The Southold.-,Town Board met at the office of Supervisor Albert Martocchia,
16 South Street, -:Greenport, New York, on January 5 ,-- - 1971 at 3 :00 P.M.
with the following present: Supervisor Martocchia ; Councilmen Valentine

WHEREAS, it is required that an enforcement officer be appointed for
Multiple Residence Law of the Town of Southold, it is
RESOLVED: That Howard M. Terry be and he he-Leby is appointed enforce-
ment officer for Multiple Residence Law for the term of one year - commenc-
ing January 1, 1971 and expiring December 31, 1971, and be it further
RESOLVED: That the salary be and hereby is fixed at the sum of $3 , 265
+$131. 00 or $3 , 396. 00 per year payable in regular bi-monthly payments
during said term and that such posit-Lon be held at the pleasure of the
Town Board unless otherwise provided for by law, and it is further
RESOLVED: That the Town Clerk be instructed to file such certification

the Town of Southold, now, therefore, be it
RESOLVED: That Howard M. . Terry be appointed and he hereby is appointed
enforcement officer of said Building Zone Ordinance for a term of one
year commencing January 1, 1971 and expiring December 31, 1971, and
FURTHER RESOLVED: That the salary be and hereby is fixed at the sum
of $7 , 229 + $289. 00 or $7 , 518. 00 per year payable in regular b-monthly
payments during said term and that such position be held at the pleasure
of the Town Board unless otherwise ptovided for by law, and be it further
RESOLVED: That the Town Clerk be instructed to file such certificate with
the proper parties as is required by Section 30 Subdivision 3 bf the Town Law.

officer of said Building Zone Ordinance for a term of one year commencing
January 1, 1971 add expiring December 31, 1971, and it is further
RESOLVED: That the salary be and hereby is fixed at the sum of $6, 165.
per year payable in regular bi-monthly payments during said term and
that such position be held at the pleasure of the Town Board unless
otherlwise provided for by law, and it is further
RESOLVED: That the Town. Clerk be instructed to file such certification
with the proper parties as is required by Section 30, Subdivision 3
of the Town Law.

manner of execution and sufficiency of sureties therein.

RESOLVED: That Cecilia Stepnoski, Greenport, N.Y. be and she hereby is
appointed School Traffic Officer, Town of Southold, effective as of
January 1, 1971 at the daily wage of $12 . 50 per day for each day worked,
she to serve at the pleasure of the Town Board.

WHEREAS, Section 64 of the Town Law requires the Town Board to designate
by resolution Banks in the state in which the Supervisor or any other
officer of the Town shall deposit all monies coming into their hands by
virtue of their offices, and
WHEREAS, the Town Board may require any Bank, so designated, to deposit
with such Board bhe Bonds or Certificates of the United States of the
State of New York or any County, Town, City, Village or School District
of the State of New York as security for such funds so deposited by
such Bond or Certificate shall be subject to the approval of the Town
Board and shall be deposited in such place and held under such condition
as the Town Board may determind,
NOW, THEREFORE, BE IT RESOLVED: That the amount of security set forth "for

RESOLVED: That the Suffolk Weekly Times , Greenport, New York, a newspaper
regularly published in the Town of Uouthold, which has been entered as
secondL'class mail matter be and the-same is hereby designated, effective
as of February 1, 1971, as- the official paper of the Town of Southold
for the publication of all notices, resolutions, ordinances and other
matter required to be published, and it is further
RESOLVED: That the Long Island Traveler-Mattituck Watchman, Southold.,
New York, a newspaper, be designated as an additional newspaper for the
publication of such notices, resolutions and ordinances.

RESOLVED: That any Town official elected or appointed who is required to
use his own automobile in the performance of duty be compensated for travel
expense necessarily and actually incurred in carrying out the duties of liis
office at a rate not to exceed twelve ( . 12) cents per mile.

RESOLVED: That the Southold Town Officials who desire to attend the Annual
meeting of the Association of Towns. of the State of New York to be held on
February 9, 9 and 10, 1971 be and hereby are .authorized to attend, . and it is
FURTHER:.RESOLVED: That the actual and necessary expense incurred in connect-
ion with attendance of such meeting shall be a legal charge against the . Town.

RESOLVED: That Supervisor Albert Martocchia be designated to represent the
Town of Southold at the Annual meeting of the Association of Towns of the
State of New York to be held in New York City, N.Y. in February 1971 and
to cast the vote of the aforesaid Town pursuant to Section ' 6 of Article
III of the Constitution and by-laws of said Association, and be it further
RESOLVED: That Justice Suter be designated to act as Alternate to cast
the vote of said Town at the Annual meeting in the absence of Supervisor
Martocchia.

WHEREAS, John J. Klein has applied to the Town Board for a single trailer

locate a single trailer on his property, Main Road, Mattituck, N.Y, be and
hereby is granted for a period of six (6) -months.

WHEREAS, Southold Town Planning Board has prepared an official report
and recommendation and the County Planning Board has been notified and
their report returned to the Town 'Board on the application of Matthew
Mullen for a change of zone from "A" Residential and Agricultural ,.District
to "B-2 " Business District on certain property situated in Cutchogue, , N.Y.
NOW, THEREFORE, BE IT RESOLVED: That a public. hearing will be held. by the
Southold Town Board at the Supervisor ' s Office, 16 .South Street, "Greenport,
New York, on January 26, 1971 at 7 :30 P.M. on the above mentioned petition
and that the Town Clerk be and he hereby is authorized and directed to
cause notice of said hearing to be published in the L.I. Traveler-Matt-
ituck Watchman pursuant to the requirements of law.

RESOLVED: That Albert Martocchia, Supervisor, be and he hereby is authorized
to act as Social Service Officer at the pleasure of the Town Board, he to
serve in such' capacity without compensation, and it is further
RESOLVED: That the Town Clerk be instructed to file such certif,itate with
the proper parties as is required by Section 30, Subdivision 3 of Town Law.

IN THE MATTER OF THE ESTABLISHMENT OF THE WEST GREENPORT
WATER SUPPLY DISTRICT, IN THE TOWN OF SOUTHOLD, SUFFOLK
COUNTY, NEW PORK, PURSUANT TO ARTICLE 12A OF THE TOWN LAW.
. The Town Board of the Town of Southold, Suffolk County, New York, having
by order duly adopted on the 5th day of November, 1970, determined to hold
a. public hearing in the matter of the establishment of the West Greenport
Water Supply District in the Town of Southold, Suffolk County, New. York
to embrace the. territory hereinafter described; and a public hearing pursuant
to due notice thereof, having been held on the 24th day of November, 1970,
at the Supervisor ' s Office, 16 South Street, Greenport, in the Town of
Southold, Suffolk County, New York, at which time and place said Town Board

considered said matter and heard all persons interested therein; and
said Town Board having by resolution duly adopted on the 24th day of November
1970, following the said hearing and upon the . evid,ence given thereat, duly
determined that all of the property and property owners within the proposed
District were benefitted thereby; that all the property and property owners
benefitted were included within the limits of said proposed district, and
that it was in the public interest to establish said district and duly
resolved to approve the establishment of such Water Supply District to
embrace the territory hereinafter described, which said resolution was sub-
ject to a permissive referendum as provided in Section 209-e of the Town
Law, and no petition requesting that the matter of the establishment of
said district be submitted to a referendum of the property owners of the
proposed district having been filed with the Town Clerk, and the time
within which such petition may be so filed having expired;
IT IS ORDERED, that the said Water Supply District to be known as the
West Greenport Water Supply District be and it hereby is established to
embrace the territory described in and containing the following boundaries,
to wit:
ALL that certain tract, piece or parcel of land, situate west
of the Incorporated Village of Greenport, in the Town of Southold,
County of Suffolk and State of New York, bounded and described
as follows :
BEGINNING at a point formed by the intersection of the northerly
line of New York State Route 25 (Main Road) with the center line
of Pipes Neck Creek (Moores Drain) , running thence in a southerly
direction along the center 1ine ' of Pipes Neck Creek to the mean
high water line of Peconic Bay, Continuing thence along the mean
high water line of Peconic Bay.`.in a generally southerly and then
westerly direction to a point formed by the intersection of the
westerly line of land now or formerly of L. Booth with said mean
high water line, running thence northerly along the westerly
line of land now or formerly of L. Booth and its prolongation to
the center line of New York State Route 25 (Main Road) , running
thence Westerly along the center line of New York State Route 25
(Main Road) to the prolongation of the center line of Bay Home
Road, running thence northerly along the prolongation of the
center line of Bay Home Road to the Northerly line of the Long
Island Railroad right-of-way, running thence in a generally
easterly direction along the northerly line of the Long Island
Railroad right-of-way to a point on the northerly line of the
Long Island Railroad right-of-way distant westerly 850. 7 feet
from a point formed by the intersection .of the northerly line
of the Long Island Railroad right-of-way with the westerly line (s
of New York State Route 25 (Main Road) , eunning thence north-
easterly 1850 feet, more or less , to a point formed by the inter-
section of the southerly line of Albertson Lane with the westerly
line .of land now or formerly of J. Wickham; running thence ast-
erly and across Albertso Lane to a point on the northerly line
of Albertson Lane distant westerly 603 feet from a point formed
by the intersection of the northerly line of Albertson Lane with
the northwesterly line of New York State Route 25 (Main Road)
running thence northeasterly and parallel with the northwesterly
line of New York Route 25 (Main Road) to the prolongation of the
southwesterly line of land now or formerly of I. Costas, running
thence southeasterly along said prolongation of the southwesterly
line of land now or formerly of Costas to the northwesterly line
of land now or formerly of A. Drossos, running thence northeasterly
along the northwesterly lines of lands now or formerly of A. Drossos
and J. Drossos to westerly line of land of Long Island Lighting
Company, running thence northerly along the westerly line of land
of Long Island Lighting Company to the northwest corner of land
of Long Island Lighting Company, running thence easterly along the
northerly line of land of Long Island Lighting Company and land
now or formerly of S. Ciacia to the westerly line of Chapel Sill
Lane; running thence easterly across Chapel Sill Lane to a point
formed by the intersection of the easterly line of Chapel Sill Lane
with the southerly line of land of Long Island Lighting Company
running thence easterly along the southerly line of land of Long
Island Lighting Company to the southeast corner of land of
Long Island Lighting Company running thence easterly to the northwest

FURTHER ORDERED, that the Town Clerk of the Town of southold be and he
hereby is authorized and directed .within ten days after the adoption of
this order to cause a certified copy thereof to be duly recorded in the
Office of the Clerk of the County of Suffolk, New York; and it is
FURTHER ORDERED, That the Town Clerk of the Town of Southold be and he .
hereby is authorized and directed within ten days after the adoption of
this order, to cause a certified copy thereof to be filed in the office
of the State Department of Audit and Control at Albany, New York

RESOLVED: That Supervisor Albert Martocchia be and he hereby is authorized
to sign the following agreement between Town of Shelter Island and the
Town of Southold:
THIS AGREEMENT made on the 5th day of January, 1971 between the TOWN OF
SHELTERi-,ISLAND, a municipal corporation of the State of New York, having
its principal office 'at State Road (Route 114) . Shelter Island, Suffolk
County, New York, party of the first part, and the TOWN OF SOUTHOLD, a ,
municipal corporation of the State of New York, having its principal
office 'at 16 South Street, Greenport,-' Suffolk County, New York, party of
the second part.
WHEREAS, the party of the first part has heretofore established a central
fire alarm system embracing the entire territory of the Town of Shelter
Island and desires to provide for the receiving and dispatching of fire
and emergency alarms by the police department of the Town of Southold, and
WHEREAS, the party of the second part maintains a police department with
radio operators on duty twenty-four hours a day and can receive and dis-
patch fire and emergency alarms to and from the Southold Town Police De-
partment to the fire authorities in the Town of Shelter Island without
undue burden to the party of the second part, and
WHEREAS , the party of the first part also proposes to install a telephone
and other necessary radio and/or electrical equipment for such purpose
at the police headquarters of the party of the second part whereby all
alarms for fire and other emergencies in the Town of Shelter Island may
be received through such equipment at the police headquarters -of the
Town of Southold, and dispatched to the fire authorities in the Town
of Shelter Island, and
WHEREAS, in view of the foregoing, it is believed that it would be in the
public iritOfb8t that the parties h-ereto mutually agree that alarms for
fire and other emergencies be received and dispatched on behalf of the
Town of Shelter Island by the Town of Southold at its Police Headquarters
at Peconic, New York and that in addition thereto the Town of- Shelter
Island at its expense install the necessary communication equipment at
the Southold Town Police Headquarters Building for such purpose.
NOW, THEREFORE, IT IS AGREED, as follows ;
I. -That the -Town of Shelter Island, at its own cost and expense
will cause the necessary telephone radio and electrical equipment to be
installed and maintained at the Southold Town -Police Headquarters building
at Peconic, New York for the 'pu'rpose of receiving and- dispatching alarms
of fire and other emergencies to and from the central fire alarm system
of the Town of Shelter Island and the Southold Town Police Headquarters.
2 . That the Town of Southold hereby agrees to maintain sufficient
personnel at the Southold Town Police Headquarters building to answer all
alarms for fire and other emergencies received from the central fire
alarm system of the Town of Shelter Island and to dispatch the same to
the appropriate fire department and/or other authorities in the Town of ,
Shelter Island and to keep and maintain a proper record of such alarms,
received and dispatched.

3 . That for the performance of such services by the Town of Southold
for the Town of Shelter Island, the Town of Shelter Island hereby agrees
to pay the Town of Southold the annual sum of $900. 00 to be paid on or
about the 15th day. of June of each year during the term of this agreement.
4. This agreement shall commence on the 1st day of January, 1971,
and shall terminate on the 31st day of December, 1975. Notwithstanding,
the foregoing provisions .of this paragraph, either party hereto shall
have the option to terminate this agreement at the end of any calendar
year by giving written notice of termination to the other party .at
least 30 days prior to the end of such year.
5. The Town of Southold shall not, in any event, be liable for any
damage or loss of property or for the injury to persons, arising from
or caused by any break-down, or interruption of service of such commun-
ication equipment nor for any such damages or injury caused by the acts
of negligence of the Town of Southold, its officers or employees. The
Town of Shelter Island shall indemnify and hold harmless the Town of
Southold of and from any and all damages, judgments, costs and expenses
of every kind, which may arise or result from the acts or _omissions
of the Town of Southold, its officers and employees performed under
and pursuant to the provisions of this agreement.
6. That all equipment to.'.-be installed pursuant to this agreement
shall be installed and maintained in such manner as. authorized and
directed by the Chief of Police of the Southold Town Police Department.
In the event that such equipment is required to be moved and/or relo-
cated, the same shall be done at the expense of the party of the first
part..

THIS AGREEMENT made . bn the 5th day of January, 1971, between the
TOWN OF SHELTER ISLAND, a municipal corporation of the State of New
York, having its principal office at State Road (Route 114) , Shelter
Island, Suffolk County, New York, party of the first part, -and the
TOWN OF SOUTHOLD, a municipal corporation of the State of. New York,
having its principal office at 16 youth Street, Greenport, New. York,
party of the second part,
WHEREAS, the party of the first part owns and operates police
vehicles containing radio equipment but does not own. and maintain
a radio transmission base station, and
WHEREAS, the party of the second part maintains a police department
with a radio transmission base station together with radio operators
on duty twenty-four hours a day and can receive and transmit radio
communications to and from said base station to the. police vehicles .in
the Town of Shelter Island without undue burden to the party of the
second part, and
WHEREAS, the party of the first part also proposes to install a
telephone at the police headquarters of the party of the second part
whereby all telephone communications directed to the police of the
Town of Shelter Island may be answered through such a telephone at the
police headquarters of the Town of Southold, and
WHEREAS, in view of the foregoing, it is believed that it would be
in the public interest that the parties hereto mutually agree that radio
transmissions be received and dispatched on behalf of the Town of Shelter
Island by the Town of Southold at its radio base station and that in
addition thereto the Town of Shelter Island at its expense install a
telephone at the Southold Town Police station which will receive teleph-
one calls directed to the- Shelter Island Town police.
NOW, THEREFORE, IT IS AGREED, as follows :
1. That the Town of Shelter Island at itfs own cost and expense
will cause a telephone and necessary equipment to be installed and
maintained at the Southold Town police station at Peconic, New York,
whereby all telephone communications directed to the Shelter Island
Town police will be transmitted over said telephone and be received at
the Southold Town police headquarters.
2. That the Town of Southold hereby agrees that its personnel
at the Southold Town police station will answer all telephone communications
received on said telephone equipment on behalf of the Town of Shelter
Island, will make .the proper record of such telephone communications and
will where required either by telephone or radio transmission dispatch
the necessary information to .,the Shelter Island Town police relative to
such telephone transmissions.
3. That the .Town of Southold hereby agrees that it will receive
and dispatch radio transmissions to and from the Shelter Island Town
police vehicles and that the Town of Southold will keep a -proper record
of all such radio transmissions.
4. That for the performance of such services by the Town of
Southold for the Town of Shelter Island, the Town of Shelter Island
hereby agrees to pay the Town of Southold the ' annual sum of $600. 00 to
be paid on or about the 15th day of June of each year during- the term of
this agreement. .
5. This agreement shall commence on the lst day of January, 1971
and shall terminate on the .31st day of December, 1975. Notwithstanding
the foregoing provisions of this paragraph, either party hereto shall
have the option to terminate this agreement at the end of any calendar
year by giving written notice of termination to the other party at least
30 days prior to the end of such year.

WHEREAS, the late T. Carl Moore of East Marion has servdd the Town of
Southold and its residents in a very important function as an Eastern
Long Island Hospital Trustee for 26 years, and
WHEREAS, during his many years of unselfish and dedicated service to
our local voluntary non-profit health facility he aided in the growth
and fine reputation of our hospital, and
WHEREAS, by his untiring efforts as vice president of the Eastern`
Long Island Hospital Association for 5 years and its President for
10 years, T. Carl Moore contributed so much to our public good because
of his work and dedication to our local hospital, and
WHEREAS, the Southold Town Board wishes to record the sincere apprec-
iation of its members on behalf of the Town of Southold and its
residents for the devotion and interest T. Carl Moore gave to our
community by giving so much time and ability- in order for the public
to have such a fine howpital, • therefore,
IT IS ORDERED that a Resolution of sympathy be adopted by the Southold
Town Board at a meeting held on January 5, 1971 on the loss of T. Carl
Moore and that his widow and family be advised of this resolution as
adopted.
