Please allow these photographs to supplement the photographs previously submitted with the permit application. Photographs 1. through 5. depict the footing and post on the north side of the portico.As indicated in photos 3-5, a footing had been placed during the original construction of the.patio. The post rests squarely on top of the footing at the corner of the paving stone. Photographs 6. through 10. depict the footing with rebar which is 36 inches deep and the post on the south side.of the portico. The post rests squarely on top of the footing in the center of the paving stone close to the next row of paving stones. Photographs 1, 2, 6 and 7 show the hurricane strapping that was installed as per the plans. Picture 11 depicts the posts as installed prior to finishing with an Azek wrap. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 13,081 square foot parcel located in an R-40 Zoning District. The parcel has two front yards,runs 106.05 feet on along South Street, runs 125.00 feet along Gagen's Landing Road, runs 115.33 feet on the West side and 112.62 feet on the South side. The parcel is improved with a one-story house, a covered slate patio, a composite stoop and steps, a below ground pool, and pool equipment. All is shown on a survey by Ralph Neil L.L.S. dated June 23,2023. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's January 12, 2024, Notice of Disapproval based on an application for a permit to legalize an "as built" roofed over on grade patio addition attached to an existing single-family dwelling; at; 1) located less than the code required minimum rear yard setback of 35 feet; located at: 60 Gagens Landing Road, Southold,Peconic,NY. SCTM No. 1000-70-10-16. RELIEF REQUESTED: The applicant requests a variance to legalize an "as built" roofed over on-grade patio addition attached to an existing single-family dwelling with a rear yard setback of 27.6 feet,where town code requires a minimum rear yard setback of 35 feet. ADDITIONAL INFORMATION: The applicant testified that the new covered patio was built to replace an old aluminum roof that previously existed on the rear of the house. However, without a survey, it is impossible to tell if the old aluminum structure had a pre-existing non-conforming rear yard setback similar to what the applicant is applying for in this application. Page 2,April 18,2024 #7895,Vella SCTM No. 1000-70-10-16 A Stop Work Order was issued April 7, 2023 to the property owner for work being done without first obtaining a Building Permit. The neighbor residing on the property adjacent to the applicant's rear yard wrote a letter of support for the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 4,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a residential neighborhood consisting of single-family homes. Covered patios are common in residential neighborhoods. The construction of a new covered patio in-the rear will not have any visual impact on the street or adjacent properties because the rear yard is totally screened by a high solid vinyl fence and very large evergreens on the neighbor property abutting the fence and the house blocks the structure for the street view.Therefore,there will be no change in the character of the neighborhood. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing rear yard setback of the dwelling is 42.3 feet. The applicant could build a 7.3 feet long covered patio off the rear of the house and conform to code. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 21%relief from the code. However, the property line has substantial vegetative screening and the covered patio is an open-air structure that will not be enclosed. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this, residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law U67-b(3)(b)(5). The difficulty has been self-created. The applicant started the work without applying for a building permit. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered patio while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
