Vote of the Town Board: - Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell, This resolution was declared duly adopted. 86 MARCH 10, 1981 I-. REPORTS 1. COUNCILMAN MURDOCK:. We have a report-.-a study done by the League of- Women Voters of. Riverhead-Southold on a Five Town East End Solid Waste Management Study which was prepared by Holzmacher, McLendon, . : and it in general is not really in .agreement with the recommendation of Holzmacher, McLendon. They would like to see a little more effort at recycling and source separation, . but the major thrust being that the Holzmacher, McLendon suggestion is much too expensive for. the type of service and what. the Town would get out of it. . They recommend, that we look for an alternative alternative and they suggest a few things of their own. Of course, the Town Board would have to consider them before they would adopt anything. SUPERVISOR PELL: These reports, are all placed on file in the Town Clerk' s Office._ Anybody who wishes to review them can go there to review them. 2. Building Inspector' s_ monthly report (February 1981) . 3. 69Lperyisor' s ,monthly financial report for the Town (February 1981) . 4. Town Clerk' s monthly report (February 1981). . 5. Police Departmeat ' monthly report (February 1981) . 6. North Fork Animal Welfare League' s monthly report (February 1981) . . 7. Judge Tedeschi' s monthly report (February 1981) . 8. Fishers Island Ferry District ' s monthly report (February 1981). 9. Highway Department ' s monthly report (February 1981). '10. Judae Rich' s. February (1981) monthly report. 11. .° Board of Trustees' . monthly report (January, February 1981) . 12. On the Councilmen' s reports, I will ask the Councilmen if ' any of them care to make any reports on any committees? Larry, I ' ll start with you. COUNCILMAN MURDOCK: I would make 'a comment, Bill, about the meeting that you and also* the Board attended with County Executive Cohalan and his aide Mr. Brotherton and had -.to do with the 7th' Squad and the problems arising.'therefrom and' I know we' haven' t sat- and- -talked as a group about it, we were busier today, maybe, but I for one was very pleased- with the meeting, the tone of the meeting. It 'has been my position-. since. we started this discussion back in April that it is covered in the County Charter that detective service shall be available to the five towns as an all-county expense. Mr. Brotherton is the first person that I have heard come up with a definitive discussion about the 7th Squad and what has evolved in the type of service the 7th Squad has been providing. If you recall; Mr. Brotherton quoted to us the intent of the County Charter and told us that it was and is and will be the purpose of the county to provide detective service in the terms of the specialized fields- murder, arson, and it was his opinion that the 7th Squad had evolved into a squad that was used more for general. detective work in aid and .assistance- to the five east end towns- and I agree with him wholeheartedly that. that was not the intent of the charter and while I can appreciate very fully the help that the county has given us it is really not the intent of the County Charter the way the 7th Squad is constituted today and' I think you and the four of us that were there feel very fortunate..that the County Executive is not in the mood to just lop everything off and stop all the services and leave us hanging in . mid air: This use of the 7th Squad has evolved over the last ten or twelve years . and 'all of the towns have availed themselves of the services--without -making"provision on our own and I think .it is the intent of our Town Board to rectify the way ,we handle our own police services and handle our own day to day detective work and as I say. I was very pleased that Mr. Brotherton had made this assessment and his explaining it' in -a way that I hope will put to rest all the hard feelings. There' s a lot of talk about the east is paying too little and . the west is going to 'do away with it, that they are going to saddle us. with the whole 450 detectives that the six precincts have, because it has been my feeling all along that neither the legis- lators as individuals, nor-_ the County Executive' s Office as -individuals really bears any ill feeling towards the east end and Mr. Brotherton, to me, delineated all of the problems and the cause of the problems. The effective course has to be very simply that the east end towns must get more active and take care of their own in-town problems and I think we all will address that. I was very very pleased with Mr. Brotherton' s attitude and, of course, he deeply reflects the attitude of our County Executive and -. I think in a matter of due time all of our little differences:i.are going to be resolved very amicably. MARCH 10, 1981 87 SUPERVISOR PELL: Any other reports, ; Larry? COUNCILMAN 'MURDOCK: Not now, thank you. SUPERVISOR PELL: Councilman Drum? COUNCILMAN DRUM: I might say while Larry was speaking on the 7th- Squad 'and in relation to the meeting with the County Executive and his Deputy .Mr Brotherton., the Co:unty 'Executive- could give us no guarantee that the Legislature would approve. of the plan whereby we would actually pay for the services receiving this year through taxes next year, which would-be the ideal way. We currently are using the 7th Squad. It is my opinion and my feeling and I feel very strongly that we 'should phase out the 7th Squad and thereby giving our Police Department, our own Police Department advancement opportunity. We have stagnation at the top at present, but this would mean we would have our detectives or some of our senior policemen becoming plain clothesmen -or detectives. Where we would replace them would be with the youth. coming in, and I feel this is the way we should definitely, go. Now, how we pay for this , cost is something that we haven' t decided, and as Larry brought out, and I bring out, Mr. Cohalan can give us no guarantee that that would be the ideal way to pay for what we are receiving in services this year through taxes next year. SUPERVISOR PELL: Any other report, Hank? COUNCILMAN DRUM: We did discuss C dar Beach to a certain extent concerning the dreding and considering putting jetties out . I might say there is a-- the Legislature has before it a motion whereby they appropriate $35, 000. 00 and they have discussed it today,. $35, 000. 00 for the dredging of Cedar Beach. SUPERVISOR 'PELL: You are going to bring that up again next.. Town Board meeting, right? The 24th that will be on the agenda in' resolution - form. Councilman Nickles? COUNCILMAN NICKLES: I ' d just like to add to that on this meeting with Mr. Cohalan and Mr. Brotherton, that the Town does have this. situation where we can 'enter into a contract for the services of the 7th Sauad this year for approximately $25, 000. 00 to .$27, 000. 00°'and I would like the record to reflect and the people to be aware of-- the Town Board did inquire as to how many years they would provide the service at this fee because I am sure everybody on- the Town 'Board is aware, and the people might not be aware, for that- fee it' is far less than to hire one patrolman. So, as Mr. Drum stated, I think the Town Board or.. the Police Committee is certainly going. to •make the final recommendation to the Town Board. It is our feelings we are leaning to the direction of going on our own. We are investigating the avenue of continuing with the 7th Squad and certainly at $25, 000. 00 or $27, 000. 00 a year we would not produce the number of men that they provide us. But the County Executive made it quite clear that this is a one year offer. I think we started out sometime in December or January at $871, 000. 00 as a cost to the five east end towns and miraculously that has come down to $171, 000. 00, so I think we are at a point now where we probably cannot procrastinate too much longer and. are probably going to move ahead with entering into some kind of agreement with the County relative to the 7th Squad. SUPERVISOR PELL: Thank you. Councilman Murphy? Something besides the .7th Squad, maybe? . COUNCILMAN MURPHY: I think we better get off that subject. Last . night we had a meeting here of the Ferry Advisory Commission.- and it was a public forum where people came to present input into .the State. We had Austin- Emory here who is the Regional Director of the Department of Transportation and Mr. Wilson Campbell who is the Director of .Planning for the State DOT. We had about 75 people that spoke. They were people who were interested in the environment; they .were people who were inter- ested in tourism, restaurant trade, horticultural industry,: florists, nursery, vegetable farmers, f armers . and. there was a tremendous amount of input given to the Department of Transportation. It was one of their better. hearings. They appreciated coming out here. and hearing from the. people on the type of service that we do have, what it ' s. like, are there needs for improving, should we improve, should new- service be adopted and all. Very good input -and I think it will. help this area, the whole . east end .economically. It think .it will be a great 88 MARCH 10, 1981 benefit for us and it looks very good.. The final meeting of this Commission is .Thursday and reports will be going up to the two governors of the State of Connecticut and New York. Thank you. SUPERVISOR PELL: Deputy Supervisor Marie, Johnson? Anything but the 7th Squad. 13. -. DEPUTY SUPERVISOR JOHNSON: The County Legislature' s Health Committee which met last Friday. The. greater part of the meeting was devoted to problems of families :in Yaphank who' s wells have been found to have carcinogens which came from the County Public Works Department laboratory. , The County is probably going to have to pay to bring the County water into the homes but the families will be burdened with paying for their water from then on. There was a great deal of discussion about what other towns are doing . to locate and deal with those business and industries which dispose of polluting materials into the ground and therefore down into our ground water. There' s a great deal to 'be done to improve the procedures here. Most towns in the County do have seem to begun programs to map these offenders but this is in kind of the beginning stage and I think perhaps Southold should get in to it. Our own ground water situation, whether we- realize it or not, is just about the most fragile in all of Suffolk County. We ' re in a worse position for finding water when our shallow aquifer becomes polluted, than any other town in the County. . - It was reported that an alarming number of people and businesses are mixing waste oils with their number two oil and burning it and this is creating considerable air pollution which the County has no means of detecting or check on. However, it is probably going to be helped somewhat with a laboratory van which is going to be out for the County Health Department and will be used to detect air pollution. It ' s in the current Capital Budget and will probably be coming into use very shortly. Thank you., SUPERVISOR PELL: Thank you, Marie. ' The Supervisor' s Report., number 14. , The Supervisor has been at many meetings, and there are many things going on and I was to go into each one we, would be here all night long. I will tell 'you just one real short one. The Towns books are being audited by_ New York State. - This is the first time in six or seven years it has been done. This gentleman will be here for four months auditing the Town records. If I don' t end up in jail. I feel I done a good job. This is a-.four months audit . Just for the information sake of the girls, we are going- to go through this rather. quickly, a lot of this. We started at 9 :00 o' clock . today and every one of these line items you see in your agenda we discussed during the day time so if we move along a little. rapidly, -we did discuss and give each item a lot of time during the daytime. II . PUBLIC NOTICES- COUNCILMAN NICKLES : We have nine public notices tonight asyou can see on your agenda. They , are all on file with the Town Clerk. You will notice that on each item you are allowed to make comments to the respective agencies that. are handling the application on the date by when you must respond. All these are pretty much the'- same. They involve piers, ramps, floating docks. 1. (Department of the Army., New York District Corps of Engineers re: application by Carol Galgano to construct. a pier, ramp, float ' with mooring piles, Mattituck Creek. - Written comments by March 19, 1981. ) ___ 2. This is a little different,, this involves an. inlet on Nassau Point and they wish to extend existing jetties a little bit further out in the Bay. - (New.--Yor-k.--State Department of Environmental Conservation re: notice of public hearing on application of George A. Burrel (fo,rmerly Charles Hammer) to _extend -two timber jetties, entrance to south .Lagoon off Cutdhogue Harbor, Cutch.ogue. ' Meeting on May 8, 1981 at 10: 30 A.M. at the Southold Town Hall. ) 3. Also a floating dock. (Department of the Army, New York District Corps of Engineers re : application of Frank T. Weber to install a platform, ramp .and floating pier at Jockey Creek, Southold. Written comments by March 10, 1981. ) , 4. Floating piers or floating : docks at a non-conforming -marina .. .in Cutchogue off of Skunk Lane. . (Department of the Army, . New York District Corps of Engineers re : application of Carl F. Boos to : install floating piers, East Creek., Cutchogue. Written comments by March 30, 1981...) MARCH 10, 1981 89 5. Another non-conforming marina in Orient . They are applying for maintenance dredging. (Department of th.e Army, New York District Corps of Engineers re: application of Raymond Pluschau for maintenance dredging, Narrow River, Orient. Written comments by March 30; 1981. ) 6 . Appli.cation for a deck, catwalk off of Nassau Point on Broad-, waters Cove. (Department of the Armv, New York. District Corps of Engineers re: application of Eugene Bolter to .construct a deck, . catwalk, hinged ramp and float, Broadwaters Cove, Cutchogue. Written comments by March 30, 1981. ) 7. I' ll let the Supervisor explain that as he is a little bit., more familiar with it than I am. SUPERVISOR PELL: Number 7 is the Winterization (Weatherization). Program in Southold Town. If you qualify for it, if your income is below a certain amount, I have it back on my desk, you can get UP to $1, 000.00 to winterize your home, such .as insulation, storm . windows, storm door; anything for your home, The Village of Greenport has received $112, 000. 00 to do this to help people out. If you qualify. There are certain stipulations: They anticipate they will use' half of that amount of money, the other half they have received permission. to use- in Southold Town' s jurisdiction and the Village of Greenport has agreed to administer the program. I have the qualifications on my desk if anybody cares to look at them, COUNCILMAN NICKLES: 8. Letter to the Supervisor and Town Board inviting .them to a meeting at 8: 00 P. M. , March 19, 1981 here. at the Town Hall: This letter indicates that Mr. .Obenauer, of of our DEC officers will present a talk and slide show on his responsibilities and what- the public can do to assist the Department. However; Mrs. Oliva, who is the President (North Fork"Environmental Council, Inc. ) was present at our work session today and it is really a bit more involved than that. As she explained to the Town Board today, it ' s .not so: much what the public can do to assist. the Department, but really what the Department can do to assist .the public. In other words,• if. you have any intentions of putting in a bulkhead or jetty or dock you might start with them to get their input. before you get involved .with a contractor who might tell you you need 150 foot. jetty, whereas the DEC might get you off on the right foot. ' So there will be three people from the DEC present at this meeting. and the public is- invited. 9. Again an open pile pier and floating .dock and I don' t think there is any -need to go into that any further. Thank you. . (New York State Department of Environmental Conservation re : , notice of complete application by Patrick Carrig for Frank L. Weber to construct a ramp, open pile pier and floating dock at Jockey Creek, Southold. Written comments by March 25, 1981. ) COUNCILMAN MURDOCK: May I make one correction, . please. On number 4 which was the application of Mr. Carl Boos. This is the brother of the man that has the marina on Broadwaters Cove. This brother' s home is just a private dock, not a marina, in Cutchogue. Unless. somebody comes down and tries to rent dock space. This is just for a private dock. III . COMMUNICATIONS SUPERVISOR PELL: 1. From Mary Fiedler pertaining to Founders Beach and.-Park. - She has a lot of good ideas and -she did suggest to me one time ' about a separation recycling plant in New Brunswick; Maine. We have wrote for information and it has not come back yet . 2. Resolution from the Riverhead Town -Board opposing the _ 24 hour sale of liquor_. The Town Board has instructed me .to. writ_ e a letter opposing this to, even though the governor has said he is going to veto it if it came to his desk. 3. A letter from Brookhaven Town Supervisor t-o our County Exec requesting financial aid to help solve the water problem; . drinking water problems they have. If this was to be adopted, Southold Town woul.d receive $60, 000. 00'. 4. From Mr. Brush in reference to the asphalt tanks in Mattituck to the''Towri Board. 5 . This is a County resolution trying to .be . introduce:d to have pre-inspections of rental homes that are going to be rented to welfare recipients. It ' s a resolution before the County: Legislature in it ' s committee. They have. not come out of."committee yet. 90 MARCH 10 , 1981 6. From Suffolk Community Development Corporation reference what we call Section 8 Housing Program. The Town might have to get involved with this slightly to a very limited number because of the federal block grant that we have received through the County of $220, 000. 00. . 7. Again a letter from Babylon supporting the pre-inspection of welfare homes. 8. Something that affects all .of us in the Town, throughout the State. The Association of Towns have recommended against a certain proposal when we were in New York. Now they ask us to write to our Congressman and our Senators asking them to vote against the proposed ruling that would take the interest from the banks. In regards to the interest. that the. banks„ make on money and it would affect our Town because -we wouldn ' t get the interest money. We will send a letter out on that one. (.IRS Ruling 8055) . 9. Request from our ' County Executive .asking each of the ten towns in Suffolk' to apprise him of the extent of damage done to our .piers and docks because of the ice this past winter and see if he should ask for federal disaster area. Your Town Board, each of us, reviewed our own areas and it ,is our view perhaps you can say, that we do not consider Southold Town to be in a critical stage to ask for disaster relief. I will so inform the County Exec. IV. HEARINGS AND DECISIONS - SUPERVISOR PELL: There are no. hearings or ab cisions . We move to resolutions . .V. RESOLUTIONS 1. COUNCILMAN NICKLES : Discussion. SUPERVISOR PELL: Discussion. COUNCILMAN NICKLES: Can the Street Light Committee tell us what the financial impact of these 24 lights are?- COUNCILMAN DRUM: I can' t . COUNCILMAN NICKLES : How much are they going to cost to install them; how much is the energy cost? COUNCILMAN MURPHY: We would have to get the breakdown. COUNCILMAN .NICKLES: Well, I think to--- COUNCILMAN DRUM: The fixtures we do not have as yet, of course, John. As far as the fixtures are concerned. COUNCILMAN MURPHY: We have fixtures but no bulbs. The bulbs are ordered. This has to be done, John, to get the necessary permits from the light company so that these lights can be installed.. COUNCILMAN NICKLES: But we don' t know what it is going to cost us yet COUNCILMAN DRUM: I have no idea. MARCH 10, 1.98.1 = ;. 95 . COUNCILMAN NICKLES: How can we . vote in 24 lights and nobody' on the Town Board has any idea what it costs? I would suggest we table this until such time as the Street Light : Committee should -tell- us, as -any other committee when they make reports and want the Town. to do something, we should know what it is going to cost .us. I 'm not. saying that these 24' lights aren' t justifi.ed, . but .I. .t.hink to justify them we at least should know what the' Town is going to pay in terms of installation; in terms of the annual energy costs, pole.. rentals and so forth. COUNCILMAN DRUM: Good point: SUPERVISOR PELL: Do you want to :make a motion to table..'it? • COUNCILMAN MURPHY: We have a motion. .SUPERVISOR PELL: The motion to table can supersede. a motion on the floor to vote on. I called to. have it tabled until such time as. the Committee .can provide the dollar impact;c SUPERVISOR PELL: We will votd on the"motion to table the, resolution on street lights. COUNCILMAN MURPHY: I think you have' to vote on the one -that -was made and.seconded. SUPERVISOR PELL: No, 'the motion to ' table- supersedes the motion there. ' To table, you vote on the one to table; Robert Rules. , COUNCILMAN MURPHY: Is that right?. SUPERVISOR PELL Before -I came tonight, I 'figured you would do, this.. Call the roll. - Vote of the Town Board: Councilman Murphy: No. Councilrria.n Murdock: Yes . Councilman Nickles: Yes. Councilman Drum: Yes . Supervisor Pell: Yes, to table until we get the information. It will be on the agenda on the 24th. This resolution was declared duly adopted. SUPERVISOR PELL: It is tabled. 19. Councilman . Murdock,, Councilman Nickles, Councilman Drum, . Supervisor .Pell, This resolution was declared duly adopted— COUNCILMAN DRUM: I'`d Pike to say that we do--the Town' Board' does provide other funds for other athletic facilities in. -the summer months and they will be forthcoming at a, .later date. .They money has been allocated. anyway. SUPERVISOR PELL: Right. We' will open the floor to the Board members.. Anything else the Councilmen wish to bring up? COUNCILMAN MURDOCK I ' ll just comment that last Thursday' Councilman Murphy, Frank. Bear of th-e North.- Fork' Environmental Council and myself traveled to Mt . Laurel. New Jersey to watch some people-burn- garbage. It was a facility that was recommended to us by an engineering firm and it was probably the first ray . of hope we've •seen in terms of' what looks like it could be an acceptable method. . We; in general, in the. Town feel that as long was we have to .do something in terms of closing. our landfill, we would like to do something- that .is both economical and . 9.6 , ` MARCH 10 , 1981 ecologically acceptable and so far this fellow seems to have the first program that looks half way acceptable on both counts and we will .be going up. to the University of New. Hampshire, . hopefull.y., on the 20th - of March to look at another system for burning garbage, or I should,. say municipal solid waste. Thank you,. Bill. SUPERVISOR PELL: Councilman Drum? Councilman Nickles? COUNCILMAN NICKLES: I have nothing further but,.I have -not seen any reports from the Robins Island Committee in some time and I was wondering if the Chairman might bring us up to date. SUPERVISOR PELL: The Chairman missed the last meeting, he. was out of town to another meeting and I have not reviewed it, . John. Councilman Murphy? (nothing),. Any members of the audience wish to address the . Board? MR. ED BAUMAN, Indian Neck Lane, Peconic: Councilman Murphy, I think. this might apply.. to you. We live down on IIndian Neck and use the facilities of the small boat ramp and beach at the end on Indian Neck. I was just wondering what was possible there. I read something to the effect that the- Town was in the process of adopting some type of codes as far as town beaches are .concerned. I don' t `know what the status of that code is and if .something like that is adopted on beaches , how residents who live. or border on a park district or something that would be .similar to a park district, if. possible to get a town ordinance for that park district. COUNCILMAN MURPHY: It' s up to the individual park district, . if they want to incorporate the Town rules and regulations as their-- a park district is like a= private owner. I '.m involved in Mattituak Park District for years. You' re the same as a private owner of property. If you want to have the rules--and regulations that the. Town adopted, the park, district themselves- has to vote on it and it' s very easy to do. Then everybody---and I strongly- recommend it .,- because then every- body will have the same rules and regulations and.make it a heck of ' a lot easier for the police if they are. called out on occasion to enforce the law. COUNCILMAN DRUM: I think that' s a Town ramp. MR. BAUMAN: I was wondering. SUPERVISOR PELL: That 's a Town area. MR. BAUMAN: . . 'What is it, a park or a. Town or what? SUPERVISOR PELL: Town ramp. COUNCILMAN DRUM: It ' s a road end. MR. BAUMAN: Does that mean that would or would not be under the ordinance? COUNCILMAN NICKLES: We did pass a law-. . It was the Beach and Recreation Law, Local Law .No. 1 and- it would apply to any road ending within the Town or town. beach. It is already adopted, COUNCILMAN MURPHY. I thought you were talking about a park district . COUNCILMAN NICKLES: Is there any particular reason why you are asking the question? MR. BAUMAN: No, I was, just curious about it.. . I always kind of wondered what _it was . Whether it was a park. Some. people, had indicated that it was a park.. I wasn' t .sure myself. COUNCILMAN NICKLES: I think we consider road ends and the Trustees take the jurisdiction below the- high water and the right of exercising the privileges of our Town where we own a, bottom acid giving onshore and offshore stakes and various moorings off of that road end. SUPERVISOR PELL: Thank you. Anyone else wish to address the Board? MARCH 10 , 1981 - 97 MRS. LEE CONTE: Councilman Drum said that the county is going to finance Cedar Beach dredging. for $35.,000.00? COUNCILMAN DRUM: There is at present before the Legislature, ..I. understand, today. There was a motion. made: I don' t know how the Legislature acted. I assume it went through, but they appropriated $35, 000. 00. Now, the County. will let a 'contract to do it. MRS. CONTE: Are they just going to dredge or .are' they going to put jetties out? COUNCILMAN DRUM: No, this;.is only concerning the dredging at this particular time, - SUPERVISOR PELL: Anybody else wish to address :the .Board? On motion of Councilman Drum, seconded by Councilman Murdock-, it was . RESOLVED that there being no further business to come before this Town Board meeting adjournment be called at 8: 35• P. M. Vote of the Town Board: Ayes: Councilman Murphy, Councilman . Murdock, Councilman Nickles, . Councilman Drum, Supervisor. Pell. This resolution -was declared duly adopted. udth T.. Terr y Town Clerk.
