MEETING OF DECEMBER 6, 1955.
The Southold Town Board met at the office of Supervisor Norman
E. Klipp at Greenport, on Tuesday, December 6, 1955. The meet-
ing was called to order at 1:30 p;m; with the following present:
Supervisor Klipp; Justices Tuthill Albertson, Clark and Demarest;
Town Superintendent of Highways Price; Town Attorney Terry and
Town Clerk Booth.
The Board sat at once as a committee on Audit to examine claims
against the Town, Concluding the Audit work' at 2 o'clock P.M.
Moved by Justice Albertson; seconded by Justice Clark:
RESOLVED: That the minutes of the previous meeting be and hereby
are duly approved as read.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill,
Albertson, Clark and Demarest.
Moved by Justice Clark; seconded by Justice Tuthill:
RESOLVED: That the Annual Audit Meeting of this Board will be
held at the office of Supervisor Norman E. Klipp at Greenport
on Friday, December 30, 1955, at 1:30 P: M.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill,
Albertson' Clark and Demarest.

WHEREAS, a apecial meeting of the Town Trustees and a group
of Baymen was held at the SupErvisor's Office on .December 3,
1-955, the following resolution relating to taking .bug escallops
in certain town waters was adopted by the Town Trustees and
was approved and adopted bythe Town Board at their regular
meeting held on December 6th, 1955.
WHEREAS, It is apparent that scallops in the two areas here-
inafter mentioned would probably die during unusually stormy
weather by being blown ashore or being covered with silt, and
WHEREAS,It is apparent that matey people could derive a living
from the taking of these scallops, now, therefore, be it
RESOLVED, That scallops of any size may be taken from the two
hereinafter mentioned areas in any amount not to exceed fi"ve
t5) bushels per person per day by hand, with scalp net or by
sail power from December 5, 1955 to March 31, 1956, both
dates inclusive, and be it further
RESOLVED, That persons taking scallops from these areas in
the amount of 5 bushels per person per day must have in their.
possession- a State of New York Conservation Department Digger 's
Permit, and be it further
RESOLVED, That scallops taken from these areas in the manner and
amount as heretofore described may be taken for commercial
purposes only and for 5 days per week only, from Mondy to
Friday, both days inclusive, and be it further
RESOLVED, That nothing contained in this resolution shall prevent
any person who is a resident or taxpayer of the Town of Southold
from taking an amount not in excess of 1/2 bushel per person in
any on calendar day.
(1) In that area commonly known as Mill Creek at Arshamomaque
New York, from, the New York State Route 25 Bridge,' north.
(2) In that area commonly known as Gidds Bay, Orient, New York,
northerly of a straight line drawn between Peter's Neck Point
and Brown's Point.

WHEREAS, the New York State Department of. Public Works is making
extended improvements and alterations on State Highway Route 25
through the Town of Southold, and
WHEREAS, it has become necessary to provide for numerous catch
basins to take care of drainage problems on this highway, and
WHEREAS, the installationig of such catch basins has made it
necessary to remove certain trees particularly in the community
of Southold, which trees contributed greatly to 'the beauty of
this community, now, therefore, be it
RESOLVED: That the Town Board of the Town of Southold request .
that our, State Representatives, Honorable Edmund Lupton, State
Assemblyman, and Honorable S. Wentworth Horton, State Senator,
take whatever steps they deem necessary to institute a program
with the New York State Department of Public Works for the re-
placement of as many of the trees that were removed as is possible,
and be it further
RESOLVED; That a copy of this resmlution be sent to Senator $ji¢T
Horton and Assemblyman Lupton.

RESOLVED: That Bond No. F 51323, issued by the Fidelity and Casual-
t Company of- New York, in the sum of Fifty Thousand Dollars
( 50,000) on behalf of Austin C. Burt, be and the same is hereby
approved as to its form, manner of execution and sufficiency
of sureties therein.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill,
Albertson, Clark and Demarest.

RESOLVED: That Bond No. SM178276 issued by the American Motor-
ists Insurance Company, in the sum of Five Hundred Dollars
($500.00) on behalf of Henry Brewster Faucon, be and the same
is hereby approved as to its form, manner of execution and suff-
iciency of sureties therein.

Albertson, Clark and Demarest.

WHEREAS, The Superintendent of Highways, Harold D. Price, .
at 'a Town Board Meeting held on December 69 1955, . recommended
the purchase of a 4 yard dump truck to replace a 1947 dump truck
used in the Highway Department of the Town of Southold,
NOW, THEREFORE, we the undersigned" members .oftthe Town Board
of the Town of Southold do hereby hereby approve and do hereby
authorize the Superintendent of Highways , Harold D. Price, to ad-
vertise, in accordance with Section 103 of the General Municipal.
Law, "or bids _to purchase one 4 yard dump truck.

WHEREAS, the Superintendent of Highways Harold D. Price, at a
n-- 'own Board Meeting held on Dedember 6, 3955, recommended the
purchase , of a Seaman Pulvi-Mixer. for the use of the Highway
Department of the Town of Southold,
NOW, THEREFORE, We, the undersigned, members dg- the Town Board
of the Town of Southold, -so hereby approve and do hereby authorize
the -Superintendent of Highways, Harold D. Price, to advertise,
in accordance with Section 103 of the General Municipal Law, for
bids to purchase one Seaman- Pulvi-Mixer.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill,
Albertson, Clark and Demarest.

WHEREAS, The Supt. of Highways, Harold D. Price, at a Town- Board
Meeting held on December 6, 1965, recommended the purchase of an
automobile to replace a 1953 Buick, for the use of the Supt. of
Highways of the Town of Southold,
NOW, THEREFORE, We, the undersigned members of the Town 11oard
of the Town of Southold. do hereby approve and do hereby authorize
the Supt. of Highways, Harold D. Price', to advertise, in accord-
ance with Section 103 of the General Municipal Law, for bids
to purchase one Automombile for the use of the Supt. of High-
ways of the Town -of Southold.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill,
.Albertson, Clark and Demarest.

RESOLVED: That the Police Report for the month of November be
accepted by the Town Board and placed on file.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill,
Albertson, Clark and Demarest.
Moved. by Justice Albertson; seconded by Justice Tuthill:
WHEREASt it is the considered oponion of the Town Board that the
work at the Southold Town Dump during the winter months is not
sufficient to warrant the employment of two labormen, therefore
be it
RESOLVED: That the services of Stephen. Coyle, laborer at the
Southold Town Dump be and hereby is terminated as of December
15, 1955.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill,.
Albertson, Clark and Demarest.
The Supervisor read a communication form Rudolph Hoerr stating
that he was tending his resignation as School Traffic Officer
at the Southold School, - effective as of December 22, 1955.
Moved by Justice -Albertson; seconded by Justice Clarks
RESOLVED: That the re.sigantion of Rudolph Hoerr, Traffic Officer
at the Southold School, be accepted with -regret, and be it
further.
RESOLVED: That the Supervisor be directed to forward a letter of
commendation to Mr. Hoerr.

Albertson, Clark and Demarest.

RESOLVED: That General Bills in the amount of $5,193.75, l,own
Trustee Bills in the amount ,of $70.00, Lighting District Bills
in the amount of $1,433:94, Fishers Island Ferry District Bills
in the amount of $7,449.87, ..be and the smae-;; are hereby ordered
paid.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill,
Albertson, Clark ,and Demarest.
The following resolution offered by Justice Demarest; seconded °by
Justice Albertson was duly adopted by A unanimous vote:
WHEREAS, God, in his .Providence, has taken from our midst the
spirit of Lyle F. Tuthill, and
WHEREAS, Lyle F. Tuthill served the Town of Southold as its
Trustee faithfully and efficiently for a term of none years ,
THEREFORE, BE IT RESOLVED: That the Town Board of the Town of
Sou.thold deeply mourns the passing of this associate and friend
and extends its profound sympathy to the members of his family
in 'their bereavement, and that when this Board adjoins this day,
it do so out of respect to the memory of Lylh F. Tuthill.
BE IT FURTHER RESOLVED: That the Town Clerk be and .he hereby is
directed to forward ,a copy of this resolution to the members
of his family and a copy of this resolution .be spread upon the
minutes of this meeting and become a part *of- the public .record ,
of the Town of Southold.
