HomeMy WebLinkAboutTB-02/15/1955 ..221 MEETING: OF FEBRUARY 15, 1955 The Southold Town Board met at the office of the Supervisor, Norman E. Klipp, at Greenport, on Tuesday, February 15, 1955. The meeting was called to order at 1:30 .P.M. with the. following present: Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demarest; Town Superintendent of Highways Price; Town Attorney Terry and Town Clerk Booth. The Board. sat at once as a committee on Audit to examine claims against the Town, concluding the Audit work at 2 P.M. Moved by' Justice Albertson; seconded by Justice Demarest: ' RESOLVED: That -the minutes of the previous meeting be and' hereby are duly approved as read. Vote of' Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demarest. Moved by Justice Albertson; seconded by Justice Clark: RESOLVED: That the regular monthly Audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport� on Tuesday, March 8-, � 19 55 at 1:30 P.M. Vote of Town Board: Ayes-Supervisor Ilipp; Justices Tuthill, Albertson, Clark and Demarest. Stanley Staron requested a street . ight be placed in front of his residence on Oak Street in Mattituck. MOVED BY Justice Tuthill; seconded by Justices Clark: RESOLVED: That the Town Clerk be and helhereby is directed to request the Long Island Lighting Company to install one addit- ional 100 c p aerial street light 'in the Mattituck No. 1 Light- ing District, sa-id" light to be placed on Pole #2 on Oak Street., Mattituck, New York.' r - Vote of Town Board: Ayes-Superfisor Klipp; Justices Tuthill, Albertson, Clark and Demarest. The Board of Fire Commissioners of the East Marion Fire District . requested a street light be placed on Pole No. 305 in front of the new Fire House. Moved by Justices Albertson; seconded by Justice Clark: RESOLVED: That the Town' :Clerk be and he hereby is directed to request the Long Island Lighting Company, to install oneaddit- ional 100 c p aerial street light in- the" -East Marion Lighting District', said light to belplaced on Pole 305 in front of the new fire. house. Moved by Justice Albertson; seconded by Justice Clark: WHEREAS, there was not sufficient amount of money appropriated for tax maps in the 1955 budget to cover the cost of work necessary to be done on new tax maps, now therefore be it RESOLVED: That Otto W. VanTuyl and Son be authorized to prepare new tax maps at a cost not to exceed Two Thousand Dollars ($2,000) . Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demarest. Mr. Ranson G. Miller, Jr. , as pesident of The Wunneweta Pond , Association, applied to the Town Board for some financial assist- ance in dredging the Inlet from Peconic Bay to Wunneweta Pond. Moved by Justice Albertson; seconded by Justice Clark: RESOLVED: That Norman E. Klipp, Supervisor, be and he hereby . is authorized to contribute half of the cost up to but not to I exceed Two Hundred and fifty Dollars ($250.00) twards the cost of dredging the Inlet from Peconic Bay to Wunneweta Pond at Nassau Point, Town of Southold, N.Y. Moved by Justice Tuthill; sedonddd by Justice Albertson: RESOLVED: That Peter Burke of Greenportbe authorized .to furnish the,.Town of Southold the following electrical equip- ment: 3 - 1000 W. electrical heating panels.. relay and thermostat, main switch and separate meter Installed in the Levin Building at Greenport, in the office. of Justice of the Peace Henry A. Clarke, for the sum of $275.00 Vote of Town Board: Ayes-Supervisor Klipp; Justices . Tuthill, Albertson and Demarest. Justice Clark not voting. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS William Way,School Traffic Officer., East Cutchogue School bistrict #8, resigned such position on February 12, 1955, therefore, be it resolved: That on the recommendation of Harold Price and Ellsworth W. Bedell, Republican, Committeeman, District #10, Town of Southold, Gordon Torkelson. of Cutchogue, be and he hereby is -appointed Special Constable to direct traffic at -4heEast Cutchogue School crossing , at a salary df-,$5. 50 per day, for each school day worked effective as of February 16, 1955, he to serve at the pleasure of the Town Board. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demarest. Moved by Justice Albertson; seconded by Justice Clark: RESOLVED: That the Police Report for the month of January be accepted by the Town Board and placed on file. Vote of Town. Board: Ayes-Supeervisor Klipp; Justices 'Tuthill, Albertson, Clark and Demarest. The following Bonds were presented to the Board for approval. Moved by Justice Demarest; seconded by Justice Tuthill: RESOLVED: That Bond No. F27461 issued by' The Fidelity and Cas- ualty Company of New York, in the sum .of One Thousand Dollars ($1,000.00) on behalf of Raymond F. Doyen, be and the same is . hereby approved as to its form, sum, manner of execution and- sufficiency of surety therein. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demarest. Moved by Justice Albertson; Seconded by Justice Clark: RESOLVED: That Bond No. F2745, issued by The Fidelity and Casualty Company of New York in the sum of One Thousand. Dollars ($1-000) on behalf of James B. Pickett, be and the smae is hereby approved as to its form, sum, manner of execution and sufficiency of surety, therein. Casualty Company of New York, in the sum of Twenty Thousand Dollars ($20,000.00) on behalf of Elizabeth McCloskey, be and the same is hereby approved .as to its form, sum, manner of , execution and sufficiency of surety therein. Klipp, Supervisor, be authorized to advertise for sealed proposald for the construction of a dog kennel at the Southold Town Dump, in accordance with plans and specifications, said proposals will be opened at the office of the Supervisor at Greenport. at 2- o'clock on March 8, 1955. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demares.t. Edwin S. Conklin, Building Inspector, for the Town of Southold, appeared before the. Board presenting a letter from Nathan Hicks requesting permission to delay compliance with the safety requirements of the 'Multiple Resident Law until .September of -1955. This request is in relation to fire escapes and a sprinkler system to be installed in the Orient Point Hotel of which he is the proprietor. I Moved by Justice Albertson; seconded by Justice Demarest: WHEREAS, IN THE CONSIDERED OPINION OF THE Town Board, it is desirable that additional lands be -purchased adjacent to the l existing Town Dump, and WHEREAS, Frank McBride has consented to sell and' convey the foll'ow- ing described property to the Town of Southold, on condition that the Town reconvey' to him a ten-foot strip of land ' adjacerit to the southerly line of premises presently owned by him, NOW, THEREFORE, BE IT RESOLVED: That the Town Board acquire by purchase from Frank McBride the following described property: ALL that tract or parcel of land, situate in the Town of Southold, County of Suffolk, lying and being -at Cutchogue, 'State of New York, bounded and described as follows: BEGINNING at a monument set on the boundary line between land of Frank McBride and land of Glover, 918.21 feet northwesterly along said boundary line from Middle Road, ,being the north- erly corner of land conveyed by Frank McBride to the Town of Southold by deed dated February 15, 1919 and recorded. in Liber 976 of deeds at Page 94; and running along said land conveyed by Frank McBride to the Town of Southold, South 21 degrees 48 minutes 20 seconds West, a distance of 16.84 feet; thence along other land of Frank McBride, 2 courses, as follows: - (1) North 56 degrees 40 minutes 00 seconds West, 150.0 feet; thence (2) South 21 degrees 39 minutes 30 seconds West, 280+8 .. feet to land conveyed by Frank McBride to the Town of Southold by deed dated April 30, 1935 and recorded in Liber 1817 of Deeds at page 486; running thence along said land North 55 degrees 19 minutes- 50 seconds West, a distance of 7�1.21 feet; thence along other land of Frank McBride,T North 27 degrees 30 minutes 40 seconds East, a distance of 280. 54 feet to an iron pipe and said land of Groover; running thence along said land of Glover, _South 56 degrees 40 minutes 00 seconds East, a distance° of , 888.10 feet to the point of beginning containing 5.0375 acres, according to survey of Otto W. AND BE IT FURTHER RESOLVBD that, pursuant to the provisions of subdivision 2 of Section 61+. of the Town Law the Town `Board sell, and convey to Frank McBride the following describred property: ALL that tract or parcel of land, situate, lying and being at Cutchogue in the Town of Southold, County of Suffolk And State of New York, bounded and described as follows: BEGINNING at a monument set on the northeasterly boundary line of land of. Frank McBride, 1825.40 feet northwesterly along said boundary line from Middle Road, being the westerly corner of land conveyed by Frank McBride to the Town of Southold by dded dated April 30, 1935 and recorded in Liber 1817. of deeds at page 486;- and running along the northwesterly line of said land conveyed by Frank McBride to the Town of Southold, North 27 degrees 30 minutes 40 seconds East, a distance of .277.92 feet to a monument .and the northerly corner of said land; thence along other land of Frank McBride, South 55 degrees 19 minutes 50 see- onds East, a distance of 10.08 feet- thence along said land convey- ed by Frank McBride to the Town of Southold, parallel with said '22 4 northwesterly line thereof and: 10.0. f..eet southeasterly there- from, .measured at right angles :there.to, South 27 degrees 30 minutes .1+0 seconds West, a distance of ,278.23 feet to said northeasterly boundary of land of Frank McBride; thence along said no-rtheasterly boundary, North 53 degrees 37 minutes 50 seconds West, .a distance of 10.12 feet to the ,point of beginning, containing 0.0638 acre, according to survey of Otto W. Klipp be and he hereby is authorized and directed to take. such. steps as. may be necessary and proper to accomplish the purchase and sale of the above parcels and to espend a sum not exceeding Five Thousand ($5)000) Dollars theref6r. V'ate-:Y'o'f'�Toti�n'Bnarcl:�:A�e:s:��up�rtt��o�<�Nlipp; `~.Ju�rtd�c.�'s, .�uthfill' s,. .A1be ts.on., Gla rkt er d 'Dema rear Moved" by Justice Tuthill; seconded by Justice Albertson: WHEREAS, THE Suffolk County .Superintendent of Highways has made a written .recommendation stating that the Old Mill Bridge over Mattituck Harbor in the Town of -Southold-, Suffolk County, New York, said bridge being a county bridge on a Town Highway, is in an advanced stage of dis-repair and would require' expendit- ures of large sums of money..to make said bridge safe for the travelling public and, such expenditure would not be in the public interest, and WHEREAS, the Suffolk County Superintendent of Highways has certified to this Board that said bridge has become. useless and not necessary for .the public convenience and welfare and WHEREAS,.' it appears that such bridge has a span of 25 feet or over and may be abandoned pursuant 'to the provisions of 'High- way Law, Section 231,. Subsec.tion ,l2, and WHEREAS, it 'is the . considered opinion of the Town Board of the Town ,of, Southold, . that the abandonment of said bridge would be in the best interest .of the residents of' the Town of Southold, NOW., THEREFORE, BE IT RESOLVED , the this Board finds - and''it hereby does find that the said bridge, owing to changed conditions, has betome, and is useless and not necessary for the .public convenience and welfare, and BE IT; FURTHER RESOLVED, that the Board of Supervisors of the County .of Suffolk be and it hereby is requested to order and direct the County Superintendent of Highways to abandon such bridge and to erect suitable, substantial barricades for closing such bridge and for the protention thereof of further use .and passage thereon and thereto, all in accordance with the pro- visions,.of the Highway Law, and BE IT FURTHER RESOLVED, that upon erection of such suit&'.b1b devices for the protection of the public, the Uounty Superin- tendent of Highways be authorized to remove said Old Mill Bridge.
