Deputy Supervisor Homan opened the meeting at 3:00 P.M. with the following pre.s.ent: Deputy Supervisor James Homan Justice Martin Suter Justice Francis T . Doyen. _ Councilman Henry W. On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that the Southold Town Board minutes of February 14, 1978 and March 14, 1978 be and they hereby are approved as submitted. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen,._ Justice Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted . On motion of Councilman Drum, seconded by Justice Doyen, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3:00 P.M.., Tuesday,. Apri1. 117. 1.978 at the. Southold Town Hall, Main Road., Southold, New York.. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice. Doyen, Justice Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted. Deputy Supervisor Homan.: 1. Reported on a meeting he had with Governor' s Aides a week ago last Thursday at Smithtown. The Supervisor' s of Suffolk County were asked what the Governor could do for them. They all had various ideas. He corrected_ a statement which was in the newspapers relative to the State. Police . Both the Supervisor of Southampton and Deputy Supervisor Homan. thought it would be very nice if there were a few • more State Police: in. the area, and it is no reflection on the local police department . It. i-s simply a matter of where there might happen to be an accident in the evening they could tie up three or four mem- bers of the Southold Town Police Department at one time, and it would be very nice. if such .an incident should occur that if the state police were available for backup it would be a great. help. Southampton is complaining also, .but they get them a lot more than Southold. 2. Reported on a meeting held a week- ago today with the people from the State and County on mentally retarded. adults . Members of the -Board heard the proposed program of. the AHRC and how they plan to go about implementing it.. There .were some local people present at the meeting who .work. .with. the AHRC, because .originally when .they made their proposal for a house in this locality, some of these people were upset with what , they did and hoer they did .i.t. Consequently, they had a very nice meeting and came. out of the meeting feeling a lot better informed about what they are trying to do. At this point, they have not informed him about any action they .ar.e taking in Southold Town at the present, other than they are looking for a site in Southold to house some of these retarded adults. 3 . Receipt of a notice from the Department of the Army, Corps of Engineers listing permits they issued for the month of February 1978. In Southold Town they only issued one permit in Cutchogue for a ramp and float in the area of Deep Hole Creek, but in Peconic Bay. Also, it was determined there is another applicant in Southold 474 0 : MAR 2 8 1978 who wanted to construct a rock groin in Long Island Sound:.,.. but -did not need a permit for that groin. 4. Receipt. of the Riverhead Town Flood Damage Prevention Ordinance which is... on .file with the: Town Clerk. . . 5. Notice from the New York State Cooperative Extension relative to Disaster Aid from Small Business Administration. This has received a great deal of public notice and will be posted on the bulletin board. 6. Receipt of a letter from Suffolk County Community College notifying the Board. tha.t on April 19th between 7:00 and 9:30 P.M. they will hold a forum on Social- Security. It will cover Medicare and. Medicaid, Eligibility, filing Procedures and Location of Local Offices. . Copies will be forwarded to the two local Senior Citizen groups.. I 7. The Board has been receiving considerable communication relative to solid waste management, both from people proposing to do sidies and from the DEC. Different steps will have to be taken at the Disposal Area because of the new regulations, which no#* one is quite sure what they comprise - of, but they are working hard on drawing them up and trying to help the Town obey them. A letter has been received from Holzmacher, McLendon and Murrell, P.C . proposing their services. for engineering studies . The Board will meet with them to discuss. the proposed:.project in view of. the, new State regulations which .are being drawn. up. 8. Receipt of a letter from. Richard J. Cron, Eq. taking exception to a bond proposed to Centennial Manor Subdivision, Section One . This matter has been referred ,to the Planning Board. 9. Letter and booklet from the Suffolk County Department of Emergency Preparedness . The booklet "Summary for Public Officials - Standards for Civil Preparedness9 is supplied as an assistance. to the Supervisor in emergency planning. 1.0. Receipt of a letter from Arthur Bergmann, Acting Suffolk County Executive,. Chairman, Suffolk County Criminal Justice Coordin- ating Council stating that Justice Martin Suter has- been designated as a full voting member representative of the Suffolk County Magistrates Association. of the Suffolk County Criminal Justice Coordinating Council,. ef-fective immediately. The Board congratulated Justice Suter on his appointment.. 11. Letter from the New York State Department of Transportation relative. to Railroad-Highway Crossing.. Program, a contract for which was signed by the Deputy Supervisor following the March 14th. meeting. The State indicates the contract will be in an April 13th letting to receive bids for the project. 12. Letter from the Greenport Fire. Department .stating they will be hosting the Southern New York Volunteer Firemen' s Association Convention on June 5th and would consider it an honor and. privilege to have theTown Board attend this convention. 13. Copy of a letter sent to Tax Receiver George Mellas by Rowland A. Robbins, Fishers Island, stating he feels the .people of Southold Town should do something about the Fishers .Island School taxes. Mr. Mellas has replied to this letter informing Mr. Robbins that the matter of school taxes. on Fishers Island .is. strictly up to the peopple on Fishers I.dand. 14. Receipt of a letter from Loretta DiMaggio, one of the bidders on the old Town Clerk' s building.. Mrs. DiMaggio writes in her letter that she withdraws c.ondi.tions. submitted as part of her bid; that the bid is unconditional and all situations-indicated are withdrawn. The Board is waiting for further information on the historical aspect of the building so when they are received they will know exactly what they can do with .the building and if Mrs. DiMaggio gets it she will know what she has. to do with it . 15. Receipt of a letter from Walter Teresko, New Suffolk;, Road, Cutchogue, complaining about the dumping of quantities of "Suffolk Life" newspaper. He gives specific instances and locations where numerous copies were dumped . Deputy Supervisor Homan did call the "Suffolk Life" circulation editor and. he had also received a copy of the letter and assured-..him that he had looked into the matter and the person in the area in charge of distribution has been replaced and it will not happen again. WAR 2 8 1979 16. Receipt of a letter from Town Attorney Taske.r informing him that the $30,000 bond antic.#tion.note for purchase and installa- tion of street lights- has been sold for the rate of 3.42% to ,the Bank of New York. Deputy Supervisor Homan stated that this certainly is evidence of the high credit rating the Town of Southold has to be able to sell bonds at such a low rate. 17• Receipt of a letter from Robert A. Villa, Chief,. General Engineering, Suffolk County Department of Health. Serv'ices stating they have been informed by the New York State Department of Environ- mental Conservation that the Captain Kidd .Water Company has no state authorization to furnish public water. to Section 2 of the Sunset Knolls subdivision, and it is the opinion of the County Attorney that it would be improper for the department to approve any .application to construct a new dwelling calling for a public water connection 'to the Captain Kidd Water supply system. 18. Letter from the. New York State Department of Environmental Conservation, Stony Brook inviting the Board to a Long Island Con- ference on Solid Waste Energy and Resource. Recovery conference to be held on April 61 1978 at 9:30 A.M. at the Stony Brook .Campus. In all probability someone from the Town will try to' attend that meeting. 19, Letter from. John: Wickham stating heas an' individual takes exception to the flood plain elevations on the Flood Plain Maps for . the Town of Southold and indicates to the Board that he as an indiv- idual is. going to formally appeal these elevations. The Board .wishes Mr. Wickham luck. 20. ,...Receipt of a. letter from Michael E. Finnican.,. Cutchogue., who was on the summer police program last year and wishes to continue this year. Also, a .s.imilar letter from Stanley V. Becker, Mattituck, who was on the same program last year and would- like to continue . These two letters have. been. r.eferred to Chief Carl Cataldo.--- A letter has been received from .Marjor.i.e. Siegel who is interested in a summer job at one of the town beaches or parks . This. letter has been referred to Highway Superintendent Dean. 21. Receipt of a letter from James B. Kaminsky, Mattituck, also signed by 2.7 other individuals relative. to..the remains of the bridge about a mile into Mat-t.ituck Inlet, the other is. the barges which the Board is well aware of and the Trustees are working on. Another item is a bar 200 to 300 ft. in front of the east breakwater and a lesser bar approximately 150 ft. off the west breakwater. Mr. Kaminsky is requesting. the Board to.. see. what consideration can be ,given to dredging the c-reek at least as far as the Old Mill Inn to a depth of seven or eight feet, and some sor.t. .of channel dug. b.etween the breakwaters out into Long Island Sound.- Deputy Supervisor Homan will contact the County of Suffolk to determine whether they are contemplating any dredging work in the Mattituck Creek, and if so, , how soon. Justice Suter stated that actually it is a federal program, and they will maintain it at a depth of not less than 6 ft.. at meanlow water from the mouth to Love Lane . It should then -go to the Army Engineers requesting a survey. If they .f.ind it less than 6 ft . they will maintain it, if over 6 ft. they won't do it .---Deputy Supervisor Homan stated he would make the Corps of Army Engineers aware of Mr. Kaminsky' s letter and request a survey. 22. Receipt of a letter from the Department of Housing and Urban Development, Washington, D .C . addressed. to John C. Seiferth, Beebe Drive, Cutchogue', relative to flood insurance . The property in question is on that portion of the flood plain map which the Board feels is not definitive enough, and Hud has determined which portion of the Seiferth .proper.ty is eligible for insurance. 23. Letter from Greenman-Pedersen,: Associates, P.C. , who have been hired in the past to research public, funds for. work projects ' and they state the Public. Works Program may go into a Round III, and if so, it is not too early to start planning for' capital facilities the Town may need. There were :some plans in Round II and we have all been assured they have been turned down. This was a justice court, a building at the highway department,. and tennis courts on Fishers Island. These projects will be resubmitted on Round III . 24. Letter from Tri-State Regional Planning Commission, New York, N. Y. relative to a waste- treatment study for the Fishers Island Sewage Collection District, due to the fact this comes under a request for a federal grant. This is merely notification that the application is' still alive and the end of the review period is April 24, 1978. 25. Letter from Suffolk County Legislator Denis R. Hurley enclosing a copy of a resolution to restore the dredge to operation which will be considered by the Suffolk County Legislature on March 28th. Also included in the letter was background information in 47-6 19iS support of restoring the dredge Nessequogue to service . (Justice Suter suggested a copy of Leg. . Hurley' s letter be sent to the Mattituck Chamber of Commerce. ) 26. Letter from Long Island Lighting Company stating they will conduct an evening seminar on Emergency Restoration Procedures on Thursday, April 20, 1978 at their Hicksville Operations Center, at which .time they will review the established communications pro- cedures and provide the Town with an insider's view of how. LILCO handles weather emergencies. Perhaps the Supervisor will wish to attend this seminar. On motion of Justice Suter, sec.onded by Councilman Drum, it was RESOLVED that the Southold Fire Department be and hereby are granted permission to use the following Town Roads for staging areas for the marching units for a parade to be held at 6:30 P.M. ,. _August 9, 1978, rain date August 10, 1978: Main Bayview Road, Akerly Pond Road, Lower Road and Jockey Creek Drive ; provided the Southolld Fire Depart- ment provides the proper insurance to hold the Town of Southold harmless . Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan,. Justice Doyen, Justice, Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted. Deputy Supervisor Homan: 27. Items. 7b and 7c on the agenda, Cluster-John Simicich and Cluster-Barbara Schriever will be put off until the' next meeting when there is a larger. Board present. On motion of Justice Doyen, seconded by Councilman Drum, it was RESOLVED that Justice James H. Rich, Jr.. b.e and he hereby is authorized to establish a petty cash fund in t're .amount of $200.00 and a voucher for this .-amount be approved by the Board. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen., Justice. Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted. On motion of Councilman Homan, seconded b;- Councilman Drum,, it was . RESOLVED that the Cutchogue Fire District be and hereby is. granted permission for the exclusive useof the fire district parking area on July 14, 159 16 for a parade and drill on the 15th of July 1978, and on August 25,. 26, 27 for their annual barbecue to be held on August 26, 1978; provided the Cutchogue Fire District provides the proper insurance to hold the Town of Southold harmless. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice. Doyen, Justice Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted. Deputy Supervisor Homan: 28. Several meetings ago- the Highway Department went to bid for road oil and conflicting bids were received. Consequently, in reviewing the bids and comments made on the bids, and on advice of attorney, it has been recommended that the Board reject the bids and rebid with more definitive specifications. On motion of Councilman. Drum, seconded by Justice Suter, it was RESOLVED that the Highway Department bids for 500,000 gallons of. Asphalt. Road materials be and hereby are rejected in their entirety. Vote of the' Town Board: Ayes: Councilman Drum, Deputy .Supervisor Homan, Justice Doyen, Justice- Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted. On motion of Justice Doyen, seconded by Justice Suter,. it was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to re-advertise for bids for 500,000 gallons of Asphalt Road materials, more or less. as may be needed.,. for the repairs of Town highways. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen,. Justice Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted. 477 '69A t '2°s, r1979 Deputy Supervisor Homan: 29. The Board must approve change. .orders for the new addition to the Town Hall. Initially when the Board was informed. they were to receive the grant there was a very limited time to approve the plans. On review of the plans after they were accepted and went to bid, making the Town eligible for .the grant, and on consu7ts.tion with several people to be located in the building, they have made several changes .. The Board must- now approve the change . orders. On motion of Councilman Drum, seconded by Justice Suter,. it was RESOLVED that the Town Board of the' Town of Southold approves Change Order No. 1, contractor Minnesota Construction Corporation, General Construction Contract "A", allowing eight changes amounting to an additional $6,1.76.00. .Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen, Justice. Sut.er. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted. On motion of Justice Suter,. seconded. by Justice. .Doyen, it was RESOLVED that the Town Board. of the .Town of Southold approves Change Order No. 17 contractor Metro Plumbing East, Plumbing Contract "B", allowing four. change.s amounting to a deduction. of $800.00. Correspondence has been- received from the New York State Executive Department, Division for Youth transmitting Project Year Modification Forms. relative to recreation program .for. the schools. He talked to the schools and the... Division.. for Youth.. There seems to be some c.onfusi.on, however, .ina.smuch as, it does, represent money toward the youth program, a, resolu.tion is required authorizing Deputy Supervisor Homan to sign the Project Year Modifbation. Further information will be received from the Division of Youth on this matter. On- motion . of Justice. Suter.' seconded by Councilman Drum, it. was RESOLVED that Deputy Supervisor Homan be .and. he...hereby is authorized to sign, on behalf of the ToUm of -Southold, Project Year Modification Forms to be. transmitted to the New York State Executive Department, Division for Youth,, for which the. Airport consisting... of. the overlayment of both runways with an average of two inches of asphalt; painting lines and numerals; replacing runway lights with underground lighting system; and reinforcement of bank, p.r.otect.ing runways from the sea. This r.e.s.olution. was declared adopted: Deputy Supervisor Homan: 31: Explained. that there .i.s.. a situation on the entrance to Mill Creek, where fishing is soon to begin,_ and.- there is no Town equipment in the water at the present time to properly mark the channel, and the channel is of such a nature the stakes must be driven in rather than pumped in., and the T.own. does. not have such driving equipment. On motion of Justice Suter,. seconded. by Councilman Drum,, it was RESOLVED that William. Li.eblein of. the. .Port of Egypt_ be and. .hereby is authorized to install channel markers at the entrance to Mill Creek, with the assistance of the Bay Constablej_ for a few of $35.00. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen7,, Justice. Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared adopted. Justice Suter asked if the Bay Constable 's boat is in the water, and Deputy Supervis.or. Homan.. stated. the Mako is in. the water. Mr. Ernest. Temple,. Southold stated there is, a .si.gn on Hobart Road about 200 ft. south of Route 25•which says "polluted area". Mr. Temple asked the .reason for this. sign.. Mr. Homan .state.d it undoubted- ly has been placed- there in error, but he. will check it out.-_--Mr. Temple asked what is meant by polluted area, and what is causing the pollution?---Deputy Supervisor Homan stated polluted areas are set aside by the Department of Environmental Conservation in Stony Brook. They have standards by which they take samples of the bottom and find the environment in the bottom or the bottom is just not up to MAR' •2 8`:1978 public health standards, therefor.ef' they would be rated polluted. There is one in New Suffolk,,as.d fnrt-dngtely Southold Town is very fortunate> in not having many polluted areas. The Town does -not have prior knowledge of when the. DEC is going. to open or close polluted areas . . going te lei-elese polluted- areas. As far as what causes pollution, Deputy Supervisor Homan stated he cannot answer, sometimes it is just the bottom itself that is polluted, it doesn't mean the water might be polluted. Mrs. Marie Johnson presented each Board member with a booklet on Suffolk County prepared by the Suffolk County League of Women Voters. Mrs. Gladys Csajko asked-if the Board knows 44hen they will start work on the bridge over the railroad again? --- Deputy Supervisor Homan stated.. he. did_not. know. Mrs. Csajko asked if the Board was going to seek the advice or recommendations of the Town Trustees in appointing a Trustee to' fill the vacancy, or will it be done strictly by the Town Board? Deputy Supervisor -Homan stated. it .is a Town Boad decision. He stated he would make the appointment today, but out of respect for the Board, Mr. Pell is -in. the hospital and Supervisor Martocchia is in Florida.,..he would.. wait, f.or their. return.. Mrs. Csajko complimented Deputy Supervisor Homan on the way he has run the last two. meetings.. Mrs. Barbara- Schriever ask.ed. when the Highway Committee is going to meet with Mr. Dean about the drainage on the Schriever property at Orient.---Deputy Supervisor Homan stated it would meet at 9:00 on Monday morning. Mr. Charles Hickey asked if there would-be any notification about the Town's feeling about burning leaves?---Deputy Supervisor Homan stated the fire departments can give permits,, but in giving permits they must warn you, you must. .obey all existing laws and regulations. The problem lies with the. County. The State says that in towns of under 20.,000 people they .can burn, but the County says you are not going to burn period.1 The problem-is with the County. So, actually, the fire. departments cannot legally issue permits.--- Justice Suter, stated the State Police picked.. up someone last night for burning. Someone started a fire and it got out . of. hand and went to the neighbors, but they put it out without calling the. Fire Department, but they still got a summons . Mattituck Fire Department mailed a notice to all taxpayers that they can no longer issue permits without approval. of. the. DE.C., Highway Superintendent Dean s.tat.ed, , on the matter of bridge at Mattituck .Inlet, .he had notified the County that the abuttment is breaking down, and they were going to take care of it last year. The Town is not responsible, even though they are getting blamed for. it., On motion of Justice Suter.,. seconded by Justice Doyen, it was RESOLVED that , there being no further, business t.o come before this Town Board meeting adjournment be _called. at 3:45 P.M.
