The Southold 'Town 'Board met at the office of Supervisor Albert Martocchia, 16 South Street, Greenport, New York, on Tuesday, February 2, 1971 at 3 :00 P.M. with the following present: Supervisor Martocchia; Councilmen Valentine and Rich, Justices Demarest -and Suter; Town Attorney Tasker; Superintendent of Highways. Dean '.and .Town :C.lerk Richmond. Moved by Justice Suter; seconded by Justice Demarest; RESOLVED: That the minutes of January 26, 1971 be and they hereby are approved. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest' and Suter. Moved by Councilman. Valentine; seconded by Councilman- Rich,- RESOLVED: That the next meeting of the 'Town Board will be held at the office of Supervisor Albert Martocchia, 16- South Street, Greenport, New)York', on Tuesday, February 23 , 1971 'at 3 :00 , P.M. Vote of Town Board: Ayes-Supervisor Martocchia;- Councilmen Valentine and Rich; Justices Demarest and Suter. Moved 'by Justice Suter; seconded by -Councilman Valentine ; RESOLVED: That the reports of the Board of Appeals, Supervisor, Building Department and 'Town Clerk for the month of January ,1971 be accepted by the Town Board and placed on file. Vote of Town Board: Ayes-Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. Moved by Justice Suter; seconded by Councilman Rich; WHEREAS, Southold Town Planning Board has prepared an official report and recommendation and the County Planning Board has been notified and it's report returned to the Town Board on the application of Gus .Schad' for a change of zone from "A" Residential and Agricultural District. 'to "M" Multiple Residence District on Parcel "A" and from "A" Residential and Agricultural District to "B-2 " Business District on Parcel '"B", situated near Greenport, New York; NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by- the Southold Town Board at the Greenport High School, Greenport, N.Y. on March 9, 1971; at 7 :30 P.M. on the above mentioned petition and =that- the Town Clerk be and he hereby is authorized and directed to cause _ notice of said hearing to' be 'published in the Suffolk Weekly Times, , -,, pursuant to the requirements of law. Vote of Town Board: Ayes-supervisor' Martocchia; Councilmen Valentine- and Rich; Justices Demarest and Suter. Moved by Justice Demarest; seconded by Justice Suter; BE IT RESOLVED: That the Town Board of the Town of Southold does hereby elect, as provided-- in Section 302 , Sub-Division Nine (d) of the Retire ment and Social Security Law as presently or- hereafter amended, to grant a one year final average salary for eligible employees" ; and BE IT FURTHER RESOLVED: That this election shall become effective "with. the payroll beginning immediately. Moved by Councilman Valentine; seconded by Councilman Rich; RESOLVED: That a public hearing will be held on the following LOCAL LAW #1 and LOCAL LAW #2 of the year 1971 .at 7 :30 o ' clock P.M. on Tuesday, February 23, 1971, at which time all persons interested will be heard; LOCAL LAW #1 Year' 1971 A local law to provide that the offices of asessors in the town of Southold shall continue to be elective. Be it enacted by the Town Board of the Town of Southold as follows : Section 1. The offices of assessors in the town of Southold shall continue to be elective, as provided by the law in effect immed— iately prior to the effective date of section 1556 of the Real Property Tax Law, as .added by Chapter 957 of the laws of nineteen hundred seventy. Section 2. .This local law shall be subject to mandatory ref- erendum and shall be submitted for the approval of the electors of the town of Southold at a special election to be held• at a time not later than July 1, 1971. 7 LOCAL LAW #$2 - Year 1971 A local law to provide that the number of assessors in the town of Southold be reduced from six to three. Be it enacted by the Town Board of the Town of Southold as follows : Section 1. Sections one and two of chapter sixty-eight of the laws of eighteen hundred. and fifty-six entitled "An Act to authorize the inhabitants of the town of Southold, in the County of Suffolk, to elect .six assessors for said town" as amended by chapter three hundred seventy-four of the laws of eighteen hundred ninety-eight and by chapter eight hundred twenty-five of the laws of nineteen hundred sixty-one, are hereby amended to read as follows: Section 1. On and after the thirty-first day of December nineteen hundred seventy-one, there shall be four assessors for the town of Southold. On and after the thirty-first day of December nineteen hundred seventy-three, there shall be three assessors for the town of Southold 1 . Section 2. At a biennial town election- for the year nineteen hundred seventy-one, one assessor shall be ebcted for a term of four years and one assessor shall be elected at every second biennial town election held thereafter. At the biennial town election for the year nineteen hundred seventy-three, two assessors shall be elected for a term of four years and two assessors shall be elected at every second biennial town election held thereafter. Section 3 . The .provisions of this local law shall not become effective unless the town board of the town of Southold, prior to Apri1 .30, 1971, adopts a local law, subject to a mandatory referendum, providing that the offices of assessor of the ,town of Southold shall continue to be elective and such local law shall be approved by the electors of the town of Southold at a special town election held not later than July 1, ,1971. Section 4. This local law shall be subject to mandatory referen- dum and shall be submitted for the approval of the electors of the Town of Southold at a special town election. Moved by Justice Demarest; seconded by Councilman Rich; WHEREAS, Matthew Mullen, Cutchogue , N.Y, by petition verified December 3 , 1970, petitioned the Town Board for a change of zone of certian property described in said petition from "A" Residential and Agricultural District to "B-211--Business District, and WHEREAS, the said petition was referred to the Southold Town Planning Board for official recommendation and report and the County Planning Board having been notified, and WHEREAS, the Town Board pursuant to due notice thereof held a hearing thereon on the 26th day of January-, 1971 at which time all interested. persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That the relief demanded in said petition be and the same is in all respects denied. Mrs. Knowles, Indian Neck, Peconic, N.Y. appeared before the Town Board on behalf of the League of Women Voters requesting information on the - following subjects : Master Plan,,--filling of land on Eugene Road, Cutch- ogue, filling of- land on Major 's Pond, Orient, and filling at the end of Moore 's Lane and New Suffolk Avenue, Cutchogue. Moved by Justice Suter; seconded by Councilman Valentine; RESOLVED: That General Bills in the amount of $10, 986.44; Special District Bills in the amount of $21, 919. 95 ; Fishers Island Ferry District Bills in the amount of. $12, 578. 77 and Highway Bills in the amount of $4,844. 06 be and the same are hereby ordered paid. NOW, THEREFORE, BE IT RESOLVED: That the Town Southold furnish such trans- portation for the Senior Citizens at a cost not to exceed $352 .00.
