SOUTHOLD TOWN BOARD
February 23, 1978
A regular meeting of the Southold Town Board was held on Thursday,
February 23, 1978 at the Southold Town Hall, Main Road, Southold,
Neu York. Supervisor Martocchia opened the meeting at 3:00 P.M.
with the following present:
Supervisor Albert M. Martocchia
Justice Martin Suter
Councilman James Homan
Councilman Henry W. Drum
Councilman William R. Pell III
Town Attorney Robert W. Tasker
Town Clerk Judith T. Terry
Absent: Justice Francis T . Doyen
Supervisor Martocchia asked for a postponement of the approval of
the minutes of February 14, 1978, as they are not complete . Most
of the membership has been away to the Association of Towns meetings.
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED, that the next regular meeting of the Southold Town Board
will be held at 3:00 P.M. , Tuesday, March 14, 1978 at the Southold
Town Hall, Main Road, Southold, New York.
Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:
Justice Doyen.
This resolution was declared adopted.
Supervisor Martocchia:
1. The reports of the committees mostly have to do with the
roads, but due to the weather conditions it is impossible to make
inspections, therefore, there will be a delay until suitable weather
conditions .
2. RecEipt of a letter from Lynne Albertson, Corresponding
Secretary for the Southold Youth Activities asking for permission
to plant a tree in front of the Town Hall so that year the Southold
Youth Activities may decorate it at Christmas time . In the past
this tree has been in front of the office of R.G. Terry, but due
to a wiring problem it may be discontinued. The Board discussed
this request and must deny it, as other organizations may have
similar requests and they would not like to set a precedent.
3. Letter from Automatic Data Processing indicating they
would like to set up a procedure whereby they could establisls
central locations near main roads for the pickup of payroll work
sheets in the event of other snowstorms as the past few we have
had,,, making it impossible for them to read the Town Hall.---Some
type or procedure will be established.
4. Receipt of a letter from John M. Riehle & Co. offering to
analyze the Town' s insurance program and requesting a meeting.---
The Town has made application to the National Sheriff ' s Association
for police insurance .
5. Letter from the North Fork Taxpayers Association, Inc . which
was handed to the Supervisor at the last Town Board; meeting
on February 14th, and discussed at that meeting. This letter asks
that in the future the Town Board announce ah.d publicize widely any
vacancies to be filled, giving sufficient time for study and interview
of the people under consideration.---This will be done.
6. Letter from the North Fork Little League asking that they
be placed in line for this year' s funding. They will submit their
bills for this year' s equipment, insurance, etc .---A meeting will
be held: with the Recreation Committee and youth organizations and
adult recreation organizations in the near future to work out the
disbursements .

7. Letter from Joe and Annemarie Hydell expressing their
appreciation to the Southold Highway .Department for their efforts
during thepast snowstorm.
8. Receipt of a letter from the Suffolk County Fire Chiefs
Council, Kenneth H. Johnson, Secretary, wishing to go on record to
ask why there was not a disaster alert called during the past snow-
storm of February 6 - 91 1978. Fire Department and rescue vehicles
were severly hampered by the tsrrible road conditions in our town-
ship.---Supervisor Martocchia stated he will respond to ..this letter
advising that the Town was on full alert, the police department fully
staffed 24 hours a day with top personnel in charge , the highway
department was on full alert with extra personnel hired. All the
fire companies were on full alert, as well as the schools . Every
base was covered. In full contact with the Office of Emergency
Preparedness. Every hour on the hour the Supervisor was in contact
with the police and highway departments . In each community there
was highway equipment stationed and a police car stationed, ready
for any emergency. It is -his opinion the Highway and Police Depart-
ments did a marvelous job.
9.Request from Gerleen Contracting Corp. who built this Town
Hall, requesting thek final payment of $1,000.00 which will be done .
10. Letter from Peter L. Jones, Vice President of the Long
Island Cablevision Corp . , Riverhead, submitting a copy of their
financial statement for the year 1976 as requested by Justice
Suter at the time of their meeting on February 14th.
11. Another letter from Mr. Jones, L. I . Cablevision,
apologing for using Channel 2 for the homebox without the Board' s
approval. They request that the Town Board approve the changes
that have been made and modify the franchise accordingly. Supervisor
Martocchia has been instructed by the Board to write to the New York
State Cablevision Commission to discuss the matter of the possibility
of Cablevision using another station for the homebox station rather
than Channel 2.
12. Today the Board met with nine individuals relative to
community residences for the mentally retarded in Southold Town.
This meeting was arranged by the New York State Department of
Mental Hygiene, Division of MentalRetardation. Considerable
discussion was held, but there is much more to talk about. When this
next meeting is held the community will be advised of the outcome .
13. The Board received two bids for the four new police cars .
J.J. Hart' s Riverhead Ford at $21,340.00 and Greenport Ford Mercury,
Inc . at $21, 512.00.
On motion of Councilman Drum, seconded by Councilman Homan, it was
RESOLVED that the lowest responsible bidder, J.J. Hart ' s Riverhead
Ford, Riverhead, New 'York be and hereby is awarded the bid for four
new police cars at a total price of $ 1,,j4Q.00 which includes the
trade in of four cars.
Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Sute, Supervisor Martocchia. Absent:
Justice Doyen.

Supervisor Martocchia:
14. A proposal has been received from Briarcliff Landscape,
Inc . Cutchogue for spring, summer and fall lawn and shrub program.
for the Town Hall grounds . This proposal will be reviewed with
some member of the Highway Department who are familiar with this
type of work. Asmuch as possible will be done by the Highway
Department and the remainder will be brought back to the Board
for review.
15. Notification from the State Insurance Fund stating
there will be a rate increase of 9.3% effective January 1, 1978.
16. Letter from Custer Institute Inc . , Southold requesting
$500. funding. In the past two or three years, at the later part
of the year, if the Board finds they will have some surplus, they
are generally given $500. The Board will wait until the later part
of the year to determine whether this will again be feasible .
17. The State of New York, Board of Equalization and Assessment
has informed the Board that the 1978 tentative equalization rate for
Southold Town is 12.37. There will be public hearings at Albany, and
eventually the rate for the year will be assigned. Last year the rate

was 12.37. County-wide the Town of Southold had the lowest drop and
in equalization rate the town is in second position with Shelter
Island being first.
18. A letter has been received from New York State Senator
Bernard C. Smith stating a committee on disaster relief has been
appointed to study the effect and the response by public agencies
and others to the storms and suggest more effective ways of dealing
with these -catastrophies . The goal of this study will hopefully
take the form of a comprehensive statewide disaster relief plan. A
represent6.t«xve of Senator Smith met with Supervisor Martocchia
yesterday to review everything that took place in Southold Town
during the last storms.
19. Receipt of a letter from the State of New York, Committee
On Public Access To Records relative to the Freedom of Information
Law and Regulations . There have been some changes in this law and
Town Attorney Tasker will prepare a set of regulations for the Town
of Southold which will be studied at the next meeting.
20. There is a proposed bill pending in the State Legislature
to amend the highway law in relation to the limitation of expenditures
on highway machinery in certain towns, and Southold Town is one of
the seven out of ten towns in Suffolk County that has shown interest
in this legislation. The present limitation is $100,000.00, and the
amendment would change it to $2001000.00.---Mr. Pell asked if now
should the Town wish to spend more than $1001000.00 would they have
to go to the taxpayers with a referendum?---Councilman Homan stated
that this figure allows the Town Board to budget that amount of
money and they go to the people at the time of the budget hearing.
--Town Attorney Tasker stated that at the present time under the
Highway Law it provides that--it sets a limit of the amount of money
you can budget or spend for the purchase or repair of highway machinery.
At the present time in Southold Town, it is $1009000.00. This
proposed amendment will raise that $100,000.00 limit to $200,000.00.
The law says that you cannot presently spend or appropriate more than
$100,000.00 for highway purchase of equipment or repairs unless you go
to the voters on a referendum to get their approval to exceed the
$100,000.00. The present amendment will increase that to $200,000.00.
---Mrs. Gladys Csajko stated, as head of the Taxpayers Association,
and can say this with the approval of the membership, that she strongly
disapproves of this amendment.---Mr. Pell stated that suppose it is in
the budget but the taxpayers have no vote on the budget like the
school budget the Town could automatically go and spend $200,000.00.
---Supervisor Martocchia stated, yes, if the budget is adopted that
way.
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the Town of Southold support Assembly Bill No. 1827-B
and Senate Bill No. 1461-B entitled "AN ACT to amend the highway law,
in relation to the limitation of expenditures on highway machinery
in certain towns, " and the Town Clerk complete the necessary forms
and submit them to the New York State Assembly and New York State
Senate.
Vote of the Town Board: No: Councilman Pell. Ayes: Councilman
Drum, Councilman Homan, Justice Suter, Supervisor Martocchia.
Absent: Justice Doyen.
This resolution was declared adopted.
The question was asked whether, the Board had spent the $100,000.00
each year the last several years?---Councilman Homan stated that
what this will help the Board do, is if they know for the next year
they must spend $70,000.00 for a truck and payloader, rather than
put the town into bonded indebtedness, they could when they prepare
the budget, make allowance for that. It does not mean they must
spend the $200,000.00, only permitted to spend up to it if necessary.
The last payloader cost approximately $70,000.00, and his ordinary
machinery budget expenses runs $60770,801000.00, how would he buy
a $70,000.00 payloader, which today probably runs $100,000.00.
Therefore , by budgeting it allows them to circumvent bonded indebted-
ness, and he personally feels it is a very good move.---Mrs . Johnson
asked how often they buy a payloader.---Mr. Homan said every two or
three years.---Supervisor Martocchia stated they have one now that is
about seven years old, and Mr. Dean wanted a new one . The Board said,
no, they will have it repaired. It cost them about $22,000.00 to have
it repaired. It should last another two or three years, but this is
not always possible .---Mrs . Johnson said that if they don't need it,
they don't spend it, but if they budget for it the taxpayer must pay
for it in taxes.---Mr. Homan stated they do not budget for it unless

they need it. They would only budget for it if the desperate need
were there .
Supervisor Martocchia:
21. The Board has received an pplication for a trailer permit
from Martin Sidor at Oregon Road, Mattituck. It is intended as
living quarters for two farm trainees for a six month period. The
individuals come to this country to work and study U.S . farming methods
and are under the supervision of the National 4-H.---The Board must
study this .new application, as they do not often grant trailer permits,
just renewals of existing trailers.---The Board will study this,
and Supervisor Martocchia has appointed Mr. Drum, Mr. Pell and Mr.
Suter to this committee .
On motion of Councilman Homan, seconded by Councilman Pell, it was
RESOLVED that employees hereafter hired into Town service must have
completed at least 10 years Town service in order to be eligible
to continue health insurance coverage in retirement.
Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:
Justice Doyen.

Supervisor Martocchia:
22. Referring to Item u. on the agenda, there will be a
meeting between Attorney Schienberg and the Planning Board to
discuss the bond estimate . The Town Board will be out of this until
the matter has been resolved.
23. Item v. on the agenda, insurance, National Sheriffs
Association, the final figures has been received; and the premium
will be approximately $6500.00.
24. A letter has been received from Frank_ S . and Margaret
E . Rosenberg which states its purpose is intended to constitute the
written consent of the owners of the property required under the
Town' s wetland ordinance in connection with the application of
Stanley S . Corwin for such a permit to do maintenance dredging
at the head of Stirling Creek, south of Champlin Place , Greenport..
---The Board is not quite sure what he is asking for, but he will
talk to Mr. Rosenberg' s attorney Stanley Corwin about the details .
25. The Board has received a request from the Eastern Long
Island Hospital Auxiliary, Southold-Peconic Branch, for permission
to hold a coffee party for the employees, at which time donations
are solicited. The Board is concerned this would set a precedent
for other organizations in the Town.
On motion of Justice Suter, seconded by Councilman Drum, it was
RESOLVED that the Southold-Peconic Auxiliary of the Eastern Long
Island Hospital be denied permission to sponsor a coffee party
at the Southold Town Hall, following previously established policy
of not using the Town Hall for fund raising activities.

26. Notification from the Department of the Army, Corps of
Engineers application of Michael J. Withers asking persmission
to replace existing open timber pile supported piers with floating
timber piers and install a new floating timber pier approximately
42 ft . in length along the southerly property line of his property
on Schoolhouse Creek, Little Peconic Bay, New Suffolk. Objections
by March 15, 1978.
Notification from the Department of the Army, Corps of
Engineers re: application of Patrick J. Carrig asking permission
to construct approximately 150 ft. of timber bulkhead extending a
maximum distance of approximately 8 ft . offshore of the existing
line of mean high water, and dredge the area immediately in front
of the proposed bulkhead to a maximum depth of 3 ft. , removing
approximately 70 cu. yds . of sand and silt and placing it .behind
the proposed bulkhead to prevent further erosion. Location: Dawn
Lagoon, Greenport, New York. Objections by March 197 1978.

Notification from the Department of the Army, Corps of Engineers
re: application of Marino Faraguna for permission to construct a
timber pier, ram and float arrangement approximately 46 fet in
length at Mud Creek, Cutchogue Objections by March 2, 1978.
Notification from the Corps of Engineers, Department of the
Army re: application of Albert L. DeLauro for permission to
construct approximately 30 ft. of timber bulkhead and place approx-
imately 20 cu. yds. of fill material from upland sources behind the
proposed bulkhead to prevent further erosion. Location: Reese
Canal, Harbor Lights, Bayview area, Southold. Objections by March 19,
1978..
Notification from the New York State Department of Environmental
Conservation upon application of Frank J. Zaleski and Virginia Suter
requesting permission to locate a garage 24 ft. by 24 ft. from a
parcel south of Beachwood Drive to a point 10 ft. north of Beach-
wood Drive, Cutchogue , New York. Objections by March 6, 1978.---
Justice Suter asked that it be noted for the record that the appli-
cation of Frank Zaleski is on behalf of Virginia Suter who happens
to be his sister-in-law and he will abstain from anything involving
this application.
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that Henry F. Moisa be and hereby is appointed Acting
Chairman of the Southold Town Board of Assessors, to act in the
absence of Chairman Melville A. Kelsey, Jr.

Supervisor Martocchia:
27. The Board is in receipt of Home Rule Requests from the
Assembly and Senate relative to the police department, which he
proposed. In the past the Board has had to hire individuals
from outside Southold Town when their names appear on the civil
service list, individuals who are not known locally. Some years
ago, they were permitted to secure a list with only individuals
residing in Southold Town. This law was challenged, and it was
learned that the law had never changed, the townships were supposed
to draw from the county list. At present the police department
is one short due to a retirement, and they are reluctant to call
for the County list. In doing so, there are individuals from
Babylon, Shirley or Brookhaven, and the Town would like to have
their employees live within the township. He therefore asked the
legislators to propose a bill that the Town of Southold be allowed
to draw from a local list first. Nothing to do with promotional.
On motion of Councilman Drum, seconded by Councilman Homan, it was
RESOLVED that the Town of Southold support Senate Bill_ No. 7647
entitled "AN ACT in relation to authorizing the governing body
of the Town of Southold to make certain permanent appointments
for the position of police officer, " and the Town Clerk complete
the necessary forms and submit them to the New York State Senate .
Voteof the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:
Justice Doyan.

On motion of Councilman Pell, seconded by Justice Suter, it was
RESOLVED that the application of Oscar Goldin dated February 16,
1978 for. a trailer renewal on Lot #60, Greenport Driving Park,
south side Linnett Street, Greenport, New. York be and hereby is
granted for a period of six months.
Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:
Justice Doyen.

On motion of Justice Suter, seconded by Councilman Drum, it was
RESOLVED that the application of Carl Frelix Jr. Dated January 25,
1978 for a trailer renewal permit on private road off north side
Main Road, Mattituck, New York be and hereby is granted for a period
of six months .

On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that the Town Board of the Town of Southold approves the
amount of $10,000 bond estimate for the roads and drainage in the
subdivision .known as "Heritage Harbor" owned by Riverside Homes
Inc . as recommended by the Southold Town Planning Board and Town
Engineer.

Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:

Supervisor Martocchia:
28. The Board has received, today, relative to the public
hearings on proposed local laws for self-service gas stations and
aluminum wiring. The Board will review the minutes before taking
action.
29. The Board is in receipt of a letter to the Southold Fire
Department from the Suffolk County Department of Environmental
Control stating there has been significant amount of open buning
of leaves being accomplished in the Southold Fire District. The
Suffolk County Sanitary Code prohibits open burning of that nature
in the Town of Southold. They ask the cooperation of the Southold
Fire District in not issuing burning permits except in those cases
where exemptions have been granted by the New York State Department
of Environmental Conservation.---All of the local fire departments
have been notified .
Mr. Elliot Meyer, Peconic , spoke to the Board about an article in
the Mattituck Traveler about a proposed fitness trail. Mr. Meyer,
speaking for himself and his neighbors read the following statement:
I oppose establishment of the fitness trail both on Goldsmith Inlet
Park or any other Town park or private property. Some of the reasons
I feel this way: It would increase traffic and create parking prob-
lems since people and cars would be coming from all over Suffolk
County. It would create police problems due to the probable use
of the trail at night by young people as a hangout and a place to
drink or engage in other undesirable activity. If the Town or
individuals sponsor the project in any way, it may cause the Town
or individuals to be liable for damages due to accidents such as
injured legs, hernias or heart attacks . Many court decisions
have ruled in favor of people who claim the facilities on the pre-
mises where athletic activities are pursued are not kept in perfect
condition and thus caused their accidents . For example , in Vermont
a skier caught his ski in a bush on the trail and fell and became
paralyzed from the neck down. He won an award of one and a half
million dollars . Two ski facilities closed after this because
they had insurance problems . In other cases, awards have been made
because the premises were not supervised by licensed personnel.
Liability insurance is becoming increasingly hard to get and more
expensive both for the Town and for individuals. This in the case
of the Town causes taxes to go up. Individuals who volunteer to
sponsor or supervise or manage activities in connection with the

fitness trail may -find that their liability insurance of 50 or 100
thousand dollars is not enough in these days of million dollar damage
suits.---Supervisor Martocchia stated sometime ago a letter was re-
ceived from Dr. Ross, Southold, submitting pamphlets to the Board
showing physical fitness trails and stations where exercises would
be done . This would involve approximately a mile of area with 20
different exercises. He met with Dr. Ross.--Prior to the meeting
the Board had not taken a position on it. The Recreation Committee
met with Dr. Ross. Different sites were discussed, if the trail
were to go through. Subsequent another meeting was set up with Dr.
Ross a few- days ago and Dr. Ross and Supervisor Martocchia went
exercise walking at Goldsmith Inlet. At that time they spoke to
Mr. Meyer at. his home . Mr. Martocchia has spoken to the Suffolk
County-Parks Commissioner, John Chester, about the possibility of
the trail, if it is approved by the Town Board, and at the present
time it is still in Committee . Mr. Chester asked him to submit a
map with the proposed stops where the exercises would take place .
Dr. Ross will prepare such a map with a proposal. Dr. Ross, in the
meantime, has received a letter from the Suffolk County Health
Department who is very much interested in the program, and want to
participate in it. Friday, Feb. 24th Supervisor Martocchia has a
meeting scheduled with a representative of the Health Department to
discuss the matter. When some sort of input has been received
for all sides the matter will be taken up with the entire Town
Board for further discussion. No commitment has been made. to
anyone .---Councilman Homan added that when Dr. Ross first approached
the Board he wanted it to be a Town project. The Town does not have
an acre of land in Town that would be suitable for this project.
Mr . Homan did bring the matter of insurance up to Dr. Ross , as it
is a concern to all.---Supervisor Martocchia stated that in the ini-
tial letter from Dr. Ross it was indicated J.C . Penny would be
willing to underwrite a lot of the expense, such as making the
signs at a discounted price .---Mrs. Csajko asked why, if this were
to be on County or State land, why is the Town involved at all?---
Councilman Homan stated, because Dr. Ross initially approached the
Town.---The question was asked whether there is a demand for this
type of facility in the Town?---Supervisor Martocchia stated he was
not aware there was, but Dr. Ross explained it has become very
popular. The program comes from Sweden and is now being developed
in the United States.
Mr . Sam Markel, Southold spoke to the Board about beach erosion
which is not only causing hardships to individuals but the town
beaches have been attacked, the boat ramps are a shambles . Mr.
Markel suggested that the Town might like to join a group of
interested citizens in starting a law suit against Suffolk County
to make them remove part of the jetty at Goldsmith Inlet. He is
aware the Board cannot answer him at this time , but to consider it,
and study it . It will definitely affect the tax base in Southold
Town because waterfront property has been taxed at a higher rate
and he doubts whether he could sell his property for any reason
at this time.---Supervisor Martocchia stated the Board fully
realizes the shorefront is having serious problems.
Mr. Driscoll asked if he understood the point that there is to be
no burning?---Supervisor Martocchia said, yes, not without a permit
from the D.E.C.---Mr. Driscoll asked if he wished to burn beach
debris would he have to obtain a permit from the D.E.C .?---
Supervisor Martocchia stated that is correct. There is a large
f ine" f:., someone is caught burning without a permit .---Mr. Tasker
stated it-.,is the Suffolk County Department of Environmental Con-
- servation..`°_ Right now there is a provision in one of the Town
Codes wherein the Town enters into contracts with the various fire
districts in the Town for the purpose of issuing burning permits .
The Town' s agreement with them states that under no circumstances
will the fire departments issue permits which would be in violation
of any law. Therefore, you would, under normal circumstances
go to the fire department chief and he would issue the burning
permit, now he would direct you to go to the County for a permit
first, and if you can get their approval he will issue a permit.
---Mrs. Barbara Schriever asked if this affects the controlled
burning the fire department themselves does,./---Mr. Tasker said
it probably does.---Mr. Driscoll asked if the Town could ask
the County to waive this provision due to the particular circumstances

WHEREAS Alvah B. Goldsmith, a most valued member of the Board
of Southold Town Trustees has retired from public service effective
December 31, 1977, and
WHEREAS Alvah B. Goldsmith has given generously of his time and
talents in his faithful service to the Town of Southold residents
for thing-four years, now, therefore , be it
RESOLVED ,that the Town Board of the Town of. Southold hereby
expresses their most sincere appreciation to Mr. Goldsmith for his
unselfish and wholehearted cooperation and untiring efforts on
behalf of the Town of Southold, and accept with sincere regret his
decision to retire, and be it further
RESOLVED that a copy of this resolution be forwarded to Mr. Gold-
smith and entered in the permanent record of this Town Board meeting.
Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Suter, Supervisor Martocchia. Absent:
Justice .Doyen.

for eleven years, now, 'therefore, be, it
RESOLVED that the Town Board of the Town of Southold hereby expresses
their most sincere appreciation to Mr. Robertson for his unselfish
and wholehearted cooperation and untiring efforts on behalf of the
Town of Southold, and accept with sincere regret his decision to
retire , and be it further
