.
Recess called at 4 :05 P.M. to reconvene at 5 :00 P.M.
Moved by Justice Demarest, seconded by Justice Suter, it was
RESOLVED: That General Bills in the amount of $110, 654.20 (bill
of Lou ' s Garage in the amount of $140. 50 is to be paid also) , Fishers
Island Ferry District in the amount of $25, 879.47, Highway bills in
the amount of $52 , 215 . 39, Lighting District Bills in the amount of
$4, 208. 50, Capital Account Bills in the amount of $4, 186. 30, be and
hereby are ordered paid.

Moved by Councilman Valentine, seconded by Justice Suter,
WHEREAS, a written petition, dated March 15 , 1971, was heretofore
and on June 8, 1971, duly filed with this board pursuant to Section
200 of the Town Law of the State of New York for the improvement of
highways in said town known as Gin Lane, Bay Haven Lane, Watersedge
Way and Midway situate at Bay Haven, in the Town of Southold, and
'shown and designated on a certain map entitled "Map of Bay Haven at
Southold, Suffolk County, New York" filed in the Suffolk County
Clerk 's Office on January 22', 1959, as Map No. 2910, by the permanent
pavement of the same and the construction of such curbs, gutters,
catch basins and drainage facilities as may be necessary; and whereas
it duly appears that such petition has been duly signed by the owners
of real estate owning at least one-half of the entire frontage or
bounds on both sides of said highways situate between the points
aforesaid and whereas it duly appears that such petition was also
duly signed by resident owners owning not less than one-half of the
frontage owned by resident owners residing in or along such highways;
and whereas such petition was duly acknowledged or proved by all the
signers thereof in the same manner as a deed to be recorded; and
whereas the -maximum amount proposed to be expended for the improve-
ment of said highways as stated - in - the -petition -is the sum- of
$10, 500. 00' it is, pursuant to the provisions of said Section 200
of the - Town Law of the State of New York, hereby
ORDERED that the Town Board of the Town of Southold, Suffolk County,
New York;- shall meet at the 'Supervisor 's Office in said Town on
the 6th --day -of July; 1971, at 3 :00 o ' clock in the afternoon of that
day,- for -the purpose of considering the -said;-petition and hearing
all -persons interested in the subject thereof concerning the same.

Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Justice Suter, 'seconded by Councilman Rich, it was
RESOLVED: That 'the Superintendent of Highways Dean be and he hereby
is authorized to attend Superintendent of Highways Convention at '
Shelter Island, New York, on June 12 and 13 , 1971, and further
RESOLVED: That the necessary expenses incurred while attending said
convention be a legal charge against the Town of Southold.

Rich, Councilman Valentine, Justice Suter, Justice Demarest. -
Recess was called at 6 :15 P.M. to reconvene at 9 :00 P.M.

RESOLVED: That the next meeting of the Town Board will be held at
the office of Supervisor Martocchia, 16 South Street, Greenport,
New York, on Monday, June 14, 1971 at 9i30 A.M.
