SOUTHOLD TOWN BOARD
NOVEMBER 15, 1983
WORK SESSION
9:00 A.M. - The Board audited outstanding vouchers.
9:30 A.M. -- Began reviewing the agenda, and off agenda items.
11:55 A.M. - Recess for lunch.
2:45 P.M. - Board of Appeals Gerard Goehringer met with the Board to discuss
the proposed move of the Tax Receiver's Office, Building Department, Board of
Appeals and Town Clerk s Office. Executive Administrator Victor.tessard,
Assessors .Henry Moisa, Charles Watts, and Frederick Gordon were also present
during this discussion. Mr. Goehringer objected to the proposed locat[6n--of
the Board of Appeals office in the outer Building Department ottice, citing the
need for privacy for preparing minutes, decisions and meetings with attorneys
concerning litigation. He requested the Board to reconsider the location and
allow, the Board of Appeals to occupy the inner private office. As an alternate
suggestion Mr. Goehringer recommended the use of the map room in the Assessor's
office for the Board of Appeals. The Assessors objected, stating there would not
be room in their outer office for the maps.and would be very inconvenient to the
public and staff in the Assessor's office' ."-The Board personally surveyed the
layout of each office in question.--Councilman Nickles then recommended that the
Board of Appeals be permitted to occupy the inner office of the Building Depart-
ment (now the inner office of the Tax Receiver), stating that when Executive
Administrator Lessard was hired it was for the purpose of directly overseeing
the Building Inspectors and this can best be accomplished by his being in the
outer office where they are situated. Councilman Townsend concurred with this
recommendation.--Due to the time (3:00 P.M.) the Board will recess their public
meeting and meet later in the afternoon with Mr. Goehringer to further discuss
the move.
REGULAR MEETING
A Regular Meeting of the Southold Town Board was held on Tuesday,
November 15, 1983 at the Southold Town Hall, Main Road, Southold, New York.
Supervisor Pell opened the meeting at 3:00 P.M. with the Pledge of Allegiance
to the Flag.

RESOLVED that the following audited vouchers be and hereby are ordered paid;
General Fund Whole Town vouchers in the amount of $20,050.01; General Fund
Whole Town vouchers in the amount of $2,082. 94; General Fund Part Town vouchers
in the amount of $7,228.22; Highway Department vouchers in the amount of
$4,461. 45; Federal Revenue Sharing vouchers in the amount of $1,410.00; Land-
fill Building & Equipment 183 Capital Account vouchers in the amount of $765.26.

This resolution was declared duly ADOPTED.

RESOLVED that the minutes of the November 1, 1983 and November 9, 1983
regular meetings oft the Southold Town Board are hereby approved.

COUNCILMAN TOWNSEND: I'm trying to coordinate a fund-raising drive for.
the Town Nutrition Program located in Greenport, with Venetia McKeighan, who
is the director. Our plan is to contact the service organizations and get them
to, schedule a couple of meetings at the Nutrition Center to see how it runs,' and
also help augment the funding of the program. That's all 1 have.
SUPERVISOR PELL: Thank you. Councilman Nickles?
COUNCILMAN NICKLES: Nothing.
SUPERVISOR PELL: Councilman Murphy?
COUNCILMAN MURPHY: Just that the seed clams--I was talking to Paul Flagg
this morning and the seed clams are being harvested with our temporary Bay
Constable, and the new one has worked with him also. The ones from last .year
have done tremendous, they are of legal size now and very good quality, and
they are in the process of transplanting these now. The ones from this year
have shown equally as good growth. We will be getting a final report within a
couple of weeks I imagine.
SUPERVISOR PELL: Thank you. Judge Edwards?
JUSTICE EDWARDS: Nothing.
SUPERVISOR PELL: The only thing I'd like to report of interest is that on
Thursday of this week we have someone coming down from Cablevision Commission
in Albany to meet with the five East End Towns and village mayors to go over
our service we are receiving. We are still working on that as a unit.
Also, on the Board of Assessment Review, Samuel A. Manarel's term expires
January 9th. The Board would like to have resumes in to the Town Clerk by
December 30th of this year so the new Board can make the appointment. Also
on the Board of Housing Appeals, the position held by John Talbot, also expires.
Again have the resumes in by the 30th of December. The new Board will make
the appointment.
II. PUBLIC NOTICES.
COUNCILMAN MURPHY: 1. Notice of Complete Application of Joseph Grasso ,
Meadow Lane, East Meadow, for Freshwater Wetlands Permit, located in the Town
of Southold, to construct a one family dwelling with 31 ft. setback. Project site
is on a lot with Suffolk County Tax Map Number 1000-59-6-3, north side of Sound
View Avenue, north and west of "Hope Lane" between lands now or formerly Oliver
and Tsontakis, Southold. Comments to the New York State DEC, Dan Larkin, by
November 25th. This is posted on the To Clerk's Bulletin Board.
2. Notice of Complete Application of Southold Bay Haven Property Owners
Association, Inc. , Tidal Wetlands, Protection of Waters, Water Quality Permit, to
construct a 65 ft. low profile timber jetty leading from the timber bulkhead located
at the southwest corner of the property. Jetty will be approximately 4 ft. above
grade of each. After construction of jetty, beach area between mean high water
and bulkhead will be filled with 300 cubic yards of clean sand from an approved
upland source. Project is locasted on Watersedge Way, Peconic Bay, Southold.
Comments to New York State DEC, Dan Larkin, by November 25th. Again, this
is posted on the Town Clerk's Bulletin Board.

3. Notice of Complete Application 'of Anthony Gambino, Deep Hole Drive,
Mattituck, Tidal Wetlands, to construct a 30 ft. by 50 ft. single family dwelling
plus attached decks a minimum of 60 ft. landward of the high marsh. Requests
a variance from the minimum setback requirements of the Tidal Wetlands Land Use
Regulations. Install a sanitary system a minimum of 100 ft. landward of the high
marsh. Project is located on a right-of-way approximately 1418 feet east of
Marratooka Road, Deep Hole Creek, Mattituck. New York State DEC is the lead
agency. Comments to Dan Larkin at Stony Brook by November 25th. Again this
is posted on the Town Clerk's Bulletin Board.
4. Corps of Army Engineers public notice on the application of Katherine
Farr, P. O. Box 568, Greenport, to bulkhead, dredge, place fill material and
i stall all a float at Sterling Creek, Shelter Island Sound, Manhasset Avenue,
Greenport. Any comments regarding this permit must be prepared in writing
and mailed to reach this office before the expiration date of this notice, which
is the 5th of December, 1983. This has to be mailed in "to the Corps of Engineers.
Again this is posted on the Town' Clerk's Bulletin Board.
III. COMMUNICATIONS.
SUPERVISOR PELL: 1. A copy of the Riverhead franchise which Riverhead Town
did sign with Long Island Cablevision. It is being reviewed by the Commissioner
of New York State right now and he will bring us up to date with what's good and
what's bad with it when he comes down here on Thursday. It is interesting to
note that it's going to be a 25 channel outfit, $13.00 per month is the monthly
charge, but if you subscribe to the optional ones which will be about $11. 00
per month you could be up a lot higher, depends on how many you want to
subscribe to. There is about twelve option channels you can subscribe to, like
Spotlight, Homebox, Sports, etc.
2. This is going to be gone over by our Building Department. It's on the
Uniform Fire Prevention and Building Code which goes into effect January 1, 1984.
Mr. Lessard will report to the Town Board on its enactment.
3. An invitation to sit down with -.the -DEC attorney on the update of our
sanitation department at our Landfill, scheduled for the end of this month in
Stony Brook. The Town Board will have representatives there.
4. Again is upgrading our Landfill from the DEC, which we have to comply
with, and in order to keep our 360 Permit.
5. Letter from the Department of Transportation saying they have granted
the' Sunrise Coach Lines a temporary certificate for one year to run a bus until
October 1st, 1984, from Greenport to the City of New York, Big Apple.
IV: PUBLIC HEARINGS.
SUPERVISOR PELL: We have five public hearings scheduled for this'time:
3:30 P.M. - proposed "Local Law to amend the Southold Town Code in
relation to fees."
3:32 P.M. - Wetland application of The Land Use Company, on behalf
of Maureen Sullivan.
3:35 P.M. - Wetland application of The Land Use Company, on behalf of
Wilhelm Franken.
3:37 P.M. - Wetland application of Ron Dobert.
3:40 P.M. - Wetland application of Michael J. Hall, Attorney, for Frank and
Margaret Rosenberg.
Moved by Supervisor Pell, seconded by Councilman Nickles, it was
RESOLVED that a recess be called at this time, 3:30 P.M. , for the length
of time it takes to conduct five public hearings..

Meeting reconvened at 3:45 P.M.
1. Moved by Councilman Murphy, seconded by Councilman Nickles, it was
RESOLVED that the Town Board of the Town of Southold hereby appoints
Martin H. Carrell a member of the Southold Town Conservation Advisory
Council, to fill the unexpired term of John Plock, Sr. , effective October
18, 1983 through May 6, 1985.

2. Moved by Councilman Nickles, seconded by Justice Edwards,
WHEREAS, The Land Use Company, on behalf of Ernest Wilsberg, applied to
the Southold Town Board for a permit under the provisions o t e Wetland
Ordinance of the Town of Southold, application dated August 3, 1983, and
WHEREAS, said application was referred to the Southold Town Trustees and
Southold Town Conservation Advisory Council for their findings and recommen-
dations, and

WHEREAS, a public hearing was held by the Town Board with respect to said
application on the 1st day of November, 1983, at which time all interested
persons were given an opportunity to be heard, now, therefore, be it
RESOLVED that The Land Use Company on behalf of Ernest Wilsberg be
granted permission under the provisions of the Wetland Ordinance of the
Town of Southold to construct bulkhead and maintenance dredge in front of
existing bulkhead, boat basin and new bulkhead and place spoil behind the
bulkhead, at Ole Jule Road, on dredged canal east of James Creek, Mattituck,
New York. This permit shall expire on November 1, 1984 if work has not
commenced by said date; there shall be two inspections required; and the Town
Clerk shall be notified when the project is completed.
Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend,
Councilman Murphy, Councilman Nickles, Supervisor Pell.

WHEREAS, a proposed Local Law No. 12 - 1983 was introduced at a meeting
of this Board held on the 4th day of October, 1983, and

to be heard thereon, now, therefore, be it _
RESOLVED that Local Law No. 12 - 1983 be enacted as follows:
LOCAL LAW NO. 1 1983
A .Local Law to Regulate the
O-Oer-ation of Unlicensed
Motor-Driven Vehicles
BE IT ENACTED by the Town Board of the Town of Southold as
follows:
The Code of the Town of Southold is hereby amended by adding
thereto a new Chapter, to be Chapter 89 to read as follows:
Section 89-1. Title
•
This Chapter shall be known as the "Unlicensed Motor-Driven
Vehicle Law of the Town of Southold".
Section 89-2. Purpose
The Town Board of the Town of Southold recognizes -the
potential adverse impact on the health, Safety and general welfare of the
residents of Southold and to property within the town by the use of
unlicensed motor-driven vehicles and, therefore, deem it appropriate to
control the use of said vehicles. ,
Section 89-3. Definitions
For the purposes of this Chapter, the following terms shall
have the meanings indicated:
PUBLIC PROPERTY - All streets, sidewalks, easements or any
other areas dedicated or commonly used by the public.
UNLICENSED MOTOR-DRIVEN VEHICLE - Any type of .
unlicensed motor-driven vehicle or conveyance, including but
not necessarily limited to snowmobiles., two-wheeled motor
vehicles known as "trail bikes" and "motor scooters", , and
four-wheeled motor vehicles commonly known as "go-carts" or
"all-terrain vehicles."
Section 89-4." Operation on town property prohibited.
It shall be unlawful for any person to operate any unlicensed motor-
driven vehicle upon any property owned or leased by the Town of
Southold.
Section 89-5. Operation on private property restricted.
The operation of an unlicensed motor-driven vehicle is
prohibited upon private property unless the operator of said unlicensed
motor-driven vehicle has with him and presents written permission of the'
owner of said private property to operate said vehicle on said property.
Section 89-6. Exceptions.
The provisions of. this Chapter shall not affect or prohibit the
following:

(1) The operation of any unlicensed motor-driven vehicle by. an
officer or employee of the Town of Southold, or any School
District, Park District, or other Public Improvement
Districts within the Town of Southold, while being operated
by such officer or -employee within the scope of his
employment.
(2) The use and operation of golf carts.
(3) The use and operation of motor-driven wheelchairs.
Section 89-7. Responsibilities of parents or guardians.
It shall be unlawful for the, parent, guardian or any person
having the care, custody and control of any child under the age of sixteen
(16) years knowingly to permit such child to operate an unlicensed
motor-driven vehicle in violation of the terms of this Chapter.
Section 89-8. Notice of violation to parents or guardians.
Whenever any child under the age of sixteen (16) years is
alleged to have violated this Chapter, his parent, guardian or any person
having the care, custody or control of the child shall be notified by the
Chief of Police or any person designated by him to give such notice.
Section 89.9. Impoundment of vehicles in violation.
The police shall immediately impound any unlicensed
motor-driven vehicle operated in violation of this Chapter. The unlicensed
motor-driven vehicle shall be returned upon payment of the fine or upon
direction of the court.
Section 89-10. Penalties for offenses.
Any operator or parent, as defined in Section .89-7, who shall .
violate any of the provisions of this Chapter shall, upon conviction thereof,
be sentenced to a fine not exceeding two hundred fifty dollars ($250. 00) .
Section 89-11. Conflicts with State Law.
Should any section or portion of this Chapter be in conflict
with the Laws of the State of New York applicable to the operation,
registration, ownership or control of unlicensed motor vehicles, then in that
instance said laws of the State of New York shall prevail.
Section 89-12. Severability.
The provisions of this Chapter are declared to be severable;
and if any section, subsection, sentence, clause or phrase hereof shall, for
any reason, be held to be invalid`or unconstitutional, such decision shall
not affect the validity of the remaining sections, subsections, sentences,
clauses and phrases of •.this Chapter, but they shall remain in effect, it
being the legislative intent that this Chapter shall stand notwithstanding
the invalidity of any part thereof.
Section 89-13. When effective.
This Local Law shall take effect immediately.

SUPERVISOR PELL: Number 4 we're not going to act on at this time (decision
on Daniel Silverman Wetland Application.)
5. RESOLVED that pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section 617. 10 and
Chapter 44 of the Code of the Town of Southold, notice is hereby given that
the Southold Town Board, as lead agency for the action described below, has
determined. that the project, which is unlisted, will not have a significant effect
on the environment.
Description of Action: Application of The Land Use Company, on behalf of Peter
Micciche for aWetland Permit to construct bulkhead and ramp on Corey Creek, at
private road off Bayview Road, Southold, New York.
The project has been determined not to have a significant effect on the
environment for the following reasons:
An environmental assessment has been submitted which indicated that no
significant adverse effect to the environment are likely to occur should the
project be implemented as planned.

Because there has been a response from the Board of Southold Town Trustees
and Southold Town Conservation Advisory Council indicating that this project
would not have a significant effect on the environment.
Because there has been no response in the allotted time from the New York
State Department of Environmental Conservation and the Southold Town Building
Department, it is assumed that there are no objections nor comments from those
agencies.

Councilman Murphy, Councilman Nickles, Supervisor Pell.

6. Moved by Councilman Murphy, seconded by Justice Edwards,
RESOLVED that pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section 617. 10 and
Chapter 44 of the Code of the Town of Southold, notice is hereby given that
the Southold Town Board, as lead agency for the action described below, has
determined that the project, which is unlisted, will not have a significant effect
on the environment.
Description of Action: Application of Frederick Falconer for a Wetland Permit
to maintenance dredge on East ree , 'on the north side of FleetwoodRoad,
Cutchogue, New York.
The project has been determined not to have a significant effect on the
environment for the following reasons:
An environmental assessment has been submitted which indicated that no
significant adverse effect to the environment are likely to occur should the
project be implemented as planned.
Because there has been a response from the Board of Southold Town Trustees
and Southold Town Conservation Advisory Council indicating that this project
would not have a significant effect on the environment.
Because there has been no response in the allotted time from the New York
State Department of Environmental Conservation and the Southold Town Building
Department, it is assumed that there are no objections nor comments from those
agencies.

RESOLVED that the Town Board of the Town of Southold hereby sets Tuesday,
November 29, 1983, Southold Town Hall, Main Road, Southold, New York, as
date and place for public hearings on the following Wetland Applications:
3:30 P.M. .- in the matter of the application of The Land Use Company, on
behalf of Peter Micciche, for a permit under the provisions of the Wetland Ordin-
ance of the Town of Southold to construct:bulkhead and ramp on Corey -Creek,
at private road off Bayview Road, Southold, New York.
3:32 P.M. - in the matter of the application of Frederick Falconer for a
permit under the provisions of the Wetland Ordinance of the Town of Southold
to maintenance dredge at East Creek, on the north side of Fleetwood Road,
Cutchogue, New York.

WHEREAS, Alfred E. and Claire Bouffard, by petition dated July 21, 1983,
applied to the Town Board of the Town of Southold for a change of zone on
certain property situated at Mattituck, New York, from "B" Light Business
District to "C" Light Industrial District, and
WHEREAS, the said petition was referred to the Southold Town Planning Board
and Suffolk County Department of Planning for official recommendations and
report, and
WHEREAS, the Town Board, pursuant to due notice, held a public hearing
thereon on the 1st day of November, 1983, at 8: 15' P.M., at which time all
interested persons were given an opportunity to be heard, now, therefore,
be it

RESOLVED that the Town Board of the Town of Southold hereby recommends
to the Director of Fire Safety for the County of Suffolk that the following
individuals serve as Deputy .Fire Coordinators within the Town of Southold
for the 1984 calendar year:

10. -Moved by Justice Edwards, seconded by Councilman Nickles, it was
RESOLVED that the Southold Town Board declares itself lead agency in
regard to the State Environmental Quality Review Act in the matter of the
application of Grace A. Finora for a Wetland Permit on certain property
located .on James Creek, on the east side of East Legion Avenue, Mattituck,
New York.
Vote of the Town Board: Ayes:- Justice`�Edwards, Councilman Townsend,
Councilman Murphy, Councilman Nickles, Supervisor Pell.
This resolution was declared duly ADOPTED.
11. Moved by Councilman Murphy, seconded by Councilman Nickles,
WHEREAS, it has been determined by the North Fork Water Supply Plan and
other studies that the amount of freshwater available in Southold Town is
limited by the narrowness of the peninsula and the surrounding bodies of
saltwater; and
WHEREAS, contamination by agricultural' pesticides and other contaminants

WHEREAS, the Water Advisory Committee has recommended to the Town Board
the establishment of a town office to oversee the town's groundwater resources;
and
WHEREAS, the Town of Southold recognizes the need to provide its residents
with a safe and reliable water supply; now, therefore, be it
RESOLVED that a Water Management Program be established with the respon-
sibilities of planning, administration and coordination of water supply activities
for Southold Town; and be it further
RESOLVED that the Water Management Program will investigage, design .and
implement an individual home filter program utilizing as guidelines the recommenda-
tions contained in the August 29, 1983 Report to the Southold Town Board of the
Water Advisory. Committee.

WHEREAS, Marine Associates, Inc. has heretofore filed a petition with the Town
Clerk, pursuant to Article XV of Chapter 100 of the Southold Town Code, for. a
Change of Zone on certain property at New Suffolk, in the Town of Southold,
from "C" Light Industrial District to "M-1" General Multiple Residence District, and
WHEREAS, pursuant to the provisions of Article 8 of the Environmental Conservation
Law, Part 617 of Title 6 of the New York State Codes, the Town Board, as lead
agency, determined that the action proposed is a Type 1 action and is likely to
have a significant effect on the environment, and
WHEREAS, the Town Clerk did file and circulate such determination.as .'required
by the aforementioned law, rules and code, and
WHEREAS, Marine Associates, Inc. did, upon request of the Town Board, cause
to be prepared and filed a Draft Environmental Impact Statement, all in accord-
ance with said law, rules and code, and
WHEREAS, the Town Board of the Town of Southold held a public hearing._on the
Draft Environmental Impact Statement submitted by Marine Associates, Inc: at the
Southold Town Hall on November 1, 1983, at which time all interested persons were .
given an opportunity to be speak, now, therefore, be it
RESOLVED that the Town Board of the Town of Southold does hereby determine
that the action proposed is likely to have a significant effect on the environment,

RESOLVED that the Town Clerk immediately notify the applicant, Marine Associates,
Inc. of this determination, and further:request said applicant to prepare a Final.
Environmental Impact Statement, all in accordance with said law, rules and code.-
within sixty days from the date of this resolution.

Amended Preliminary Budget as the Annual Budget of this Town for the fiscal year ,
beginning on the 1st day of January, 1984, and that such budget -as so adopted by
this Board be entered in detail in the minutes of the proceedings of this Town Board,

RESOLVED that the Town Clerk of the Town of Southold shall prepare and certify,

proposal of Krieger Well & Pump Corp. to install well, pump and necessary
miscellaneous fittings at the Southold Town Landfill Site, Cutchogue, New York,
at a cost of $4,789.00, with the provision that trenching and additional, well
depth would be an additional charge as specified in said proposal dated
November 14, 1983.

The Code of the Town of Southold is hereby amended as follows:

I. Section 46-15 of said Code (Flood Damage Prevention Law of the Town
of Southold) is amended by adding :thereto a new subdivision; to be _
subdivision E, to read as follows:
E All applications to the Board of Appeals for any relief
provided for in this Chapter shall be accompanied.-by a fee
of fifty ($50.) dollars.
11. Section 69-105 of Chapter 69 of said Code (Peddling and Soliciting)
is hereby amended to read as follows:
Section 69-105. License fees.
The fee for each license issued pursuant to this Article
• shall be [twenty-five ($25.)] fifty dollars ($50.) per year or
ten dollars ($10.) per day or fraction thereof.
III. Subdivision A of Section 77-203 of Chapter 77 of said Code
(Shellfish) is hereby amended to read as follows:
A. The fee for a commercial shellfish permit shall be [five
dollars ($5.) . Effective on an after January 1, 1983, the
fee for a commercial shellfish permit shall be] fifteen --

A Every application for a permit filed with the Town Clerk

refundable.
V. Section 1.00-124 of Chapter 100 of said Code (Zoning) is hereby
amended to read as follows:
All applications to the Board of Appeals for any relief herein shall

V1. Section 100-135 of Chapter 100 of said Code (Zoning) is hereby
amended to read as follows:

WHEREAS, a public hearing was held by the Town Board with respect to said

RESOLVED that The Land Use Company, on behalf of Maureeen Sullivan, be
granted permission under the provisions of the Wetland Ordinance of the Town
of Southold to construct ramp, float, and two (2) spiles on Cedar Beach Inlet,

RESOLVED that The Land Use Company, on behalf of Wilhelm Franken, be
granted permission under the provisions of the Wetland Ordinance of the Town
of Southold to construct bulkhead, dredge, and fill at Gull Pond, on Snug Harbor
Road, Greenport, New York, provided a minimum of 1000 square feet of intertidal
marsh shall be planted, and 17 ft. of .timber bulkhead located on the eastern edge
of the structure shall be removed, all as provided for under New York State
Department of Environmental Conservation Stipulation Order dated October 2," 1983.
This permit shall expire on November 15, 1984 'if work has not commenced by said
date; there shall be two inspections required; and the Town Clerk shall be notified
when the project is completed.

COUNCILMAN NICKLES: I'd like to make one comment, and that's about last
Tuesday. I think the Board should be pleased that the people approved the
Farmland Preservation Bond proposition in the amount of 1,750,000.00, ,and I --
meant to bring this up at the Work Session, Bill, but with all the excitement
about moving furniture and offices it slipped my mind, but I think we ought
to reconvene the Farmland Committee and get them cracking on tightening
up their procedures and so forth, and arranging for getting bids and for
arranging to interview various appraisal companies that have familiarity with
this type of appraisal process.
SUPERVISOR PELL: I'll put it on the agenda for the 29th, and have something
all worked out with your help. Would anyone in the audience like to address
the Board
MRS. KATHLEEN GRASECK, North Bayview Road, Southold: Good afternoon
members of the Board. I'd like the members of the Board to reconsider
Resolution No. 3, enactment of Local Law No 12 1 feel that the public
hearing, a week ago, that you had on this law was unfair to have it at
3:00 P.M. in the afternoon when a lot of people who were interested in this
law were unable to attend, and I feel that we should be entitled to an evening
Town Board meeting to reconsider this law. It affects a lot of children in our
Town and I really think there should be some reconsideration before this law
is enacted. .Thank you.
SUPERVISOR PELL: Thank you. The law has been enacted by the Board. The
Board also has the power or the right at any time it sees fit to rescind it through
the proper channels.
COUNCILMAN MURPHY: Was there anything specific that you would want to
change--see changed in the law?
MRS. GRASECK: Yes. First of all I think the property owner handing out
letters of permission to everybody who wanted to use their land for the use
of these vehicles--to be writing out permission notes--the property owner isn't
going to do this type of thing. You know. I- think, you know, they're going
to worry about liability first of all. I think everybody is worried about those
things today, and a lot of property owners I know in my area, where their land
is undeveloped, know that the children use these lands for these purposes and
have never complained or said anything to any of these children. You know, I
don't know why this law was even brought about.
COUNCILMAN MURPHY: One of the main reasons was because of complaints of
property owners of people using their property illegally and the police not being
able to do anything about it.
MRS. GRASECK: But if a person posts their land, if they post their land and
then say, "This land is posted," isn't that trespassing?. Aren't we all--
COUNCILMAN MURPHY: Nobody has a right to walk on your land without your
permission.
MRS. GRASECK: That's right:, so if the land is posted wouldn't these--you know,
wouldn't their rights be, you know, protected?
COUNCILMAN MURPHY: Evidentally they weren't enough for the police department
to feel they had enough enforcement power to do this. Now we're putting the
burden on the people who--if you know somebody who wants to give your land to
use, a sandpit or something, and he wants to allow children, adults, whoever,
dirt bikes, whatever, to use it this is perfectly fine, but we've had the complaints
of the Town not doing anything because people, children, were abusing their
property, causing a lot of disturbance, noise disturbance, riding--a good example
is the Long Island Railroad right-of-way--riding dirt bikes up and down there.
Most annoying for people living near .there to hear this bike going back and forth
constantly. They might be having a party outside, they might be trying to go to
sleep. This is one of the main reasons. If somebody has a piece of property and
wants to grant permission, fine, there's .no hassle.
MRS. GRASECK: But that means that this person now has to legally give these
children a note in their pocket saying that they---
COUNCILMAN MURPHY: Sure.
MRS. GRASECK: If you owned that property, would you give a note?

MR. PHIL BARTH, Southold: I wouldn't, but I wouldn't want a kid riding there
on my property either.
SUPERVISOR PELL: All right, please address the chair up here.
. COUNCILMAN MURPHY: That was one of the reasons. If you have a suggestion
or a way to bring about this change--a change to amend this law to make it a
little more open, we would be happy to look into it, but the reason for the law
was that there was so many abuses of people's property by people who didn't
even know who. these people were using their bikes on their property, destroying
vegetation. We had it down at the Mattituck Park District. We had people going
on our,property completely destroying the vegetation, the beach grass, the plums,
the grown that's on the dunes and all, and this is one of the reasons for this
law. Puts a little more guts into the law, makes it a little bit more enforceable
so that' if the policeman is called that he has something to go by.
MRS. GRASECK: I .think it makes it very enforceable to the point that now any
of these children who have any of. these vehicles will be unable to use them.
SUPERVISOR PELL: Unless on authorized land.
MRS. GRASECK: Right, and where is the authorized land?
COUNCILMAN MURPHY: Technically you shouldn't be using it before either.
SUPERVISOR PELL: 1 live on two acres of land--my own house--and one day I
was out at a friend's house for a party, two summers ago, and the police traced
me down and I had a neighborhood--summertime it was--bikes were all over my
two acres of land ripping up--jumping my wife's flower bed and everything else.
I did get in my car and go home and had to find out whose kid it was and went
up to the house then. It was a nasty time, but they were on my personal land
with no permission.
MRS. GRASECK: But didn't you have your rights to, you know, enforce your---
SUPERVISOR PELL: I went right to the house and knocked on the door. Your
kid's on my land, keep him off. , But this is, as Frank says, if you have specifics
and would like to come in I'd be more than willing to sit down and review them
with you and see if an amendment is in order for the Board to consider--to the
law.
MRS. GRASECK: I would appreciate that.
SUPERVISOR PELL: Any time,
COUNCILMAN MURPHY: Maybe -a certain area in the Town could be set aside,
designated that way, under proper supervision and---.
MRS. GRASECK: With set hours.
COUNCILMAN MURPHY: Well, you can't go on somebody's land.
MRS. GRASECK: I was just saying, you know, if land would be set aside so
children could use the bikes in the afternoon.
COUNCILMAN MURPHY: We'll look into it. It would have to be public land,
maybe there is an ideal spot around somewhere. Maybe something could be
worked out, something with supervision so that the Town is not liable too great.
I realize it is a recreational need in the Town and 1 hate to take it away, but
you have to look at the people who were being abused also, who these bikes
had no right, really, being on their property. There are some spots and just
off the top of my head, maybe eventually when we do some work in the Landfill
on capping, maybe you could make some trails up there. Something like this
you could work out, but it will take cooperation of the people.
MRS. GRASECK: Okay, well, thank you.
SUPERVISOR PELL: Thank you, Mrs. Graseck. Anybody else wish to address
the Board? Mr. Frank Bear.
.. . MR. FRANK BEAR, Southold: I think that I can speak for all the members of
the Water Advisory Committee in expressing our appreciation for this first step
in establishing a Water Management Program and getting started on getting some-
thing go so ar as individual wells are concerned, and we're looking forward to
an opportunity to work with the Town Board in proceeding from this point on,
Petting someone in charge of it and getting moving on it. We're very happy

we got the line item in the budget and are willing to go.
SUPERVISOR PELL: Step two, Frank. Line item in the budget was first,

Mrs. Jean Tiedke.
MRS. JEAN TIEDKE, Southold: Having been deeply involved in the passage of
the Wetland Ordinance, what twelve years ago?--approximately, I am a little
appalled that there were fifteen Wetland items on just today's agenda, some of
which you still have to act upon, the _rest of which were all passed, only two,
believe, ,with any real restrictions. But, I do wonder how much more bulk- .
heading our creeks can take. Those that are already bulkheaded--Gull Pond
is a lost cause, I'm sure of that. There are a couple of others that are probably
lost causes, but there are still many that are not and that's where the catwalks
and that sort of thing is ideal to be built there.
SUPERVISOR PELL: Thank you. Mr. Townsend?
COUNCILMAN TOWNSEND: I'd just like to respond a little bit to that, because
it's a question that I won't say I agonize, but I gave considerable thought to.
You see these-things come. up over and over again- and there are things you get
to look at, and others you don't. I can only say that the Town Trustees, in
general, and the Conservation Advisory Council, .are the Boards that do the
-research on this. Generally they make a recommendation that involves preserving
as much of the wetlands, as you well know. If there is bulkhea ing to be' .done--
a lot of these things--bulkheading that is behind the wetlands, and then you have
a catwalk that goes up past the wetlands to a dock. I find that we've got a
Board of. Trustees that is very cognizant .of the issues that you're talking about
and that's .why these things are approved. Our job is to allow people to make as
much use of their property as they can and be consistent with preserving the
breeding grounds for the aquatic life and flora, marine flora, that we. can do,
and that's the only thing we can do. You cannot, for no reason, deny somebody
the use of his property.
MRS. TIEDKE: No, but you can make sure that the bulkheads are up above high
tide line, so that they do preserve the fish.
COUNCILMAN TOWNSEND: I think that's what Paul Stoutenburgh and his crew--.
MRS. TIEDKE: 'They are. I want to compliment you on your choice for the'
Advisory Council also.
SUPERVISOR PELL: Thank you. Mrs. Ruth Oliva.
MRS. RUTH OLIVA, President, North Fork Environmental Council: I just want
to Jean, really. The Trustee policy, and I'd say, having been at just about
all the Trustee meetings, 1'd say 95% of the bulkheading that is done is really
replacement :bulkheading, .or really to prevent an erosion pro em on a of o
these dredged canals, and any new bulkheading is not allowed. The only type
of structure that is allowed is a retaining wall that is placed above the high water
mark and as far back as possible, especially if there is any grasses concerned
at all, so it is really just a retaining wall, but they have been very very strict
about allowing any new bulkheading at all.
SUPERVISOR PELL: I'd like to comment on this, if I could, before we. close
the meeting. Sunday I was down in Gull Pond looking at some of these permits
and one of the fellows who had to put his bulkhead behind the grass, or some-
thing, was up one side of.me and down the other side of me. He wanted to know
why he had to put the bulkhead back there, why it couldn't be out there. If
there is nothing else, I'd like to recess this meeting.

WORK .SESSION.
4:35 P.M. - The Board met with Mr. Sam McLendon of Holzmacher, McLendon &
Murrell, P.C. and residents of the Captain Kidd area to discuss the Engineering
Report for the proposed Captain Kidd Water District. Mrs. Cleo Tsounis, a
member of the Board of Directors of the Captain Kidd Estates Civic Association
thanked the Board for initiating the feasibility study and suggested that at this
time the County should begin helping the residents with the water problem. Mr.
Don Cooper said their farm, which is in the Town Agricultural District, is included
'in the water district and he does not feel it should be, and is quite sure they
would be exempt from taxes. It was pointed out that the Mattituck Park District
property is in the proposed district and would be taxes. Mrs. Lydia Totora ques-
tioned whether the Stanley Road well was tested.- She was advised it was and
quite a few private wells were also tested and no pesticides or organics were
detected. Mrs. Totora said she was mainly concerned about future contamination
at the well site, to which Mr. McLendon responded that he does not see such.a
problem. Mrs. Andrea Pappas and Mrs. George Lomaga also addressed the Board
questioning the cost to the district. residents if it were established. Mr. James
Monsell, Superintendent of Public Works for the�Village of Greenport, said he has
had communications from Legislator Blass who has suggested the Village begin
making applications for grant monies to put the system into good order. Mr.
Steve Tsontakis, General Manager and President' of the Captain Kidd Water
Company cited the history of monitoring the public water.supply wells. He
alleged that private wells go bad after seven or eight years and have to be
replaced- arid private wells are more costly than public water supply. Most of
the residents of the proposed districts disagreed with this theory. He stressed
that he is unable to operate the company and bring it up to standards, and the
only option is for the municipality to absorb the company.--At the conclusion
of the meeting, Supervisor Pell asked those present to give the Town Board six
weeks to do the necessary research to determine if public funding would be
available to purchase and upgrade the ,system.
5:25 P.M. - The Board again' met with Board of Appeals Chairman Goehringer
to further discuss the departmental moves. Councilman .Nickles reiterated his
suggestion that the Board be permitted to occupy the Tax Receiver's private
office .and the entire Building Department occupy the outer Tax Receiver's
office.--Councilman Townsend said that after an inspection of the facility, he
would suggest that sometime in 1984.consideration be given to expanding the
southwest corner of the room to provide a. private office for Executive Admin-
istrator Lessard.

Receiver.
The Zoning Board of Appeals will move into the inner office of the
Tax Receiver.
The Tax Receiver's Office will move'into the inner and outer offices of
the Town Clerk.
The Town Clerk's Office will,move into the Building Department and
Zoning Board of Appeals Offices.
