HomeMy WebLinkAboutTB-07/20/1982 198 198 SOUTHOLD TOWN BOARD JULY 20, 1982 WORK SESSION 8: 30 A.M. - The Board members consisting of Supervisor Pell, Councilman Nickles, Councilman Townsend and Justice Edwards - began reviewing the agenda. 9: 15 A. M. - Lieutenant Stanley Droskoski, Southold Town Police Department , met with the Board to update them on the weekend police activities. EXECUTIVE SESSION 9: 20 A.M. - Lieutenant Droskoski apprised the Board of various police investigations. 9: 40 A.M. - Mrs . Sophia Adler presented a .petition and requested the Board members to sign it, seeking the Long 'I'sland Lighting Company' s approval for an impartial inspection of the Shoreham Nuclear Plant . Supervisor Pell previously signed the petition and Councilman - Townsend - and Justice Edwards signed at this time. Councilman Nickles declined and explained he did not sign petitions which pertained to a matter which might require his vote as aTown Board member. 9: 50 A.M. - The Board continued reviewing the agenda. 10: 00 A.M. - Mr.' Harry Knoch and Mr. Dave Riehli-ian from the N.Y. S. D.E.C. , Stony 'Brook, -net with the Board to _discuss a proposed deer hunting* season in Southol'd Town 'during the month 'of' 'January .l'.9'83. Mr. Knoch and Mr. Riehlman feel the deer population is much too high in Southold Town. The month of December is archery season on Eastern Long Island, but they requested a 10 day shotgun;.se,ason in January since there has been serious damage to crops for the past several years. ' The Board members outlined the areas to be designated for this hunting season. In order to obtain a permit, the applica- tion must be accompani!ed .by the written consent of the landowner where hunting will be conducted. A resolution was placed on the agenda (Resolution #20) authorizing the establishment of a. 10 day deer hunting season in January 1983 in Southold Town. 10: 30 A.M. - The Board resumed reviewing agenda and off-agenda items. 12: 10 P.M. - Recess for lunch. 1: 35 P.M. - Work Session resumed and the Board met with Executive Administrator Victor Lessard for an update on the progress in re- organizing the Building Department . 1: 55 P.M. - Suffolk County Legislator Gregory Blass met with the Board to advise the the Robins Island issue could use support from the Town between Board members and Legislators. Only two votes are needed in the Legislature to pass the appraisal resolution. There is state money available under the State Bond issue Environmental Bond Act of 1972. ---On the question of the Long Island' Railroad Dock at Greenport , Mr. Blass said there has been a question of the spoil site being the location or a clam bed or has the potential of clams being grown. He said the major questions are- being raised by the U. S. Fish & Wildlife Department . -=-Pecon'i'c Dunes is doing very well under SCOPE' s contract and is showing a profit.---Mr. Blass asked the Board to keep in close communication with Sid Mitchell of the Suffolk County Department of Real Estate on the propriety of prices being offered under the Tarinland' Program. ---Mr. Blass urged the Board to sign the petition relative to the nuclear plant at Shoreham. JULY 20 , 1982 199 2 : 10 P.M. - T.Zr. -Frarik Panek,' Re.gional Fisheries Manager, N.Y. S.-D .E.C. , Stony Brook, met with the Board to discuss a proposed fishing access plan at Laurel' Lake. In 1977 the D.E.C. spent $58, 000 to acquire the 12. 6 acres of land on Laurel Lake which has been found to be one of the three highest quality lakes on Long Island for fish development . They would now like to build a small access site and five-car parking area 400 ft.. back from the Lake for fishing from the shore or from _a canoe or small hand-carried boat. The have two site plans in mind, the second of which: calls for a small parking lot adjacent to the Town road to Laurel Lake. This would be the most inexpensive and easiest patrolled and -monitored. --Members of the Board and Highway Superin- tendent Dean. suggested that the D.E.C. might wish to use Town -property for a temporary parking lot to see how the plan worked out. Mr. Panek seemed to be in. agreemen.t with. this and will discuss it further with Mr. Dean. 2 : 45 P.M. - Work. Se.ssion adjourned. REGULAR MEETING A Regular Meeting of the Southold Tovin Board was held on Tuesday , July 20, 1982 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Pell opened the meeting at 3: 00 P.M. with the Pledge of Allegiance to the Flag. Present : Supervisor William R. Pell , III Councilman John J. Nickles Councilman Joseph L. COUNCILMAN NICKLES: I would like to report that the dog negotiating committee for animal services with the North Fork Animal Welfare have been concluded and at this meeting there will be a resolution authorizing the Supervisor to sign a contract, a two year contract. SUPERVISOR PELL: Judge Edwards? JUSTICE EDWARDS: Nothing from this end. SUPERVISOR PELL: Two Councilmen are not with us today, one is on vacation, Councilman Murdock, and Councilman Murphy is on personal business and cannot be with us. The Supervisor has nothing At this time to report except progress on all fronts. II . PUBLIC NOTICES - None III . COMMUNICATIONS SUPERVISOR PELL: These are letters to the Board and the Board has taken action on them by direction to me on how to respond to them. 1. Letter from Laughing -Tat'er Propert'v -Owners 'Association, Inc. about four conditions- they- list- in the bay they would like to see action taken on, which we will respond to and the DEC to respond to two of them. 2. Letter from the District Attorney 'of Suffolk. County,' Patrick Henry informing us that his office that provides stenographic 'seryices for the local courts will no longe7 , as of January 1st, provide these services and he says it is a county charge. We are going to dispute this a little bit with him and see if we can' t win, whether we are going to pay that bill or the- county .. .. 3. Letter from the ;County Comptroller' s Off ice..asking .us:.to. give them the amount.-of.-money it costs us to mairita.in the railroad parking lots and platforms in the Town of Southold and they are going to try to get us reimbursed.-from the railroad. 4. Letter from Bertri'ce Small relative to* 'sidewalks "in' :.S'authold which will be turned over to Mr . Dean. 5 . Letter, .from Don Scott reference sidewalks 'in Southold hamlet `- which will also be turned over to Mr. Dean to see if we can' t get these things repaired. .. .. 6. HEARINGS SUPERVISOR PELL: We have a hearing at 3: 30 which we will conduct at that time. ("A Local Law to amend Chapter 92 of the Code of the Town of Southold in relation to traffic regulations" . ) V. RESOLUTIONS 1. Moved by Councilman Nickles, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold appoint Christine A. Stulsky, from the Suffolk County Civil Service List , to the position of Justice Court Clerk, at her present. salary, effective this date July 20, 1982. Vote of the Town Board: Ayes: Justice Edwards , Councilman Townsend, Councilman Nickles, Supervisor Pell . This resolution was declared duly ADOPTED. SUPERVISOR PELL: This is not a new person, she is employed here as a Clerk-Typist and she will be employed now as a Justice Court Clerk. This is just a change of title. 2. Moved by Justice Edwards, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southold declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Thomas & 'Ja'cqueli e Occhiogrosso for a wetland permit on certain property located at Corey Creek Lane, on Corey Creek, Southold, New York. '` Vote,.of the Town Board: Ayes: Justice - Edwards, Councilman Townsend, Councilman Nickles, Supervisor 'Pell. This resolution was declared duly ADOPTED. 201 JULY 20 , 1982 SUPERVISOR PELL: Number 3 ,was. put ,lon.,t.he agenda today at the request of Councilman Murphy who is not here with us today (Town Board go on record supporting freeze on further development of nuclear weapons) . Frank got involved with this when he went to the west coast to see one of his- daughters and he came back and asked us to put this on the agenda. We did so today and the Town Board did discuss it . We do not have the four votes necessary to pass th.is' today by the Town Board, so we are going to table it. until August 3rd at which time we will have a copy of Assemblyman John L. Behan ' s bill in hand. We do not have a copy of his bill with us today. So that is the decision on number 3.. I know there are people here who would like to address that.. I usually make you wait until the end of the meeting to address the Town. Board, ' but while you are here I will let you address the Board now instead at a limited debate. If you go on too long. I 'm going to cut it off and go on with. the meeting. So if a couple of you want to address us go right ahead, COUNCILMAN NICKLES*, Before you start I would just like to rectify one thing that you said that I' don' t think you meant.. It wasn 't a question of the fact that there were not enough. votes to pass this today, it was the fact that Mr. Murphy was the sponsor of. this '.and the fact that we did not have the bill that Assemblyman Behan has co-sponsored, is the reason that it is not being voted on today. SUPERVISOR PELL: Thank you, John. Who wants to address the Board first? Mr. LeCompte, MR. OLIN HARPER LeCOMPTE, Southold: I. am. temporary chairman of the steering committee of the North Fork Peace Group which was formed only last week and at this meeting we unanimously voted to urge that the Town Board adopt a resolution for freeze on nuclear weapons, not knowing that Councilman Murphy had already introduced Such a proposal. There are a number of us here today just to show our support for this resolution and we wish to commend Councilman Murphy--I 'm sorry he' s not here--but we wish to commend him for his forsight and his wisdom in introducing what we consider this terribly important resolution. There are more than a few of us in the Town of Southold who are very much interested in a freeze on nuclear weapons. I know of this from my own knowledge because last year I participated in a petition drive to- get signatures for a freeze on nuclear weapons, and we obtained 5, 000 signatures in this Congress- ional District and a number, of course, were from this Town. There are considerable number of people in this Town who strongly and enthus- iastically in favor of a freeze 'on nuclear weapons. I know this from my own knowledge because of the contingent which went to the June 12th rally in New. York City from this Town and because of the fact that last week, on. A sweltering night about 38 or more people gathered and voted to establish. the Peace Group .on the North Fork and also voted unanimously to urge this Board to adopt a freeze on nuclear weapons resolution. It is widely felt in this country, and I 'm one of those who feel this,, that the grave danger facing; the world today is a danger of nuclear holocaust and an essential first step to lessen this danger is to adopt a mutual verifiable freeze on nuclear weapons and thereafter establish a drastic reduction on nuclear weapons in the. world.. I 'm aware of the fact that Councilman Murphy' s resolution also speaks of the freeze referendum proposal which is before the State Legislature and I* understand that the State Legislature which is now in recess may r:eturn sometime this summer or fall , at which time there will be ample time for--them to pass a bill putting this referendum on. the November ballot, and I think it would be most appropriate if the people of this State would be permitted, by ballot, to send a message to Washington which. is relevant to their own survival. Now, T. realize that a resolution by this Board, of itself and by itself, would be of little weight, but when you consider a resolution of this nature from this Board in conjunction with- such a. resolution by 257 town meetings, in New England and many numerous resolutions of city councils, town councils and state legislatures throughout the state and when you consider the combined effect of all of these resolutions I think it could have a tremendous effect on Washington .. As a matter of fact , of course, more endorsements are being gathered all the time. It could perhaps be instrumental in not only saving our own lives but in saving the lives of neighbors in other countries and perhaps saving the human race. It shouldn' t be overlooked that if this Town Board does approve this resolution it may lead the way to other town board' s on the east end as well as throughout Suffolk. County. Thank you. 20a JULY 20, 1982 SUPERVISOR PELL: Thank you. I would like to move on to Resolution No. 4 and if anybody wishes to address the Board can do so after we go through our agenda. Number 4 (Local Law to establish a "Landmark Preservation Commission) we decided to wait until August 3rd and to put that on the agenda again. We only have four members here, two members of the Board are -not here today, and they all will be here on August 3rd so we are going to wait until the 3rd on that. 5. Moved by Supervisor Pell, seconded by Councilman Townsend, it was RESOLVED that the Town Board of the Town of Southold accept the bid of Bill Ballan Ford-Lincoln-Mercury, Inc. for supplying the Town of Southold with one-(!) 4 Door 1982' Ford LTD Victoria at the bid price of $11, 298. 21. Moved by Councilman Townsend, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of, Southold appoint Victor J. Przepiora, part'-'time Cominuni'cations Officer, effective immediately, at a salary of $5 . 00 per hour. Moved by Councilman Nickles, seconded by Councilman Townsend, it was RESOLVED that Supervisor William R: Pell, III be and he hereby is authorized and directed to 'enter into a contract between the Town of Southold and the North Fork' Anima*1 Welfare League, Inc. under the terms -of which the North Fork Animal Welfare League, Inc. will provide dog control services and dog pound services for a term of two years commencing on. the 1st 'day of 'August,' 1982, and terminating on the 31st day of .Ju�y, 1984 at a contract sum.-of $ 38, 000. 00 for the period August 1, 1982 through July 31, 1983, and the contract sum of $41, 800. 00 for the period August 1, 1983 through' July 31, 1984. SUPERVISOR PELL: In regard to the one we just passed, I ' d like to comment on. John Nickles, Councilman, has done a superb job representing the Town Board in negotiations with the North Fork Animal League and also with the problems we have had under this for the last three months, John has sat on top of it and I feel the Board and Town owe him a vote of thanks for a good job well done. COUNCILMAN NICKLES: Thank you, Bill, but I mus.t .point that you served on the committee with- me as did our Town Clerk and I appreciate your help and also the help that the Town Attorney. Bob Tasker rendered in some of the knotty issues that came up. SUPERVISOR PELL: Thank you, John, 11. Moved by Justice Edwards , seconded by Councilman Nickles., it was RESOLVED that- the -Town Board.-of the -Town .of- Southold .'authorizes the Muscular .Dystroph:y Association to use. Southold Town roads on September 12, 1982 to conduct a Bike-A'-Thon, provided they secure the necessary insurance to hold the Town of Southold harmless. Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend, Councilman Nickles, Supervisor Pell. This resolution was declared duly adopted. 12. Moved by Councilman Nickles, seconded by Councilman Townsend, it was RESOLVED that the Southold Town Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Friedrich Krug for a wetland permit on certain property located at Budd' s Pond, off Budd' s Pond Road, Southold, New York. Vote of the Town Board: Ayes : Justice Edwards, Councilman Townsend, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. 13. Moved by Justice Edwards, seconded by Councilman Nickles, WHEREAS, Burton' Potter Post #185 , American Legion, Greenport , New York has applied to the Town Clerk for a. Bingo License, and WHEREAS, the Town Board has examined the application, and after investigation, duly made findings and determinations as required by law, now, therefore,. be it RESOLVED that the Supervisor be and he hereby is authorized and directed to execute on behalf of the Town Board of the Town of Southold the findings and determinations as required by law, and it is further RESOLVED that the Town Clerk be and she hereby is directed to issue a Bingo License to. 'tr'ansfer the sum of $12, 000. 00 within the 1982 Budget, Federal Revenue Sharing Funds , from CF9006. 4 Land Acquisition to CF8160. 4 Disposal Area. Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. 204 , JULY 20 , 1982 SUPERVISOR PELL:. As explanation , we have considerable amount of break-down with equipment up at the Landfill , about $20, 000. 00 worth of equipment had to be repaired and we did not have the money in the Disposal Area line item of the budget to do it so we have to transfer to cover ourselves for the balance of the year. 15.. SUPERVISOR PELL: Number 16 ( Feasibility of computerization of Town facilities by The North Fork Bank & Trust Co. ) we are going to wait . one month on. We want .to look into a few more ideas about this, so it will be back. on August 24th. ) Number 17 (.Transfer moneys for initiating Phase I of the Master Plan and Zoning Update) will be on the August 3rd agenda to raise the funds for our Planning Board' s request to update the Master Plan. 18 . 'oii behalf of Matt-A-Mar Marina for a permit under the provisions of the Wetland Ordinance of the Town of Southold., for permission to install four "T" shaped floating docks to allow berth- ing for deeper draft vessels unable to moor closer to the bulkhead at west side of .Wickham Avenue on -Mattituck Creek, Mattituck, New York. Vote of the` Town Board: Ayes: Justice Edwards, Councilman Townsend, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. 19. Moved by Councilman Townsend, seconded by Councilman Nickles, .it -was RESOLVED that -the Town -Board -of the Town .of Southold recognize 'the ,years of service of Lifeguards from Park District beaches who are now assigned to Town beaches, and they shall be' compensated .a.ccord- ingly at the rate of $3.75 per hour plus $ . 15 per year for . each yea.r of experience, not to exceed $5. 00 per hour. We had the D.E.C. in here today to talk to the Town Board about a deer season in January. 20. Moved by Cupervisor Pell, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the. Town of Southold request the New York State ;Department of Environmental .Conservation to 'establish a ten day deer hunting 'season in January 1.983 `in certain areas' of Southold Town that will be determined by the Town Board and the D.E.C. RUTH OLIVA, President, North Fork Environmental Council: I have a letter to read you from the. Moratorium Committee. "On June 22, this committee presented the Town Board with 3, 242 signatures requesting a moratorium on all major subdivisions until the Southold Town master plan has been updated. And we repeat our request in behalf of the more than 3, 000 ,citizens who signed- the moratorium petition and of the many thousands of others sympathetic with its aims. What this moratorium seeks is a pause; a temporary halt in .matters of development; a period in which Southold Town can dwell on preventive maintenance and the balance between planned growth and open land. Southold Town is fortunate to have a margin of 'time to plan for the best use of its land. If major subdivisions are approved while we wait for an update of the master plan, we can lose that precious margine. "Moreover , without a moratorium, some recommenda- tions of the master plan may be obsolete by the. time the plan has been completed. This would be a waste of town money. We believe that the right to private ownership cannot be denied. - But we are also convinced that land use must be directed and controlled. As development increases we will have continuing problems with water supply, sewage, increased services, and the escalating costs associated with all of these problems. The town' s agricultural base must be considered, as must its fishing industry, its tourist industry, and its unique quality of life. In 1969, Ramapo, N.Y. , in an action declared constitutional by the Supreme Court of the State of New York, passed a moratorium as a delaying action .while it framed a program for controlled growth. Since then , the moratorium has been used successfully by villages, towns and counties throughout the United States when existing legislation was not adequate in the face of its growth rate. Here on Long Island, several towns, Including North Hills, Belle Terre, Upper Brookville and East Hampton, have used the moratorium as a.n effective planning tool.. Moratorium does not stop development. - At, its best use it encourages and stimulates economic, social and environmental qualities necessary for the well-balanced community. That best use depends upon the cooperation an:.d interaction of a concerned town board with its equally concerned constituents. Together, they can make the town' s future a promise rather than a threat . There are many unanswered questions which- point to the need for a moratorium.. .For a start, we would like to sit down with the Board and talk. SUPERVISOR PELL: What you' re asking for is a chance to come in and talk to the Board during the Working Session? AIRS. OLIVA: Or even just informally chat with you for a couple minutes now. SUPERVISOR PELL: The floor is yours, care to chat? Anybody else? As you know, we are going to discuss this on August 3rd at the Working Session of the Board. MRS. OLIVA: We were going to suggest to the Board that perhaps you are not aware of some of these other towns that have instigated a moratorium and perhaps we could compile some sort of facts and figures of how they did it and what the results were. That perhaps we could get it to you before the next Town Board meeting so you could review. it and give you a little homework to do and we could have a better discussion on the whole thing. SUPERVISOR PELL: That would subperb idea to get it to us on the Friday by noon time before the August 3rd meeting when we make the agenda up or it could be distributed before, as soon as you get it to us we' ll pass it out to the Board. MRS. OLIVA: Because we' re just finding out these things and naturally you wouldn' t have an opportunity either. SUPERVISOR PELL: Joe is inviting some people to come in and address the Board on the 3rd also on it too so we should have a good discussion that day during the Working Session. I ' ll try to put it on the first thing in the morning, depending what the agenda looks like. Joe, do you want to comment on anything, is this what you wanted? COUNCILMAN TOWNSEND: . Basically I was ,just going to inform the people 206 JULY 20, 1982 that we' ve scheduled the meeting on the 3rd and I think you were going to see if we could get some input from the East Hampton Supervisor and I 'm going to contact the Suffolk County Planning Commission to get someone out here to discuss their point of view. We' ve already heard from the Planning Board and I' d like to have Henry here if possible to--- MRS. OLIVA: You know who might be a good one to ask who is supposed to be very good at land use and we haven 't spoken to him yet and it would be great to have him, is a fellow by the name of Russ Stein and I believe he' s over in Montauk. He .was a lawyer for one of the towns on the south shore. He' s supposed to be an expert in it. SUPERVISOR PELL: Thank you. Anybody else wish to address the Town Board? If not , before we adjourn I would like one more resolution today and that is to approve the Local Law on traffic regulations that the hearing was just held .. 21.
