SOUTHOLD TOWN BOARD

WORK SESSION
9: 30 A.M. - Receiver of Taxes George Mellas met with the Board to
discuss the plan being considered by the committee to revise the
Suffolk County Tax Act whereby school taxes would be paid to the
County. Another proposal is a four payment system starting with
the first payment in October. --Councilman Murdock favored that
proposal stating it would save the Town of Southold money.--Council-
man Townsend opposed the proposal indicating it would cost more
money county-wide. --Supervisor Pell said the majority of the Suffolk
County Supervisor Association members opposed the four payment
system as being more costly county-wide .
Mr . .' Mellas said he has spoken with the North Fork Bank & Trust
Co. relative to computerizing the tax office. Over a seven year
period he can save the Town approximately $25, 000. 00 in labor costs.
This will be discussed further in the near future.
Supervisor Pell asked. Mr. Mellas about furnit-ure he has been
advised was donated to the Town of Southold by the North Fork Bank
& Trust Co . and Mr. Mellas had picked up by the Highway Department
and delivered to the Town Hall and distributed to various offices
as well as his own. The Bank in a letter to Supervisor Pell stated
the furniture was offered, donated, and accepted by Mr. Mellas.
Mr. Mellas;,assured the Board that he personally purchased the
furniture and has the cancelled check at home to prove it .
9: 55 A .I.M. - The Board audited the outstanding vouchers.
10: 25 A.M. - Lynne M. Gordon, Attorney, of Schechter , Schechter,
Lamb & Kenney, appeared before the Town Board on .behalf of No Number
Naugles Drive. Ms. Gordon was accompanied by 'Sam Allen, prospective
purchaser of the property; 'they wished ,to discuss the repairs to the
tank at the., property in question which was the subject of a .h,,e:aring
on February; 23, 1982 under Chapter 90 of the Code of the :;Tou7n .of
Southold, "Unsafe Buildings" . Building Inspector Hinderma;nn had
submitted a report to the .Town Board on March 23rd citing lack of
compliance with the Town Board' s resolution at the conclusion of
the hearing. On April 21st Building' Inspector Hindermann submitted
a report stating that most of the conditions of the resolution had
been complied with, however , repair was not made to the top of the
tank, but he would accept it as having been done as a temporary
measure until permanent repair is made. Mr. Allen described to the
Town Board .the method of temporary repair to prevent the skin from
coming off the tank and stated such a repair should last for twenty
years. The Board was inclined to accept the adequacy of the repairs ,
but reserved the right to inspect the premises and make a final
decision at their May 18th meeting. Mr. Allen advised that at the
present time he does not have a plan of how he will use the property,
but he expects to take title by June and will return to meet with the
Board in mid-summer to discuss his long-range plans.
10: 50 A.M. - Robert Traugott of Energy Development Corporation met
with the Board to discuss his previous involvement with the Town
to contruct a municipal solid waste to energy facility - MSW-Southold,
New York, Ltd. Mr. Traugott was interested in determining what the
status of Energy Development Corp. is with the Town--where does he
go from here. He traced EDC' s past involvement with the Town, includ-
ing proposals, hearings, application to the DEC, funding proposals.
EDC has received a permit from the D.E.C. to construct a municipal
solid waste to energy facility in the mown of Southold. The letter
from the D .E.C . indicated there were general and special conditions
attached to each permit and. Mr. Traugott explained that the permit
for the water would require meters, air emissions - meet all regulations,
construction site - all final drawings must be submitted to the D.E.C.

before beginning construction; .a-d'4if `c on'struction is not completed
within one year , it can be extended by giving the D. E.C. ten days
notice. --Mr. Traugott was advised by Councilman Murdock that the Land-
fill Committee has been. invited to,.%.meet with the North Fork Environmental
Council on Thursday, May 13th at which time,-they will hear a presentation
by Lantz America representative Richard Greenfield: --The Board discussed
.with Town Attorney Tasker the procedure for seeking requests for proposals
from solid waste management firms. However, before taking that step,
the Board will await the report of Holzmacher , McLendon and Murrell
to determine the quantities of solid waste disposed of at the landfill
site, and determine existing and projected costs of disposal of solid
waste by landfilling.
12: 30 P.M. - Recess for lunch.
1: 50 P.M. - Work Session reconvened. Board began reviewing the agenda.
3: 00 P.M. - Work Session recessed for the purpose of holding two public
hearings - 3: 00 P.M. - - application of Long Island Lighting Company for
a gas franchise; ,3: 05 P.M. - application of Enconsultants, Inc. on
behalf of Muriel Baldwin for a wetland permit .
3: 15 P.M. - Work Session reconvened. Board continued reviewing the agenda
and the following off=agenda items: Confirmation that the N.Y. S.
Disaster Preparedness Commission will send its representatives to
Southold on September 15 and 16 to provide assistance to appropriate
staff members in preparing a disaster preparedness plan and implementing
procedures . Prior to September ,the Commission will collecting data
toward use in preparing the plan.
The Board discussed the request by Senior Building Inspector George
Fisher to .permit Building Inspector Edward Hindermann .to attend the
New York State Concrete Masonry Association seminar in Smithtown on
May 18th. This request was denied. --Discussed the request of 'C'. S'.E.A.
President Curtis Horton to use the Recreation Center at Pe-conic for
the C.S ..E.A. installation of officers on May 19th. This request .was
denied on the basis that it has been the policy of-the Town Board to
allow the building to be used only by civic groups, and the C.S.E .A.
does not quality under the guidelines established by the Town Board.
They may, however, use the building for membership meetings .--Set
May 11, 1982, 6: 00 P .M. to 7: 30 P. M. for interviews of candidates
for the position of Executive Administrator to the Supervisor and
Town Board. Seven candidates will be interviewed: -Richard C. Edwards, .
Robert Stevenson Hughes, Lance E. Larsen, Victor G. Lessard, Bennett
Orlowski, Jr. , James A. Richter, Lawrence M. Tuthill. --Set 8*:'00' A .'M.
for Work Session prior to May °18th Board meeting.

A Regular Meeting of the Southold Town Board was held at' 7 : 30
P.M. , Tuesday, May 4, 1982 at the Southold Town Hall, Main Road,
Southold, New York. Supervisor Pell opened the meeting with the
Pledge of Allegiance to the Flag.

SUPERVISOR PELL: Let it be noted that Councilman Townsend .did arrive.
8. Councilmen' s reports . Councilman Townsend.
COUNCILMAN TOWNSEND: The Landfill Committee met, of which I 'm not
chairman,. but since Larry' s got one I 'm going to take this one.
Basically what we decided to do is hire Holzmacher, McLendon and
Murrell to do-a two part -study in preparation for coming to a
decision on . what to do with the landfill. The first part is to
monitor the volume going into the landfill. One of the questions
we keep coming up against is . how much solid waste is actually going
into the landfill and that can affect the viability of incineration
plants or the cost of solid waste by maintaining a landfill . So
that is the first step. The second step is to analyze the cost ,
involved in maintaining a landfill with various levels of volume
reduction, resource recovery and that sort of .thing. The first
part of that study is going to cost us $1, 500. 00 and the second
part is $5, 800. 00. That ' s all I have to report.
SUPERVISOR PELL: Thank ,you. Councilman Murdock what do you have to
report?
COUNCILMAN MURDOCK: In continuation of that we will have a resolution
later on where we are going to split our Landfill Committee. One half
of the Landfill Committee will go to on a seminar on landfilling,
composting, etc. and the other half of the Landfill. Committee will
be going either to Toronto or Houston, depending on where the
company involved thinks- it ' s easier- for them to` put a demonstration
4.on for -us. The process of a lot of ' source separation of garbage and
looks very int,eresting. to 'us in the brochures we got. We will also
be engaging a: surveyor. We' ve.'reached a tentative agreement to

purchase more property. The Landfill Committee has been rather
active the last three or four weeks.. ..We also meet Thursday night
again with the North `Fork Envirod em fatal Council and Richard Green-
field to talk about Lantz America. Certainly anybody is welcome
to come. That is all on the Landfill.
SUPERVISOR PELL: Any other committee you want to report on?
COUNCILMAN MURDOCK: On the Code Committee. We will have a meeting
Tuesday night with the Building Department, Planning Board and Zoning
Board of Appeals. Today at the Work Session the Town Attorney is
going to put forth all the recommendations of the Code Committee that
worked on this previous to this year and we' ll probably adopt those,
and put the Code Committee on hold until we decide at the Town' s
Master Plan update. Most of the Code reviews will be gone over in
that forum anyway and I don' t see any sense in doing it twice.
SUPERVISOR PELL: Thank you. Any other Councilman wish to report
anything? John?
COUNCILMAN NICKLES: I would just like to announce that I met with
the Commissioner of Public Works and we are -.going to open the beaches
up basically the same sequence as we did last year, which means that
Gull Pond and the Town Beach, known as Jack' s Shack Beach, will open
on June 26th and all other beaches on July 1st ., Mr. Muir has been
notified so. that he ' ll have lifeguards on hand.
SUPERVISOR PELL: Any other Councilmen? Councilman Murphy?
COUNCILMAN MURPHY: Yes, I ' d like to report Bill, for the record, the
rafts for the Clam Seed Program are going to start to be put in the
water tomorrow (May 5th) . Paul Flagg is coming over. He ' s also
meeting with interested students and adults and teachers to explain
the program. Paul expects to be working here two or three days to
get the rafts all set up and the clam seed will be delivered here, I
believe next Wednesday, a week from tomorrow. So it ' s going along
fine and looks good. We have a lot of interest and I would like to
publicly thank, and we will send them a letter , the Mattituck High
School Shop Department, the whole Mattituck High School really, the
Shop Department and the Science Department for a great job of coopera-
tion and the fine job they did making these rafts. Thank you.

III . COMMUNICATIONS
SUPERVISOR PELL: These communications are on file in my office and
the Office of the Town Clerk.
1. From the Federal Emergency Management Agency informing us
that the preliminary draft of the Flood Insurance Study report was
sent to the Town Hall. They will contact us to arrange for a meet-
ing to come out here and go over it with us. We are not in agr.eeance
with all- of it . Some of it we are. Our Town Engineer is going to
review it and reply to them. Tell them the parts we are not in
agreement with.
2. From our Congressman William Carney, a letter on nuclear
weapons and a bill attached to it, House Bill 297. He asks us to
review it and if we have comments we can make them back to him.
3. From the New York State Department of Environmental Conserva-
tion. Councilman Nickles will get in touch with the D.E.C . They
would like to open up part of Laurel Lake which is state owned. They
ask cooperation of the Town and Councilman Nickles will sit down and
see what they plan to. do there.
4. A letter from Islip Township, Supervisor Michael A. LoGrande,
saying if the Town ' s are going to take over the railroad stations they
should be reimbursed from the MTA.
5. From Assemblyman John Behan saying the $11, 000 we noted two
weeks ago that the Town would receive from the Special Municipal Aid
Act was being held up and it would not be coming at this time . He
says. the Governor has vetoed the measure .
6. From the Southold Town Fire District Officers Association
giving us their views on the kerosene heater law that we did pass .
I will respond to. it.
7. From the Southold Town Baymen' s Association, Inc. informing
us that they oppose any shellfish racks placed in public'' waters, on
the bottom under water. A permit has been applied for some t-o be
placed on Fishers Island. I think this is what brought it to their
attention. It is not against the seed clam floating racks. It is
racks that will be on the bottom.

IV. HEARINGS
SUPERVISOR PELL: We had two hearings this afternoon which the Board
will review and act on them at .the next meeting on the 18th.

V. RESOLUTIONS
1. Moved by Councilman Nickles, seconded by Councilman Murphy,
WHEREAS, a proposed Local Law No. 2 - 1982 was introduced at a
meeting of this Board held on the 23rd day of March, 1982, and
WHEREAS, a public hearing was held thereon by the Board on the
20th day of April, 1982, at -which time all interested persons were
given an opportunity to be heard thereon, now, therefore, be it
RESOLVED that Local Law No. 2 - 1982 be enacted as- follows:
LOCAL LAW NO. 2 - 1982
A Local Law to amend Chapter 92 of the Code of the Town of
Southold in relation to traffic regulations.
BE ENACTED by the Town Board of the Town of Southold as follows:
Article IV of Chapter 92 of the Code of the Town of Southold is
hereby amended as follows:
I. By amending Section 92742 thereof by adding thereto the
following: ;

RESOLVED that the Town Board of the Town o �outiNd accept the
proposal of Holzmacher , McLendon and Murrell , P. C . for engineering
services in conjunction with Solid Waste Disposal, under the follow-
ing categories and respective fees:
I. - Establish Solid Waste Disposal Quantites - cost not to
exceed $1, 500. 00.
II. Determine Existing and 'Projected Costs of - Disposal of
Solid Waste, by Landfilling - cost not to exceed. $5., 800. 00.

RESOLVED that the application of Ange & Barbara 'Boursiquot, dated
April 9, 1982, to maintain a single family house trailer on their
property on private road off north side Main Road, Mattituck, New
York (formerly property of Carl Frelix, Jr . ) , be and hereby is
gran.t-ed for a six (6) month period.

4. Moved by Justice Edwards, seconded by Councilman Murdock , it was
RESOLVED that the Southold Town. Board declare itself 'lead agency
in regard to the State Environmental nuality 'Review Act in the
matter of the application of Gerald P. McGinty for 'a wetl'and
permit on certain property located at 355 W'estview Drive, on Long
Creek, Mattituck, New York.

5. Moved by Councilman Murdock, seconded by Councilman Nickles , it was
RESOLVED that the application of' 'George A. 'McCarthv dated April 19,
1982 for permission to maintain a single family house trailer on
private road off south side Main Road, Laurel, New York, be and
hereby is renewed for a period of six (6) months.

6. Moved by Councilman Nickles, seconded by Councilman Murphy, it was
RESOLVED that pursuant to Article 8 of the Environmental 'Conservation
Law State Environmental Quality Review and 6NYCRR Part 617 , .Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that the Southold Town Board, as lead agency for the
action described below, has determined that the project, which is
unlisted, will riot 'have a significant . effect on the environment.
Description of Action : Application of Kenneth Strachan, Jr. for a.
wetland permit to construct a 240 ft. catwalk across the marshland
to provide access to the beach at Orient Harbor, east of King Street,
Orient, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect',to the environment are likely to
occur should the project be implemented as planned.
Because there has been no response in the allotted time from
the New York State Department of Environmental Conservation, it is
assumed that there is no objection nor comments by that agency. .

7. Moved by Councilman Murphy, seconded by Justice Edwards, it was
RESOLVED that the Southold, Town Board declare itself lead agency
in regard to the State Environmental Quality Review Act in the
matter of the application of Arthur A. Spangel for a, wetland-
permit on certain property located at Glenn Road on West Creek
extension of Goose Creek; Southold, New York.

Matt-A-Mar marina for a wetland 'permit on certain property located
on the west side of '?9ickham Avenue on Wickham Creek, Mattituck,
New York.

matter of the application of Ronald 'L. Zito for a wetland permit
on. certain property located at Bungalow Lane, on Deep Hole Creek,
Mattituck, New York.

SUPERVISOR PELL: Number 10 we are going to hold until the May 18th
agenda for the Board' s consideration - (engage the services of Ward
Associates, P .C . to prepare specific proposals .for Comprehensive
Development Plan and Zoning Ordinance update) .

WHEREAS, a small business is the cornerstone of :bur 'free `en:erprise
system and since the birth of' this country has' r'epresented oppor-
tunity, independence, and the fulfillment of dreams for generations
of Americans; and
WHEREAS; combining the dynamic forces of individual initiatia with
an alertness to consumer needs, small business increase's'. :the ','�1_ex'i'
bility of our economic system and is a leading source of;;dnnc,,ati'on
and technological advancement for much of our industry;.;,?a'nd
WHEREAS, we are indebted. to small business for its contributions to
our success as a nation and .dependent on its progress and vitality
for our economic well-being; and
WHEREAS, small firms employ over half of the labor force and .are
leaders in .employment creation and innovation, , and playan.,. important
role in expanding economic opportunities for women and minorities; and
WHEREAS, historically, small firms have enjoyed a specialZrielationship
with their communities. Now they not only will be leader' in the
renaissance of their communities but also will be in the forefront of
revitalizing the economy and bringing a new sense of direction to the
American people; and
WHEREAS , by addressing the problem of excessive government regulation
and taxation, the small business person can continue to b.e the,-- prime
investor in his or her community, investing in its people, both served
and those employed; now, therefore, be it
RESOLVED that the Town Board ,of the Town of Southold in tribute to
the courage, initiative, and hard work of the small business men and
women in our community, do hereby proclaim the 'week of May 9' through
15, 1982, as SMALL BUSINESS WEEK in the Town of Southold, and call
upon the Chamber of Commerce, industrial and commercial organizations,
board of trade and other public and private organizations to partici-
pate in ceremonies recognizing the contributions made by the small
business men and women of this town to the progress and well-being
of our people.

Nutrition Program, the Economic Opportunity Council' s Home Aid
Program, at a cost to the Town of 5% of in-kind services, and
balance of the program to be paid by County and State funds. The
part-time employees who shall work in this program shall not work
more than 20 hours per week.

SUPERVISOR PELL: We have two resolutions we will save to the end.
I will ask the Town Board members if there is anything they would
like to add at this time.
COUNCILMAN MURDOCK: I would, Bill . I would like to comment a
little on our meeting with 'Robert Traugott here today who is
the President of Energy Development Corporation of Norwich,
Connecticut. On behalf of MSW-Southold he gave us a copy of
a letter signed by David DeRidder of the New York Department
of Environmental Conservation saying, "Enclosed herewith are
the necessary permits required by this Department for the
construction of the above noted facility" . There were three
permits issued by the New York State Department of Environmental
Conservation for the burning of municipal solid waste in the Town
of Southold. I believe this is the first and probably the only
permit at the present time in the State of New York for a modular
system. The Town of Southold right now is in the unique position--
this Board, not just the committee, but this Board has put many
long hours into discussing municipal solid waste and the problems
thereof and at the present time we probably are in a leadership
role in the entire State of New York and certainly on Long Island
and evidenced by the number of resolutions we passed today. We' re
still not satisfied that this is completely the:-way to go and we
do not want to close out any options, but this Town today -could
build and operate a plant to burn municipal solid,,`waste and as I
say again, this is the only Town in the State of' New York that has
a permit by. the New York Department of Environmental Conservation
to burn in a modular system based on producing electric,it.y, as, a::.
by-product. Thank you, Bill.
SUPERVISOR PELL: Thank you. Anyone in the audience wish to
address the Board?
MR. JOHN WHITE: Last year I bid for the Town of Southold for the
delivery of' bluestone. I was awarded the bid and deliver ,1:900 tons
of bluestone to the Highway Department. This year I spoke .to )Mr.
Dean on a number of occasions and in the beginning he had ,-told- me
that they might go under a county bid as far as delivery of blue-
stone. Today again I also had spoken to him and he was rather
annoyed at me for trying to find out from him if there was going
to be a bid or if they were going to go under the county bid. I
did express to him today that the county bid would be higher than
what my price would be to him. At' that time he did not seem' to
care if the price was going to' be any cheaper or not . Now, last
year I saved the Town almost $800. 00 over the price of the closest
bidder and he still would not give me an answer if the Town was
going to have a bid this year or if they were going to go under
a county bid. Does the Town Board know?
SUPERVISOR PELL: No, the Town Board--unless somebody on the Board
does--I do not know. Mr. Dean has not brought this up to my attention
,,
yet . He has not asked the Town to go out to bid yet . I just don' t
know. Does anyone know?
COUNCILMAN MURPHY: Ray mentioned it to me today and he said he' s.
not ready to decide on how much he wants and how he' s going .to
handle it and where he wants to go to. I don ' t think he' s made
the decision yet . I don' t think it ' s a Town Board decision. I
will talk to him for you as I. will see him tomorrow and see if I
can get some information for you.
.;:!,,MR. WHITE: Okay, because as I say, I know what the county .bids are.
'- -A: a matter of fact in this area for the county bid as far as for
gravel I'm tied with somebody else. I don' t know if you people
do use gravel or not, but as . far as the county goes I am tied and
I do have everything from Brookhaven Town line as far as Jamesport

and I do also have Shelter Island under the county bid. But as I
did tell him, I can underbid what the county bid is so I just wanted
the Town Board to know; that .there;--k:would be,__a...:savings.

office the last part of last week and introduced himself. He
lives in Riverhead, he sold a store in Hampton Bays , he sold a
food store there, and hardware too John says.
MR. LYTLE: Is there a name for it yet?
SUPERVISOR 'PELL: He didn' t give it to me—
MR. LYTLE: I ' ve had a lot of questions about it. Everything from
that ' s going to be the site of the 7-11 to Genovese and so forth.

JOHN F. McNULTY, and

a Southold Town Trustee from 1946 through 1971, Mr . McNulty-
distinguished himself as a dedicated and conscientious public
servant, now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby gives
formal expression of its loss in ,the death of John F. McNulty, a
man esteemed by his associates and respected by all, and be it
further
RESOLVED that whenthe Town Board adjourns this date, it does so .
out of respect to the memory of John F. McNulty, and be it further
RESOLVED that a copy of this resolution be spread upon the minutes
of this Town Board meeting and a copy be transmitted to the family
