MEETING OF APRIL 20, 1971
The Southold Town Board met at the office of Supervisor Albert Martocchia
on Tuesday, April 20, 1971 at 7 :30 P.M. with the following present: .
Supervisor Martocchia, Councilmen Rich and , Valentine, Justices Suter and
Demarest, Town Attorney Tasker, Supt. of Highways Dean, and Town Clerk
Richmond. absent : Justice E. Perry Edwards.
Moved by Justice Suter, seconded by Councilman Rich;'
RESOLVED: That the minutes of April 6 , 1971 be and they hereby are approved.
Vote of Town Board: Ayes- ALL.
Moved by Councilman Valentine, seconded by Justice Suter;
RESOLVED: That- the next meeting of the Town Board will be held at the
office of the Supervisor Albert Martocchia, 16 South Street, Greenport, N.Y.
on May 11, 1971 at 3 :00 P.M. Vote of the Town Board: Ayes : Supervisor
Martocchia, Councilman Rich, Councilman- Valentine, Justice Suter and
Justice Demarest.

WHEREAS , The Town Board of the Town of Southold advertised for bids for
the operation of the refreshment- stand and facilities at the Town Beach
on March 19, 1971, and ,
WHEREAS , after study, it was recommended that the bid of Custodia Brandi
of $700. 00 per annum be accepted by the Town Board of Southold, N.Y. ,
NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be directed to enter
into a contract with Custodia Brandi for the operation of the Town Beach
Refreshment Stand and Facilities for a period of five (5) years in accord=
ance with the corrected terms set forth in the specifications prepared by
the Town Attorney. Vote of the' Town.. Board: Ayes : Supervisor Martocchia ,
Councilman Rich, Councilman Valentine, Justice Suter and Justice Demarest.
At 3 :00 P.M. on March 31, 1971 in accordance with the notice published

and he hereby is directed to enter into a contract with John McMahon & Co.
for the building of a police building as advertised at a cost of
$78, 500. 00.

WHEREAS , the Board reported that the lowest bid on the Hearing, Ventila-
ting and Air Conditioning for the Police Building was submitted by

NOW, THEREFORE, BE IT RESOLVED: That Albert Martocchia , Supervisor,
be and he hereby-.is directed to enter into a contract with Total
Cond. , Inc. , Deer Park, N.Y. , for the heating, ventilating„and air
' conditioning of the police building as advertised at a cost of $11, 400.00.

NOW, THEREFORE, BE IT RESOLVED: That Albert Martocchia, Supervisor,
be and he hereby is directed to enter into a contract with Mattituck
Plumbing and Heating, Mattituck, N.Y. for the plumbing and sanitary
work as advertised at a cost of $7 , 730.00. .

be and he hereby is directed to enter into a contract with Hinck
Electric, Inc. , as advertised at a cost of $16, 990.00.

RESOLVED: ,That a public hearing will be held by, the Town Board of
the Town of Southold on the llth day of May, 1971, at the Supervisor ' s
Office, 1'6,, South Street, Greenport, New York at 3 :00 o' clock P.M.
of said day upon the matter of the application of Long Island Light-
ing Company requesting the granting of a right, Franchise, permission
or consent. for the use of the streets, highways and public places of
the Town of Southold or any part thereof or the space above or under
them or any of them for the purpose of erecting, maintaining and
operating electric and gas facilities .

RESOLVED: That on the Certiorari Proceedings, Mr. Joseph Lite appeal
before' the Hon. John P. Cohalan, Jr. on Monday, April 19, 1971, and
.the following cases were marked settled: Beling, Corwin, Bennett and
Raymond, Greenport Play, House, and further
RESOLVED: That the Board approves of the action of Joseph Lite on
this case.

RESOLVED: That the following Ordinance was passed by the Town Board:
"An Ordinance to provide for a partial tax exemption of real property
owned by certain persons with limited income who are 65 years of age
or over, pursuatt to Section 467 of the Real Property Tax Law of the
State of New York. " as : follows , to wit :

Se6t2oni1: Real property owned by` one or more persons , each of whom
is sixty-five years of age or over, or real property owned by husband and
wife, one of whom is sixty-five years of age or over, shall be exempt
from town taxes 'to the extent of fifty per centum' of the ' assessed 'valuation
thereof.
Section 2 . " No exemption shall- be granted
(a) If-the 'income of the owner or the" ' combined income of the
owners of the property for the income tax year immediately preceding the
dateof making application for exemption exeeeds the sum of five thousand
dollars . Income- tax year shall mean the twelve month period for which the
pwner or owner's filed a. federal personal' income tax return, or if no such
return is filed, the calendar year. Where title is vested in either the
husband or the wife, their combined income may not exceed such sum. Such
income shall include social security and retirement benefits, interest,
dividends, net rental income, salary or earn'ings,- and net income from self-
employment,' but shall not include gifts. or inheritances ;
(b) Unless the title of the property shall have been vested in
the owner or all of the owners of the property for 'at least- sixty con-
secutive monthsp�ior to the date ' of making application for exemption;
provided, however, that in the event of the death of either a husband
or wife in' whose name title of the property shall have been vested at
the time of death and then becomes vested solely in the survivor by
vittue of devise by or descent from the deceased hu"sband or wife, the
time of ownership of the property by the deceased husband or wife shall
be deemed also a time of ownership by the survivor and. such ownership
shall be deemed continuous for the purposes of computing such period
of sixty consecutive months and provided further that where ,property of
the owner or owners has been acquired to replace property formerly
owned by such owner or owners and taken by eminent domain or other
involuntary proceeding, except a tax sale, the period of ownership of,
the former-property shall -be combined with the period of -ownership of
the property for which application- is made for exemption and-- such
periods of ownership shall- be deemed to 'be consecutive for purposes
of this ordinance;
(c) Unless the property is- used exclusively for residential
purposes ;
(d) Unless the real-property- is the legal. residence of and
is occupied- in whole or- in part by the owner or by all of the owners of
the property: _ .
Section 3. Application for such exemption must be made by' the,
owner or all of the owners of the -property, -on, forms- prescribed .by the
state board to be furnished by the appropriate assessing- authority and
shall furnish the--information and be executed in- the' manner- required or
prescribed in such forms, and shall be filed in such assessor '-s office
on or before the appropriate taxable status date.
Section 4. At least sixty days prior to theappropriate- taxable
status date, the assessing authority shall mail to each person who
was granted exemption pursuant to this .ordinance- on the latest completed
assessment roll an application form and a notice that such application
must be filed on or before taxable status date :and. be approved in order
for the exemption to be granted. Failure- to mail any such application
form 'and notice or' the failure of such person• to receive the same shall
not prevent the levy, collection and enforcement of the-,payment of the
taxes- on property owed by such person,. -
Section 5 . - Any conviction of having made .any wilful -fa-Ise--statement
in the application for such exemption, shall' be punishable --by a fine of
not more than one hundred dollars and shall disqualify the applicant or
applicants from further exemption for a period of five years .
Section- 6. This ordinance-- shall take effect immediately.

4. This agreement may be cancelled by the. gra,ntors -upon sixty

ofa sum equal - to three times the difference between the amount of real
estate taxes paid or assessed against the premises,-and the amount of
real estate taxes _that would be assessed against the premises had . the
premises not been..burdened with the provisions of -this .instrument, .both-.,
computed in the tax year in which the cancellation shall take place.

Upon payment; of -such sum; -the grantee-, shall execute and: deliver, .to the
grantors a,-release• of easement instrument in .recordable-, -form. - . . .. .
5 : In the event that the grantors desire .to- depose of the premises
or any party thereof, during the term of this. agreement, or any renewal
or extension thereof, by sale, gift, or otherwise, the grantors shall
give the grantee 30. days notice of .such proposed .dispos.ition and: the
terms thereof. The grantee shall have the first' option to acquire the
premises within said .thirty (30) -day, period on. the same. terms as any
such proposed dislbosition.
-6. The -failure. of the grantee' to, insist upon the strict performance
of any of the terms, conditions, covenants or restrictions contained . .
herein, shall not be deemed a waiver of any subsequent breach or, default
in the--terms , conditions!, ,'covenants ,. or restrictions,, contained ;herein.
7_. If the whole or .any. part of the pr:emis:es shall be condemned
or taken by eminent 'doma-in, then-this agreement shall .forthwith' cease
from the date of title vesting in such proceeding. In such event the:
grantors shall be .required to.- pay.- no penalties, nor shall the value of
the premises be limited .by .this easement, :nor shall any part of any -
award belong .to the grantee.=
8. The grantee covenants that to the extent legally- permissable
the valuation placed upon the premises- for purposes' of -real estate tax-
ation will be limited by the restriction of this scenic ease.ment 'in
accordance with Section. 247 :of the General Municipal Law of the State
of New York. -
9. A1.1- -of the covenants, --conditions., reservations, .-,restrictions,
easements and provisions of this agreement shall continue and remain
in effect until the 31st day o.f .December,. 1981, a-t which time all .of

7 I`f the whole or any part, of. the' premises shall be condemned
or taken by eminent domain, then this agreement shall forthwith cease .from
the date of title vesting in such proceeding. In such event the grantors
shall be required :to pay no penalties),: nor shall the value :of 'the premises
be limited by this easement, nor shall any -part of any award. belong to : the
grantee. -
8. -The grantee covenants that to the extent legally permissable
the valuation placed upon the premises for purposes of real estate tax-
ation will be limited by the restriction of this scenic easement in accord-
