The Southold Town Board met at the office of Supervisor Albert Martocchia,
16 South Street, Greenport, New York, at 3 :00 P.M. on February 23, 1971
with the following present: Supervisor Martocchia; Councilmen Valentine
and Rich; Justices Suter and Demarest; Town Attorney Tasker; Superintendent
of Highways Dean and Town Clerk Richmond.
Moved by Justice Suter; seconded by Councilman Rich;
RESOLVED: That the next meeting of the Town Board will ,be held at the
office of Supervisor Albert Martocchia, 16 §outh Street, Greenport, .
New York, on Tuesday, March 9, 1971 at 3 :00vP.M.
Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine
and Demarest; Justices Demarest and Suter.

RESOLVED: That the minutes of the meeting of February 6, 1971 be and
they hereby are approved.

RESOLVED: That William McGonegal be and he hereby is appointed Police
Patrolman of the Town of Southold, Suffolk County, New York, for a pro-
bationary period ending March 1, 1972 , and be it further
RESOLVED: That William McGonegal will serve in the capacity of Police
Patrolman at the pleasure of the Town Board, and
RESOLVED: That the compensation during this probationary period be
fixed at $8, 250. 00 payable biweekly, . effective . as of March 1, 1971.

that they would reach the top salary grade upon completion of three

RESOLVED: That notwithstanding the current contract between .the-:Town..
of Southold -and the Patrolmen'-s Benevolent Association, . that the: afore-
said police officers be paid the top salary grade upon their completion
of three years of service:- in. the: Town of Southold -.Police..Department, .
commencing with their permanent appointment from the Civil Service List:

RESOLVED: That this Town Board opposes the following ACT;
AN ACT to amend the county._law; in.- relation to the assessment of costs
of sewer districts in the county of . Suffolk. -
The People of the State of New York, .represented-.in°Senate:.and Assembly
do enact as follows :
Section 1. The County Law- is hereby :amended :by.--adding:,thereto: a new -
section, to be '-section two hundred 'seventy-a; to read -.as follows : ,
Section 270-a: Assessment 'of -costs . of sewer districts in- Suffolk County.
Notwithstanding the provisions of this article or of any general,, special
or local law, the county of Suffolk may, by a resolution of its legislature
body, provide that part of the cost of any sewer district .constructed or
operated within the county be a charge against the entire county and assess
the cost thereof as a county charge.

WHEREAS, bids have been submitted to this Board on January 29, 1971 pursuant
to :,public notice for the construction of a police building for the Town of
Southold,, and
WHEREAS, the amount of said bids exceeded the amount of funds .author-ized
for said project,
NOW, THEREFORE, BE IT RESOLVED: Thatall of said bids be and they hereby
are rejected.

WHEREAS, this Board heretofore advertised for bids for the construction of
the police building for the Town of Southold, and
WHEREAS, all of said bids were rejected for the reason ,that the amounts
therefore exceeded the amount of the appropriation for said project, and
WHEREAS, the plans and specifications for said. police building have been
revised and it is now desired to advertise for bids for the said police
building in accordance with said revised .plans and specifications;.

NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is
authorized and- directed to advertise for bids for the construction of a
police building for the Town of Southold in accordance with said revised
plans and specifications therefore.

RESOLVED: That a fee of $5. 00 be charged for the Master Plan Map and Text.

RESOLVED: That the outhold Town Board accept a Bond of $42 , 000 as recommend-
ed by the Southold town Planning Board for roads and improvements in the
subdivision known as"SHORECRES.T,) , located at south side of Middle Road
(CR 27) Greenport, New York, subject to the approval of the Town Board in
writing by the Highway Superintendent and the Town Engineer.

RESOLVED: That George Fisher, Building Inspector, be and he hereby- is
authorized to purchase cards and files for all information on roads in
the Town of Southold, the sum not to exceed $100.00.

WHEREAS, the Superintendent of Highways of the Town of Southold by- order
dated February 23 , 1971, changed the location of a portion of a certain
highway known as Nassau Point Road, and
WHEREAS, - the lands lying to the east of said town highway as relocated
have been discontinued and closed as a town highway,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby-
is authorized and directed to issue and deliver a quit claim deed to the
owners of the lands lying to the east of said Town highway as relocated.

RESOLVED: That the -Superintendent of Highways of the Town of Southold
be authorized to advertise for bids and to purchase from the lowest
responsible bidder, 2 - 10 ft. Box Type Sand Spreaders.

WHEREAS, this Board has heretofore authorized the construction %of the
Grand Avenue Bridge at Mattituck, New York, in the Town of Southold,
jointly with the County of Suffolk, and
WHEREAS, as a part of such project, the -Town of .Southold is required to
acquire the necessary lands for the approaches to said bridge, and
WHEREAS, a portion of the lands required to be acquired for said project
must be acquired by condemnation,
NOW, THEREFORE, BE IT RESOLVED: That Joseph Lite be and he hereby is
retained as Special Town Attorney for the purpose of conducting all
proceedings necessary for the acquisition- of -the necessary lands for the
construction of the Grand Avenue Bridge at Mattituck in the Town of
Southold including the commencement of condemnation proceedings for
said purpose.

Upon Reading and Filing the application of the Cutchogue-New Suffolk Park
District and the Nassau Point Causeway Association, dated and acknowledged
December- 4, 1970, ' and the consent, dedication- and release of the Cutch-
ogue-New S•ugfolk Park District and the Nassau Point Causeway Association
dated December. 4, 1970, and duly acknowledged, consenting that- the location
of the .above-mentioned road be- changed-in. the manner therein set, forth,
and dedicating and, releasing ..the necessary lands therefor,. to which
application and release 'is attached a -map showing tH6 -existirig highway
and_the :new location to -which it is desired to _move the 'same, ,

LOCAL LAW NO .1 - 1971.
A Local law to provide that the offices of assessors. in the. town ;of
Southold shall continue to be elective.
Be it enacted by .the town board of the town of Southold as follows:
SECTION 1. The offices of assessors in the town of Southold shall con-
' tinue to be elective, as provided by the law in effect immediately"
prior to the effective date of section 1556 -of 'the Real Property .
Tax Law, . as added by chapter..957 ..of the, Laws of nineteen hundred
seventy. ,
SECTION• 2. . This local, law. shall be subject. to mandatory referendum and
shall be. submitted for the -approval of the ,electors of the town..of '
, Southold at a ..special election to beheld at a time not later than,
July 1, 1971.,.

LOCAL LAW,NO. 2 -YEAR- 1971
A local law to provide that, the ,number of assessors in, the town,
of. Sputhol.d ,be reduced. from six ..to: three,..
Be it enacted by the Town Board of the. Town of Southold, as follows:
SECTION ,1,. . Sections one and two of..chapter..sixty-eight of thei :laws of
eighteen hundred and fifty-six entitled ."An Act,- to authorize, the in-
. habitants of. the Town of Southold; .,in the County of Suffolk; to elect
six assessors for said town" as .amended by Chapter three hundred,
seventy-four of, the laws of eighteen hundred, ninety-eight and by
chapter eight hundred twenty-five of the laws of nineteen hundred
sixty-one, ,are; hereby amended to: read. as _follows.:
SECTION Lo On and after the..thirty=first day of December, - nineteen
hundred seventy-one, there shall be four assessors for the town of
Southold, On and after. the thirty-first, day of December nineteen -hundred
.seventy-three,,-there shall be three assessors .for the town. of .Southold.
,.:,,,, SECTION 2., At a,,biennial town election ;for the year, nineteen. hundred
seventy-one, one.: assessor shall be elected _ for:.a term of - four ,.years
and one assessor shall be; elected at every second biennial town. election
held thereafter: At the biennial town election for the year nineteen- ,
hundred seventy-three, two assessors shall be elected for a term of
four years and two assessors shall be elected at every second biennial
town election held thereafter.
SECTION 3. The provisions of this local law shall not become effective
unless the town board of the town of Southold, prior to April 30, 1971,
adopts a local law, subject to a mandatory referendum, providing that the
offices of assessor of the Town of Southold shall continue to be elective
and such law shall be approved by the electors of the town of Southold
at a special town election held not later than July 1, 1971.
SECTION 4. This Local Law shlall be subject to mandatory referendum and
shall be submitted for the approval of the electors of the town of
Southold at a special town election.

WHEREAS, Dr. John Hansen, Cutchogue, New York, has been a faithful
and conscientious member of the Local Narcotic Guidance Council
since his appointment in 1968, and
WHEREAS, Dr. John Hansen has diligently and faithfully performed all
of the duties in connection with the Narcotics Council, and has been
of great service to the people of Southold Town,
NOW, THEREFORE, BE IT RESOLVED: That it is with deep regret that the
Town Board of the Town of Southold accepts the resignation of Dr.
Hansen, and be it further
RESOLVED: That a copy of this resolution be forwarded to Dr. John
Hansen and a copy be recorded in the minutes of the meeting of the
Town Board.

WIE REAS, James Mulhall, Southold, New York, has been a faithful and
conscientious member of the Conservation Advisory Council since his
appointment in May of 1969, and
WHEREAS, James Mulhall has diligently and faithfully performed all of
the duties in connection with the Conservation Council and has been of
great service to the Town of Southold,
NOW, THEREFORE, BE IT RESOLVED: That it is with deep regret that the
Town Board of the Town of Southoid accpets the- resignation of James
Mulhall, and be it further

RESOLVED: That a copy of this resolution be forwarded to James
Mulhall and a copy be recorded in the minutes of the meeting of the
Town Board.

RESOLVED: That the Town Clerk of the Town of Southold be and he hereby
is directed to request the Long Island Lighting Company to install the
following lights :

Vincent Bialecki and Henry Stepnoski complained of horses trespassing
on private property, also the possibility that they may spread golden
nematode.
Mrs. Lytle, Mr. & Mrs. Pospisil and other members of the Senior Citizens
appeared to request the Town approve of raising the benefits in taxes
for Senior Citizens from $3000 to' $5, 000 as the State and County have done.
Irving Latham, Orient, N.Y. requested that the map and text on the Master
Plan be made available to the public. The Supervisor assured him they
would be available very soon.
Edward Latham reported that he was not happy with the Master Plan in
relation to the wetlands.
