WORK SESSION
8: 30 A.M. - Audit of outstanding August, vouchers.
EXECUTIVE SESSION
9 : 30 A. M. - Mr. Charles Graves , negotiator, met with the Board to
discuss P .B. A. negotiations .
WORK SESSION
10 : 15 A.M. - Request from Fred Adler on behalf of the North Fork
Peace Group to use the Town Hall on October '20th. This group is
considered by some Town Board members to be political in nature and
the Senior/Youth Building will be suggested for the meeting..
10 :20 A. M. - Mrs . Margaret' Conway addressed the Board concerning the
restoration of the steps at Horton's' Point . Mrs . Conway had presented
a petition to the Board at their August 24th meeting cont:aining 500
signatures in favor of reinstating the steps . Mrs . Conway contended
that if the steps. had been adequately maintained they would never have
been in such disrepair as to warrant their removal and the 'election of
a fence cutting off access to the beach. Highway Superin'te-n,aient Dean
will obtain estimates from a private contractor for construction of new
steps and the Board will consider the matter further. Councilman
Nickles asked th.e Board to consider putting $5000. 00 in the`_,P83
budget for this project .
EXECUTIVE SESSION
10 : 30 A.M. - Special Attorney Richard Cron met with the .Board to discuss
pending certiorari proceedings .
11 : 30 A.M. - James McMahon , Youth Coordinator and Grantsman met with
the Board to discuss his progress. He has met with. the County
Consortium Director and is working on Year IX Community Development
Block Grant Funds and eligible and ineligible activities. --He advised
the Board that the County will do the environmental review record for
the use of Community Development Block Grant Funds for which H2M was
asking $1, 500. 00 for preparation of this document . There are many
aspects of the grant funds the county will aid the Town with free of
charge . --Discussion was held concerning a bond for purchase of additional
land at the landfill site. Supervisor Pell suggested using $50 ,000. 00
from 1983 FRS funds and the $25 ,000. 00 from CD Year VII funds which
were set aside for the oil tanks. --Mr. McMahon advised the Board the
Town has again received $1,600. 00 under the Drug Abuse Prevention
Council program, and Juvenile Officer Sidor would like to use half
of the funds to purchae booklets concerning drunk driving, drug abuse ,
etc. and the other to .go to Jim Christy for his drug/alchohol youth
program. --Dividers for the Senior/Youth Center was discussed and
Supervisor Pell recommended one divider to be paid for from Year VII
C•.D. Block Grant Funds at a cost of approximately $15 ,000. 00. He
also recommended allocating $15,.000 . 00 of the funds for parking and
basketball court , and the remaining $5, 000. 00 for roof maintenance
of the Center.
12 :15 P. M. - Began reviewing the agenda.
1 :00 .P.M. - Recess for lunch. - East Hampton Supervisor Mary Fallon
and East Hampton' s Moratorium Attorney Frank Eissler lunched with
the Board at the Mill Creek Inn .
2 : 45 P.M. - East Hampton Supervisor Mary Fallon and East Hampton' s
Moratorium Attorney Frank Eissler met with the Board to explain the
history behind the East Hampton moratorium. The moratorium was

declared 'on June 13 , 1982 for a, water study eriod on 10 ,000 acres
during which. time the: planning` ,boardd= woul`dg view maps for preliminary
status. A group of subdividers took the East Hampton Town Board to
court and the Supreme Court ruled that the Town Board does not have
the right to tell a planning board that they cannot process maps.
The State Law states that when a map is submitted to the planning
board and the developer has met all the necessary criteria, they
must proceed in a 45 day period. East Hampton has appealed the
decision. In the meantime, East Hampton is- putting into effect an
Open Space and Overlay District Local Law since the "Town Board
recognizes the need from time to time to study the continued
viability of existing zoning classifications and examine the need
for possible change in zoning, and" - "during such period .of study
there is a need to maintain the status quo as to development of
the areas of the town under such. study--" . East Hampton is also
in the process of drafting a turf ordinance restricting the amount
of lawn area developed. Although the moratorium was initially
defeated, Mrs . Fallon said it gave the Town a chance to look at
what they have , enact ordinances and carry out development in an
orderly fashion.

3:20 P.M. - The Board resumed reviewing the agenda and off agenda
items .
3 :55 P.M. - Chief Winters met with the Board to discuss the lease/
or purchase of Motorola police radios. Supervisor Pell and Chief
Winters will look over the budget relative to the possible outright
purchase of three radios.
4:45 P.M. - Work Session adjourned.
Supervisor .Pell advised th-e Board he would be out of Town on vacation
as of November 4, 1982 for approximately 10 days .
REGULAR MEETING - 7 : 30 P .M.
A Regular Meeting of the Southold Town Board was held on ,
Tuesday , September 7, 1982 at the Southold Town Hall, Main Road,
Southold, New York. Supervisor Pell opened the meeting at 7 : 30
P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR PELL: The next order of business is something we have
Pleasure to do as a Town Board and it is one of our Town employees
who is retiring from service to the Town, so I ' d like to ask him to
come up at this time - Mr. Nicholas Kouros.
SPECIAL RESOLUTION
Moved by Supervisor Pell, seconded by Councilmen Nickles , Murdock,
Murphy, Townsend and Justice Edwards ,
WHEREAS , Mr.' Nicholas Kouros has retired 'from service with' the Town
of Southold, and $- _
WHEREAS , Mr. Kouros has faithfully served the Town of Southold as a
Traffic Warden and School Crossing Guard for 29 ,.years., and
WHEREAS , his record of fine service to the Town of Southold and its
people deserves the sincere gratitude of those with whom and for whom
he worked, now, therefore, be it
RESOLVED that the Town Board of the Town of Sokthold accepts with
regret the retirement of Nicholas Kouros , and express its appreciation
to him for his long record of fine service , and extends best wishes
for the years ahead, and be it further
RESOLVED that this resolution be made a part of the permanent records
of the Town of Southold and a copy be given to Mr. Kouros.

COUNCIL11Aiv NICKLES : As Chairman of the Parks and Beaches Committee
I just submitted a report to the Town Board earlier which is on file ,
but I would like to make sure that the record reflects that after
Item 5 there should be another item, Item 6 , which is an ap.propriation
for the budget of 1983 of $300. 00 so that the supervisor of life-
guards „for the Town and the park districts will have $300 .00 to
train sii,immers in the 7-Z' s pool in Flanders to get their speeds up

so they can pass the `civil sere "ice'' test which occurs some time in the
spring. Additionally, I got a call while I was out of my office
today from Senator LaValle who I have been working with and he has
been assisting the Chief of Police and I in trying to get a traffic
light at Boisseau Avenue. They were out here this past Friday , I
didn ' t observe anybody, but so they say and have reevaluated that
intersection and they ' ll have a decision forth coming by the end of
this month. Hopefully it will be favorable.

SUPERVISOR PELL: Judge Edwards?
JUSTICE EDWARDS : Just that the Island is being evacuated with the
summer people and it ' s becoming more quiet over there.
SUPERVISOR PELL: Supervisor' s report is progress on all fronts , but
I would like to note that the Board did meet today with Charles
Graves the man who represents the Board in our negotiations with
the P.B . A. which is under way and the C.S .E .A. who will start to begin.
It is like anything else, we would hope it would come to an end soon ,
especially for budget purposes , but if it does not we will be working
towards having it come to a climax as soon as we can.
II . PUBLIC NOTICES
COUNCILMAN MURPHY: 1. Application of Ve'ct•or Re al' Est ate• Corporat ion ,
c/o Stephen R. Angel, Esq. , P. 0. Box 279 , Riverhead to construct a
46 unit condominium housing project with municipal water and sewer
service; relocate and reconstruct a bulkhead along shoreline of site;
dredge to six feet below mean low water; provide 46 boat mooring slips
and construct swimming pool , tennis courts, and accessory parking area.
Public hearing on this will be held on the application on October 21st
at 10 :00 A.M. in the Southold Town Hall and this will be also posted,
I believe, in th.e papers , and it will be on the Town Clerk ' s Bulletin.

2. New York State Department of Environmental Conservation on
Coastal Areas-... .. On July. 27., 1981 Governor Carey signed into law the
Coastal Erosion 'Hazard Areas Act , codified as Article 34 of the
Environmentai Conservation aw. Article 34 directs the Department
of Environmental Conservation to map coastal areas subject to
serious erosion and to adopt regulations which will establish
standards for regulation of certain activities and development
in identified erosion hazard areas. A hearing will be held in
the New York State Office Building, Room #3-A04, Veterans Memorial
Highway , Hauppauge at 2 : 00 P.M. and 7 :00 P.M. on Thursday, Sept-
ember 30 , 1982.
III . COMMUNI CAT IONS.
SUPERVISOR PELL: 1. From residents (23) complaining that the dredging
at Goldsmith Inlet this year was not done as he thinks it should be.
We will take this up with the Department of Public Works from the
County and we will look into it ourselves and ask them to look into
it.
2. Letter (.from Don• Arcuri) with reference to the steps at.
Horton Point Lighthouse. There are two sides to every request and
the gentleman here is appreciative of the fence being put up but he
also realizes that we are under the petition that was presented two
weeks ago to the Town Board and he asks that we consider all sides
carefully before we make further decisions on this matter.
3. Letter from the Department of' Agriculture and Markets
saying there is a subject that will be discussed in Riverhead on
October 21st at 10 :00 A.M. to approximately 3 :00 P.M. Agriculture
Districts Program Workshops. There are workshops being held through-
out the state . A couple of our Board members will be there to see
what it 's all about.
4. Diary DeNis`co requesting that we put more patrol cars on the
road in the Town of Southold from Nassau Point . We will respond to
her that we are considering it . We' ve called for the police list in
anticipation of hiring two -more -police officers .. -
5. . Letter from the New York State' Departinent' of Tran'sport'ation
giving us sets of detailed -plans for the -three bridges to be repaired
on New Suffolk Avenue, Mud',Downs and West Creeks. West Creek will be
the first one to be done. We now have on file with the Town Clerk
detailed plans on how.-it.-will- be. done.

6 . Letter from, Su'ff'olk County Department 'of' Health Services
and I will read part of it : "I would like to take this opportunity
to invite- you to the first organizational meeting of a citizens
planning council 'for mental health services on the East End. I
would appreciate it if you could also share this information with
any of your constituents who might have a particular interest in
this area. " The meeting will be held Tuesday , September 14 ,, 7: 30 P.M.
I do plan to be there myself along with anyone else from the community
that would like to go.
7. Memorandum from the New York State Department of Environmental
Conservation asking us to review a draft proposal of the wastewater
treatment grants- program. Any comments they would like to have in by
the end of this month.; . September.
8. Letter from Patrick E.' Lyons requesting that the speed limit
in Orient village to the ferry boat be reconsidered and perhaps droppe
down from 55 to lower. That is a State road and we will send it on to
the State.
SUPERVISOR PELL: IV. Hearings . We have a hearing at 8:00 P:.M. tonight
which we will have to come back to. We will move on to Resolutions.
V. RESOLUTIONS
1. Moved by Justice Edwards , seconded by Councilman Nickles, it• was
RESOLVED that Supervisor William R. Pell , III be and he hereby
is authorized and directed to execute an agreement between Unitel
Communications and the Town of Southold for maintenance and repair
service on the Town Hall telephone equipment for the period of one
year, commencing on October 30, 1982 and ending on October 29, 1983 ,
at a total cost of $1, 264. 69.

in regard to the State Environmental Quality Review Act ' iri the
matter of the application of Enconsultants , Inc. on behalf -of
Felix Alfano for a Wetland Permit on certain property located at
the east side of Harbor Lane, on Eugene's Creek, Cutchogue, New
York.

RESOLVED that the Town Board of the Town of Southold hereby auth-
orizes Southold Towri Juvenile Officer Edward Sidor to attend the New
York State Police Juvenile Officer' s Association Conference at the
Concord Hotel , Kiamesha Lake, New York, from September 20, 1982
through September 23, 1982) and his necessary expenses for travel,
meals and lodging shall be a legal charge against the Town of
Southold in an amount not to exceed $250. 00.

5 . Moved by Councilman Murdock, seconded by Councilman Townsend, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes
the . Town Clerk to enter into a contract with The Staley Corp, for the
placement of a laminating machine in the Southold Town Hall at the
Town Clerk 's Office , under such terms' and conditions as the Town Clerk
deems appropriate.

6. Moved by Councilman Nickles , seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of .Southold will hold a
public hearing at the Southold Town Hall, Main Road, Southold, New
York on the 2.1sa day of September, 1982 at 3 : 30 P.M. , at which time
and place all interested persons will be given an opportunity to be
heard upon the following matter: "A Local Law in relation to fees
and charges for the removal and storage of vehicles , " which reads
as follows : Be it enacted by the Town Board of the Town of Southold
as follows :
1. Section 92-51 of the Code of the Town of Southold (Vehicle
and Traffic) is hereby amended to read .as follows :
92 . 51 . Storage and charges .
After removal of any vehicle as provided in this Article or
the removal , seizure, storage and/or impoundment of any vehicle
pursuant to any other provision of law, the police officer may
store or cause such vehicle to be stored in a suitable place at
the expense of the owner. Such owner or person in charge of the
vehicle may redeem the same upon payment to the Southold Town
Police Department of the amount. of all expenses actually and
necessarily incurred in effecting such removal, such removal
charges not to exceed fifty dollars ($50. ) , together with any
charges for storage, such storage charges not to exceed three
dollars ($3. ) per day or fraction thereof .
2 . This local law shall take effect immediately..

RESOLVED that the Southold Town Board declare itself lead agency
in regard to the State Environmental Quality Review Act in the
matter of the application of Enconsultants , Inc, on behalf of
Peter Sterling for a Wetland Permit on certain property located
at Harbor Lane, on Eugenes Creek, Cutchogue, New York.

SUPERVISOR PELL: _Number 8 is a hold at this time (Proclamation -
National Bowling Week - September 1 through 7, 1982) .
g . Moved by Councilman Townsend, seconded by Councilman Murdock, it was
RESOLVED that the Town Board of the Town of Southold will hold a
public hearing at the Southold Town Hall , Main Road, Southold, New
York on the 21st day of September, 1982 at 3 : 35 P.M. ,. at which time
and place all interested persons will be given an opportunity to be
heard upon the following matter: "A Local Law broviding for the
adoption of unr dbembd' dogs , " which reads as follows :
Be it enacted by the Town Board of the Town of Southold as
follows :
Chapter 38 of the Southold Town Code (Dogs ) is hereby amended
to read as follows :
1. Section 38-2 thereof is amended by deleting therefrom the
words "Dog Warden" and substituting in place thereof the words "Dog
Control Officer" .
2. Section 38-6 thereof is amended by deleting therefrom the
words "Dog Warden" and substituting in place thereof the words "Dog
Control Officer
3 . Section 38-7 thereof is amended to read as follows :
38-7. Confinement; redemption; disposition.
Any dog impounded under the provisions of this Article
shall be confined in accordance with the provisions of the Agriculture
and Markets Law of the State of New York and may be redeemed by the
owner or harborer thereof upon payment to the Town Clerk or Dog

Control Officer of the sums set forth in the Agriculture and Markets
' Law. Any dog not so redeemed shall at the option of the Dog Control
Officer be made available for adoption or be destroyed or given to
a recognized society for the care and welfare of dogs. All proceed-
ings shall b.e in accordance with the provisions of the Agriculture
and Markets Law of the State of New York. Th.e fee for the adoption
of a dog shall be in such amount as_ may be, from time to t.ime, estab-
lished by town board resolution. The Dog Control Officer may, as a
condition to an adoption, require that th.e dog shall be spayed or
neutered within one year after such adoption, and may require a
deposit of $20. 00 to assure that such doh; is spayed or neutered
within such time.
4. This local law shall take effect immediately..

RESOLVED that Supervisor William R. Pell , III be and •h.e •hereby is
authorized and directed to execute an installment p rch'ase agreement
with Savin Corporation for the installation of new Savin - 870 copy
machine's in the Ass-essor's' Office , Highway Departmeht Of'fi'ce, and
Police Headquarters , at a monthly installment cost of $106 . 77 per
Machine. The Savin 775 copiers in the aforementioned offices will
be removed and the outstanding installment payments for the past
36 months will lie waived by the Savin Corporation upon entering
the new installment purchase agreement .

RESOLVED that the Town Clerk be . and she hereby is authorized and
directed to advertise for bids for the resurfacing of Sound :Avenue
at the western town limit . Bid opening: 11: 00 A.M. Thurs-.day,
September 30 , 1982 at the Southold Town Hall, Main Road, Southold,
New York.

Capital Projects-$20, 000.00.

hereby is authorized and directed to advertise a public hearing at

WHEREAS , the emergency department personnel at Eastern Long Island
Hospital and the volunteer area Rescue Squads are specialists trained
to handle life or limb-threatening illnesses or injuries requiring
immediate attention, and must be available 24 hours every day of the
week to all patients who need medical aid, and
WHEREAS , the emergency medical services system at Eastern Long Island
Hospital has provided emergency health care to thousands of our citizens ,

and countless lives- 'at Eastern' Long Island Hospital have been saved due
to the efforts- of men and women trained in emergency medical care, and
WHEREAS , emergency medicine is the newest medical specialty , and vast
improvements- have been made within the past ten years , and Eastern Long
Island Hospital emergency department pers-onnel and the volunteer Rescue
squads have completed extensive training and continuing education to
enable them to keep up with those improvements , and
WHEREAS, emergency calls have increased nationwide , with over 82 million
visits occurring in 1980 , and
WHEREAS , Emergency Medicine Week is being held to educate the citizens
of Southold Town, now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby declare the
week of September 12 through 18, 1982 to be Emergency Medicine Week.

SUPERVISOR PELL: Does any Councilmen have anyth.ing they would like
to add at. this time?
COUNCILMAN MURDOCK: Maggie' s(Mrs . Conway-)here . and I imagine she ' d
like to address the Board again about Hortons Point . We did have a
discussion this afternoon , I wasn' t here this morning and I would
like to offer that the Board gather the pertinent information. We
have a letter saying it would be roughly a $5 ,000. 00 cost to replace
the steps at Hortons Point. I would like the Board to authorize the
Highway Superintendent to put together a more comprehensive plan of
what it would cost and his method of putting in steps . At 67 Steps
we put in removable sections so we could repair damages easier and
since we put in the removable sections nobody has damaged it. Maybe
that ' s the secret, but I ' d like the Town Highway Superintendent to
draw that up and when we have it ready I ' d like to have a public
hearing. We have mail on b.oth sides of the fance and a petition from
450 people and I" d like everybody ',;o get the opportunity to- properly
hear the costs involved, and express their views- in relation to it
as well as getting a more true feeling about what the people of the
Town feel about this road end at Hortons Point .
SUPERVISOR PELL: Any other Councilmen have anything they would like
to add at this time?
COUNCILMAN NICKLES : I ' d address that:: issue a moment. I think this
morning Mr. Dean said he was going to look into estimates .
COUNCILMAN MURDOCK: I said I wasn 't here this morning--
COUNCILMAN NICKLES : But I think your suggestion about removable
steps is a good idea, sectionalized stairs would be good.

WORK SESSION
8: 35 P.M. - The Board met with Gary Loesch, P.E. , Holzmacher,
McLendon & Murrell, P. C. to discuss the Greenport-Southold 201
Study , Scavenger Waste Facility. Mr. Loesch advised the Board
that Southold Town , number two on the priorty list for funding
this project , had been dropped entirely- from the list and the
grant went to Glens Falls, New York. Communications from the
N.Y.S .-D.E . C. (_undated) received by- H2M on August 23rd and a
letter from H2M- to Mayor Hubbard and Supervisor Pell had not
been received by Supervisor Pell. Had the letters been received
the Town might have had time to fight the change in priority by
the D.E.C. The Board members were highly disappointed with Mr.
Loesch for failing to notify them as far back as June when the
funding percentages were reduced. There has also been a shift
in funding which. would increase the Town' s share from approximately
$280 ,000 . 00 to $320 ,000. 00 and the Town ' s share of the design phase
of the scavenger waste facility would rise to 25%, whereas projects
on the priority list would receive 922%o throughout the design and
construction phases . The Town had been advised by H2M throughout

the progress of the project that engineering costs would be paid
until funding was received, now Mr. Loesch said engineering costs
would have to be negotiated with H2M. Mr. Loesch was instructed to
prepare a letter for the D.E. C. urging that the project be placed
back on the priority list and be grandfathered so the Town would
receive a grant for design rather than an allowance as currently
proposed, and inform them that in the interval since the timetable
had been submitted, the Town held a public hearings•,on the Selected
Plan and formation of the Scavenger Waste Improvement District and
the hearings were held in a timely manner in accordance with D.E .C. ' s
requirements . Throughout the hearings the community was advised that
funding for this project for design and construction would be from
FY1982 funds based on the draft priority list , upon appropriation by
Congress. Copies of this letter will go to Senator LaVal.le, Assembly
man Behan, Congressman Carney , Senator D' Amato, Senator Moynihan.
