TOWN BOARD DECEMBER 21, 1982 WORK- SESSION 8: 30 A.M. —Audit of outstanding vouchers . 9: 00 A.M. - Harold Dombeck of Ho zmacher , McLendon & Murrell , P.C. , and Doug Neilson of Wehran Engineering Corp. met 'with the Board to discuss Wehran ' s proposal to burn the methane gase at the landfill site, generate electricity , sell it to LILCO and the Town would receive approximately $30,000 in revenue a year from the operation. The project would only require the installation of a trailer at the site by 'Wehran Engineering. He presently has contracts in Smithtown, Brookhaven and Huntington. Board members will inspect the Smithtown site which is scheduled to open in January, and Mr. Neilson will submit a sample contract to Town Attorney Tasker for him to study. 9: 30 A.M. - The Board began reviewing the agenda. ' 10: 00 A.M. - Reverend Coleman of St . Peter' s Lutheran Church met with the Board to discuss the possibility of San Simeon by the Sound purchas- ing fill from the proposed drainage sump on Route 48. Reverend Coleman was advised that the Town is getting- the fill from the sump and it is being transported to the landfill site. This was a condition of the bid proposals and contract put forth by the County of Suffolk, which stated the fill must be used for municipal purposes , which is capping the landfill. He was advised that any change in the contract would be illegal . 10:20 A.M. - Jon Richmond of the Plum Island Animal Disease Laboratory met with the Board to brief them on the proposed change in services to that agency. Under Office of Management and Budget A76 Guidelines the government should not undertake jobs which can be done by the private sector. Under the commercial/industrial area outside of the laboratories bids are being sought to contract out maintenance, clerical , safety , etc. Permanent employees in the categories to be contracted, if needed by the contractors , will be offered first refusal of a position. Final decision on contractors will be made in June or July of 1983. 11 : 00 A.M. - The Board resumed reviewing the agenda. 11 :15 A.M. - James McMahon , Community Development. Director, met .with the Board to bring them up to date on community development grant fund projects. 11: 30 A.M. - Ms. Jody Adams met with the Board to discuss her letter of December 21 , 1982 concerning police procedures as related to the Town Board. Ms. Adams had prepared a lengthy presentation, which was typewritten, and .preferred the Board members read it .before discussing it with them. She will make an appointment for another meeting with the Board at a later date. (Chief Winters was present during this appointment with Ms. Adams. ) 11:40 A.M. - The Board resumed reviewing the agenda. 12: 10 P.M. - Recess for lunch. 1: 30 P.M. - Work Session reconvened. 1: 35 P.M. - Mrs . Cleo Tsounis and a .group of residents from Captain Kidd 'Estates met with the -Board to discuss the water problem. Mrs. Tsounis presented the Board with petitions containing 113 signatures requesting the Town Board to conduct a feasibility study for the purchase of the Captain Kidd Water Company and the establishment of a public water supply district . The Board agreed to take the first steps toward the establishment of such a district by directing Super- visor Pell to request Holzmacher , McLendon & Murrell , P.C. ., ERM- Northeast, and Peconic Associates to appear at the December 28th work session with engineering proposals for the feasibility study. 391 DECEMBER, 21, 1982 1': 50 P.M. - The Board continued reviewing the agenda. 2: 05 P.M. - Receiver of Taxes George Mellas met with the Board -to explain his procedures for publishing the tax rate information to the public. Mr. Mellas stated he has followed previous .procedures' in placing this notice several times in both local newspapers. He was advised there is a resolution on the agenda directing him to place this notice only once in each newspaper. 2: 15 P.M. - Henry Raynor, Jr. , Chairman of the Southold Town Planning Board discussed the Planning Board' s proposal for a public referendum to create a preservation trust fund for farmland and open space preservation in the Town of Southold. Mr. Raynor has discussed this concept with Suffolk County Director of Planning Lee Koppelman and he is in agreement with it . On the recommendation of Councilman Nickles , a resolution was placed on the regula.r' meeting agenda to request County Executive Cohalan to make arrangements for the re- appr4isal of those properties which have been, submitted for purchase of development rights under the Phase II County Farmlands Preservation Program------Mr. Raynor discussed the input he has received toward gathering data for updating the Master Plan. 2": 30 P.M. - Supervisor Pell raised the question of the necessity for a resolution to encumber funds. Town Attorney Tasker advised Mr. Pell that a resolution was not necesssary , it is his duty as. Chief Fiscal Officer of .the . Town to encumber the necessary funds. 2: 35 P.M. - Supervisor Pell submitted to the Board a proposed resolution calling for the enactment of a six month moratorium on new subdivision applications. He said he would like it studied and comments of the Board submitted. This resolution will be on the January 4th or 18th agenda. 2: 40 P.M. - The Board resumed reviewing the agenda. REGULAR MEETING 3: 00 P:! M. A Regular Meeting of the Southold Town Board was held on Tuesday , December 21, 1982 at the Southold Town Hall , Main Road, Southold, New York. Supervisor Pell opened the meeting at 3: 00 P.M. with the Pledge of Allegiance to the Flag. Present : Supervisor William R. Pell , III Councilman John J. Nickles Councilman Lawrence Murdock, Jr. Councilman Francis J. Murphy Councilman Joseph L. Townsend, Jr. Justice Raymond W. Edwards Town Clerk Judith T. Terry . Town Attorney Robert W. Tasker Moved by Councilman Nickles, seconded by Justice Edwards , it was RESOLVED that the following audited bills be and hereby are ordered paid: General Fund Whole Town bills in the amount of $26 ,737. 25; General Fund Part Town bills in the amount of $10,543.18; Highway Department bills in the amount of $11,712. 34; Consolidated Highway Program (CHIPS) bills in the amount of $1 ,496 . 30; Fishers Island Ferry District bills in the amount of $4 , 066 . 80; Home Aide Program bills in the amount of $114. 51 . (Nothing at this time. ) Councilman Murdock? COUNCILMAN MURDOCK: Southold Town Youth Projection had a Christmas party at the Youth Center. There was roughly 500 children in attend- ance. The program seems to be growing and getting good attention and we look forward to a bigger year. Thank you. SUPERVISOR PELL: Councilman Nickles? COUNCILMAN NICKLES: Nothing to report other than I understand that Santa Claus is loading up his sleigh. One of his elves is here in the audience and if you don ' t run off you might `get an early Christmas present . SUPERVISOR PELL: Councilman Murphy? (No report . ) Judge Edwards? (Nothing from the east. ) For information sake the only thing I have to report , and I thought Frank was going to do it , is the five East End Town Supervisor' s met the other day, Frank went in my place, and they are all having problems with Cablevision like we have been in Southold Town.- We have requested a hearing before the Public Service Cablevision Committee in Albany. The other towns are about a year behind us of going down the path of all the things you have to do . We .were quite amazed that we were that far along, but Southampton--villages are involved and I think it is going to be quite an interesting Cablevision year. Everybody is complaining to the State about them. II . PUBLIC NOTICES. 1 . Emanuel Xefos by James Rogers to construct a sundeck attached to landward side of bulkhead at East Marion. Response date to the N.Y.S. -D.E.C. is December 31 , 1982. This is on file in the Town Clerk' s Office. III . COMMUNICATIONS. SUPERVISOR PELL: : We have 11 communications that we put on the agenda today. The Board has directed me to reply to the majority of them. 1. From William Timm and Associates in regard to the building up on- Peconic Lane - certain recommendations to be done up there. It will be gone over with our Clerk of the Works up there Lyle Meredith, and our Building Department to see what should be done. 2. Letter from the Chairman of the Zoning Board of Appeals in regard to legal notices put in the paper and suggested that they were put in there in error or not put. in and had to be reput in and we will adjust the bills accordingly ., ,, 393 DECEMBER 21, 1982 3. From William Hamilton for support to maintain the Riverhead Post Office Center , not the post office itself , just the distribution post office--support keeping it in Riverhead and not moving it to . Hicksville or down west . In fact , I 've even got a bumper sticker here, it says , "Save The Riverhead Mail Center" . I 'm going to put it right here on the dais. 4. From Reverend William Coleman of St . Peter' s Lutheran Church requesting the Town for some fill on the land down there where they ' re going to build their retirement community. That will be responded to by the County. - 5. A letter from the Farm Bureau informing us, and. something that our Assessors already do, that .there is a program of continuing educati on assessment of farmland. We passed that on to the Assessors but they already are aware of it . 6.. Letter from County Executive Cohalan in response to a 1etter'"�,y. ' sent him on November 3rd in support of the Riverhead Court Complex to stay in Riverhead. He informs us that he did sign a law to maintain that . . 7. Letter from the Trustees requesting that we do several things, and one of the things that they did request us to do is put a fact sheet for when somebody comes in . and gets their shellfish license, to have a fact sheet basically of the laws of the Town of Southold regulating our bottom land--underwater land, which the Tow. Clerk is going to look into. 8'. Draft report from ERM, the consulting firm from Plainview who has conducted a water study for the North Fork. I think the -cost of this is about a hundred thousand dollars . It ' s being formed for the County Legislature. They will be out next month, the first. part of 1983, to go over the report with the Town Board in detail. 9. From the Southold-Peconic Civic Association , Inc. informing the Town of several violations which will be turned over to the proper authorities.--it has been turned over already. 10. From Reeve Lumber & Woodworking Co. , Inc . complaining about the signs that are in Mattituck under the railroad " bridge °height - a few weeks ago there was another trailer truck that was -too high and tried to go under the bridge and an accident .occurred. Mr.. Reeve says that the signs warning of the low bridge should .be replaced . and perhaps more of them. 11 . Letter from Kenneth Scheuerman who would ,like- to .put up a luncheonette in Mattituck and is having problems. . locating his .-cess- pools. The land he has is not quite big enough and we are , go ng to tell him to go back and appeal to the County Board of Health and go from there. IV. HEARINGS . SUPERVISOR PELL: We have four today and the first one is ,at 3 :25 . It is not quite that time yet so we move on to Resolutions. V. RESOLUTIONS. 1 . Moved by Councilman Townsend, seconded by Councilman Murdock, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the following transfer within the 1982 Highway Budget : From: DM5130.2 Equipment , Item III $1 , 982.79, Into: DS5142. 1 Personal Services , Item IV - $1 , 982. 79. Vote of the Town Board: Ayes: Justice Edwards , Councilman Townsend, Councilman Murphy , Councilman Murdock, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. 2. Moved by Councilman Murdock, seconded by Councilman Nickles , it was RESOLVED that the Town Board of the Town of Southold hereby author- izes Police Officer James Fitzpatrick to use his 13 days of sick Leave which were accumulated between the years 1955 and 1961 . These 13 days represent one-quarter of his total accumulated sick leave for that period of time in the amount of 53 days , and Police Officer Fitzpatrick, by accepting the 13 days, thereby forfeits any future claim to sick leave accumulation between the years 1955 and 1961. Moved by Councilman Nickles , seconded by Supervisor Pell , WHEREAS, Section 22 of the Suffolk County Tax Act provides that the notice to be given by the Receiver of Taxes upon the receipt by him of the tax and assessment roll and warrant , shall be published in such newspapers printed or circulated in the Town or elsewhere as DECEMBER 21, 1982 394 NOW, THEREFORE , BE IT RESOLVED that the Receiver of Taxes shall publish the notice required by Section`=-22 of the Suffolk County Tax Act once in the following two newspapers published in the Town of Southold , to wit : The Suffolk Times and the Long Island Traveler- Watchman . Moved by Councilman Murphy, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold accept the bid of West Mountain Sales, Inc. for furnishing and delivering one tractor with detachable compost auger, all in accordance with the bid documents at the total price of $62,963. 00, and Option A. One :brush shredder or cutter; a1,;L .:in.-accordance with the bid documents at a total price of $12, 443. 00. . Total package is $74, 706. 00. Vote of the. Moved by Justice Edwards , seconded by Councilman Murphy, . it was RESOLVED that the Town Board of the Town of Southold hereby appoints Addie Pace, Peconic, New York, School Crossing Guard at the Peconic School at a salary of $13. 00 per day, and Traffic Warden , as needed, at a salary of $4. 25 per hour. Said appointment shall become effective January 1, 1983. Vote of the Town Board: Ayes : Justice Edwards , Councilman Townsend, Councilman Murphy , Councilman Murdock, Councilman Nickles , Supervisor Pell. This resolution was declared duly ADOPTED.. 6. Moved by Councilman Nickles , seconded by Councilman Townsend, it was RESOLVED thatthe Town Board of the Town of Southold hereby authorizes and directed Supervisor William R. Pell , III to execute a maintenance agreement with Gestetner Corporation for the duplicating machine at the Southold Town Police Headquarters at a cost of $200. 00 for the period January 1, 1983 through January 1, 1984. Vote of the Town Board: Ayes: Justice Edwards , Councilman Townsend, Councilman Murphy , Councilman Murdock, Councilman Nickles , Supervisor Pell. This resolution was declared duly ADOPTED. Moved by Councilman Townsend, seconded by Councilman Murdock, it was RESOLVED that Supervisor William R. Pell , III be and he hereby is authorized and directed to execute an amendment to the agreement dated September 24, 1982 between the Town of, Southold and Academy Printing Services , Inc. for 'the printing of 500 volumes of Liber D , Volume III of the Southold Town Records , to change the date of completion from January 31 , 1983 to March 31 , 1983. Moved by Councilman Murphy, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby author- izes and directs Supervisor William R. Pell , III to execute a Participating Agency Agreement between the Suffolk County Department of Labor and the Town of Southold for the assignment of one or more recipients of Public Assistance to perform work for the Town of Southold, with the condition that the County of Suffolk will provide and pay for the required Workmen' s Compensation Insurance for recipients of public assistance included in the program. Cron to engage Gerard Snover, Babylon , New York, for the purpose of preparing the necessary appraisals in the Tax Certiorari cases of Donald G. King v. Board of Assessors, Town of Southold, and Eylene H. King v. Board of Assessors, Town of Southold. Moved by Councilman Murdock, seconded by Councilman Nickles , it ,was RESOLVED that the Town Board of the,,,.Town.- of,;.Southold set 2 : 55- P.11. , Tuesday , January 4, 1983, Southold Town Halle, Main Road, Southold, New York as time and place for hearing upon the application of Enconsultants , Inc. on behalf of Strong' s Marine Center for a Wetland Permit to install an "I" beam on pilings to create- a travel-lift slip , dredge an area to be used as slip and deposit spoil on adjacent upland at James Creek, off Camp Mineola Road, Mattituck, New York. Moved by Justice Edwards, seconded by Councilman Murdock, it was RESOLVED that the Southold Town Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Ken Hahn of Tidewater Dock Building Co. on behalf of Boatmen' s Harbor Marina for a Wetland Permit on certain property located at Boatmen ' s Harbor Marina, on West Creek Avenue, off Cutchogue Harbor, Cutchogue, New York. Moved by Councilman Murphy, seconded by Councilman Townsend, it was RESOLVED that the Town Board of the Town of Southold hereby approves the amount of $400, 000. 00 for a performance bond for roads and improve- ments in the subdivision to be known as Hill Crest Estates, Section I , Orient , New York, as recommended by Town Engineer Lawrence M. WORK SESSION 5: 12 P.M. - The Board discussed request of Town employees to have a year-end- party at the Senior/Youth Center. The Board reluctantly , okayed such a party. Supervisor Pell advised the Board that the Mattituck Fire District left $50, 000. 00 out of their budget submitted to the Town. None of the departments in the Town handling the budget request picked up the . $50, 000. 00 error. Mattituck is the only fire district that does not use the standard Audit and Control form. Supervisor Pell advised the Board that Receiver of Taxes Mellas has no further use for the Burroughs Accounting machine being leased by the North Fork Bank & Trust Co. and planned to remove it to the disposal . Supervisor Pell advised him to wait until he can check the appraisal value of the machine. EXECUTIVE SESSION 5: 30 P.M. - The Board discussed engineering services of Holzmacher, McLendon & Murrell , P.C. with regard to the Wastewater Disposal District .
